AUTHORIZING THE CITY MANAGER TO EXECUTE AND ACCEPT
NECESSARY CONVEYANCE DOCUMENTS AND CONTRACTS TO
ACQUIRE A 0.042-ACRE WARRANTY DEED FROM THE
PROPERTY LOCATED AT 5611 AVERY ROAD, IDENTIFIED AS
FRANKLIN COUNTY PARCEL NUMBER 274-000098 FROM
GURPAL KAUR, FOR THE PUBLIC PURPOSE OF CONSTRUCTING
A SHARED USE PATH, DRAINAGE AND ROADWAY
IMPROVEMENTS, WHICH SHALL BE OPEN TO THE PUBLIC
WITHOUT CHARGE
WHEREAS, the City of Dublin (“City”) is preparing to construct the Avery Road
Shared Use Path Project, 24-018-CIP (“Project); and
WHEREAS, the Project requires that the City obtain the following property rights
from the parcel identified as Franklin County Parcel Number 274-000098, owned by
| Gurpal Kaur (“Property Owner”), as described in the attached Exhibit A and depicted
| in the attached Exhibit B:
e 1-WD: a 0.042-acre fee simple right-of-way, without limitation to existing
access rights.
WHEREAS, the City and Property Owner participated in good faith discussions and
have come to mutually agreeable terms for the acquisition of the necessary property
rights for the sum of $7,243.00; and
WHEREAS, the City desires to execute and accept necessary conveyance documents
and contracts to complete the transaction between the City and Property Owner.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State
of Ohio, lo of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute and accept all
necessary conveyance documents and contracts to acquire the above referenced
property interest from the property located at 5611 Avery Road, identified as Franklin
County Parcel Number 274-000098, from Gurpal Kaur to the City, for $7,243.00.
Section 2. Council further hereby authorizes and directs the City Manager, the
Director of Law, the Director of Finance, the Clerk of Council, or other appropriate
officers of the City to take any other actions as may be appropriate to implement this
Ordinance without further legislation being required.
Section 3. This Ordinance shall take effect upon passage in accordance with
Section 4.04(b) of the Dublin Revised Charter.

Re: Ordinances 16-26 through 18-26 – Acquisition of Right of Way for the Avery
Road Shared Use Path Project, 24-018-CIP
Background
The Avery Road Shared Use Path Project (Project) provides for approximately 1,530 feet of shared
use path along the west side of Avery Road from Cramer’s Crossing Drive to the existing path at
5745 Avery Road, approximately 460 feet south of Woerner Temple Road. The Project also
includes associated Americans with Disabilities Act (ADA) accommodations, drainage, and lighting
improvements for public safety and visibility. A Location Map showing the parcels subject to these
acquisitions for this Project is attached to this memo for reference.
This Project, as defined in the 2026-2030 Capital Improvements Program (CIP), is part of the
Mobility Infrastructure Improvements Program. The Mobility Infrastructure Improvements Program
plans and implements mobility connections throughout the City. These improvements are
reviewed, scored, and prioritized by a staff-led committee. This Project provides a vital safety
connection to the shared use path network along Avery Road and fills one of the remaining gaps in
this portion of Avery Road.
Design was substantially complete for this Project in 2025 and was coordinated with the impacted
residents and businesses. The City’s selected path alignment necessitates right-of-way acquisition
from three (3) parcels located along the west side of Avery Road, with the addresses of 5611
Avery Road (Parcel 1), 5689 Avery Road (Parcel 2), and 5695 Avery Road (Parcel 3). Construction
of this Project is anticipated to commence in 2026.
Summary
The City engaged O.R. Colan Associates (ORC) as the acquisition agent for the Project. In that
role, ORC has been the point of contact with the property owners on the Project, with active City
staff support. The City has participated in good faith discussions with the property owners and has
successfully reached an agreement with all three (3) of the affected parcels on this Project.
Acquisitions
A Good Faith Offer Letter, the appraisal report and associated information were provided to all
property owners in November 2025. The property acquisitions are from properties located within
the Project area and consist of the following property interests from each of the named property
owners, as depicted in the exhibits attached:

Gurpal Kaur (Warranty Deed): The good faith discussions with the property owner have
resulted in mutually agreeable terms for the acquisition of their individual property interests at the
appraised value of $7,243.00.
Scioto Properties SP-17 LLC (Warranty Deed): The good faith discussions with the property
owner have resulted in mutually agreeable terms for the acquisition of their individual property
interests at the appraised value of $53,048.00. The appraised value for this parcel includes the
cost of the property’s sign in conflict with the Project work.
Ohio Venture Properties LLC (Warranty Deed): Good-faith discussions with the property
owner have resulted in mutually agreeable terms for the acquisition of their individual property
interests at an appraised value of $26,157.00.
Ordinances 16-26 through 18-26 authorize the City Manager to execute and accept on behalf of the
City all necessary conveyance documents to formally acquire the necessary property interests from
each property owner.
Recommendation
Staff recommends adoption of Ordinances 16-26 through 18-26 at the second reading/public
hearing on March 23, 2026, as these ordinances will allow the Project to remain on schedule and
proceed to construction.
