AMENDING CHAPTER 35 OF THE CODIFIED ORDINANCES
AND OTHER APPLICABLE SECTIONS TO REVISE THE
SCHEDULE OF FEES AND SERVICE CHARGES FOR CITY OF
DUBLIN SERVICES
WHEREAS, the City of Dublin, Ohio has conducted an analysis of its services, the full
costs of providing those services, the beneficiaries of those services, and the revenues
produced by those paying fees and charges for the services; and
WHEREAS, based on this analysis, cost analysis worksheets have been prepared; and
WHEREAS, the specific fees to be charged for City-provided services must be adopted
by the City Council.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, [__ of the elected members concurring:
Section 1. Chapter 35 of the Codified Ordinance of Dublin, Ohio is hereby amended
to read as follows:
Chapter 35
FEE AND SERVICE CHARGE REVENUE/COST COMPARISON
SYSTEM AND FEES
Section 35.80 “Full Costs” Defined
For the purpose of this subchapter, the following definition shall apply unless the context
clearly indicates or requires a different meaning. “Full Costs” includes the following
elements:
(1) All applicable direct costs including, but not limited to salaries, wages, overtime,
employee fringe benefits, services and supplies, maintenance and operating expenses,
contracted services, special supplies, and any other direct expense incurred.
(2) All applicable indirect costs including, but not restricted to, building maintenance and
operations, equipment maintenance and operations, communications expenses,
computer costs, printing and reproduction, vehicle expenses, insurance, debt service,
and like expenses when distributed on an accounted and documented rational pro-ration
system.
(3) Fixed asset recovery expenses, consisting of depreciation of fixed assets, divided by
the approximate life expectancy of the fixed asset.
(4) General overhead, expressed as a percentage, distributing and charging the
expenses of the City Council, including the Clerk of Council, Department of Law, City
Manager, Accounting and Auditing, Taxation, Procurement, Information Technology,
Economic Development, Human Resources and City promotional programs, and all other
staff and support service provided to the entire City organization. Overhead shall be
prorated between tax-financed services and fee-financed services on the basis of said
percentage so that each tax-financed service and fee-financed service shall
proportionately defray such overhead costs.
(5) Departmental overhead, expressed as a percentage, distributing and charging the
cost of each department head and his or her supporting expenses as identified in
subsections 1, 2, 3, and 6 of this Section.
(6) Debt service costs, including the payment of interest, and trustee fees and
administrative expenses of all applicable bond, certificate, or securities issues or loans
of whatever nature or kind.

(7) The “full costs,” in most instances, will be rounded to the nearest five or ten dollars, with the actual fee established by the ordinance establishing a schedule of fees and
charges for City services.
Section 35.81 Findings and Intent
(a) It is the intent of the City Council to ascertain and recover the specified percentages
of full costs from fees, charges, and regulatory license fees levied in providing the
regulation, products, or services set forth in this Chapter.
(b) The fee and service charge revenue/cost comparison system set forth in this Chapter
provides a mechanism for ensuring that fees adopted by the City for services rendered
do not exceed the reasonable estimated cost for providing the services, unless otherwise
noted.
(c) It is the intent of the City Council to achieve a more equitable and fair mix for financing services set forth in this Chapter in order to reduce or eliminate subsidizing these services with general tax revenue; thereby, allowing those general tax revenues
to be used for general services, including infrastructure maintenance and replacement.
Section 35.82 Delegation of Authority and Direction to the City Manager
(a) The City Manager is hereby delegated the authority and directed to provide documents to the City Council to implement its policy to adjust fees and charges to
recover the percentage of full costs as established in this Chapter.
| (b) “Full costs” shall be as defined in Section 35.80. In adjusting fees and charges, the City Manager shall act in an administrative and ministerial capacity and shall consider
only the standards and criteria established by this Chapter and the applicable State laws.
Section 35.83 Schedule of Fees and Service Charges
(a) The City Manager, Director of Finance, and each City department head, under the direction of the City Manager, shall review annually the fees and service charges listed in Appendix A - Schedule of Fees and Service Charges, and provide an adjusted fee or charge schedule to the City Council for its consideration so as to recover the listed percentage of full costs necessary to provide the listed regulation, product or service as
modified by the notes following the list of services. These fees, unless otherwise specified, are for City of Dublin services and are in addition to any charges made by any other governmental agencies.
(b) The services as listed in this Section shall be as defined in the document entitled “Cost Study for the City of Dublin, Ohio” as produced by the City of Dublin.
(c) All fees and charges set pursuant to this Chapter and Section shall take effect as specified in this Ordinance.
(d) The City Manager may vary the review schedule listed in the Section if, in the judgment of the City Manager and a directly affected and requesting department head, a gross inequity would be perpetrated by not revising a fee or charge prior to the next rate review. Any such special rate review shall be reported to the City Council at its next succeeding meeting where the City Council may revise the fee or charge by Ordinance.
(e) If fees are not collected at the time that the service is provided, the City has the right to pursue collection of any of the fees listed in this Ordinance, including certification to the County Auditor, remittance to a collection service, or any other appropriate pursuit for payment. When additional fees need to be levied and collected for City-provided | services in the amount of $10 or less, or when a refund is due in the amount of $10 or less, a refund or additional charge need not be made.

