Form No. 1097 ~ Held April 18, 1988 19 The regularly scheduled meeting of the Dublin City Council was called to order by Mayor Michael L. Close at 7:34 P.M. on Monday, April 18, 1988. Mr. Jankowski led the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mayor Close, Mr. Jankowski, Ms. Maurer, Mr. Rozanski, Mr. Strip and Mr. Sutphen. Mr. Hansley, City Manager, Mr. Smith, Law Director, were present as were the following City staff members: Mr. Bowman, Lt. Geis, Mr. Harding, Mr. Johnson, Ms. Jordan, and Mr. Willis. Ms. Prushing arrived at 8:26 P.M. Minutes Mr. Jankowski moved to approve the minutes of the Council meeting of April 4, 1988. Mr. Sutphen seconded the motion. The vote was unanimous in favor. Correspondence 1. There was no objection to a request for a one day liquor permit from the Columbus Area Chamber of Commerce for a function to be held at 6175 Shamrock Court on Thursday, April 21, 1988. 2. There was a request for a D3 permanent permit from Mr. H. R. Ransom (address listed as west side of S.R. 33 at Martin Road; this address being zoned for office in a P.U.D.). Mr. Smith was requested to check to see if that permit, if granted, would be placed in escrow. If so, Council had no objection. 3. A request for a D3 permanent permit from Mr. Ronald L. Leslie (address, 3865-3901 West Dublin-Granville Road). Mr. Smith will check to see if that permit will be placed in escrow; if so, Council had no objection. 4. There were no objections to a transfer of a permit from Chi Chis of Ohio, Inc. to Chi Chis USA Inc. Public Hearing Mayor Close repeated the Council Rules of Order as they apply to public hearings. Ordinance No. 22-88 - Change of Zoning on 11.927 Acres on West Side of 1-270, South of Shier-Rings Road. Public Hearing There were no registered proponents or opponents. Mr. Bowman had the following comments: 1. The 11.9 acres is the existing Corporate Park of Dublin. 2. A Conditional Use permit for a day care center in one of the build- ings was approved by the Board of Zoning Appeals. 3. One of the conditions of approval was that the property be rezoned from the Limited Industrial classification to the Restricted Industrial Use classification. 4. The applicants agreed. S. The suggestion was staff's, who endorse the Restricted Industrial use classification. 6. The Planning and Zoning Commission agreed, and voted unanimously to recommend approval of this rezoning application. There will be a third reading of the Ordinance at the Council meeting on Ma y 2, 1988. Ordinance No. 35-88 - Ordinance to Accept an Annexation of 53.0 Acres from Washington Township to the City of Dublin (Brand Road Area). Second Reading. There will be a third reading of the Ordinance on May 2, 1988. Ordinance No. 36-88 - Ordinance to Accept an Annexation of 109.27 Acres from Washington Township to the City of Dublin (Tuttle Road Area). Second Reading. Form No. 1097 ~ Held April 18, 1988 19 Page Two The Ordinance will be heard for a third reading on May 2, 1988. Ordinance No. 37-88 - Ordinance to Accept an Annexation of 2.1 Acres from Washington Township to the City of Dublin (Bellaire Avenue). Second Reading. A final reading of the Ordinance is scheduled for Monday, May 2, 1988. Ordinance No. 42-88 - An Ordinance to Amend Chapter 1187 of the Planning and Zoning Code Regarding Street Tree Planting Requirements. First Reading. Mr. Rozanski introduced the Ordinance. Mr. Sutphen moved to refer the Ordinance to the Planning and Zoning Commission. Mr. Rozanski seconded the motion. The vote was unanimous in favor. Ordinance No. 43-88 - Request for Storm Water Exemption - Donegal Cliffs, Section 7. First Reading. Mr. Amorose introduced the Ordinance. There will be a second reading of the Ordinance on May 2, 1988. Other Request for Approval of Final Plat - Dublinshire, Section 2 Mr. Amorose moved to approve. Mr. Jankowski seconded the motion. Mr. Bowman had the following comments: 1. Dublinshire is a Planned Unit Development, the southern part being located between Tara Hill and Sells Mill Drive, with Indian Run Meadows Section 5 to the west and Hemingway West to the east. 2. Section 1 with 134 lots was approved approximately one year ago. 3. Section 2, with 111 lots, will complete the subdivision. 4. The Planning Commission moved for approval with the following conditions: A. That there be a designated appropriate landscape treatment along the frontage of Reserve "B". B. Coordination of the street tree selection with Dublin's land- scape planner. C. That an 18" pipe be used underneath a swale that is being created to carry the low flow of the stream. S. Both the Planning Commission and staff recommended approval. Council voted unanimously for approval. Acceptance of Dedicated Public Right-of-Way from Jail Investments Mr. Jankowski moved for acceptance. Mr. Amorose seconded the motion. The vote was 7-0 in favor of the motion. Request for Funds from Hotel/Motel Tax - Dublin Art League The Dublin Art League applied for $5,000.00 from the 1988 funds provided for under Ordinance No. 133-87 known as the Hotel/Motel Tax of the City of Dublin. Form No. 1097 ~ Hclc/ April 18, 1988 19 Page Three Mr. Strip requested that whenever such a request is received that Council be brough up to date as to how much money has been collected and how much has been allocated. There was some concern expressed about spending monies before they are received. Mr. Hansley said that the way Council adopted the budget that these monies were put into an account in the General Fund. Mr. Ross Ekstrom, President of the Dublin Art League, was present at the meeting, and said that most of the monies would be used to purchase