AUTHORIZING THE SUBMISSION OF A PETITION FOR THE
REGULAR ANNEXATION OF 201.7 ACRES, MORE OR LESS, OF
PROPERTY FROM DARBY TOWNSHIP, MADISON COUNTY TO
THE CITY OF DUBLIN, OHIO
WHEREAS, the City of Dublin desires to annex from Darby Township 201.7 acres, more
or less, of property located north of Rings Road and east of Iams Road, as legally
described in the attached Exhibit A and depicted in the annexation plat attached hereto
as Exhibit B; and
WHEREAS, pursuant to Ohio Revised Code Section 709.02, the City of Dublin, as the
majority of the owners of real estate contiguous to land already within the City of Dublin,
may petition the Board of County Commissioners of Madison County, State of Ohio, for
a regular annexation; and
WHEREAS, upon receipt of an annexation petition from the City of Dublin for the
annexation of the property, the Board of County Commissioners of Madison County,
State of Ohio, shall schedule a hearing for the annexation petition.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, __‘T_ of the elected members concurring, that:
Section 1. The City of Dublin hereby authorizes a petition for annexation of 201.7
acres, more or less, of property located north of Rings Road and east of Iams Road, as
legally described in the attached Exhibit A and depicted in the annexation plat attached
hereto as Exhibit B.
Section 2. The City Law Director is hereby appointed the Agent of the Petitioner and
the Law Director and City Clerk are hereby authorized to file a regular annexation
petition for this property with the Board of County Commissioners of Madison County,
State of Ohio, to submit all required paperwork and evidence, and to appear before the
Commission on behalf of the City of Dublin for all necessary hearings.
Section 3. This Ordinance shall take effect and be in force from and after the earliest
date allowed by law.

Background
The City of Dublin has acquired approximately 348.6 acres of land which can be leveraged for a
number of strategic opportunities related to economic development and transportation
enhancements. This land is split between Franklin and Madison Counties and currently falls
outside the corporate boundaries of the City of Dublin.
At the April 27, 2026, City Council Meeting, Council adopted Ordinance 25-26, which authorizes
the City to move forward with annexing 146.9 acres of the land located in Franklin County through
the municipal annexation process. This annexation provides the necessary contiguity to pursue
annexation of the balance of the acquired land.
The City intends to pursue the annexation of an additional 201.7 acres of the land located in
Madison County through a regular annexation. This memorandum addresses the regular
annexation process.
Municipal Annexation
Ohio R.C. Section 709.02 governs the regular annexation process. It requires a majority of the
owners of real estate within the proposed area to be annexed to sign and file the petition. The
City of Dublin is the sole landowner of 201.7 acres to be annexed and is thus able to file the
petition.
The regular annexation process requires a hearing before the Madison County Board of County
Commissioners. At that hearing, the City will be represented and present evidence in favor of the
annexation. The County Commissioners are required to review objective, statutory criteria when
deciding whether to grant the annexation.
The regular annexation process contrasts with the municipal property annexation process
prescribed in R.C. 709.16. Under that statute, the City is permitted to annex municipally owned
land that is contiguous to the municipality’s boundaries, and the Board of County Commissioners
is obligated to accept the petition for annexation. The municipal property annexation process
does not allow for boundaries of the underlying township to be adjusted. This process was
nevertheless appropriate for the land within Franklin County because that land is already in

Washington Township.
The regular annexation process is necessary in Madison County because it is the only available
process that will allow the City to conform township boundaries after the annexation so that the
newly annexed territory will become part of Washington Township. This is consistent with the
City’s longstanding policy and desire to maintain uniform fire and EMS service from Washington
Township throughout the City.
Recommendation
Staff recommends approval of Ordinance 27-26 at the May 26, 2026, City Council Meeting.
