Form No, 1097 ~ Held November 28, 1988 19 The meeting of the Dublin City Council was called to order by Mayor Michael L. Close at 8:05 P.M. on Monday, November 28, 1988. Mr. Jankowski led the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mayor Close, Mr. Jankowski, and Mr. Rozanski. Ms. Maurer and Mr. Sutphen arrived at 8:08 P.M. Mr. Strip was attending another City meeting and was absent from this Council meeting. Mr. Harding, Director of Personnel and Purchasing, and Mr. Banchefsky, Assistant Law Director, were present as were Mr. Bowman, Ms. Clarke, Mr. Jones and Mr. Willis of the City Staff. There was no correspondence. Mr. Amorose moved to approve the minutes of the November 21, 1988 meeting of the Dublin City Council. Mr. Jankowski seconded the motion. Vote - Mr. Amorose, yes; Mayor Close, yes; Mr. Jankowski, yes; Mr. Rozanski, yes. Ordinance No. 75-88 - Ordinance to Adopt the Dublin Bikeway Plan. Third Reading. Mayor Close suggested deferring Ordinance No. 75-88 until additional Council members were present. Ordinance No. 103-88 - Ordinance Approving the Editing and Inclusion of Certain Ordinances as Parts of the Various Component Codes of the Codified Ordinances. Third Reading. Vote on the Ordinance - Mr. Jankowski, yes; Mayor Close, yes; Mr. Amorose, yes; Mr. Rozanski, yes. Ordinance No. 106-88 - Ordinance to Enter into Rehabilitation and New Construction Project on IR 270 with the Ohio Department of Transportation. Third Reading. Let the record show that Ms. Maurer and Mr. Sutphen were now in attendance. Vote on Ordinance No. 106-88 - Mr. Rozanski, yes; Mr. Sutphen, yes; Mr. Amorose, yes; Mr. Jankowski, yes; Ms. Maurer, yes; Mayor Close, yes. Ordinance No. 107-88 - Ordinance to Accept Petition for Annexation of 9.398 Acres Jerome Township, Union County, to the City of Dublin, Ohio. Second Reading. The Ordinance was held over for a third and final reading on Monday, December 19, 1988. Ordinance No. 108-88 - Legislation for Resurfacing Project on S.R. 745. Second Reading. There will be a third reading of the Ordinance on December 19, 1988. Ordinance No. 109-88 - Ordinance Amending Section 509.08 of the Codified Ordinances of the City of Dublin - Minor's Curfew. Second Reading. Mr. Sutphen reported that the Safety Committee had not met to discuss the Ordinance and make a recommendation, but that they would be meeting on Thursday, December 1, 1988 at 8:30 A.M. There will be a third reading of the Ordinance on December 19, 1988. Form No, 1097 "'%~ Held November 28, 1988 r 19 Page Two Resolution No. 23-88 - Resolution in Support of Second Municipal Court Judge in Delaware County. Second Reading. Mr. Harding reported that Mr. Hansley was expecting a letter from the City of Delaware conveying their point of view. There will be a third reading of the Ordinance on the third Monday in December. Ordinance No. 117-88 - Ordinance Adopting an Open Space Plan for the City of Dublin, Ohio. First Reading. Mr. Rozanski introduced the Ordinance. There will be a Public Hearing scheduled for Ordinance No. 117-88 on Monday, December 19, 1988. Ordinance No. 75-88 - Ordinance to Adopt the Dublin Bikeway Plan. Third Reading. Mr. Wally Maurer, a resident of Dublin Road, had questions and concerns regarding the proposed plan, specifically relative to a proposed bike path along Dublin Road from approximately Bellaire Avenue to 1-270. Mr. Maurer asked if Councilor relative committees had considered the potential developments west of Brand Road which can involve bike paths, saying that as he understood the situation that it was that developers are responsible for providing bike paths within developments; that the particular bike path along Dublin Road would have to be financed by the City. Mr. Maurer wondered if there had been any consideration of probable bike path patterns which would not require a bike path along the west side of Dublin Road from approximately Bellaire Avenue south across Brand Road into downtown Dublin. Mayor Close noted that designations in the bikeway plan do not always mean bike paths; that in most of the subdivisions the lesser traveled streets can be considered as part of the bikeway plan as opposed to a separate and segregated bike path itself. On a personal level and relevant to his own property, Mr. Maurer asked what consideration would be given to the stone wall and the trees which line the front of his property on Dublin Road; whether the stone wall would be endangered by the engineering or will the path fit between the edge of the road and the stand of trees. Mayor Close commented that there had been no engineering done on any of the bike paths; that the actual physical layout of a bike path is not a part of this plan; that the plan states merely, in general, where the bike paths or bikeways ought to be; that before any bikeways or bike paths can be installed that there would be a requirement that engineering would be done, engineering that would ultimately be approved or disapproved by Council. Mayor Close went on further to say that he could not foresee Council approving a plan which would require that stone walls be taken out or that stands of mature trees would be indiscriminately torn out. He also said that public input and comment would be welcomed when an engineering plan is presented before Council. Ms. Maurer suggested that perhaps Council should consider legislation which would protect the stone fences and provide for the replacement of trees should trees have to come down. She mentioned the 150 plus year old tree that will have to be taken down to provide for