(f) Should it become necessary to establish a new service fee or charge during the year,
the City Manager may set the fee administratively. Any such fees set by the City Manager
shall be reported to the City Council at its next succeeding meeting where the City
Council may revise the fee or charge by Ordinance. The new service will then be included
and analyzed in the next rate review.
Section 35.84 Fee Appeals and Waivers
Irrespective of the percentage of recovery and the “notes” in Section 35.83 - Appendix
A, the City Council reserves the right to waive any fee in order to encourage development
projects that enhance the City’s tax base as outlined in the City’s Economic Development
Strategy. The City Manager may recommend further waivers or fee adjustments, based
on hardship, to be accepted or rejected by City Council at its next regularly scheduled
meeting.
Section 2. Section 94.21 of the Codified Ordinance of Dublin, Ohio is hereby
amended to read as follows:
Section 94.21 License Required
(A) No person shall engage in retail sales of tobacco products or alternative nicotine
devices within the city without a valid license issued by the city, or on the city's behalf,
to sell tobacco products or alternative nicotine devices.
(B) No licensee shall engage in retail sales of tobacco products or alternative nicotine
devices in violation of § 135.17 of the Codified Ordinances, or any substantially
equivalent provision of applicable law.
(C) The following items shall be required in applying for a license, or renewing a
license, under this section:
(1) A valid vendor's license from the Ohio Department of Taxation;
(2) If the applicant engages in retail sale of cigarettes, a valid Retail Cigarette
Dealer's License as required by R.C. Chapter 5743;
| (3) The location where the applicant proposes to engage in retail sales of tobacco
products or alternative nicotine devices;
(4) A nonrefundable license administration fee in the amount provided in the fee
schedule created under Chapter 35 of the Codified Ordinances;
(5) Such other information as determined, by the City Manager or the city's
licensing agent, to be necessary to administer the licensing system provided herein and
effectuate the purposes of §§ 94.20 through 94.24, and § 135.17 of the Codified
Ordinances.
(D) A license granted under this section shall be valid from June 1 of the year of
application to May 31 of the following year. A license issued to a new licensee after
January 1 shall be valid until May 31 of the following year.
(E) License administration fees, reinstatement fees, and civil penalties collected in
administering §§ 94.20 through 94.23 may be collected by the city or the city's licensing
agent, and shall be credited to the city's General Fund to defray the costs of
administration and enforcement of these sections; alternatively, the city and its licensing
agent may agree that the licensing agent will retain all or a portion of the fees as
compensation for its services as licensing agent.
(F) For purposes of this section, VALID LICENSE means a license issued under this
section that has not expired, that is not within a period of suspension or failure-to-
reinstate status, and that has not been revoked.
| Section 3. Section 94.22 of the Codified Ordinance of Dublin, Ohio is hereby
amended to read as follows:
Section 94.22 License Revocation, Denial, or Suspension
(A) Application for a license required under § 94.21 may be denied for any of the
following reasons:
(1) The applicant has had a license under § 94.21 revoked within the previous
three years;

(2) The applicant is determined to have knowingly included false or misleading
information in the license application or renewal application;
(3) The applicant's current license under § 94.21 has been suspended, and the
period of suspension has not elapsed;
(4) A property owned or operated by the applicant engaging in the retail sale of
cigarettes, tobacco products, or alternative nicotine products within the City of Dublin is
the subject of a court order declaring such property to be a public nuisance, where said
nuisance has not been abated as determined by the court, or where the court has
ordered that retail sales of tobacco products or alternative nicotine products shall cease
pursuant to any temporary restraining order, preliminary injunction, or permanent
injunction issued by the court;
(5) The applicant is in arrears with respect to any fine imposed for violation of
§ 135.17 of the Codified Ordinances, or any substantially equivalent offense, or for any
civil penalty levied under § 94.23; or
(6) The applicant has failed to provide any of the items required under § 94.21(C).
(B) For purposes of division (A) of this section, "applicant" shall include entities with
common ownership or management to the entity or natural person listed on the
application.
(C) A license may be suspended for a definite period, not to exceed six months, as
determined by the city or its licensing agent. Prior to reinstatement of the license
following expiration of the suspension, the licensee shall remit reinstatement fee in the
amount provided in the fee schedule created under Chapter 35 of the Codified
Ordinances. A license may be suspended for any of the following reasons:
(1) Two violations of § 135.17 of the Codified Ordinances, or any substantially
equivalent offense, by the licensee or agent of the licensee within the previous 12-month
period;
(2) Failure to appear at any court proceeding where the licensee or any agent of
the licensee has been charged with a violation of § 135.17 of the Codified Ordinances,
or any substantially equivalent offense. If the licensee's agent is the person charged, the
appearance of the agent shall be sufficient;
(3) A property owned or operated by the applicant engaging in the retail sale of
tobacco products or alternative nicotine products within the city is the subject of a court
order declaring such property to be a public nuisance, where said nuisance has not been
abated as determined by the court, or where the court has ordered that retail sales of
tobacco products or alternative nicotine products shall cease pursuant to any temporary
restraining order or preliminary injunction issued by the court;
(4) The finding by a federal or state agency or court that the licensee has violated
a federal or state rule or regulation governing the retail sale of tobacco products or
alternative nicotine products; or
(5) The licensee is in arrears with respect to any fine imposed for violation of
| § 135.17 of the Codified Ordinances, or any substantially equivalent offense, or for any | civil penalty levied under § 94.23.
(D) A license may be revoked for any of the following reasons:
(1) The licensee is determined to have knowingly included false or misleading
information in the license application or renewal application;
(2) Three or more violations of § 135.17 of the Codified Ordinances, or any
substantially equivalent offense, by the licensee or agent of the licensee within the
previous 12-month period;
(3) A period of suspension imposed under division (C)(5) of this section has
elapsed, and the licensee remains in arrears of payment of such fine or penalty; or
(4) The licensee has been subject to three or more suspensions in the previous
24-month period.
(E) For purposes of divisions (C) and (D), "licensee" shall include entities with
common ownership or management to the entity or natural person listed as the license
holder.

Section 4. SEVERABILITY
If any portion of this Chapter is found to be unconstitutional or invalid, the City Council
hereby declares that it would have enacted the remainder of this Chapter regardless of
the absence of any such invalid part.
Section 5. REPEALER
All Ordinances, the Codified Ordinances of Dublin, Resolutions, City Council Motions, and
all actions of all City Boards and Commissions in conflict here within are hereby repealed.
The fees and charges established by this Chapter shall supersede all previously
established fees or charges for the same regulation, product or service, and all such
previous fees and charges are hereby repealed on the effective date of the Order of the
City Manager.
Section 6. EFFECTIVE DATE
This ordinance shall be in effect on January 1, 2026.

