HomeMy WebLinkAbout08/03/1992 RECORD OF PROCEEDINGS Minutes of Dublin City Council Meeting Meeting Held_ Anv pct 1992 19 The regularly scheduled meeting of the Dublin City Council was called to order by Mayor Jan Rozanski at 7:30 p. m. on Monday, August 3, 1992 and Mr. Campbell led the Pledge of Allegiance. Members of Council present for roll call were: Mr. Amorose, Mr. Kranstuber, Mr. Campbell, Mayor Rozanski, Mr. Strip, Mr. Sutphen. Mrs. King was absent (excused). Mr. Foegler, Assistant City Manager, and Mr. Stephen Smith, Law Director, were also present. Anuroval of Minutes of ul, 20 1992 Meeting Mr. Strip moved and Mr. Amorose seconded a motion to approve the minutes of the July 20, 1992 meeting. Mr. Campbell noted that on Page 12, following his statement that quick takes are not possible under the Ohio Revised Code for water towers, Mr. Smith had then responded that this is true. Mr. Smith noted that he had also added that the only exception to this would be in an emergency situation, and the courts are very reluctant to allow a quick take even in that circumstance. Vote on the Minutes as modified: Mr. Amorose, yes; Mr. Kranstuber, yes; Mr. Campbell, yes; Mayor Rozanski, yes; Mr. Strip, yes; Mr. Sutphen, yes. Correspondence The Clerk reported that there was no correspondence to Council. Comments from Visitors There were no comments from visitors. Legislation Ordinance 41-92 - An Ordinance Providing for a Change of Zoning of 1.99 Acres, Located on the East Side of Riverside Drive Approximately 400 Feet to the North of Martin Road, to be Rezoned from: R-4, Suburban Residential District, to: SO, Suburban Office and Institutional District. (Public Hearing) Mayor Rozanski requested that proponents and opponents of the rezoning come forward and sign in. Don Griffith, 6465 Martin Place, registered as an opponent of the rezoning. Ms. Clarke noted that the applicant is not in attendance tonight. Mr. Strip proposed that the public be permitted to comment on the rezoning since Mr. Griffith was present to do so tonight, and that the public hearing then be tabled until the next Council meeting. Mayor Rozanski requested that Ms. Clarke give her presentation at the next Council meeting when the public hearing takes place. He invited Mr. Griffith to make his comments at this time. Don Griffith, 6465 Martin Place, stated that he was opposed to the rezoning for all of the reasons as stated by the Planning & Zoning Commission. This rezoning could result in a development over which adjacent property owners would have no control. Mr. Strip moved to table the public hearing on Ordinance 41-92 until the next Council meeting on August 17, 1992. Mr. Amorose seconded the motion. Vote on the Motion - Mr. Campbell, yes; Mayor Rozanski, yes; Mr. Strip, yes; Mr. Sutphen, yes; Mr. Amorose, yes; Mr. Kranstuber, yes. Mr. Ralph Hogle, owner of the subject property, came forward and stated that he is no longer requesting a rezoning. He stated that Mr. Schonhardt, applicant for the rezoning, would not be attending tonight. He added that the rezoning was turned down by the Planning & Zoning Commission and that he no longer has a contract with Mr. Schonhardt to purchase the property at 6332 Riverside Drive. There is therefore no reason to seek a rezoning. Mr. Smith asked if Mr. Hogle is requesting that the application for rezoning be withdrawn. Mr. Hogle confirmed that he is withdrawing his request for a rezoning of the property. He apologized for amving late at the public hearing. Resolution No. 40-92 - A Resolution in Support of a Comprehensive Economic Development Plan for the City of Dublin. (Second Reading) , Mr. Kranstuber commented that the Chamber of Commerce and Dublin Convention and Visitors Bureau will be in attendance at the third reading to express their support of this joint resolution. He asked the clerk to invite Lynn Slomsky, Dan Rubin and Margie Amorose to the third reading scheduled for August 17, 1992. There will be a third reading of the Resolution at the August 17, 1992 Council meeting. Ordinance No. 98-92 - An Ordinance Amending Chapter 181 ("Income Tax") of the Codified Ordinances of the City of Dublin. (Second Reading) Chuck Coleman, Assistant Finance Director, commented that the Finance Department has not received any negative feedback from area accountants on this amendment. There will be a third reading of the Ordinance at the August 17, 1992 Council meeting. Reports from Council Committees Mr. Sutphen, Public Service Committee, stated that he spoke to Mrs. King last evening about setting a date for a meeting sometime late this month. Mr. Foegler asked if the Muirfield maintenance memo would be discussed at the meeting. Mr. Sutphen commented that there are several issues to be discussed. Mr. Foegler stated that staff has prepared a draft memo which clarifies the responsibilities of the City and the Muirfield Association for maintenance regarding public improvements. Staff would like the Service Committee to review this memo and make a recommendation. Mayor Rozanski requested that the memo be distributed to all Council members and Mr. Foegler agreed to do so. Comments from Staff Mr. Kindra, City Engineer, stated that staff is in the process of awarding the Muirfield Drive crosswalk modification job to the low bidder -Columbus Asphalt Paving - with a bid RECORD OF PROCEEDINGS Minutes of Dublin City Council Meeting Page 3 Meeting Held ~4ugust ~l002 19 of $6,200. He commented that Mr. Johnson can report on the status of the school flashing lights for the project. Mr. Johnson. Maintenance, reported that the brown posts were ordered to match the street lights and special orders require 6 to 8 weeks for delivery. The contractor will be Jess Howard & Sons, and the project should be completed before school begins. Mr. Strip emphasized that the residents of the area are relying on the City to complete this project before school starts. Mr. Johnson stated that the project is now in the fifth week and he will advise Council if it cannot be completed prior to the school starting date. Mr. Johnson stated that the mosquito spraying program is now underway and is scheduled for five nights per week. The schedule for spraying will be set up in districts and published in the newspaper. Ms. Jordan. Parks and Recreation, reported that the Dublin Dolphins, the City-sponsored swim team from the Dublin Municipal Pool, recently won the N.E.W. league championship for the second year in a row. The team is