display screens. Mr. Amorose asked Mr. Ekstrom if the display panels would be loaned to civic associations or the schools. Mr. Ekstrom said that that decision would probably be best left to the membership of the Dublin Art League. He noted that one of the reasons that they like to have their own panels is for the purpose of keeping them looking well. As regards the schools he said that he would think for their own con- venience that they should probably buy their own. Mr. Ekstrom presented a few facts: the League has nine monthly meetings during a year; they have a minimum of four art shows in the community; next year there will probably be six or seven; they have a workshop each year; this year they hope to initiate a show for a single artist from somewhere in Ohio; membership fees are $20.00; they have grown from 11 members to 37 members. The anticipated life span of the display panels will be approximately 10 years. Mr. Strip moved to approve the request. Mr. Sutphen seconded the motion. The vote was unanimous in favor. Comments from Staff Mr. Hansley 1. Danny Johnson attended a field trip arranged by the Franklin County Disaster Services Agency to look at the siren system that Council budgeted for earlier this year. The City wanted to make a field trip assessment; this is a voice message system which is rather unique. There are not very many installed nationwide. Mr. Johnson reported good success with the tests that he heard. He also discovered that there are a variety of different sirens. The one that was being tested, the one that is being proposed, is rather large and Dublin will probably have difficulty finding suitable locations. There is a type that can be placed in the public rights-of-way and may be less intrusive than the type suggested. Staff is beginning discussions with the county disaster services agency to see if Dublin can consider the smaller type siren. The proposed system would have activation points only at the county, and at the City of Westerville for backup. Staff is also negotiating for the capability of being able to use the system for a totally local emergency. Discussions will also be held with surrounding townships to perhaps place sirens in an overlapping fashion so that more of the area can be covered. Staff will report to Council at a later date regarding the results of the discussions. 2. The City received 65 applications for the position of Chief of Po lice. Form No. 1097 ~ H chi April 18, 1988 19 Page Four Well over a half of those applicants were above the minimum qualifications of a Bachelor's Degree, plus a Master's Degree, plus seven years of command experience. Staff is well satisfied with the results of the recruitment effort. An interview panel of five local resource persons (e.g., Mr. William Denihan) is being brought together to interview 10 to 12 selected candidates. Following that process, staff will do the final interviews on a selected five to six persons. A Chief of Police should be "on board" in four to six weeks. , Additionally, since adopting the 1988 budget, approximately five persons have been hired by the City. There has also been a turnover of one position in the Building Department. 3. A post-audit conference was recently held with the Mayor, the Manager, and the Finance Director in attendance. It was a very good review with only a few housekeeping-type recommendations. Ms. Prushing is to be commended. 4. A proposed contract between the City and the Law Director should be on the Council agenda for action at the next meeting. S. Regarding the O'Shaughnessy Bridge project-discussions are continuing with the City of Columbus and the business people in the area. The project must include the widening of Glick Road to Dublin Road as well as the widening of the approaches to the bridge. Mr. Bob McCoy and Mr. Hansley appeared at a Shawnee Hills Council Meeting some months ago to discuss the possibility of a "land swap" (Banning property and commercial property east). At the time the idea, for whatever reason, seemed to be unacceptable. Also discussed was the very remote possibility of the merging of the two communities (because of their need for water and sewer service). Shawnee Hills is continuing to study the matter and will perhaps want to meet with Dublin Council for additional discussions. For informational purposes, the City of Columbus has some privately owned land held in deed; the land is owned by the City of Columbus but is not in the City. With regard to delaying construction on the bridge on Dublin Road at Marion Street until after the Memorial Tournament, Mr. Willis said that he has discussed the situation with Mr. Circle but has not yet received a final answer. Mr. Johnson reported that he and Mr. Willis have met with the residents on South Riverview Street about the drainage problem, and that they will be meeting with them again next week. Mr. Smith 1. With regard to the Concord Township situation, he and Mr. Hansley have met with Mr. Shimp of the County Prosecutor's Office and a representative of Concord Township. A recommendation from the Law Director's office will be forthcoming. 