ACRES, 0.089 ACRES, AND 0.025 ACRES, MORE OR LESS, FROM
PETER M. KLEIN AND THE JENTGEN-KLEIN COMPANY, SAID
ACREAGE LOCATED IN CLOSE PROXIMITY TO THE
INTERSECTION OF POST ROAD AND COMMERCE PARKWAY,
CITY OF DUBLIN, COUNTY OF FRANKLI\T, STATE OF OHIO.
WHEREAS, the City of Dublin is preparing to improve the intersection of Post Road and
Commerce Parkway; and
WHEREAS, improvement of this intersection will require the City of Dublin to obtain fee
simple interests, a bikepath easement and temporary construction easements in and to the
premises described in the attached Exhibit "A", Exhibit "B", Exhibit "C", Exhibit "D",
Exhibit "E", Exhibit "F", Exhibit "G" and Exhibit "H", located in the City of Dublin,
County of Franklin, State of Ohio.
NOW~REFORE, BE IT ORDAINED by the Council, of the City of Dublin, State of
Ohio, of the elected members concurring that:
Section 1. Council hereby authorizes the City to appropriate, for the purpose of improving
the intersection of Post Road and Commerce Parkway, fee simple interests, a bikepath
easement, and temporary construction easements in and to the premises located in the City
of Dublin, County of Franklin, State of Ohio as more fully described in the legal
descriptions attached hereto as Exhibit "A", Exhibit "B", Exhibit "C", Exhibit "D", Exhibit
"E", Exhibit "F", Exhibit "G" and Exhibit "H".
Section 2. Council hereby fixes the value of the interests to be appropriated at one hundred
thirty-one thousand six hundred fifty dollars ($131,650.00) which sum shall be deposited with
the Franklin County Court of Common Pleas, for the use and benefit of the owners of the
property appropriated as their interests may appear. Upon such deposit, the City of Dublin
shall take possession of and enter upon the property pursuant to law.
Section 3. Council finds that the appropriation is necessary for the stated purpose, that the
City has been unable to agree with the owner of the property as to appropriate compensation,
and that the City intends to obtain immediate possession of the property.
Section 4. The City Law Director is directed to file a petition for appropriation in the
Franklin County Court of Common Pleas, to have a jury impaneled to assess the compensation
to be paid for the real estate herein described above.
Section 5. This ordinance shall take effect and be in force from and after the earliest period
allowed by law.

Post Road! Commerce Parkway Intersection Improvement Project
Peter M. Klein and the Jentgen-Klein Co.
This legislation is a follow-up Ordinance to the Resolution 26-09 passed by Council regarding
this same property at the June 1, 2009 meeting. By way of background, the Resolution
authorized the City to pursue all the necessary legal requirements to review the possible
appropriation of property owned by Peter M. Klein and his company, the Jentgen-Klein Co.
Acquisitionlappropriation of this property is necessary for the improvement of the intersection of
Post Road and Commerce Parkway. The purpose of this Ordinance is to authorize the Law
Department to pursue an eminent domain action in the Franklin County Court of Common Pleas
if, through good faith negotiations, the City cannot settle with the landowner.
APPROPRIATION SPECIFICS:
This memorandum discusses the appropriation of property owned by Peter M. Klein and his
company, the Jentgen-Klein Co. The appropriation would consist of fee simple interests of
0.238 acres, 0.025 acres, 0.053 acres (with 0.016 acres as present road occupied) and .197 acres,
more or less, as well as a bikepath easement of 0.210 acres, more or less, and temporary
construction easements of 0.027 acres, 0.089 acres, and 0.025 acres, more or less, located in the
City of Dublin, County of Franklin, State of Ohio.
ACTION TAKEN IN THIS CASE:
The Law Department eggaged Horner Appraisal Group, Inc. to perform an appraisal of the
property being appropriated by this legislation. The property was appraised at one hundred
thirty-one thousand six hundred fifty dollars ($131,650.00).
Mr. Klein also had the property appraised, and his appraiser valued the property at two hundred
twelve thousand four hundred eighty-eight dollars ($212,488.00). The Law Department eggaged

TranSystems (Mr. Ty Brown) to negotiate the acquisition with Mr. Klein. Negotiations with Mr.
Klein will continue to take place after passage of this legislation, but in the event that the City is
unable to come to an agreement with Mr. Klein within the timeframe required for construction of
the intersection improvement, the City will file a lawsuit against Mr. Klein and the Jentgen-Klein
Co. in order to obtain access to, and take possession of, the necessary property interests.
If an agreement is reached, then the Law Department will prepare an ordinance authorizing the
City Ivl:m.~_,er to enter into a real estate purchase contract and associated conveyance documents
with the l.m~aowner.
RECONIlVIENDATION:
The Law Department recommends approval of Ordinance No. 30-09.