a right hand turn onto Brand Road. She also mentioned the stone fences at Llewellyn Farms which were taken down. Form No, 1097 '-,;8 Held November 28, 1988 19 Page Three Ms. Maurer suggested that to avoid desecrating the canopy of trees that make Dublin Road what it is, that perhaps this section of the bike path along Dublin Road from Bellaire Avenue down to 1-270 could be placed in the developments rather than along the road. Ms. Kay Wagner, a resident of Dublin Road, also expressed a concern with regard to the loss of large, mature trees and stone fences in front of her property. Mr. Rozanski said that he would be against deleting that section of the bike path. He noted that he had been in favor of proposing an 80' right-of-way on Dublin Road so that a bike path could be manipulated without taking any trees or walls down, allowing for flexibility in construction of same. Mayor Close suggested that perhaps an impact study done by staff as it would relate to cutting down trees should be required. Mr. Amorose said that he also was in favor of a bike path along this route to provide a transportation system for the biker who likes to bike some distances, and yet who could stay off of that narrow highway. Mr. Sutphen noted that he also had voted for the 80' right-of-way in order to provide for manipulation of a bike path through the trees, stone fences, etc. Discussion followed regarding the actual right-of-way at present along that section of Dublin Road, 60', 70', 80', etc. Vote on the Ordinance - Mr. Sutphen, yes; Mr. Amorose, yes; Mayor Close, yes; Mr. Jankowski, yes; Ms. Maurer, yes; Mr. Rozanski, yes. Comments from Staff Mr. Harding 1. Commented that staff will be introducing legislation at the next meeting of Council regarding the purchase of telephone equipment and furniture for the Police Division's move to Discovery Systems. Comments from Citizens None Council Roundtable Discussion Mr. Sutphen 1. Suggested that perhaps Mr. Harding have made available to members of the Safety Committee information regarding the telephone equipment and furniture prior to their meeting. 2. Mentioned the meeting regarding the fire issue being held at the moment at Deer Run Elementary School with Mr. Strip as moderator, and said that he felt it was "great" to see the democratic process at work. Mayor Close 1. Announced that at present there were 16 applicants for the soon to be vacant Council seat. I I 1/ II II II II Ms. Maurer discussed the application form that she, Mr. Amorose, and Mr. Harding had developed; that several Council members were in favor of having a careful, quality selection process, including interviews of applicants. Form No, 1097 "'~ 1I eld ... -- u_ T--- November 28, 1988 19 Page Four Mr. Rozanski said that he had suggested extending the deadline for submittal of applications to December 6, 1988, allowing the applicants a few more days to complete a rather lengthy questionnaire. There was discussion about whether or not the selection process could be completed before the Council Goal-Setting Retreat on December 9 and 10, and Mr. Jankowski commented that he felt that the consensus of members of Council was that the selection process is more important than having someone named prior to the Goal-Setting Retreat. Mr. Lee Beall, an applicant, requested that Council inform applicants as soon as possible as to the timing of the process, noting that perhaps people would be leaving for vacations during the Holiday Season. Mr. Beall was assured that no one would be left out of the process. Mayor Close announced that there would be a Special Meeting of Council which will adjourn to Executive Session on Monday, December 12, 1988 at 7:30 P.M. with no anticipated action as a result of that Executive Session. The purpose of the meeting would be to discuss the selection process as it would apply to the filling of the vacant Council seat. Mayor Close adjourned the meeting at 8:44 P.M. Mayor Close reconvened the meeting at 8:48 P.M. Mayor Close announced that Mr. William Denihan wished to address Council with a report concerning the Dublin Irish Festival. Mr. Denihan had the fbllow- ing comments: 1. Thanked Council for approving the celebration. 2. Commended the Parks and Recreation Department, the Police Division and the City Manager for all their help and assistance. 3. On Saturday there were approximately 2000 people in attendance, with approximately 300 participants from allover the country. 4. The participants had only very favorable comments on the facilities, planning, etc. 5. In total there were approximately 3500 people in attendance, and participants, including foot ball players from Detroit. 6. There were 18 antique cars, 30 participants in the dart contest, 65 different entertainers, 30 different vendors as well as 12 Irish Wolf- hounds. 7. The event proved to be very successful. Mr. Denihan reported that the cost of the insurance to sell beer at the Festival was $3,286.50 and that there was a $3,200.00 loss on the sale of the beer. He reported that the Committee had planned on spending from $750.0 to $1,000.00 for the insurance and noted that they were requesting that Council help the Committee to defray some of the cost of the loss on the beer sales. Mr. Denihan also said that the Committee had made a decision that should they have approval to host the Festival again that they would not sell beer. Mr. Sutphen moved to approve the additional $2,200.00 from the bed tax funds to the Irish Festival Committee to reimburse their loss on the sale of the beer. Mr. Jankowski seconded the motion.
