RECORD OF ORDINANCES BARRETT BROTHERS - DAYTON, OHIO Form 6220S | Ordinance No. 39-26 _ Passed AUTHORIZING THE CITY MANAGER TO EXECUTE AND ACCEPT NECESSARY CONVEYANCE DOCUMENTS AND CONTRACTS TO ACQUIRE A 0.511-ACRE WARRANTY DEED, A 0.143-ACRE | PERMANENT/PERPETUAL PUBLIC UTILITY EASEMENT, AND A | 0.014-ACRE TEMPORARY EASEMENT FROM THE PROPERTY LOCATED AT 7730 RIVERSIDE DRIVE, IDENTIFIED AS FRANKLIN COUNTY PARCEL NUMBER 273-008625-00 FROM ANITA C. PLEW AND CHARLES W. HESS, FOR THE PUBLIC PURPOSE OF CONSTRUCTING THE RIVERSIDE DRIVE SHARED USE PATH, WATER MAIN AND SANITARY SEWER EXTENSIONS, AND RELATED STREET MAINTENANCE PROJECT, WHICH SHALL BE OPEN TO THE PUBLIC WITHOUT CHARGE WHEREAS, the City of Dublin (“City”) is preparing to construct the Riverside Drive Shared Use Path, Water Main and Sanitary Sewer Extensions, and Related Street Maintenance Project, 22-013-CIP (“Project”); and WHEREAS, the Project requires that the City obtain the following property rights from the parcel identified as Franklin County Parcel Number 273-008625-00, owned by Anita C. Plew and Charles W. Hess (“Property Owner”), as described in the attached Exhibit A and depicted in the attached Exhibit B: e 6-WD: a 0.511-acre fee simple right-of-way, without limitation to existing access rights. e 6-U: a 0.143-acre permanent/perpetual easement for construction and maintenance of public utilities, storm drainage, and grading. e 6-T: a 0.014-acre temporary easement. WHEREAS, the City and Property Owner participated in good faith discussions and have come to mutually agreeable terms for the acquisition of the necessary property rights for the sum of $89,516.00; and WHEREAS, the City desires to execute and accept necessary conveyance documents and contracts to complete the transaction between the City and Property Owner. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, 7_ of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute and accept all necessary conveyance documents and contracts to acquire the above referenced property interest from the property located at 7730 Riverside Drive, identified as Franklin County Parcel Number 273-008625-00, from Anita C. Plew and Charles W. Hess, for $89,516.00. Section 2. Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to take any other actions as may be appropriate to implement this Ordinance without further legislation being required. Section 3. This Ordinance shall take effect upon passage in accordance with | Section 4.04(b) of the Dublin Revised Charter. Passed this 24" day of August, 2026. Miller, P.E., Senior Civil Engineer Re: Ordinances 37-26 through 42-26 – Acquisition of Right of Way and Easements for the Riverside Drive Shared Use Path, Water Main and Sanitary Sewer Extensions, and Related Street Maintenance Project, 22-013-CIP Background The Riverside Drive Shared Use Path, Water Main and Sanitary Sewer Extensions, and Related Street Maintenance Project (Project) brings together four planned City projects as follows: Riverside Drive East Shared Use Path – Tonti Drive to Wyandotte Woods Boulevard; Water Main Extension – Areas 3A and 3B; Sanitary Sewer Extension – Areas 3A and 3C; and street maintenance within the Drexel Hills and Woodlands subdivisions. A Location Map has been attached to this memo for reference showing the approximate limits of the project. This Project includes the construction of approximately 1,400 feet of shared use path along the east side of Riverside Drive between the existing paths at Tonti Drive and Wyandotte Woods Boulevard. The project will also construct approximately 2,200 feet of 12-inch water main for Utility Extension Area 3A connecting existing dead-end water mains at Hard Road, Tonti Drive, and Wyandotte Woods Boulevard while installing water services and/or water service sleeves for Water Utility Extension Areas 3A and 3B. The proposed water main is planned to be constructed under the proposed shared use path due to limited available right-of-way, and as a result the shared use path and water main improvements have been combined into a single construction plan set. Approximately 7,500 feet of 8-inch and 10-inch sanitary sewer will be extended in Sanitary Sewer Utility Extension Areas 3A and 3C. Finally, this project will perform necessary street maintenance work on all streets within the Woodlands and Drexel Hills subdivisions. In the 2026-2030 Capital Improvements Program (CIP), funding has been provided for acquisitions in 2026. The timing of construction will be dependent upon when funding is provided in the adopted 2027-2031 Capital Improvements Program later this year. Summary The City engaged ms consultants, Inc. (ms) as the acquisition agent for the Project. In that role, ms consultants has been the point of contact with the property owners of the Project, with active City staff support. Presently, the City has reached agreement with six (6) of the nine (9) affected property owners. The City has participated in good faith discussions with all nine property owners and hopes to arrive at mutually agreeable terms with all property owners by the end of 2026. Recommendation Staff recommends adoption of these ordinances at the second reading/public hearing on August 24, 2026, as this will allow the Project to remain on schedule and proceed to construction once funding for construction is programmed in the 2027-2031 Capital Improvements Program.
