Form No. 1097 ~ r Held nNpvember 3, 1986 19 ------- - ---- -- --- -------~-------------~-- The regularly scheduled meeting of the Dublin Village Council was called to order by Mayor Michael L. Close at 7:30 P.M. on Monday, November 3, 1986. Mr. Thornton led the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mayor Close, Mr. Jankowski, Ms. Maurer, Mr. Rozanski, and Mr. Thornton. Mr. Sutphen was absent. Mr. Sheldon, Village Manager, and Mr. Smith, Law Director, were also present as were Mr. Bowman, Mr. Harding, Ms. Jordan, Ms. Prushing, and Mr. Warner of the Village Staff. Mr. Thornton moved to approve the minutes of the October 20, 1986 meeting of the Dublin Village Council. Mr. Rozanski seconded the motion. The vote was 6-0 in favor of approval. Mr. Amorose moved to approve paying the bills. Mr. Jankowski seconded the motion. Mayor Close commented that, for reference, any of the bills listed that have an asterisk before them are bills from self-supporting funds; e.g., instructor fees, indicating that those services are supported directly and totally by user fees and are not a drain on the general trusery. The vote was unanimous in favor of paying the bills. There was no correspondence. Ordinance No. 15-86 - Rezone 3.66 Acres on Dublin-Granville Road, West of Sawmill Road. Third Reading. The vote was unanimous in favor of the ordinance. Ordinance No. 78-86 - Accept Quotation for Design of Tuller Road Improve- ments. Second Reading. Mr. Amorose asked Mr. Warner if the specifications had been drawn up for Tuller Road. Mr. Warner said that they will not be done until the plans are approved. Mr. Warner also said that he would work with shomever is awarded the contract and review the number of lanes, etc. There will be a third and final reading on Monday, November 17, 1986 at 7:30 P.M. Ordinance No. 80-86 - Creation of New Job Classification - Maintenance Department. Second Reading. Mr. Rozanski requested that Council allow the Village Manager to advertise for the position while waiting for the third reading. Ms. Maurer moved to do away with the three time reading rule and treat as an emergency in order to give the Maintenance Department the opportunity to hire this person prior to the time in which he will probably be needed most. Mr. Thornton seconded the motion. The vote on doing away with the three time reading rule and treating as an emergency was as follows: Mr. Rozanski, yes; Mr. Thornton, yes; Ms. Maurer, yes; Mr. Jankowski, yes; Mr. Amorose, no; Mayor Close, yes. Mr. Amorose wondered whether or not a High School Diploma or GED equivalency should not be required of a potential employee. Form No. 1097 ~ Held l~ovember 3, 1986 19 r= Page Two Mr. Amorose also said that he would recommend that such a person be licensed for dealing with pesticides. He said that the State of Ohio requires individuals to possess a pesticide license if they are going to be spraying herbicides. Mayor Close suggested that Mr. Amorose's comments be directed to the Village Manager. Mr. Rozanski suggested training several persons in the Maintenance Department in that respect. The vote on the ordinance was unanimous in favor. Ordinance No. 82-86 - Accept Quotation on Liability Insurance Coverage. First Reading. Mr. Amorose introduced the ordinance. Mr. Thornton moved to do away with the three time reading rule, treat as an emergency, and accept the recommendation of staff (that the bid of the Len Webb Agency, Inc. in the amount of $20,021.00 be accepted. Mr. Amorose seconded the motion. ,r;-.- Mr. Harding reported that the umbrella liability market is very expensive at the present time. He also commented that if there should be a claim in an amount in excess of the coverage provided by the comprehensive general liability policy, that an embrella policy would "kick in" the additional amount and is termed excess liability coverage. The vote on the motion was unanimous in favor. The vote on the ordinance was 6-0 in favor. Ordinance No. 83-86 - Establish Position of Planner (Architecture and Landscape Design). First Reading. Mr. Amorose introduced the ordinance. There will be a second reading of the ordinance at the next meeting of Council on Monday, November 17, 1986 at 7:30 P.M. Ordinance No. 84-86 - Approve Change in a Street Name in Muirfield. Firs4 Reading. Mr. Rozanski introduced the ordinance. It was noted that the request came from the six families who will be constructing homes on this street in the near future. The request was to change the name of the street from Balmahoy Court to Muirfield Run. Mr. Amorose moved to do away with the three time reading rule and treat as an emergency. Mr. Thornton seconded the motion. The vote was unanimous in favor of the motion. If"" The vote on the ordinance