Background
The proposed Ordinance revises the Schedule of Fees and Service Charges for the City of Dublin.
This Ordinance, with its proposed fee schedule, is the annual update to Chapter 35 of the City’s
Codified Ordinances, which revises the current “City’s Schedule of Fees and Service Charges for City
of Dublin Services.” Proposed changes for 2026 are shown in Appendix A.
The goal of the annual review of service fees is to provide information regarding the actual cost to
provide the City’s services. With that information, City Council may choose to increase, reduce or
modify the proposed fees in consideration of the established target cost recoveries. Beginning with
the 2014 fee schedule, a plan was established and approved to forgo the comprehensive annual
Cost of Services Study review every other year and instead apply an inflationary measure. To
determine fees for 2025, a comprehensive Cost of Services Study review was conducted. For the
2025 Cost Study, the US Midwest CPI-U of 2.6% (November 2024) was applied to the per-unit cost
to determine fees for 2026, consistent with the methodology applied in past years.
Below are several key fee updates. For a comprehensive list of all proposed changes, please refer
to Appendix A of the Ordinance. This year, the City is introducing a new ClearDoc document powered
by ClearGov, which presents all fees and services in a user-friendly, accessible format. This tool
allows residents and other users to easily search for fees by department and access translations in
over 100 languages, enhancing transparency, accessibility, and collaboration around the fee
structures and related ordinance details.
Court Services
Staff recommends two fee adjustments within Court Services:

Currently, CT-06 – PNC/Non-Reporting Probation and CT-08 – Reporting Probation are set at $0.
The proposed adjustments would increase these fees to $50 and $150, respectively. These
recommendations are informed by cost recovery. Dublin residents typically do not pay these fees,
as this is not a service provided to them, but rather a fine for law violations. The increased revenue
will help offset direct expenditures and reduce the general fund subsidy.
Additionally, staff recommends passing credit card processing fees for all Court Services transactions
on to the payee. This is a common practice among jurisdictions in Central Ohio. In 2024, Court
Services incurred over $12,600 in credit card fees, and over $8,800 in 2023. These changes support
Court Services’ goal of achieving full cost recovery by more accurately reflecting administrative and
labor-related expenses.
Community Events
Staff is proposing a shift in the DORA program from branded cups to stickers as an operational
efficiency measure. The change addresses retailer feedback, reduces storage needs, and allows for
more flexibility in cup types, including options for wine and hot beverages. The use of QR codes on
stickers would also enable real-time updates to DORA rules. This shift aligns with practices in
neighboring communities and could improve retailer compliance, which has been inconsistent based
on recent order trends.
The current rental fees for shelters and pavilions (CE-10 and CE-12) have remained unchanged since
2019. Staff is proposing a modest increase to better align with current operational costs and market
standards. Additionally, staff proposes a higher adjustment for pavilion rentals to reflect the
enhanced amenities they offer. While basic shelters typically include picnic tables, pavilions provide
more features, such as kitchens, fireplaces, and attached restrooms. To ensure pricing accurately
reflects the cost to maintain the facilities and amenities of each option, a greater differential is
proposed between shelter and pavilion rental rates.
Parks and Recreation
Lap Pool Rental Rates
According to Fee Ordinance 41-24, Schedule of Fees and Service Charges, RC-22 Community
Recreation Center (DCRC) Rental Rates, Section 1: Lap Pool, the current rental rate for authorized
use by Dublin residents is $9 per lane per hour. This rate has been in place since 2019. Staff
recommends an increase to $20 per lane hour. The 2024 Cost of Services Study determined that a
rate of $56 per lane hour is necessary to fully recover operational costs. The 2026 Cost of Services
Study will conduct a further comprehensive analysis of these fees, and at that time, staff will be able
to better recommend a pricing structure for future years. This proposed adjustment supports the
goals outlined in the most recent Parks & Recreation Master Plan, which emphasizes cost recovery
and planning for future population growth. This adjustment also aligns with the rate adopted by
Ordinance 12-25 for Authorized Dublin City School District Functions Effective October 1, 2025.

Building Standards
To align with Council’s cost recovery objectives, an inflationary adjustment of 2.6% will be applied
to applicable fees. A separate Cost of Development memo includes a benchmarking analysis that
compares the City of Dublin’s Building Standards, Community Planning & Development and
Engineering fees with those of neighboring municipalities. Fees will be further assessed during next
year’s comprehensive cost study to ensure fees are meeting cost recovery goals.
Recommendation
Staff recommends approval of the Ordinance at the second reading/public hearing on
October 20. Fees would become effective on January 1, 2026.

Section 1. Chapter 35 of the Codified Ordinance of Dublin, Ohio is
hereby amended to read as follows:
Chapter 35
FEE AND SERVICE CHARGE REVENUE/COST COMPARISON SYSTEM
AND FEES
Section 35.80 “Full Costs” Defined
For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a
different meaning. “Full Costs” includes the following elements:
(1) All applicable direct costs including, but not limited to salaries, wages, overtime, employee fringe benefits, services
and supplies, maintenance and operating expenses, contracted services, special supplies, and any other direct
expense incurred.
(2) All applicable indirect costs including, but not restricted to, building maintenance and operations, equipment
maintenance and operations, communications expenses, computer costs, printing and reproduction, vehicle expenses,
insurance, debt service, and like expenses when distributed on an accounted and documented rational pro-ration
system.
(3) Fixed asset recovery expenses, consisting of depreciation of fixed assets, divided by the approximate life
expectancy of the fixed asset.
(4) General overhead, expressed as a percentage, distributing and charging the expenses of the City Council, including
the Clerk of Council, Department of Law, City Manager, Accounting and Auditing, Taxation, Procurement, Information
Technology, Economic Development, Human Resources and City promotional programs, and all other staff and support
service provided to the entire City organization. Overhead shall be prorated between tax-financed services and fee-
financed services on the basis of said percentage so that each tax-financed service and fee-financed service shall
proportionately defray such overhead costs.
(5) Departmental overhead, expressed as a percentage, distributing and charging the cost of each department head
and his or her supporting expenses as identified in subsections 1, 2, 3, and 6 of this Section.
(6) Debt service costs, including the payment of interest, and trustee fees and administrative expenses of all
applicable bond, certificate, or securities issues or loans of whatever nature or kind.
(7) The “full costs,” in most instances, will be rounded to the nearest five or ten dollars, with the actual fee
established by the ordinance establishing a schedule of fees and charges for City services.
Section 35.81 Findings and Intent
(a) It is the intent of the City Council to ascertain and recover the specified percentages of full costs from fees,
charges, and regulatory license fees levied in providing the regulation, products, or services set forth in this Chapter.

