Form No. 1097 ~ ------------T------ Held October 6, 1986 19 --- ----~----_._- - ------.-------------_...._.----- .._------_._-------_._~----_.__._~._--- The regularly scheduled meeting of the Dublin Village Council was called to order by Mayor Michael Close at 7:30 P.M. on Monday, October 6, 1986. Cub Scout Den 1, Pack 185, of the Boy Scouts of America presented the Colors and led those present in the Pledge of Allegiance. Mr. Mantel, their leader, was also present. Mayor Close asked for a moment of silence in remembrance of Mrs. Helen Thornton. Members of Council present were: Mr. Amorose, Mayor Close, Mr. Jankowski, Ms. Maurer, Mr. Rozanski, and Mr. Sutphen. Mr. Thornton was absent. Mr. Smith, Law Director, and Mr. Sheldon, Village Manager, were present as were Mr. Bowman, Mr. Harding, Ms. Jordan, Ms. Prushing, and Mr. Warner of the Village Staff. Mr. Amorose moved to approve the minutes of the September 15, 1986 meeting' of the Village Council. Mr. Rozanski seconded the motion. The vote was 6-0 in favor of approving the minutes. Mr. Amorose moved to approve paying the bills. Mr. Sutphen seconded the motion. The vote was 6-0 in favor of paying the bills. Correspondence 1. There was no objection to granting a one day liquor permit for a function to be held at OCLC on October 11, 1986 by The Special Wish Foundation Inc. 2. There was no objection to granting a one day liquor permit for a function to be held at OCLC on October 25, 1986 by the Dublin Women's Club. 3. A letter from a resident, Anita Davison, objecting to the chimes in the bell tower at the Village Square Shopping Center. 4. A letter from Jan Patterson, Festival of the Arts Chairman, thanking Mr. Sheldon and the Dublin Village Council for their assistance in the Annual Festival of the Arts that was held on September 14, 1986. Mayor Close reported that the Village of Dublin had received notification from the City of Hilliard regarding a proposed annexation that would annex approximately 350 acres within southern Washington Township into the City of Hilliard; that being the southernmost portion of Dublin's service area. Mr. Rozanski moved that Mayor Close write a letter to the City of Hilliard stating that the Council of the Village of Dublin does not oppose said annexation. Mr. Sutphen seconded the motion. The vote was unanimous in favor of the motion. Third Reading Ordinance No. 58-86 - Land Dedication or a Fee in Lieu Thereof. Mr. Sutphen moved to table the ordinance until the October 20th meeting of Council since Mr. Thornton was not able to be present at the meeting. Ms. Maurer suggested that before Council votes on the ordinance that they confer with the Village Planner as to how the Planning Staff will handle the issue; if passed how it would be implemented since there is RECORD OF PROCEEDINGS 247 Minutes of Dublin Village Council Meeting ~tbs Meeting National Graphics Corp., Cols., O. Form No. 1097 ~ -------- '1 -- Held October 6, 1986 19 Page Two not a consensus among the Council members as to how the land will be used as well as legal problems which have been discussed previously by certain members of Council. Ms. Maurer also referred to the spread sheet provided by Ms. Jordan, the Parks and Recreation Director. Mr. Sutphen suggested that the Planner, members of Council, and members of the School Board discuss the issue among themselves so that there would be no "false promises, everything would be open and up front, and so that there would be no questions raised in the future". Mr. Rozanski seconded the motion. The vote was 6-0 to table until the October 20th meeting of Council. Ordinance No. 67-86 - Adopt Chapter in Fire Protection Code Regarding Fireworks. Third Reading. The vote was unanimous in favor of the ordinance. Ordinance No. 70-86 - Accept Quotation for a Sewage Pump Station Study. First Reading. Mr. Sutphen introduced the ordinance. Mr. Sutphen made a motion to accept the Village Manager's recommendation to accept the bid of Floyd Browne Associates Ltd. in the amount of $9,300.00, do away with the three time reading rule and treat as an emergency. Mr. Rozanski seconded the motion. With regard to the lowest bid by Burgess & Niple, who designed the pump station originally, Mr. Sheldon said that as designed it has completely changed - the motors have been changed, the impellers have changed, etc. The estimated completion date for the study would be a little over six weeks. Mr. Sheldon said that the bidder would recommend a method of measuring, in this case a metering chamber with recording devices which they would design. Mr. Warner said that at the completion of the study the Village would have some available data as to how soon the pump station will reach capacity, and in the interim will provide data for an ongoing flow study. The vote on doing away with the three time reading rule and treating as an emergency was 6-0 in favor. The vote on the ordinance was unanimous in favor. Ordinance No. 71-86 - Accept Quotation for a Low Pressure Water Study. First Reading. Mr. Rozanski introduced the ordinance. Mr. Rozanski moved to do away with the three time reading rule, treat as an emergency, and adopt the Manager's recommendation (F. Dan Boothe, P.E. Inc. at a cost of $7,400.00). Mr. Jankowski seconded the motion. Ms. Maurer asked about the discrepancy between the low bid and the high bid - $19,200.00 to $7,400.00. Mr. Warner said that the high bid included a computer analysis which the Village did not ask for (an analysis of the waterline system throughout the entire Village), and felt that at this time the Village did not need the particular information. Ordinance No. 72-86 - Amend the 1986 Annual Appropriation Ordinance. First Reading. Mr. Amorose introduced the ordinance. Mayor Close announced that the ordinance would be referred to the Parks and Recreation Committee for their review prior to the next Council meeting so that it can be voted on at that time. Judge Richard Metcalf had the following comments: 1. Has had one in his back yard for approximately 30 years. 