was 6-0 in favor. -..".. A Ordinance No. 85-86 - Appropriating Fee Simple Title to Property at Corbin's Mill and State Route 161 for Traffic Signal Installation. First Reading. Mayor Close said that Ordinance No. 85-86 has been pulled from the agenda and will be considered for a first reading at the Council meeting on November 17, 1986. Mr. Amorose introduced the ordinance. There will be a second reading on November 17, 1986 at 7:30 P.M. Acceptance of Final Plat - The Woods of Dublin Mr. Thornton moved to accept the Final Plat - The Woods of Dublin. Mr. Rozanski seconded the motion. The vote was 6-0 in favor of acceptance of the Final Plat - The Woods of Dublin. Ms. Maurer asked why Ordinance No. 85-86 was pulled from the agenda. Mayor Close explained that there have been additional discussions regarding this particular subject, and further explained that the ordinance speaks to the quick take provision of condemnation. He said that after discussion with the developers, rather than improve the probability of litigation over this issue that apparently there is going to be a proposal, and that this issue will be resolved without the need for the Village to do the quick take or have a condemnation proceeding. He also said that the developers are asking for a period of two weeks to work out the details with the Law Director and the Village Engineer. Ms. Maurer said that she would prefer having a first reading rather than pulling the ordinance off of the agenda. Mayor Close said that there is a probability that the land would be donated to the Village if Council does not introduce the ordinance. Comments from Staff There were no comments from staff. Comments from Citizens Mrs. Robyn Fillman thanked Council members for their prompt attention to the matter of non-handicapped individuals parking in handicapped parking spaces. Mrs. Fillman asked if there were any plans to landscape the grassy median on S.R. 161 in front of the Dublin Plaza Shopping Center. Mr. Rozanski explained that that section of the roadway is a limited access State highway; it is not in the Village of Dublin and the Village is very limited in what it can do. Mayor Close said that perhaps the Village could work with the State in doing something on the site. Mr. Thornton suggested that plans for other areas of the Village perhaps could be done at the same time. Mr. Amorose said that there are some problems with islands because often there are no curbs and gutter. It was suggested that this might be a good project for the Forestry Commission. Mrs. Nicholls, a resident of Old Pond Drive was present, representing persons concerned about the raw sewage being deposited into the Scioto River in the area of the pump station. Mrs. Nicholls expressed the following concerns: 1. The sewage dumps into the river after a heavy rain. 2. Representatives observed the sewage in the river after a heavy rain on October 3rd and October 10th. It appears that the Village its greatest "assets" (the Scioto River). Mr. Thornton has mentioned the problem at previous but the issue has not been adequately discussed. Some Planning and Zoning Commission members were not situation at all. to do about this severe is destroying one of T ~- I I I I I Council meetings, , ! 19 Held November 3, 1986 Page Four 4. 5. aware of the Mayor Close reminded those present about the considerable sum of money the Village invested in the pump station during the last year in an effort to correct the situation. He said that to his knowledge on one occasion after a saturating rainfall that lasted about a week (approxi- mately 5 inches of rail in a relatively short period of time) there was an infiltration problem. He said that that situation was the only one that he was aware of at this time, and that if Mrs. Nicholls had other information that he would certainly be willing to look at same. Mrs. Nicholls said that she had the National Weather Service rainfall charts available for that time period and on that day (October 3rd) there was only 1.69 inches of rainfall. Mr. Warner presented the following information: 1. In reviewing the last four months of records there have been some other spills beside the one on October 4th (not October 3rd). 2. The other two spills that did occur during the summer were on September 4th and July 9th which were as a result of a malfunction in the pumps. 