(b) The fee and service charge revenue/cost comparison system set forth in this Chapter provides a mechanism for
ensuring that fees adopted by the City for services rendered do not exceed the reasonable estimated cost for
providing the services, unless otherwise noted.
(c) It is the intent of the City Council to achieve a more equitable and fair mix for financing services set forth in this
Chapter in order to reduce or eliminate subsidizing these services with general tax revenue; thereby, allowing those
general tax revenues to be used for general services, including infrastructure maintenance and replacement.
Section 35.82 Delegation of Authority and Direction to the City Manager
(a) The City Manager is hereby delegated the authority and directed to provide documents to the City Council to
implement its policy to adjust fees and charges to recover the percentage of full costs as established in this Chapter.
(b) “Full costs” shall be as defined in Section 35.80. In adjusting fees and charges, the City Manager shall act in an
administrative and ministerial capacity and shall consider only the standards and criteria established by this Chapter
and the applicable State laws.
Section 35.83 Schedule of Fees and Service Charges
(a) The City Manager, Director of Finance, and each City department head, under the direction of the City Manager,
shall review annually the fees and service charges listed in Appendix A - Schedule of Fees and Service Charges, and
provide an adjusted fee or charge schedule to the City Council for its consideration so as to recover the listed
percentage of full costs necessary to provide the listed regulation, product or service as modified by the notes
following the list of services. These fees, unless otherwise specified, are for City of Dublin services and are in addition
to any charges made by any other governmental agencies.
(b) The services as listed in this Section shall be as defined in the document entitled “Cost Study for the City of
Dublin, Ohio” as produced by the City of Dublin.
(c) All fees and charges set pursuant to this Chapter and Section shall take effect as specified in this Ordinance.
(d) The City Manager may vary the review schedule listed in the Section if, in the judgment of the City Manager and a
directly affected and requesting department head, a gross inequity would be perpetrated by not revising a fee or
charge prior to the next rate review. Any such special rate review shall be reported to the City Council at its next
succeeding meeting where the City Council may revise the fee or charge by Ordinance.
(e) If fees are not collected at the time that the service is provided, the City has the right to pursue collection of any
of the fees listed in this Ordinance, including certification to the County Auditor, remittance to a collection service, or
any other appropriate pursuit for payment. When additional fees need to be levied and collected for City-provided
services in the amount of $10 or less, or when a refund is due in the amount of $10 or less, a refund or additional
charge need not be made.
(f ) Should it become necessary to establish a new service fee or charge during the year, the City Manager may set the
fee administratively. Any such fees set by the City Manager shall be reported to the City Council at its next succeeding
meeting where the City Council may revise the fee or charge by Ordinance. The new service will then be included and
analyzed in the next rate review.

Section 35.84 Fee Appeals and Waivers
Irrespective of the percentage of recovery and the “notes” in Section 35.83 - Appendix A, the City Council reserves the
right to waive any fee in order to encourage development projects that enhance the City’s tax base as outlined in the
City’s Economic Development Strategy. The City Manager may recommend further waivers or fee adjustments, based
on hardship, to be accepted or rejected by City Council at its next regularly scheduled meeting.

Section 2. Section 94.21 of the Codified Ordinance of Dublin, Ohio is
hereby amended to read as follows:
Section 94.21 License Required
(A) No person shall engage in retail sales of tobacco products or alternative nicotine devices within the city without
a valid license issued by the city, or on the city's behalf, to sell tobacco products or alternative nicotine devices.
(B) No licensee shall engage in retail sales of tobacco products or alternative nicotine devices in violation of
§ 135.17 of the Codified Ordinances, or any substantially equivalent provision of applicable law.
(C) The following items shall be required in applying for a license, or renewing a license, under this section:
(1) A valid vendor's license from the Ohio Department of Taxation;
(2) If the applicant engages in retail sale of cigarettes, a valid Retail Cigarette Dealer's License as required by
R.C. Chapter 5743;
(3) The location where the applicant proposes to engage in retail sales of tobacco products or alternative
nicotine devices;
(4) A nonrefundable license administration fee in the amount provided in the fee schedule created under Chapter
35 of the Codified Ordinances;
(5) Such other information as determined, by the City Manager or the city's licensing agent, to be necessary to
administer the licensing system provided herein and effectuate the purposes of §§ 94.20 through 94.24, and
§ 135.17 of the Codified Ordinances.
(D) A license granted under this section shall be valid from June 1 of the year of application to May 31 of the
following year. A license issued to a new licensee after January 1 shall be valid until May 31 of the following year.
(E) License administration fees, reinstatement fees, and civil penalties collected in administering
§§ 94.20 through 94.23 may be collected by the city or the city's licensing agent, and shall be credited to the city's
General Fund to defray the costs of administration and enforcement of these sections; alternatively, the city and its
licensing agent may agree that the licensing agent will retain all or a portion of the fees as compensation for its
services as licensing agent.
(F) For purposes of this section, VALID LICENSE means a license issued under this section that has not expired,
that is not within a period of suspension or failure-to-reinstate status, and that has not been revoked.

Section 3. Section 94.22 of the Codified Ordinance of Dublin, Ohio is
hereby amended to read as follows:
Section 94.22 License Revocation, Denial, or Suspension
(A) Application for a license required under § 94.21 may be denied for any of the following reasons:
(1) The applicant has had a license under § 94.21 revoked within the previous three years;
(2) The applicant is determined to have knowingly included false or misleading information in the license
application or renewal application;
(3) The applicant's current license under § 94.21 has been suspended, and the period of suspension has not
elapsed;
(4) A property owned or operated by the applicant engaging in the retail sale of cigarettes, tobacco products, or
alternative nicotine products within the City of Dublin is the subject of a court order declaring such property to be a
public nuisance, where said nuisance has not been abated as determined by the court, or where the court has ordered
that retail sales of tobacco products or alternative nicotine products shall cease pursuant to any temporary restraining
order, preliminary injunction, or permanent injunction issued by the court;
(5) The applicant is in arrears with respect to any fine imposed for violation of § 135.17 of the Codified
Ordinances, or any substantially equivalent offense, or for any civil penalty levied under § 94.23; or
(6) The applicant has failed to provide any of the items required under § 94.21(C).
(B) For purposes of division (A) of this section, "applicant" shall include entities with common ownership or
management to the entity or natural person listed on the application.
(C) A license may be suspended for a definite period, not to exceed six months, as determined by the city or its
licensing agent. Prior to reinstatement of the license following expiration of the suspension, the licensee shall remit
reinstatement fee in the amount provided in the fee schedule created under Chapter 35 of the Codified Ordinances. A
license may be suspended for any of the following reasons:
(1) Two violations of § 135.17 of the Codified Ordinances, or any substantially equivalent offense, by the
licensee or agent of the licensee within the previous 12-month period;
(2) Failure to appear at any court proceeding where the licensee or any agent of the licensee has been charged
with a violation of § 135.17 of the Codified Ordinances, or any substantially equivalent offense. If the licensee's agent
is the person charged, the appearance of the agent shall be sufficient;
(3) A property owned or operated by the applicant engaging in the retail sale of tobacco products or alternative
nicotine products within the city is the subject of a court order declaring such property to be a public nuisance, where
said nuisance has not been abated as determined by the court, or where the court has ordered that retail sales of
tobacco products or alternative nicotine products shall cease pursuant to any temporary restraining order or
preliminary injunction issued by the court;

