The regularly scheduled meeting of the Dublin City Council was called
to order by Mayor Michael L. Close at 7:30 P.M. on Monday, September
21, 1987.
Mr. Thornton led the Pledge of Allegiance.
Members of Council present were: Mr. Amorose, Mayor Close, Mr. Jankowski,
Ms. Maurer, Mr. Rozanski, Mr. Sutphen, and Mr. Thornton.
Mr. Hansley, City Manager, was present as was Mr. Stephen Smith, Law
Director.
Members of the City Staff present were: Mr. Bowman, Ms. Clarke, Mr.
Darragh, Ms. Jordan, Mr. Mayer, Ms. Prushing, and Mr. Willis.
Mr. Amorose moved to approve the minutes of the September 8th meeting of
Council.
Mr. Thornton seconded the motion.
The vote was 7-0 in favor of the motion.
Mr. Amorose moved to pay the bills.
Mr. Sutphen seconded the motion.
The vote was unanimous in favor of paying the bills.
Dr. Sam Smiley, Chairman of the "Celebrating City Status Party" thanked
members of Council for their support of the party and presented, on
behalf of the committee, a framed and matted poster signed by the artist.
Dr. Smiley reported that he would have a complete cost accounting of the
party in about two weeks and noted that they came well within~the budget.
Mayor Close commended Dr. Smiley and the Committee for their work.
Mayor Close repeated the Council Rules of Order as they apply to Public
Hearings.
Ordinance No. 88-87 - Rezoning of 9.81 Acres on the West Side of Muirfiel~
Drive, 150 Feet North of Tain Drive. Public Hearing.
Mr. Howard Adams and Ms. Karen McCoy registered as proponents.
There were no registered opponents.
Mr. Bowman had the following comments:
1. This is a 9.81 acre site located in Muirfield on the west side of
Muirfield Drive just south of the Country Club.
2. Mr. Bowman showed slides of the site.
3. The site is zoned high density in the Muirfield subdivision with up
to 20 units per acre on the site.
4. The applicant is proposing to halve the site - approximately 4.8
acres would be used for an office building with the remaining
five acres to be used for limited lower density development (very
similar to Lochslee with a maximum of five dwelling units per acre
on the site).
S. A median break on the site has been discussed as well as making
certain that the residential will be done in a manner very similar
to that of Lochslee.
6. The Planning and Zoning Commission and Staff recommend approval of
the rezoning.
Mr. Howard Adams said that the site is the last piece of high density
zoning in Muirfield and this zoning would greatly reduce densities.
He also commented that the office building at the north end of the site
does make sense because it is directly across the street from the
original Muirfield Village Golf Club maintenance facility.

The road that dead ends from Lochslee will be the entry street into the
housing area.
The Planning and Zoning Commission did not want an additional curb cut
off of Muirfield Drive. There will be no curb cut for the residential,
but there will be a curb cut for the office building.
Ms. McCoy said that the type of materials to be used on the office
building will be very compatible with the other buildings in the area.
Mr. Adams said that the housing has not been designed; the only commit-
ment that has been made as regards the housing is that it will not
exceed five units to the acre and that it will be compatible with the
other housing in the area.
With regard to a median cut for the office building, Mr. Adams said that
the proposal will be addressed at the time of the final development plan
submission.
There will be a third reading of the Ordinance on Monday, October 5, 1987
Ordinance No. 89-87 - Amending Codified Ordinances, Section 1181.09,
Planned Commerce District. Public Hearing.
There were no registered proponents or opponents.
The Planning Commission suggested a number of revisions to the Ordinance
as originally proposed.
1. A change in the purpose statement to somewhat more reflect the type
of development that Dublin is seeking.
2. A number of changes were made to the approval procedure; before
it was much too narrow and did not allow a sound basis for discretio
in the review of the development plan. The change would permit the
Commission to disapprove a development plan when the approval would
be a deterrent to the existing use, improvement, or the development
of adjacent property. Similar wording is found in the existing
P.D.D. regulations.
3. There was a great deal of discussion about drive-in uses. In
response, drive-in commercial uses were listed as a separate
permitted use.
4. Another issue raised was that there must be a proper amount of time
designated for Commission review, but it was noted that it is the
Charter that regulates the timing and that this regulation is very
inflexible.