2. Reported on the recent Supreme Court decision on utility services being furnished by larger cities to other municipalities. The Law Director's office is reviewing that decision and will be reporting their recommendation to Council on that decision also. Invited Council and the community to the first major Arbor Day celebration which will be held on Friday, April 29, 1988 at 5:30 P.M. at the East Shelterhouse in Coffman Park. Mayor Close will lead the activities and refreshments will be provided. This will be another step on the way to Dublin becoming a tree city. 2. On this date, April 18th, the first day for season pool pass applications, approximately 150 applications were given out. Mr. Bowman 1. The Planning Department is planning a workshop along with the East Side Civic Association, to be held at the Dublin Middle School (1919 building) on Saturday, April 23, 1988, from 9:00 A.M. to 12:30 P.M. Mr. Martin Jenkins of Organizational Resources will facilitate. It will be conducted in a similar manner to the community workshop conducted last year. 2. Staff has met with representatives of the Old Dublin Historic District Association for the purpose of planning and identifying uses for a portion of the bed tax funds. Comments from Citizens None Council Roundtable Discussion Mr. Strip 1. Perhaps an appropriate use of bed tax funds for the City would be to create, perhaps with landscaping, interesting entryways into the City. Mentioned the positive nature of the large green space as one comes off of the freeway (1-270) into Dublin. Ms. Jordan reported that that issue has been discussed by the Tree and Landscape Advisory Commission and that it has been identified as one of their priority projects. Mr. Amorose suggested establishing a deadline so that planting could I. begin this Fall. Ms. Maurer and Mr. Strip mentioned Ameriflora in 1992 as well as the pandas at the zoo and suggested the Scioto Park, being on the way to the zoo, be a priority. Ms. Maurer 1. Reviewed the financial statement of the Dublin Irish Celebration group. 2. Mentioned she had met also with the Old Dublin Historic District Association recently, and the fact that they are desirous of adopting a plan for that area. Said that she did not think that the monies required for the development of the parking lot area should come from the bed tax; that there is $75,000.00 in the street construction budget that is not being used, and that it would probably take a minimum of $50,000.00 to develop that parking lot. il II II RECORD OF PROCEEDINGS M imdes of Dublin City Council Meeting ~~K:S Meeting National Graphics Corp., Cols., O. Form No. 1097~" Held April 18, 1988 In \~ Page Six Mr. Hansley said that he thought that development of that parking lot might be an appropriate use of the bed tax. It was decided to wait until the application was submitted for further discussion. Mr. Amorose 1. Thanked Mr. Bowman and staff for planning the Northeast Neighborhood Planning Workshop and invited members of Council to attend as well as interested members of the community. Mr. Hansley reported that he had met with the Greater Dublin Civic Association the previous evening and that a member of that group mentioned the positive nature of the community workshop that was held a year ago. He suggested that that type of format might be good for the merger issue as well as for other issues of concern and interest to the residents of Dublin. 2. With regard to the general spring cleanup program, Mr. Johnson said that a street program would be started shortly with the arrival of a street sweeper that will be available for the rest of the year. Mr. Hansley reported that the City will also be working with the County Office of Litter Control and Prevention on a cleanup program. 3. With regard to the street improvement program, Mr. Willis reported that they are in the process of beginning to make estimates of cost for the repairs. Mr. Amorose suggested getting the bid package out as early as possible so that the work will be completed before the asphalt plants close in the fall. Mr. Hansley reported that the contractor for last year's street improvement program will begin June 1 to complete the work that was not finished last year. Mr. Willis said that improvements on Muirfield Drive will be done after the Tournament. Mr. Sutphen 1. Mentioned the possibility of problems unless the ditch along Shier-Rings Road east of the fire station down to Wilcox Road gets some straw in it for retention. He noted that with spring rains the possibility of mud getting in the ditch, "plugging up" the creek, and perhaps flooding the yard of a landowner on Wilcox Road. Mr. Rozanski 1. Requested an updated employee list. 2. With regard to possible beautification projects, Mr. Hansley said that he is looking at the possibility of new wooden entrayway signs in the City. 3. Suggested examining the possibility of placing planters, for example, on the concrete median strip on Frantz Road to lessen the "cold" appearance that is there now. Mentioned the trash behind State Savings on Corbin's Mill along the line of trees (trash from the shopping center). Mr. Hansley said that for the short term the City could perhaps clean it up or get some volunteers to clean that area. For the long term, however, he said that the City with the expertise of the Franklin County Department of Litter Control will be examining legislation that will identify problem areas and assign responsibility for keeping those areas clean. S. There is also a problem with trash from the shopping center dumpsters in Monterey Park. 6. With regard to the 1-270 bridge trash, Mr. Willis said that he has spoken again with the responsibile parties and that it is their intent to have their maintenance people smooth that ditch and clean it up. Mayor Close 1. Council was again victorious in the Annual Bocce Ball Tournament. 2. Due to the increase in the numbers at Mayor's Court, the Clerk of Courts definitely needs assistance from a police officer until a civilian person is hired and lion board". Reported that because of the number of cases Mayor's Court will probably in the near future be held weekly.