(4) The finding by a federal or state agency or court that the licensee has violated a federal or state rule or
regulation governing the retail sale of tobacco products or alternative nicotine products; or
(5) The licensee is in arrears with respect to any fine imposed for violation of § 135.17 of the Codified
Ordinances, or any substantially equivalent offense, or for any civil penalty levied under § 94.23.
(D) A license may be revoked for any of the following reasons:
(1) The licensee is determined to have knowingly included false or misleading information in the license
application or renewal application;
(2) Three or more violations of § 135.17 of the Codified Ordinances, or any substantially equivalent offense, by
the licensee or agent of the licensee within the previous 12-month period;
(3) A period of suspension imposed under division (C)(5) of this section has elapsed, and the licensee remains
in arrears of payment of such fine or penalty; or
(4) The licensee has been subject to three or more suspensions in the previous 24-month period.
(E) For purposes of divisions (C) and (D), "licensee" shall include entities with common ownership or management
to the entity or natural person listed as the license holder.
Section 4. SEVERABILITY
If any portion of this Chapter is found to be unconstitutional or invalid, the City Council hereby declares that it would
have enacted the remainder of this Chapter regardless of the absence of any such invalid part.
Section 5. REPEALER
All Ordinances, the Codified Ordinances of Dublin, Resolutions, City Council Motions, and all actions of all City Boards
and Commissions in conflict here within are hereby repealed. The fees and charges established by this Chapter shall
supersede all previously established fees or charges for the same regulation, product or service, and all such previous
fees and charges are hereby repealed on the effective date of the Order of the City Manager.
Section 6. EFFECTIVE DATE
This ordinance shall be in effect on January 1, 2026.

Note: In general, the recreation program will attempt to recover, on an aggregate basis, 50% of direct costs and
building maintenance costs plus an assigned percentage of costs associated with certain recreation program capital
improvement projects, while recognizing that some programs may be somewhat less than that for certain reasons and
some more than that. This to be based on the nature of the program. This will ensure that individual fees are
reviewed annually, and any set unusually high/low are flagged.

RC-22 - DCRC Rental
Section 1. That the following schedule of rental rate fees be established for exclusive use of the specified areas with
the Community Recreation Center:
Lap Pool
$20 per hour per lane for Dublin resident recreational use. (Payment for daily admission fee or DCRC
membership is required).
$20 per hour per lane for authorized Dublin City School district functions.
$20 per hour per lane for charitable organizations. (Includes admission fee for participants.)
$40 per hour per lane for non-resident recreational use. (Payment for daily admission fee or DCRC membership is

Saturday After-Hours Pool Rentals
Pool amenities are available for rental after-hours on Saturday evening from 8:15 p.m. – 10:15 p.m. Rental fees for
this time period (Resident / Non-Resident):
$290 / $430 for rental of leisure pool only.

Section 2. That each area has designated hours of operation and an additional $30 per hour will be charged for time
rented after those established hours.
Section 3. That in order to implement the rental fees established herein, the City Manager or designee shall have the
authority to promulgate and amend written administrative rules, regulations, and procedures not inconsistent with
sections 1, 2, and 3 within this service center, and related policies adopted by City Council.
Community Hall Rental Rates (per hour)
(A)– Primary address located within the City of Dublin.
Table and chair set-up is included in the rental fee. A warming kitchen is available. Podiums, a PA system, and other
basic AV support are available upon request, and must be set up by Dublin employees. Risers (platforms) are available
to rental groups and may be subject to an additional fee ($70) to cover costs of additional set-up and tear down time.
Meeting Room Rental Rates (per hour)
(A)– Primary address located within the City of Dublin.
Alcohol:
Rental groups are limited to serving beer, wine, seltzers or other undistilled/fermented alcohol not to exceed 25% ABV
after 7:30 p.m. on Friday and Saturday nights only. All other circumstances will require a waiver from City Council at
its next regularly scheduled meeting. Consumption is limited to the confines of the Community hall, and must comply
with State of Ohio liquor laws. Additional proof of insurance may be required (see “Insurance Coverage” below). The
City of Dublin is not liable for any injuries to guest or negligence where alcohol is involved. Special Duty Police
Officer(s) must be contracted by the rental group and are required on the premises throughout the entire event when
alcohol is being served.

Caterers will be asked to provide a current professional caterer’s license and proof of insurance, and will be asked to
sign a letter of agreement.
Insurance Coverage:
Depending on the risk classification of the event, the rental group may be required to obtain appropriate insurance. If
the City requires insurance for the event, the rental group will be asked to provide proof of liability insurance satisfying
the City’s lease requirements.
Rental Hours:
Rental hours will follow the existing hours of operation of the Dublin Community Recreation Center (DCRC) for Monday
through Thursday rentals. Rental hours may be extended to midnight (12:00 a.m.) on Friday, Saturday, and Sunday
pending staff and facility availability.
Rental Contract and Policies:
Each rental group will be required to sign a detailed facility rental contract and agree to abide by all policies,
procedures, rules and regulations governing the rental and operation of the facilities.
Refund Policies:
Community Hall – Upon cancellation of a reservation more than 60 days from the event date, the City will refund the
rental fees collected, less a $15 administrative. Upon cancellation of a reservation less than 60 days before the event
date, the City will refund the rental fees collected, less $200.
Meeting Rooms, Classrooms, Pavilions and Shelter houses – Upon cancellation of a reservation at least two weeks
before the scheduled event, the City will refund the rental fees collected, less a $15 administrative fee. Upon
cancellation of a reservation less than 60 days before the event date, the City keeps rental fees (up to $200 max.) &
refunds remaining fees (if any) or renter may reschedule without penalty.
Note: Rather than a percentage of recovery, the City Council has specified a fee structure to be adopted. Rental fees
for the gymnasium, classrooms, and park shelters are waived for youth organizations and schools, both public and
private, serving the Dublin Community.