S. Recommended that a check list be developed to guide the applicant in
preparing for Commission review. Staff agreed that this is a very
good recommendation.
Mayor Close suggested that before the Ordinance comes back to Council for
a third reading that the Planning Director and the Law Director work
together to produce a final integrated Ordinance.
There will be a third reading of the Ordinance on Monday, October 5,
1987.
Ordinance No. 101-87 - Accept an Awards and Commendations Program for
Dublin Division of Police. Third Reading.
At the request of the Police Chief and the Safety Committee, Mr. Amorose
moved to table the Ordinance until the next meeting of Council.
Mr. Sutphen seconded the motion.
The vote was 7-0 in favor of the motion to table until the October 5,
1987 meeting of Dublin City Council.

Ordinance No. 108-87 - Accept Petition for Annexation of 243! Acres to
Dublin from Washington Township, South of Shier-Rings Road and East and
West of Wilcox Road. Second Reading.
There will be a third reading of the Ordinance at the meeting of October
5, 1987.
Ordinance No. 114-87 - Amending Annual Appropriations. First Reading.
Mr. Sutphen introduced the Ordinance.
Mr. Sutphen moved to do away with the three time reading rule and treat
as an emergency.
Mr. Jankowski seconded the motion.
The vote was unanimous in favor of the motion.
The vote on the Ordinance was 7-0 in favor.
Ordinance No. 115-87 - Amending Codified Ordinances Regarding Abatement
of Noxious Weeds. First Reading.
Mr. Amorose introduced the Ordinance.
Mr. Amorose asked how the City would be addressing the naturalized areas
within the community; for example, areas along waterways.
Mr. Darragh noted that a definition of noxious weeds was included in
the Ordinance, which would hopefully take care of such a situation.
The title of the Ordinance was changed - "An Ordinance Repealing Chapter
561 And Adopting Chapter 561 of the City of Dublin Codified Ordinances
Regarding Abatement of Noxious Weeds and Declaring an Emergency".
Mr. Rozanski moved to do away with the three time reading rule and treat
as an emergency.
Mr. Sutphen seconded the motion.
The vote was unanimous in favor of the motion.
The vote on the Ordinance was 7-0 in favor.
Ordinance No. 116-87 - An Ordinance Authorizing the City Manager to
Adopt Collective Bargaining Procedures. First Reading.
As a result of a legal question raised by the City Law Director the
Ordinance will not be introduced until the meeting of October 5, 1987.
Ordinance No. 117-87 - An Ordinance Authorizing the Manager to Declare
a Lawn Watering Ban, and Declaring an Emergency. First Reading.
Mr. Jankowski introduced the Ordinance.
Mr. Amorose had the following concerns and comments regarding the
Ordinance:
1. Did not know whether it was justified.
2. The number one hobby in Dublin, as well as for many people through-
out the country is a garden and he would hate to take that away
from them.
3. The grasses in our community are basically cool season grasses which
require soil temperature somewhere between 55 to 80 degrees and it
is necessary from time to time to water these grasses. The way to
green them up is to cool them down, cooling the grasses down with
water to get some evaporation.
4. Must consider that when the lawns go into a very stressful dormant
stage that they are very susceptible to diseases and insects.
S. People could lose their lawns completely if they are not allowed
to water.
6. It is the duty as members of Council to supply the water and not
necessarily limit the availability of water.

Ms. Maurer noted that she was the person who requested that this
Ordinance be drawn up and noted that this was not an ordinance to
introduce a watering ban; that it allows one to be introduced and that
it can be of any duration depending upon the degree of emergency.
She noted that the Ordinance would permit the Manager to determine
whether there is an emergency and whether a ban is justified.
She also noted that recently it was not just that people did not have
water to water the lawns but that they lacked water to bathe, cook,
etc.
She also commented that since the City had the emergency in August that
the Columbus water tower on Summitview has come on line and every
record that the City has indicates that there is very stable and
fair pressure.
Mayor Close said that he was personally opposed to delegating this type
of decision to the City Manager and could not imagine any circumstance
where five members of Council could not meet if it were an emergency
meeting on an emergency measure.
Mr. Jankowski and Mr. Rozanski agreed that such a ban should be a
Council decision.