2. The minimum number of days of usage in Dublin would probably be 45 days. 3. The Columbus Foundation has agreed to pay virtually all of the initial cost. 4. Offers a recreational facility for young people in the wintertime when there are virtually no other recreational facilities available to them. 5. After paying for the basic molds to build the side rails the annual cost would be approximately $1000 to $1500 per year (amoritizing it over the life expectancy of the equipment). 6. White sand is used as an insulation from the blacktop. 7. There will not be a flat top cover. It will be wiring across with a hang down of a fence, casting a shadow (somewhat similar to the shade canvas that is put around a tennis court effect). 8. Ms. Maurer asked Ms. Jordan what the cost would be to the Village - part-time help, etc. 9. It will take six weeks to cut the mold. There will be a second reading at the meeting of Council on October 20th. Ordinance No. 73-86 - Industrial Revenue Bond Issue - River's Edge III. First Reading. Mr. Richard Kane gave the following information: 1. Council earlier in the summer, upon receipt of the appropriate certification from the Community Improvement Corporation adopted an inducement ordinance. 2. The project will be the construction of a five building office complex on the east side of U.S. 33. 3. The bonds have been marketed by The Ohio Company. Mr. Amorose introduced the ordinance. Mr. Amorose moved to do away with the three time reading rule and treat as an emergency. Mr. Rozanski seconded the motion. The vote was unanimous in favor. The vote on the ordinance was 6-0 in favor. Ordinance No. 74-86 - Accept Quotation for Engineering Design of a 12" Waterline. First Reading. Mr. Amorose introduced the ordinance. Mr. Warner said that as soon as the plans are available (hopefully 30 to 60 days) contracts will be initiated to start construction yet this winter, and it should be in by next summer. Approval of Final Plat Earlington Village, Section 3 Mr. Smith said that he was satisfied that there was no impediment on the plat of Earlington Village, Section 3. i Mrs. Diane Nicholls expressed a concern of persons living in the Earling-I ton area, the Coffman Road area, citing the fact that there is no ' traffic relief. She said that she would like to see some of these plats tabled until it can be shown that Muirfield Boulevard is going to be put in. The vote on approval of the Final Plat, Earlington Village, Section 3 was 6-0 in favor. Approval of Concept Plan - Morse/Mast Plat Mayor Close said that the Concept Plan is a preliminary stage that developers can be asked to take prior to the preliminary plat stage. He also said that in discussing the matter with Mr. Smith that there might have been an irregularity at the Planning and Zoning Commission meeting at which this was discussed and for that reason recommended rescheduling discussion of the plan until the October 20th Council Meeting. Mr. Smith said that in reviewing the minutes of the Planning and Zoning Commission meeting it appeared that there was a motion to table which was voted on as 3-2 in favor, and the next thing that happened was that there was a vote taken on the issue itself. He said that he was not certain that, procedurally, the issue was not tabled. It was noted that if it was tabled, then it will have to go back to the Planning and Zoning Commission. Mr. Bowman said that the plan came to Council for two reasons: the Planning Commission wanted Council feedback regarding the impact of such a large site on the utilities, etc. and that they were concerned about the density. Approval of Preliminary Plat - Dublin Technology Center Mr. Rozanski moved to approve the preliminary plat with the conditions as recommended by the Planning and Zoning Commission. Mr. Amorose seconded the motion. Mr. Bowman said that the applicants have been advised that Council and the Planning and Zoning Commission have considered an area rezoning for this property, and will probably have it for a first reading at the Council meeting on October 20th. The conditions of approval were as follows: 1. To be consistent with the Jentgen/Klein tract to the east, the Post Road setback should be 100'; 2. Prior to final plat approval it is suggested that the applicant have prepared a landscaping plan along Post Road to be implemented at an agreed upon date so that the plantings will achieve an 80% opacity; That Wilcos Road intersects Avery be vacated at Post Road when proposed Wall Street Road. 4. The Commission made an additional comment after some discussion that they would be willing to discuss modifications to the 100' setback for the possibility of parking 25' of it based upon the final plat when it comes in. Comments from Staff Mr. Sheldon reported that the 0.55 acre annexation was heard by the Delaware County Commissioners and will be heard by Council in the latter part of December or the first part of January. .t>.' , Comments from Citizens Mrs. Robyn Fillman, a resident of Avery Road, noted that she had seen a number of non-handicapped persons parking in the handicapped spots in the various shopping centers around town. Mr. Rozanski said that he had ridden with a police officer last Friday evening; the officer gave out three tickets to persons parking in the handicapped zones; but as soon as those spaces were empty, someone else would park in them. He also said that perhaps the $5.00 fine was not sufficient to deter persons from parking in those spaces. Mayor Close requested that the Law Director prepare an ordinance for the next meeting, increasing the fine for those non-handicapped persons who park in handicapped zones. Mrs. Pat Painter of 7650 Riverside Drive had the following comments regarding The Woodlands Subdivision which is being built next to her property, specifically the drainage situation on Tonti Drive: 1. When this development was first brought to the Planning and Zoning Commission it was noted that there is a water problem on Tonti Drive. 