RC-23 - Theater Rental
(A) – Primary address located within the City of Dublin.
* Fees will be waived for rental groups falling under the umbrella organization of the DAC. DAC will be charged a fully
burdened hourly rate for the Theater Technician’s time upon request of that service. The Theater Technician rate will
be charged at $45 per hour/per technician.
Fees listed as part of the Standard package includes the use of the stage, theatrical lighting, one projector, choral
microphones, handheld microphones, one theater technician and use of dressing rooms. Videography services and
additional technicians charged at $45/hr.
Fees listed as part of the Premium package include the standard package plus lapel/wireless microphones, up to two
additional projectors and two theater technicians. Videography services and additional technicians (beyond two) will
be charged at $45/hr.
City employees (or City-contracted professional service) are the only ones authorized to use/program the theater’s
technical equipment, lighting, and any other theatrical appurtenances.
Rental Rates and Collection Fee:
A three-hour minimum is required for all rental groups. Should a rental group request the City of Dublin to facilitate
ticket sales and collections for its performance(s), the City of Dublin will charge a 15% collection fee. This fee will be
calculated based on total ticket sales, and the balance of ticket collections will be remitted to the rental group.

play on City fields. Dublin Soccer League will be responsible to provide sponsorship and representation to other
leagues, field scheduling and field services for other eligible organizations. Such services will be performed for a pre-
set fee established by DSL. Fees for services, or changes to fees for service, must be provided to the club
organizations at least one year in advance.
** As a long standing provider of “Middle Tier” soccer league play in Dublin, the Dublin United Soccer Club will be
accommodated prior to other organizations at this level of play, so long as all organization and program eligibility
requirements have been met.

Re: Update on Development Fee Structure Analysis
Summary
As part of the comprehensive cost study presented in November 2024, members of City Council
requested an update to the cost of development analysis that was provided in 2020. Staff compiled
a list of current building standards, engineering and planning fees to demonstrate the cost of
development in 2025 for City Council’s review.
Background
In December 2020, Staff provided City Council with a comprehensive overview of the cost of
development using the Building Department, Engineering and Planning fees and compared them
with neighboring municipalities’ fees, at the request of Dublin City Council. Staff used a 17,642-
square-foot commercial office building in the Camden Professional Center as the model of
commercial development for comparison. Dublin’s fees were compared to those municipalities the
city commonly competes against in attracting commercial development, including Columbus,
Westerville, New Albany, Delaware, Marysville, Worthington and Hilliard. This was presented to
Council for informational purposes on November 16, 2020, after a request following the first reading
of the cost study on November 9, 2020. At the time, Dublin City Council members found this
information informative but understood that comparing only fees is one part of the story, whereas
it is also important to consider including time for plan review, level of customer service and quality
of work.
Cost of Development Update
At the direction of City Council in November 2024, staff updated the cost of development data and
conducted a comparative analysis of fees across several Central Ohio municipalities, including
Columbus, Westerville, New Albany, Marysville, and Hilliard. This initiative was prompted by a
request from Council members during the first reading of the cost study on November 4, 2024,
where staff committed to providing a follow-up in 2025, similar to the memo presented in 2020.
The 2025 update is based on an approved 16,100-square-foot commercial building and an approved
7,189-square-foot residential property. In the sections that follow, staff members present a detailed
analysis of building department fees for both commercial and residential properties, as well as a

comparison of engineering and planning fees for commercial development. This analysis is
accompanied by contextual insights to help interpret the data and understand the broader
implications for development in the City of Dublin.
Building Standards Fee Structures
Commercial building permit fees for a 16,100-square-foot structure vary significantly across Central
Ohio municipalities, with Columbus being the most expensive at $31,425. This is primarily due to its
New Building Inspection plus 3% State Surcharge, which totals $14,600 and includes two building
inspections, two inspections per trade, and 73 additional inspections averaging $200 each. Dublin
ranks second at $19,831, with its New Building Inspection fee (including the 3% surcharge) priced
at $5,042, which covers unlimited inspections and does not charge per additional inspection. In
contrast, New Albany ($6,915) and Westerville ($4,926) cost less overall, with lower fees for
inspections and plan reviews. Westerville charges for its plan review by the hour, unlike Dublin,
which charges a flat fee with no reinspection fee. Marysville ($9,255) and Hilliard ($7,705) fall in the
mid-range, and their inspection costs are included in the building permit review fee, rather than
itemized separately.

These differences reflect how municipalities structure their fee schedules—some bundling services

Engineering Fee Structures
Due to the layered fee structure, the City of Dublin has the third most expensive engineering fee
structure, which is the same result that was presented in 2020. Westerville has the most expensive

Similar to 2020, Engineering’s fees are largely dependent on the cost of water and sewer capacity
charges. Cities included in this comparison either run their own municipal water and sewer services
or contract with Columbus for their services. Columbus and Marysville manage their own water and
sewer services, while Dublin, Hilliard and New Albany contract with Columbus. Westerville has a
hybrid system, where part of the City contracts with Columbus, and the other half is run by the City
of Westerville. In Dublin, a new development connecting its building to the water and sewer taps
pays both fees associated with Dublin and Columbus, which are included in the costs above. The
Cities of Hilliard, New Albany, and a portion of Westerville also pay that fee to the City of Columbus,
because they are all contract areas that use Columbus water services.
Planning Fee Structures
The City of Dublin has the highest Planning and Zoning fees of any of the municipalities included in

this comparison, which is the same result that was presented in the 2020 memo. Similar to 2020,
the fees outlined below show the cost for development applications for a Planned Unit Development
(PUD), which allows developers to gain the approval of customized development standards and
development plans. The cost of the applications needed to gain approval through the required three-
step process reflects the amount of time and detailed review required by staff to navigate the PUD
process. As a result, fees levied by the City of Dublin for PUDs are significantly higher than those of
other municipalities.