Mr. Rozanski also suggested that one way of possibly relieving the
problem could possibly be to ban jockey pumps or extra pumps on the
waterlines.
He suggested that this should be researched to see what kind of effect
the use of those pumps has on the pressure system.
Dr. Stoycheff suggested that perhaps one way of addressing the problem
could be to issue building permits only on the contingency that there
are no new lawns around the house.
There will be second reading of the Ordinance on October 5, 1987.
Ordinance No. 118-87 - Ordinance to Accept Lowest/Best Bid for Snow and
Ice Removal. First Reading.
Mr. Sutphen introduced the Ordinance.
The lowest best bid was the bid of Domtar Industries Incorporated in
the amount of $26.12/ton.
Mr. Sutphen moved to do away with the three time reading rule and treat
as an emergency.
Mr. Thornton seconded the motion.
The vote on the motion was 7-0 in favor.
The vote on the Ordinance was unanimous in favor.
Other
Informal Review of Dublin Municipal Pool at Earlington.
1. Plans were presented before the Planning and Zoning Commission in
September; the final plans will be before the Planning and Zoning
Commission in October.
2. Bids would, hopefully, be advertised for in November.
3. The project is on schedule; Dublin residents will be swimming on
the first of June.
4. The site is in the southwest corner of Earlington, just north of an
existing tree line.
S. It is a pool of approximately 9,000 square feet; there is also an
alternate to expand it some 1500 to 2000 feet in the event that
money becomes available.
6. It is primarily a recreational pool with some competitive elements.
7. It also has a physical educational or therapy element in the sense
of lap swimming.

8. It is probably a third larger in area than the Muirfield pool.
9. The majority of the area of this pool is for swimming and
recreational purposes as opposed to diving.
10. The bathhouse as proposed picks up the materials of the school -
brick, asphalt shingle roof, etc.
11. There will be a fence around the entire facility - Planning and
Zoning requested that it be wrought iron.
12. Landscaping will be significant around the site, sheltering the
facility from the neighbors to the east, to the north, and to the
west.
13. As regards the fence of wrought iron, it will be closer in place-
ment than the one in Muirfield
14. The existing tree line will be supplemented with additional vegeta-
tion.
There was discussion regarding the types of trees that will be planted,
noting that the landscape architect has suggested using locust trees.
Some persons mentioned that locust trees are "dirty trees", dropping
leaves, bugs, etc. into and around the pool area.
It was noted that there will be a variety of shady kinds of facilities
for eating and for relief from the sun; trees, umbrellas, and cabanas.
Discussion Regarding Glenbeigh Incorporated Project.
Glenbeigh Incorporated requested support of the City Council for their
project, specifically a Certificate of Need. Their proposal is to
develop a specialty hospital for the psychiatric care of youth.
The Clerk was instructed to write a letter to Glenbeigh Incorporated,
indicating that Council took no position because they did not feel that
they had sufficient information to do same.
Discussion Regarding Annual Congress of National League of Cities.
Mr. Amorose moved that Mr. Sutphen represent the City of Dublin as a
voting delegate and Mr. Rozanski as the alternate.
Mr. Jankowski seconded the motion.
The vote was unanimous in favor.
Ms. Maurer suggested that whoever is selected as a voting delegate
might spend some time reviewing the issues so that other members of
Council might have some input.
Comments from Staff
Mr. Hansley
1. Reported that approximately 195 applications had been received from
persons interested in the three police person positions.
2. The township study group met with the fire chief of Huber Heights.
He said that staff will draw all the information from the various
meetings together and give Council a list of options (the informa-
tion to be in the next Council packets).
3. The City Engineer has presented information to the Manager,
specifically a list of recommendations which he feels are critical
needs as far as staffing, etc. in the Building and Engineering
Department.
Ms. Prushing
1. Referred to the memorandum from the Income Tax Administrator
regarding the tax issue and invited all to attend a fund raising
event on October 6, 1987 at the Muirfield Pavilion.
2. Also mentioned the Mayor's Council Golf Outing on October 2, 1987,
and asked that those Council Members interested in attending
notify her of same.

Ms. Jordan
1. Specifically thanked the members of the Parks and Recreation
Department's maintenance staff for their work at the Celebration
of City Status Party, mentioning specifically Fred Hahn, Eli Yoder,
Bob Bailey, Ken Urban, and Jim Hargrove.