3. There was a minor spill which occurred on July 2nd, that date being shortly after the new pump was installed. There was a malfunction in a pump, and a heavy rain also occurred that day. Mayor Close asked Mr. Warner, "Do we have adequate pumping capacity at this point to take care of the sewage problem?" Mr. Warner said, " Based on my latest calculations we have adequate pumping capacity because the average daily flows aren't that high where we require another pump to be installed to handle heavy rain- sotmrs. Pump #1 is running about 22 to 23 hours a day; pump #2 is running about 5 to 6 hours a day; pump #3, since it was installed, has run about 120 hours and most of those hours were on test runs to make sure that the pump is running properly." Mr. Warner also said that there is an excess amount of infiltration into the sanitary system which he feels is unwarranted but that he has not been able to trace it down in the three years he has been with the Village. He did say that that infiltration is primarily on the west side of the river. Mayor Close commented to a resident that two weeks ago the Village commissioned a separate engineering study to tell the Village about capacity in the main trunk on the east side of the river as well as the Village's ability to handle the amounts that are being pumped across the river. Mr. Warner said that it will probably be four weeks before test data is available. Mayor Close said that when that data is available it will be made available to those of the public who wish to study it. He also said that when the subject of a possible moratorium was suggested, the Village Council took a position that there had to be certain legal criteria that had to be met before discussing a moratorium. He noted that among those criteria are included an absolute necessity that the Village be able to produce substantive evidence of an inability to provide services. Page Five operating at capacity presently, he said that he felt that the Village would find that they would have the capacity to put the sewage across the river. Mayor Close did say that if the studies show that the Village does not have the capacity to handle the sewage that the Village has, then at that point the substantive evidence is available that allows the Village to make a decision as to whether or not Dublin puts a moratorium or whatever else it may decide to do in order to handle that particular problem. Additionallly he said, if Dublin imposes a moratorium, the Village is required to come up with an immediate solution to the problem. Responding to a question from Dr. Stoycheff regarding the possibility that the sewer branch on the east side of the river is at capacity, Mayor Close said that if it is a pump problem on the west side of the river then the solution is closer at hand; if the sewer on the east side of the river is full, the only solution to that is the completion of the west branch trunk. He noted that from information available presently the east branch is not full. Mayor Close went on to say that he felt that there had been a perception created (that is inaccurate) as far as Council's attitude concerning growth and growth management and a moratorium, commenting that instead of working together to solve the problem that it has become a situation of "we against them". He noted that there is a need to look past the immediate short term solutions. He also said that there are questions that need to be resolved before any decisions can be made - how would a moratorium affect the Village's bond rating - would the citizens be agreeable to an increase in taxes, etc. The Village needs to examine the long term affects. With regard to the school district, Mayor Close noted that Dublin has about one half of the students, Columbus has the other half, and pointed out that there is still a great potential for growth on the Columbus side of the Dublin school district and such issues would have to be studied carefully before voting on a moratorium or growth management. Mayor Close noted that Council members had been given a legal opinion on the issue in Ohio, under Ohio law as to controlled growth, and that it is an unfair characterization that anyone on Council is against controlled growth and pro-developer. Mrs. Nicholls, a resident, mentioned the petitions brought forth some time ago to Council and the fact that there was no ad hoc committee formed and no legal opinion asked for at that time. Mayor Close said that a legal opinion had been asked for and had been received. Ms. Maurer had the following comments: 1. Regarding the communication from Citizens for Better Planning and responding to same said: A. The Land Use Committee had discussed the issues, and at the time they were discussed had already received the attorney's opinion on the moratorium, and that basically what the opinion was was that one cannot have an instant moratorium; that one has got to have information indicating that there is an emergency situation. She said that the issue was discussed by the committee with the Village Planner and the Village Manager and that it was felt that the hiring of an engineer