The 16,000-square-foot building used as a model in this analysis followed the PUD tract, requiring
approval of a concept plan, preliminary development plan, and final development plan. In Dublin,
the application costs for the three applications total $8,730 for planning and zoning fees ($2,695 for
the concept plan, $2,395 for the preliminary development plan, and $3,640 for the final development
plan). It is important to note that although Dublin’s planning and zoning fees were significantly
higher than those of the other municipalities, it is a goal of the city to streamline the development
review process, which will be highlighted in the development review process section of this memo.
The second-highest planning and zoning fees were from Hilliard at $1,600, then Marysville at $1,500,
followed by New Albany at $1,400, Westerville at $1,125 and Columbus at $450.
Residential Building Standards and Engineering Fee Structures
Staff also determined it was important to include residential building department and engineering
fees in this year’s analysis to provide a more comprehensive view of development costs in Dublin,
an element that was not included in the 2020 cost study. For a 7,189-square-foot residential
structure, the total combined fees vary significantly across Central Ohio municipalities. Marysville
has the highest cost at $22,234, followed by New Albany ($20,075), Columbus ($19,815) and Dublin
($19,349). Hilliard is slightly less than the top four costs at $16,797, while Westerville is the least

how each city structures and itemizes fees for plan review, inspections, utilities, and permits.

When considering just building standards fees for a 7,189 square-foot property, Dublin is the fourth
most expensive municipality, totaling $7,238. The most expensive residential building standards fees
are Columbus at $11,468, followed by Marysville ($10,243) and New Albany ($7,953). The least
expensive residential building standards fees are Hilliard ($4,860) and Westerville ($3,100).
The Plan Review, Inspection, and State Surcharge is a major cost driver, ranging from $1,388 in
Columbus to $8,252 in Marysville, with Dublin at $4,152. Minor revision fees are relatively low across
the board, typically between $50 and $240, though Westerville does not list a cost. HVAC permit
fees vary significantly, from $101 in New Albany to $1,122 in Dublin, reflecting different approaches
to mechanical system regulation. Gas line permits are modest, with most cities charging between
$65 and $250, though Westerville does not list a fee.
Electric permit fees range from $250 in Columbus to $800 in Westerville, with Dublin at $637.40.
Plumbing permits are consistent across municipalities at $855, regardless of fixture count. Certificate
of Occupancy fees are minimal, ranging from $0 in Hilliard to $110 in Marysville, with Dublin charging
$95. Utility capacity charges also vary: Water capacity fees range from $1,924 in Columbus to $5,289
in Marysville, while Sewer capacity fees range from $1,550 in Westerville to $6,562 in Marysville.
Some municipalities include certain services in bundled fees, while others itemize each component,
contributing to the wide range in total costs. These differences reflect not only local infrastructure
costs but also policy decisions about how development fees are assessed and collected.

Development Review Process
While Dublin has increased building standards, engineering, and planning fees over the last five
years, the City has also improved the development review process, making it more transparent and
predictable. An update on the development review process was provided to Dublin City Council on
June 23, 2025, which can be found attached to this memo.
Findings and Conclusions
Ultimately, the City of Westerville is the most expensive municipality to develop within, with a total
cost of $135,448. Despite having one of the lowest building department and planning fee structures,
Westerville’s water and sewer tap charges push it to the top of the list. Marysville follows closely at
$134,688. In 2020, Marysville was the most expensive, primarily due to its engineering fees. If
Columbus sewer and water fees are excluded, Marysville becomes the most expensive municipality,
as it does not contribute to Columbus’s sewer and water infrastructure. Dublin ranks third in overall
development cost. To develop a 16,100-square-foot building in Dublin, the total cost is $112,876,
which includes building department, engineering, and planning fees, as well as fees paid to the City
of Columbus. Although Dublin has the second-highest building department fee structure and the
highest planning and zoning fees, it ranks third in engineering fees. This is largely because Dublin
utilizes the City of Columbus’s infrastructure, which helps its engineering costs compared to
Marysville and Westerville.
Following Dublin are Hilliard, Columbus, and New Albany, respectively. While Columbus has the most
expensive building department fees, its engineering fees rank sixth among the municipalities.
Conversely, Hilliard and New Albany have lower building department fees, but their engineering
costs are comparable to Dublin’s, placing them lower on the overall cost scale. The total development
costs for each are $93,182 (Hilliard), $83,429 (Columbus), and $82,031 (New Albany).
Compared to 2020, Dublin has shifted from the second to the third most expensive municipality for
development. This is likely due to the increased engineering fees in Marysville and Westerville.
Additionally, Dublin’s cost recovery policy for its fees distinguishes its building department costs from
other municipalities, which may rely more heavily on general fund subsidies to offset development
expenses.

Lastly, while comparing the City of Dublin’s development fees to those of neighboring municipalities
provides valuable context, it is important to recognize the added value that Dublin offers to
developers. Feedback from the development community consistently highlights Dublin’s exceptional
customer service as a key factor that justifies the cost. Included in Dublin’s building department fees
is an unlimited number of inspections, regardless of the size or complexity of the structure—an
offering not commonly matched by other jurisdictions. Additionally, a developer may call as late as
6:00 a.m. and get that same-day inspection. Dublin’s fee structure is designed to fully capture the
cost of services provided, avoiding reliance on the general fund. This approach ensures that only
those who utilize development services bear the associated costs, maintaining fairness and fiscal
responsibility for all residents.

Summary
On October 23, 2023, City Council adopted the 2023 Economic Development Strategic Plan
Update, which outlined a series of implementation strategies to help ensure the city’s continued
economic vitality. A cross-departmental team has focused on Strategy 2 regarding the
development review process and identified six major action themes through a Lean Six Sigma
analysis. On October 16, 2024, City Council, alongside the Board and Commission members,
reviewed the materials and provided feedback on the presentation at the Joint Work Session. Staff
have continued to implement the recommendations with the goal of completing the remaining
tasks by the end of 2025. Staff has prepared a brief update for Council’s awareness.
Background
A cross-departmental team, including representatives from the Office of the City Manager,
Community Planning & Development, Economic Development, Building Standards, Engineering and
Transportation & Mobility, in conjunction with 3-Point Consulting LTD, conducted a Lean Six Sigma
analysis focusing on Strategy 2 from the Economic Development Strategic Plan, which indicates
the City should:
Make Dublin’s Development Processes More Transparent and Predictable, Thereby Reducing
Uncertainty. The rationale behind this strategy identifies that attracting and retaining value-added
business enterprises is highly competitive, and the ability to grow and scale such companies within
a region is extremely difficult. For a city to be a competitive location for attracting and retaining
industrial drivers, it must ensure that its government policies, procedures, regulations, and codes
are encouraging rather than discouraging investment.
The Plan goes on to identify Action 5, which states that the City should Foster Understanding and
Predictability Regarding the Type of Development Being Sought and Adhere to the Stated
Vision/Plan for Development.
This action includes:
• Validate the Council’s commitment to the city’s area plans, specifically the Dublin Corporate
Area, West Innovation District and Bridge Street District.
• Update the Community Plan.
• Articulate the Council’s vision to the Council/Board/Members/Staff.