comprised of two programs: one for skill development and the other for competitive swimming. The championships were hosted at the Dublin Municipal Pool on Wednesday and Thursday last week, and City staff received many favorable comments about the pool from visiting team members and their families. Chief Ferrell announced that over 200 police chiefs will come to Dublin for their convention this week. The Mayor will attend the opening ceremonies and welcome them to Dublin. The Irish Festival was a big success with over 15,000 attending each day. Three offers have been made to dispatcher candidates; hiring will be completed shortly. Chief Bostic commented that he is pleased with the additional staffing to be provided by the new dispatcher positions. Council Roundtable Mr. Kranstuber stated that he was pleased with the turnout at the Irish Festival over the weekend. He added that the event was well-run and very enjoyable. He asked Chief Bostic to provide clarification about the flow testing data sheet for hydrants in Llewellyn Farms. Chief Bostic stated that the levels reported at this time are good for a residential area, but continued growth, especially commercial, will overburden the system, resulting in unacceptable flow levels. Mr. Kranstuber added his congratulations to the Washington Township trustees on the opening of their new park. He commented that the Dublin Municipal Pool continues to run very smoothly. Mr. Stria asked about the status of the tree giveaway program announced at the time of the Tree City USA program. Ms. Jordan responded that she is attempting to coordinate this program with the schools, specifically the curriculum director, for implementation in the fall. She promised to keep Council apprised of the status. Mr. Strip also noted that the City is in need of a check-up on its signage, especially where there is sign "overkill". Many signs were installed on a temporary basis, and yet have remained when the need no longer exists. Mr. Foegler responded that he and the City Engineer have had discussion in this regard, and some work orders for sign removal have already been issued. RECORD OF PROCEEDINGS Minutes of Dublin City Council Meeting Page 4 Meeting DAYT N LE AL B N Held Ausus~lQQ2 ~ 19 Mr. Strip expressed his hope that removal of unnecessary signage could take place without delay, and hopes that the new City Engineer will make this a priority. Mr. Foegler responded that Mr. Kindra has already recommended that a number of signs ~ be removed from the Muirfield/Brand intersection. He added that Mr. Kindra has a strong background in traffic and transportation planning which will help to distinguish discretionary " from necessary signage. Mr. Kindra added that he will be soliciting feedback following removal of some signs prior to continuing with a program of reducing unnecessary signage. Mr. Amorose commented that he still notes a tremendous number of Code violations relating to business signage, off-site real estate signs, etc. He notes that cars for sale are parked in vacant lots, especially on the weekend, in areas such as Bright Road and Sawmill. Mr. Foegler responded that an offer has been made to a candidate for the Zoning Code enforcement position and staff is hopeful of a confirmation tomorrow. He also reminded all City employees and Council members to alert staff df Code violations that are observed for follow-up by staff. Mr. Amorose also noted that the landscaping along Blazer Parkway is in poor condition. He is hopeful that the landscaping will be replanted in the fall to bring it back to its original condition. Mr. Campbell requested a status report on new signage to be installed at the entrances to the City which Council approved a few months ago. Many visitors have come or will come to Dublin for the special events scheduled for the summer months, i.e., Irish Festival, baseball tournament, U.S. Amateur Open, and he would like to have these signs installed as soon as possible. He also noted that some of the advertising signage for special events in the right-of--way is a Code violation and creates a traffic hazard. He believes that the City needs to devise a better method for groups to publicize their events. He requested a status report on the mound at Browning Court. Mr. Sutphen responded that the mound is being removed. Mr. Sutphen noted that staff does respond promptly to calls on Code violations. He called from a car phone over the weekend to report a violation noted by his daughter. Within a short period, the police responded and asked the vendor to leave the site. He also reported that the television in the Council meeting room was borrowed over the weekend and not hooked up to the cable system upon return. He suggested that staff members who continually borrow this equipment budget for and purchase their own equipment. He asked that anyone who borrows the equipment sign it out with the Clerk of Council and return it to proper working condition upon return. Mayor Rozanski commented that Mr. Foegler distributed a memo last month regarding the use of Council meeting rooms and equipment. Council members are willing to share the meeting space and the equipment, but only if the equipment and room are returned to serviceable condition after their use. Mayor Rozanski noted that the type of landscaping installed along right-of--ways needs to be reviewed. The portion of 161 between Frantz Road and the freeway is an example where the landscaping is lovely, but the maintenance is an ongoing problem. He cited the Blazer Parkway landscaping as another example where the maintenance requirements are excessive, resulting in dead or diseased plants. Mr. Amorose concurred that the planning, design, and maintenance plans should be reviewed for these areas. He received many calls for directions to the park and predicts that it will be highly utilized by area residents. Mr. Foegler reported that the contractor for the 161 project has adjusted the start date for the project from the end of July to the end of August. The completion date remains the same. Mayor Rozanski requested a motion to go into Executive Session to discuss legal matters related to land acquisition. He announced that the meeting will not be reconvened following the Executive Session. Mr. Sutphen moved and Mr. Amorose seconded a motion to go into Executive Session. Vote on the Motion -Mayor Rozanski, yes; Mr. Strip, yes; Mr. Sutphen, yes; Mr. Amorose, yes; Mr. Kranstuber, yes; Mr. Campbell, yes.
