Form 6220S Ordinance No. 36-26 _ Passed , AUTHORIZING THE CITY MANAGER TO EXECUTE AND ACCEPT NECESSARY CONVEYANCE DOCUMENTS AND CONTRACTS TO ACQUIRE A 0.068-ACRE EASEMENT FROM THE PROPERTY LOCATED AT 4497 HARD ROAD, IDENTIFIED AS FRANKLIN COUNTY PARCEL NUMBER 273-009871-00 FROM WASHINGTON TOWNSHIP, FOR THE PUBLIC PURPOSE OF CARRYING OUT THE ANNUAL STORMWATER MANAGEMENT BASIN MAINTENANCE PROGRAM 2026 PROJECT (25-024-CIP) WHEREAS, the City of Dublin (“City”) is preparing to construct the Annual Stormwater Management Basin Maintenance Program 2026 Project, 25-024-CIP (“Project); and WHEREAS, the Project requires that the City obtain the following property rights from the parcel identified as Franklin County Parcel Number 273-009871-00, owned | by Washington Township (“Property Owner”), as described in the attached Exhibit A and depicted in the attached Exhibit B: | e A 0.068-acre permanent/perpetual access easement for the construction, operation, and maintenance of a public stormwater management basin. | WHEREAS, the City and Property Owner participated in good faith discussions and the Property Owner has agreed to donate their individual property interests; and | WHEREAS, the City desires to execute and accept necessary conveyance documents and contracts to complete the transaction between the City and Property Owner. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of Ohio, / of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute and accept all necessary conveyance documents and contracts to acquire the above referenced property interest from the property located at 4497 Hard Road, identified as Franklin County Parcel Number 273-009871-00, which are being donated to the City by the Property Owner. Section 2. Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to take any other actions as may be appropriate to implement this Ordinance without further legislation being required. Section 3. — This Ordinance shall take effect upon passage in accordance with Section 4.04(b) of the Dublin Revised Charter. Passed this 24" day of ‘y 2026. Hendershot, P.E., Director of Utilities and Stormwater Management Re: Ordinance 36-26 – Acquisition of an Easement for the Annual Stormwater Management Basin Maintenance Program 2026 Project, 25-024-CIP Background The Annual Stormwater Management Basin Maintenance Program (Program), as defined in the 2026-2030 Capital Improvements Program (CIP), provides for the maintenance of City of Dublin (City)-owned and maintained stormwater management basins, as identified in the Stormwater Master Plan. Maintenance activities include basin dredging and other necessary repairs to ensure continued functionality of the stormwater management system. Project locations are determined based on stormwater management basin inspections. These improvements preserve basin storage capacity, maintain effective stormwater runoff control, and reduce the risk of localized flooding. The Program also supports the City’s compliance with National Pollutant Discharge Elimination System (NPDES) Phase II requirements by ensuring the stormwater management system remains in proper working condition and continues to support overall water quality objectives. Summary The Annual Stormwater Management Basin Maintenance Program 2026 Project (Project) was identified as part of the Program and includes improvements to two (2) dry detention basins at the following locations and as shown on the two Location Maps attached to this memo for reference: • City reserve area in the Riverside Woods neighborhood • 4410 May Apple Court within the City drainage easement in the Woodlands neighborhood The Project includes regrading, installation of storm sewer, placement of rock with underdrain, installation of an outlet control structure, and construction of a berm and emergency spillway to improve basin functionality and performance. The Project is currently planned to be advertised for bids in August 2026, with construction planned to commence in Fall 2026 and be completed by Spring 2027. To facilitate construction and support the long-term maintenance of the Riverside Woods basin, the Project requires acquisition of a permanent/perpetual access easement from Washington Township, property owner of 4497 Hard Road. The City has participated in good faith discussions with Washington Township regarding this easement. At the April 14, 2026 Washington Township Board of Trustees meeting, the Board of Trustees approved a motion authorizing Township Administrator Eric Richter to execute all necessary documents to donate the City requested easement at 4497 Hard Road to the City. The City would like to thank the Washington Township Board of Trustees for their kind gesture and donation, which helps to allow for the execution of the Project. This Ordinance authorizes the City Manager to execute and accept on behalf of the City all necessary conveyance documents to formally acquire the necessary property interests from the property owner. Recommendation Staff recommends adoption of this Ordinance at the second reading/public hearing on August 24, 2026, as this will allow the Project to remain on schedule and proceed to construction.
