NECESSARY CONVEYANCE DOCUMENTS AND CONTRACTS TO
ACQUIRE A 0.032-ACRE PERMANENT DRAINAGE EASEMENT
FROM THE PROPERTY LOCATED AT 5584 BRAND ROAD,
IDENTIFIED AS FRANKLIN COUNTY PARCEL NUMBER 273-
000587-00 FROM STEPHEN K. GILL AND RACHEL K. TEITT
GILL, FOR THE PUBLIC PURPOSE OF CARRYING OUT THE
EARLINGTON PARK DRAINAGE BASIN IMPROVEMENTS
PROJECT (24-023-CIP)
WHEREAS, the City of Dublin ('City"} is preparing to construct a stormwater
management basin improvements project within Earlington Park, south of Brand Road
and east of Bristol Parkway, known as the Earlington Park Drainage Basin
Improvements Project (24-023-CIP) ("Project); and
WHEREAS, the Project requires that the City obtain the following property rights from
the parcel identified as Franklin County Parcel Number 273-000587-00, owned by
Stephen K. Gill and Rachel K. Teitt Gill ('Property Owner" }, as described in the attached
Exhibit A and depicted in the attached Exhibit B:
• A 0.032-acre permanent drainage easement for the construction, operation,
and maintenance of public and private utilities; and
WHEREAS, the City and Property Owner participated in good faith discussions and
have come to mutually agreeable terms for the acquisition of the necessary property
rights for the sum of $11,200.00; and
WHEREAS, the City desires to execute and accept necessary conveyance documents
and contracts to complete the transaction between the City and Property Owner.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, State of
Ohio, '_7 of the elected members concurring that:
Section 1. The City Manager is hereby authorized to execute and accept all
necessary conveyance documents and contracts to acquire the easement from the
property located at 5584 Brand Road, identified as Franklin County Parcel Number 273-
000587-00, from Stephen K. Gill and Rachel K. Teitt Gill, for $11,200.00.
Section 2, Council further hereby authorizes and directs the City Manager, the
Director of Law, the Director of Finance, the Clerk of Council, or other appropriate
officers of the City to take any other actions as may be appropriate to implement this
Ordinance without further legislation being required.
Section 3. This Ordinance shall take effect upon passage in accordance with
Section 4.04(b) of the Dublin Revised Charter.

Re: Ordinances 28-25 and 29-25 — Acquisition of Easements for the Earlington Park
Drainage Basin Improvements Project (24-023-CIP)
Background
The Brand Road pedestrian tunnel, located east of the Brand Road and Bristol Parkway
intersection, has experienced repeated stormwater flooding over the past several years. The City
of Dublin (City) has concerns with this frequent flooding condition and its impacts on public health
and safety. In 2023, the City contracted with EMH&T to perform an investigation and determine
the cause of this frequent flooding condition. As a result of this investigation, the City identified the
Earlington Park Drainage Basin Improvements Project (Project) to improve public health and safety
by decreasing the frequency with which the Brand Road pedestrian tunnel floods. In 2024, the City
of Dublin was awarded $468,000 in grant funding for the Project through the One Time Strategic
Community Investment Fund from the State of Ohio.
Summary
The Earlington Park drainage basin was constructed in 1987 as a stormwater detention basin for
Earlington Park and the surrounding watershed tributary area. This Project will adjust the flood
routing of the drainage basin in Earlington Park, located south of the Brand Road pedestrian tunnel
and shown on the Project Location Map at the end of this memo, away from the pedestrian tunnel.
It will also raise the embankment on the north end of the basin to provide more storage capacity,
which will increase the threshold at which the basin overtops from a 2-year storm event to a 100-
year storm event. A 2-year storm event is a storm event when there is a 50% chance of a storm
event of equal or greater magnitude happening in any given year. A 100-year storm event is a
storm event when there is a 1% chance of a storm event of equal or greater magnitude happening
in any given year.
The Project will also reconstruct the pedestrian trail in the immediate Project area and increase the
storm pipe outlet for the basin from a 24-inch to 36-inch pipe. Additionally, the Project will create
a berm on the north side of Brand Road to reduce the frequency the Brand Road pedestrian tunnel
floods from North Fork Indian Run. Presently, the Project is planned to be advertised for bids in
July 2025, with construction planned to commence in Fall 2025 and be complete by Spring 2026.
The Project requires the acquisition of a permanent drainage easement from the property at 5584
Brand Road for the construction, operation, and maintenance of public and private utilities.
Additionally, the Project requires the acquisition of a temporary easement from the property at
5584 Brand Road for construction operations.

The City engaged West Erie Realty Solutions, Ltd., as the acquisition agent for the Project. In that
role, West Erie Realty Solutions, Ltd. has been the point of contact, in addition to City staff, with
the property owners in the Project area. The City has participated in good faith discussions with
the property owners of the affected parcel and has come to mutually agreeable terms with the
property owners. After Council's adoption of these two ordinances, the City will have completed all
necessary acquisitions for the Project.
Acquisitions
The Good Faith Offer Letter, the appraisal report and associated information were provided to the
property owners for the affected parcel in May 2025. The property acquisition consists of the
following property rights from the named property owners listed below and as depicted in the
exhibits attached hereto:

Recommendation

Situate in the State of Ohio, County of Franklin, City of Dublin, lying in Survey Number
3010, Virginia Military District, being on, over, and across that 3.392 acre tract conveyed as
Tract No. 2 to Stephen K. Gill and Rachel K. Teitt-Gill by deed of record in Instrument Number
202401080002667 (all references are to the records of the Recorder's Office, Franklin County,
Ohio) and being more particularly described as follows:
Beginning, for reference, at the westerly corner of said 3.392 acre tract, the northerly
corner of that 0.375 acre tract conveyed as Parcel 12-WD to City of Dublin, Ohio by deed of
record in Instrument Number 201302120025038, and being in the line common to said Virginia
Military Survey Number 3010 and Virginia Military Survey Number 2544, in the centerline of
Brand Road, and in a southeasterly line of that subdivision titled "Bristol Commons Section 1
of record in Plat Book 77, Page 7;
Thence South 470 13' 33" East, with the southwesterly line of said 3.392 acre tract, the