to investigate the water and sewer situation was the appropriate step to take to deter- mine whether or not the Village did have an emergency situation. ~ RECORD OF PROCEEDINGS 451 Alinutes of Dublin Village Council Meeting ~tb Meeting National Graphics Corp., Cols., O. Form No. 1097 ~ Held November 3, 1986 19 ~ I Page Six B. The committee did discuss the growth management issue and said that the goal setting process continued to be an ongoing issue. In this process the Council have developed a number of issues which they feel are top issues - west branch sewer, master plan, etc. She noted that responsibility for those issues has been allocated to various members of the Village Staff and meetings have been held with staff to develop those ideas and review them. C. After discussions with the Planner the committee felt that any growth management needed to be incorporated into the master plan. Legally that is the approach that must be taken in Ohio. A long term master plan for the Village is required prior to any growth management. That process has been instituted, and part of that process will include public hearings. 2. There will be public meetings at the appropriate time when Council will be gathering information from the community about what they would like to see in a master plan. There was some discussion on what an acceptable amount of growth would be for Dublin. Mayor Close pointed out that with regard to applications for rezoning (specifically referring to the Brand Road/Dublin Road rezoning) that the Planning and Zoning Commission must examine what the surrounding area is zoned on a potential rezoning; they cannot arbitrarily say what a rezoning should be. If the Village takes that position then the Village will be back in court. Legally, the Village must be consistent. He did not that the Village does have quadrant plans which are being followed. are 1. 2. iI''' 3. - 4. 5. 6. The legal advice that the Village has been given is that until and unless the Village has substantive evidence then the Village cannot do it. Mr. Thornton said that he felt that the Village does not know "what is going on in our own sewage system"; e.g., which of the three lines provides most of the sewage, which one is being infiltrated. He said that it should be determined which of those three lines is causing the infiltration so that the problem can be corrected (there could be a shopping center draining into the Village's sanitary sewer). He suggested that perhaps the Village should pay someone to run TV cameras up the line, and also said that monitors could have been put on the lines as he suggested a long time ago. Ms. Maurer again referred to the attorney's opinion that there are six things to consider before instituting a growth management plan which as follows: Does the state's enabling legislation empower the municipality to enact growth management legislation; Does the need for such legislation actually exist as clearly evidenced by extensive study and analysis; Does the plan limit development so as not to constitute a total ex- clusion of an owners use of his or her land; Is the limiting process well defined and understandable and not indefinite in nature; Does the plan provide for an ongoing planning and review process in the context of a master development plan; Is the plan non-discriminatory as to development style, type and value. Ms. Maurer also said that as she had reviewed the plans she had noted that each of the plans approved by a superior court required that there be low and moderate income residential development in those communities. Form No. 1097 ~ Held November 3, 1986 19 ...~ Page Seven Mayor Close said that any person wanting a copy of the legal opinion written by the Law Director would be welcome to have same. Mrs. Nicholls asked if any priority had been given to development of a master plan. Mayor Close said that an additional planner will be added to the Planning Department staff shortly so that Mr. Bowman can devote a subsLantial portion of his time in getting the master plan completed. Dr. Stoycheff said that he thought that the "real problem" was infra- structure, mentioning the water pressure problem in Muirfield, the fire department saying that there is not enough water pressure to fight a fire, the people on Coffman Road mentioning the safe hazard, the possibility of the sewer being at capacity, etc. Dt. Stoycheff again referred to the Hammond Resolution passed by the City of Columbus wh~ch states that there will be no upzoning until there is sufficient infrastructure, and suggested that the Village of Dublin pass a similar resolution. Mayor Close said that as soon as the Village gets the report back from the engineers that Council will be willing to