2. At the first meeting it was decided that Mr. Yeager would not be permitted to have any surface water drain on anything that is already there on the north side of Tonti Drive. 3. When his grandfather put in Tonti Drive he put the culverts under Tonti Drive not to go down to Riverside Drive but across the road and then across her property which runs parallel to Tonti Drive (the full length), and all going into a gully 4. There are 10 12" field tiles that are exposed on their property because all of the water is draining onto their property. 5. When there is a good rain storm they cannot get across the road to get onto Riverside Drive. The fire trucks could not find the road, should they have a fire, to get to their house. 6. There are two cul-de-sacs that come into Tonti Drive - the lower cul-de-sac has a holding lake where the water is draining to same. It is going into the one that was there that his grandfather built and is coming over the highway. In talking to Mr. Warner this morning, he said that he did not know if this could be corrected; it might be too late. Warner responded as follows with these comments: Mr. 1. He had been out to the site this morning, that he had informed Mrs. Painter that he had looked into the situation and had told her that it is not too late to get it corrected. 2. There is still a possibility to get the drainage diverted away from the drain tile which has been there for years, and he will see what he can do to get rid of the water that is draining onto her property. 3. There is a slope of about 200' on the cul-de-sac that comes out towards Tonti Drive and that is the way the natural ground slopes. Mr. Sutphen said that he, Mr. Rozanski, and Mr. Amorose have tentatively planned to visit the site this coming Sunday. Mrs. Painter said that the front yard of the Watson's property was covered with water from this last rain storm. Mr. Rozanski recalled that Mr. Amorose had expressed concern about this very matter when the development of the site was approved by Council, and the developer had assured Council that this problem would not happen. Mr. Rozanski reported that the heavy rain on the past Friday did not cause any problems on Martin Road of which he was aware. Council Roundtable Discussion Mr. Rozanski 1. Asked for a progress report regarding the installation of lights up Monterey Drive to the park in Waterford Village. Mr. Harding reported that C&SOE is looking into the situation and will give a cost estimate and written proposal will be given to Council when it is received. 2. Recalled that Mr. Vincent Rakestraw, attorney, told members of Council that 10 days after approval of Muirfield Phase 29 that the waterline down Avery Road would be under construction. Mr. Warner said that he had seen no plans. Mr. Bowman said that he will look into the situation. Ms. Maurer 1. Had an inquiry from the merchants association at the Dublin Plaza Shopping Center regarding the light at Corbin's Mill and the status of same. Mr. Warner said that presently the Village is waiting for the Law Director's office to obtain the necessary right-of-way. The engineering has been completed. The other inquiry from the association, Ms. Maurer noted, was whether or not there could be an entry only turn in from S.R.161 coming from the west into the shopping center in the middle. Mr. Warner said that that would involve State Highway Funds and that he would not want to get involved with the situation; it being a legal process. Form No. 1097 ~ Held October 6, 1986 ]~ I I I 19 Page Seven With regard to the light it was noted that the developer has to provide the right-of-way (on the west side of Corbin's Mill adjacent to the Bane Ohio). 2. Referred to the information made available from the Ohio EPA and the notice of meeting regarding the Final Draft Ground Water Protection and Management Strategy. 3. Asked whether there was any further information available regarding the status of the West Branch Sewer proejct. Mr. Sheldon said that that information should be available the latter part of October or November. Mr. Amorose 1. The water problem on Riverside Drive - the standing water after a rain. Mr. Sheldon said that he would schedule a meeting on the afore- mentioned topic with officials from the Ohio Department of Transportation. Mr. Sutphen 1. Mentioned also the water problem along Riverside Drive. Mayor Close 1. With regard to tte drainage situation(s) persons should probably keep in perspective the fact that the recent rains were much harder than what we normally get. 2. Commented that whoever did the engineering on the fields at Avery Park did a fine job. 3. Expressed appreciation to Mr. Rozanski, Mr. Smith, and others who were able to get the "Meijer's problem straightened out". 4. The trash situation seems to have been straightened out. 6. Reminded those present of the "Bridge Opening" ceremonies to be held on October 15, 1986 from 5:30 P.M. to approximately 9:00 P.M. Ms. Maurer mentioned that there will be another Goal Setting Meeting with Department Heads at 4:30 P.M. on Tuesday, October 14, 1986.
