HomeMy WebLinkAboutResolution 20-26RECORD OF RESOLUTIONS BARRETT BROTHERS - DAYTON, OHIO Form 6301 Resolution No. 20-26 Passed. ; AUTHORIZING THE CITY MANAGER TO ENTER INTO A LETTER OF AGREEMENT WITH THE OHIO POWER COMPANY TO RELOCATE FACILITIES FOR THE CONSTRUCTION OF THE AVERY ROAD SHARED USE PATH PROJECT, 24-018-CIP WHEREAS, the City of Dublin (“City”) and Ohio Power Company (“AEP”) have coordinated the relocation of certain electric facilities to allow the construction of the Avery Road Shared Use Path Project, 24-018-CIP (“Project”); and WHEREAS, the total construction cost associated with the AEP relocation, as currently estimated, is $20,983.13, for which the City will reimburse AEP; WHEREAS, the City hereby agrees to continue coordination of the Project with AEP during construction. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of Ohio, “1_ of the elected members concurring that: Section 1. The City Manager is hereby authorized to execute and accept all necessary documents to enter into a Letter of Agreement with the Ohio Power Company to reimburse the estimated cost of their portion of the Project in the amount of $20,983.13. Section 2. This Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to prepare and sign all other agreements and instruments and to take any other actions as may be necessary to implement this Resolution and complete the work for this Project. Section 3. This Resolution shall take effect upon passage in accordance with Section 4.04(a) of the Dublin Revised Charter. Passed this 27" day of April, 2026. Groves, P.E., Civil Engineer II Re: Resolution 20-26 – Authorizing the City Manager to Enter into a Letter of Agreement with the Ohio Power Company to Relocate Facilities for the Construction of the Avery Road Shared Use Path Project, 24-018-CIP Background The Avery Road Shared Use Path Project (Project) provides for approximately 1,300 feet of shared use path along the west side of Avery Road from Cramers Crossing Drive extending north to the existing path at 5745 Avery Road, approximately 460 feet south of Woerner Temple Road. The Project also includes associated drainage, lighting, and American with Disabilities Act (ADA) improvements for public safety and visibility. This Project, as defined and funded in the 2026-2030 Capital Improvements Program (CIP), is part of the Mobility Infrastructure Improvements Program which provides for the planning and implementation of mobility connections throughout the City. These improvements are reviewed, scored, and prioritized by an internal staff-led committee. This Project provides a vital safety connection to the shared use path network along Avery Road and fills in one of the last gaps of the shared use path network along this portion of Avery Road. Design was completed for this Project in 2025 and construction of this Project is programmed in 2026. Summary Staff has worked closely with the Ohio Power Company (AEP) on a Letter of Agreement (Agreement), as attached for Council’s reference and information, to relocate AEP facilities along Avery Road in order to construct the Project. The shared use path alignment necessitates the relocation of one aerial utility pole, guy wires, and associated infrastructure that is in conflict with the Project. The AEP Ohio electric facilities are currently located in an existing private easement, wholly owned by AEP outside of the public right-of-way. Relocation of the planned path alignment is not feasible due to the presence of another AEP pole, existing drainage structures in close proximity, and the offset from the roadway. An exhibit showing the location of the conflicting pole in relation to the planned improvements is attached to this memo for reference. The City of Dublin is responsible to reimburse AEP for relocating their facilities on this project due to existing private easement. The estimated cost to the City to perform this work is $20,983.13. AEP requires advance deposit of these funds prior to scheduling and performing their work. Due to this, staff desires to execute this agreement prior to the Project advertisement to avoid potential schedule impacts for construction in 2026. Once the relocation is complete, AEP will verify and review the actual construction cost with the City. The proposed Agreement has been reviewed and approved by the City’s Legal staff and has already been executed by AEP. Recommendation Staff recommends approval of Resolution 20-26, authorizing the City Manager to enter into a Letter of Agreement with the Ohio Power Company to advance and complete the necessary utility relocation for the Project, as this resolution will allow the Project to remain on schedule and proceed to construction.