• Explore additional opportunities for innovative/expedited visioning processes involving the
Council, Board, members, staff developers and landowners.
• Ensure new hires connect with industry leadership.
The cross-departmental team has scrutinized the development review process to identify
improvement areas per the strategy outlined above. The objective was to assess each stage of the
development process, from the initial project concept to building occupancy, and to pinpoint
opportunities for enhanced efficiency. City Council and Boards and Commissions representatives,
and external stakeholders, such as developers, architects, engineers/project managers, and legal
advisors, were invited to participate in the evaluation. Their input provided valuable insights into
the City’s review process and assisted in identifying areas for potential improvements. This
stakeholder feedback established six major action themes: project management, staff reports,
central intelligence, requirements and review processes, tiers of service and technology. Each
theme contains a list of tasks designed to fulfill its objectives.
At the October 2024 Joint Work Session, staff members shared the tasks completed to date and
sought feedback regarding staff reports and recommendations provided to the Boards and
Commissions, and potential Code modifications to streamline the review process. The outcome of
this feedback included:
1. Redefined and reorganized staff reports for clarity, with additional information within
reports and associated presentations tailored to suit the relevant Board or Commission’s
needs.
2. Continued incorporation of staff recommendations within staff reports for Board or
Commission consideration.
3. Adoption of an initial Code modification, focusing on the concept plan step.
Six Action Themes
An updated version of the presentation provided at the October 2024 work session has been
prepared with additional tasks completed, identification of the remaining in-progress items to
complete and estimated times for completion. Staff have continuously progressed on deliverables
following the work session across the six major action themes. The tasks completed following the
October Work Session are highlighted below.
Project Management Approach
Staff members have delineated the Case Manager responsibilities by incorporating this description
into the roles and responsibilities spreadsheet presented in the Planning and Economic
Development onboarding processes. This document undergoes continuous review and is updated
as needed. This approach provides a single point of contact for potential applicants as they
progress through the full development review process.
Staff Reports and Recommendations
Community Planning & Development staff completed several major tasks reviewed at the October
Work Session. The first task was gaining feedback from Council, Board, and Commission members
regarding staff reports and presentations. This aided the staff in identifying the appropriate
amount of information and organization of information within the staff report. Subsequently,
alternative report options were drafted to address the varying informational needs of each Board
or Commission, which have since been updated and implemented for each group. Finally, the staff
continues to provide educational and training opportunities for Boards and Commissions. This

includes on-topic specific training, conferences, individual meetings with staff as needed, and our
annual Board and Commission training scheduled for July 2025. These opportunities continue to be
evaluated and adapted to meet the needs of the Board and Commission members.
Centralized Intelligence
Development staff members received training on the new inquiry tracking tool called the Property
Inquiry Tracker. The Tracker serves as a catalogue of initial communication points between staff
and inquirers regarding zoning questions, potential projects or economic development leads. Built
using the ArcGIS platform, this tool enhances the searchability of historical records through a
mapping feature and database. The Tracker is updated regularly by staff and includes inquiries
received since 2021. Staff continues to have check-ins to ensure the platform provides the
information needed and is updated to include any additional improvements.
Requirements and Review Process
A number of tasks have been completed under this theme, including the adoption of Ordinance 07-
25 to amend the Zoning Code to retain the Concept Plan as a required step in the review process
for large-scale development projects. However, it transitioned from a determination step to a non-
binding feedback step by the required reviewing body for projects both with and without a
Development Agreement. This amendment provided consistency amongst the City’s review
processes, allowing applicants to obtain feedback and streamline approval steps. Additionally, the
Engineering and Transportation & Mobility teams are also updating their standard construction
drawing detail requirements. An interim update was completed in December 2024, with a
comprehensive update scheduled for completion in the third quarter of 2025. One of the larger
outstanding items is related to our development process mapping analysis, which will be
completed by the end of Q4 2025, with more details below under the next steps. The outcome of
this work will further one additional task outlined in this theme, which ensures the enhanced
integration of the Transportation & Mobility team into the application review process.
Tiers of Service
Staff have accomplished several tasks within this theme to provide guidance for new or complex
projects and establish a standard application process. Weekly Development Office Hours have
been implemented every Thursday, 10:00 am – 11:00 am, to foster engagement, understanding,
and awareness among Dublin’s constituents and corporate residents. The City of Dublin’s
Development Office Hours offer an opportunity for the property owners, applicants and their
design professionals to meet with key plan review staff. As part of these meetings, staff provide
feedback on potential projects in an informal setting prior to formal application submission. Office
Hours meetings can help identify and guide developers and businesses through any issues that
might arise in a formal review. A record of Office Hours meeting attendees, topics, and associated
materials is stored internally to track stakeholder engagement in our processes and development
plan alterations between the initial contact inventoried by the Property Inquiry Tracker and the
formal application submission process with the Community Planning & Development department.
The feedback received from Office Hour participants to date has been very positive and
participants shared that they would like to see other municipalities take a similar approach.
Technology Use
The Information Technology department collaborated with Building Standards and Planning staff
members to identify quick fixes in current development software solutions. The team has also
provided additional support to enhance the software’s internal and external usability while

identifying and implementing continual improvements. Staff will continue to identify opportunities
for software improvements and enhancements to our website as needed.
Next Steps
One of the larger outstanding items is related to our development process mapping analysis. This
analysis will more clearly identify the scope of review conducted at each stage of the process and
outline and look for opportunities to streamline the internal review process. The goal is to
complete the analysis and begin implementing the recommendation by the end of Q4 2025.