Mr. Willis
1. Reported that he and Mr. Hansley had met with members of the BIA
(approximately 12 persons) recently. There were some problems
that were presented to the City that he said some of which the
City needs to take a close look at. Some of those concerns
are quickness of inspections, issuance of building permits, etc.
Mr. Hansley commented that he felt that the meeting, while it
could have been very negative turned out to be quite positive;
that all felt that a better job of communication between the
parties is probably indicated.
2. Referred to the memorandum he had written regarding the updating of
the City's Construction Specifications. He mentioned specifically
two items of considerable interest in the industry _ those being,
new typical pavement sections for use in Dublin and PVC sanitary
sewer pipe not being included in the specifications.
3. The street repair contract has been signed and work will begin the
week of September 28th.
The Clerk reported that the City will be seeking applications for the
vacancies on the various boards and commissions and noted that the
Forestry Commission will, with representatives of the Parks and
Recreation Department, become active once again.
Council Roundtable Discussion
Mr. Jankowski
1. Mentioned the appearance of the area around Adventure Drive where
the Church of Latter Days Saints connected up to the sewerline;
that appearance being very negative in nature and wondered whose
responsibility it is to "clean it up and repair same".
Mayor Close mentioned a letter from Jack Eggspuehler expressing
similar concerns regarding that site.
Mr. Bowman said that he will meet with Mr. Smith regarding the
problem. He said that the City has a situtation in which some
engineering improvements were done, and a bond, unfortunately, was
not taken out for the project. Whose responsibility it is has not
been determined.
Mayor Close said that something has to be done even if the City
has to do it itself.
He also requested that Mr. Hansley contact Mr. Eggspuehler and
give him an update on the status, and inform him that the City
is working on the project.
Mr. Jankowski said that the City should have had a bond and that
an incident such as this should not happen again.
Mr. Rozanski
1. The League of Women Voters at 7:30 P.M. on October 13, 1987 will
have their Candidate's Night in the High School Performing Arts
Center and urged everyone to attend

2. Said that several citizens have suggested looking into the feasibili y
of putting up "Do Not Block Intersection" signs on S.R. 161 at
Franklin Street and Monterey Drive.
Mr. Amorose
1. Requested that the contractor "clean up the area" in the 1-270
bridge site since the project apparently has been completed. The
contractors left behind approximately thirty tons of sand, etc.
2. The sewer project along Riverside Drive seems to be coming along
quite well, the barriers and hazards having been removed, etc.
Mr. Hansley commented that the City has received a number of com-
plaints from the residents regarding restoration of driveways. etc.
Mr. Willis said that he has contacted the inspector on the project
a number of times but that the City has no leverage. He said also
that he thought that they were making some effort to restore the
project area and that they should be finished in a couple of weeks
with the project.
Mayor Close
1. Mentioned the east side of the bridge; why there has not been some
permanent resolution to the sidewalk going from west to east along
the bridge.
Mr. Amorose said that he felt that there was a real hazard; that
when one is making a turn from Riverside Drive onto S.R. 161; there
is no curb, etc.; that someone could go right into that wall.
Mr. Sutphen said that if the City is not going to put in a cross-
walk there that the City should at least take the wall down so
that one does not have to walk out into the road.
Mr. Willis said that he had been told by a traffic engineer that
[t is technically possible to signalize a pedestrian crossing at
the intersection. He said also that he believed that the wall was
built at the insistence of either the Ohio Department of Transporta--
tion or the Federal Government.
It was strongly recommended by members of Council that something be
done.
Mr. Hansley said that he would present at the second Council meeting
in October the cost for an at grade crossing and the subsequent
effects if one were to be installed.
2. Mentioned that if any citizens are interested in~serving as poll
workers at the next election that they contact him so that he might
refer them to the appropriate persons for additional information.
3. Suggested that something be done with the Council Chambers so that
all persons present can observe what is going on; visual aids,
slides, etc. that are part of presentations, as well as making it
possible for Council members to see each other.
Mr. Halloran said that the Bridge Street/High Street street signs have
not been put back up since the bridge project was completed, as well as
the signs all the way up S.R. 161.
Mayor Close adjourned the meeting of Council at 8:55 P.M.