consider same. Ms. Maurer said that she had talked with a Fire Department official about the statement that was made regarding the fact that there was not enough water pressure in Muirfield to fight fires. She said that Mr. Sedlock said that that was absolutely not ture, that where there is low water pressure, water can be brought in to fight a fire. Mr. Dennis Muchnicki, a resident, said that he felt that the issue is the character of Dublin, "what kind fo community we are going to have here". He also said that he felt that the "first step" should have been to hold public hearings to find out what the community wants. He also said that he felt that Council should ask the Law Director to examine the possibility of changing the various provisions of the Code which pose unreasonable deadlines on the staff for turnaround times in reviewing plats, etc. Mr. Muchnicki also mentioned to case of the Village of Hudson vs Albrecht in which the Ohio Supreme Court said that aesthetics is a proper consideration in zoning. Mayor Close again said that if there is to be a slow down or moratorium that the lo~ical place for that to happen is at the issuance of building permits, not in the zoning process. Mayor Close said that members of Council are always willing to cooperate and meet with concerned citizens. Mrs. Nicholls said that she was not allowed to attend the meeting of the Land Use Committee. Dr. Stoycheff commended Council for all their hard work and sincere interest in the community. ~' Council Roundtable Discussion .... Mr. Thornton 1. Regarding the illumination lights in Monterey Park and the fact that after an announcement of same regarding that particular possibility, that no residents had come forth to express an opinion, and therefore Council authorized the Village Manager to go ahead with the installation of lights in Monterey Park. Mr. Jankowski said that it was not entirely correct that he favors growth control issues; that he favors discussing growth control issues - whether or not it turns out that that is what should be done remains to be seen. He suggested that each Council member study and review very carefully the legal opinion of the Law Director on the growth management issue. Mr. Rozanski 1. Regarding the letter from Mr. Cline and his concern with the traffic situation and number of accidents on a certain section of Post Road, suggested referring the matter to the Engineer and the Police Department for further study and a report back to Council. 2. Recalled the allocation for landscaping of the Frantz Road median. Mr. Warner reported that the plans and specifications have been completed and bids will be taken on November 20th. 3. The waterline on Avery Road. It was reported that they are getting updated engineering on the line and plan to start construction as soon as the engineering is completed. The project should be completed by early spring. He recalled that early spring was not the date for completion first mentioned. He also said that he felt that the Village should take a firm stand on the issue and get the line in. Ms. Maurer 1. Recalled that about two months ago a Design REview Committee was formed by Council - the purpose of the group being to come up with some proposals for design of buildings, primarily commercial and office buildings, to determine what can be done. Mr. Grace volunteered, at that time, to be Chairman of the committee, but since has decided that due to other commitments he is not able to serve as chairman. Mayor Close said that he felt that the committee members should select their own chairman. After additional discussion Ms. Maurer moved that Mrs. Pam Rozanski be selected as chairman. Mr. Thornton seconded the motion. The vote was as follows: Mr. Thornton, yes; Mr. Rozanski, abstain; Ms. Maurer, yes; Mr. Jankowski, yes; Mayor Close, abstain; Mr. Amorose, yes. 2. Commented on an item in the minutes of the Dublin Fund received by members of Council. There was a discussion about whether they should choose a particular focus for their funds. Ms. Maurer said that she felt that the group should not narrow their focus to one area; Dublin needs different creative approaches and projects. Mr. Amorose 1. .,41 Suggested that the Forestry Commission be utilized, perhaps update the landscape code. 2. Expressed concern with retention and detention basins in many of the Village's developments, noting that some of those in residential areas are very unattractive (Indian Run Meadow, along Dublin Rd., etc.) He said that he will review the specifications and make some suggestions as to how to upgrade them and also how to enforce their implementation. n_ 1 i RECORD OF PROCEEDINGS Minutes of Dublin Village Council Meeting ~~b National Graphics Corp., Cols., O.
