A RESOLUTION TO INITIATE THE RE-
ZONING OF APPROXIMATELY 650 ACRES
OF LAND BOUNDED BY POST ROAD ON
THE NORTH, U.S. 33/S.R. 161 ON
THE WEST AND SOUTH AND I-270 ON
THE EAST. TO BE REZONED FROM LI,
LIMITED INDUSTRIAL, RI, RESTRICTED
INDUSTRIAL AND R, RURAL DISTRICTS,
T0: P.L.O.R., PLANNED LABORATORY,
OFFICE AND RESEARCH DISTRICT.
WHEREAS, Section 1125.01(a) of the Dublin Planning and Zoning Code
authorizes Council to initiate amendments to the Zoning District Map
by resolution; and,
WHEREAS, it is necessary from time to time to insure that the Zoning
District Map reflects an arrangement of permitted land uses that advances
the general welfare of the Municipality; and,
WHEREAS, the zoning district classification of certain tracts of land may
no longer be appropriate due to changes in the overall character of
Dublin and appropriate comprehensive plans;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of Dublin,
Ohio, 7 of the elected members concurring:
Section 1. That zoning proceedings be initiated to rezone the following
described real estate in the Village of Dublin, State of Ohio, and
being further described:
Beginning at the intersection of the south right-of-way
line of Post Road and the east right-of-way line of
U.S. 33, the east following the south right-of-way of
Post Road passing Avery Road and Wilcox Road to the
intersection of Post Road and the northwest right-of-way
of I-270; the south and west following the west
right-of-way of I-270 and the north right-of-way of
U.S. 33/S.R. 161 passing Wilcox Road, Avery Road and
Ligget Road to the beginning.
TO BE REZONED TO P.L.O.R., PLANNED OFFICE LABORATORY AND RESEARCH DISTRICT.
Section 2. That this Resolution is hereby declared to be an emergency
measure necessary for the immediate preservation of the public peace,
health, safety and welfare; and provided it receives the affirmative
vote of two-thirds of the members of Council, it shall take effect
immediately after passage and approval by the Mayor; otherwise it
shall take effect and be in force from and after the earliest period
allowed by law.

SUBJECT: Area Rezoning
DATE: November 13, 1986
The resolution to initiate the rezoning of 650 acres south of Post Road was
prepared as a result of a traffic and land use plan prepared by the firm of
Trott and Bean. The recommendations of the study were considered by a
combined Council and Planning and Zoning Land Use Committee. The new
P.L.O.R. District was devised and a committee recommendation was made to
rezone the subject 650 acres to the P.L.O.R. classification.
Staff's main concern at this point is to insure that Council is fully aware
of the issues prior to the actual rezoning. Other than arranged meetings with
the property owners during the very early stages of the land use study, the
owners have not been consulted about the proposed rezoning. As expected
there are some very real concerns among some of the property owners.
Another issue involves the P.L.O.R. classification. The study recommendation was
that a Planned Industrial/Office District be devised. This would have preserved
some of the use rights now enjoyed by the owners of the property zoned Limited
Industrial, but also eliminate the uses not compatible with straight office
uses. The Land Use Committee decided to eliminate industrial uses completely
and substitute laboratory and research uses. Staff does not question the
appropriateness or desirability of O.L.R. uses as opposed to industiial uses,
although Council must be advised that the elimination of all industrial uses
makes the Village's rezoning effort Less defensible should the rezoning be
contested. The property owners have also expressed some economic development
consequences if all industrial uses are eliminated.
Staff has no doubt that Council is empowered to rezone the area. There is also
little doubt that the Limited Industrial Zoning District is not the most appropriate
classification of the subject property, although the probability of litigation
if the rezoning passes is high. It is therefore recommended that Council, prior
to the final consideration of the resolution to zone hold a public meeting with
the property owners and other interested citizens. The purpose of the meeting
would be to insure that Council is aware of all the implications surrounding
the rezoning in an amicable manner before proceeding with the actual rezoning.
The actual ordinance to rezone will be distributed to Council, should Council
decide to vote on the resolution and begin the rezoning proceedings.
