WHEREAS, the City of Dublin is preparing to improve the intersection of Post Road and Commerce Parkway; and WHEREAS, improvement of this intersection will require the City of Dublin to obtain fee simple interests, a bikepath easement and temporary construction easements in and to the premises described in the attached Exhibit "A", Exhibit "B", Exhibit "C", Exhibit "D", Exhibit "E", Exhibit "F", Exhibit "G" and Exhibit "H", located in the City of Dublin, County of Franklin, State of Ohio. NOW, TH FORE, BE IT RESOLVED by the Council, of the City of Dublin, State of Ohio, of the elected members concurring that: Section 1. Council considers it necessary and declares its intention to appropriate, for the purpose of improving the intersection of Post Road and Commerce Parkway, fee simple interests, a bikepath easement, and temporary construction easements in and to the premises located in the City of Dublin, County of Franklin, State of Ohio as more fully described in the legal descriptions attached hereto as Exhibit "A", Exhibit "B", Exhibit "C", Exhibit "D", Exhibit "E", Exhibit "F", Exhibit "G" and Exhibit "H". Section 2. The City Manager is hereby authorized to cause written notice of the passage of this Resolution to be served upon the owners and persons in possession or having an interest of record in the above-described property. This notice shall be served according to law. Section 3. This Resolution shall take effect and be in force from and after the earliest date permitted by law. Klein and the Jentgen-Klein Co. PROJECT BACKGROUND wv:.$ZD.com columbu: cle.el,tw The City of Dublin is preparing to improve the intersection of Post Road and Commerce Parkway. This improvement project requires the acquisition of property interests from two property owners. A C QUISITI ON INTRODUC TION: This memorandum discusses the acquisition of property owned by Peter M. Klein and his company, the Jentgen-Klein Co. The acquisition consists of fee simple interests of 0.238 acres, 0.025 acres, 0.053 acres (with 0.016 acres as present road occupied) and .197 acres, more or less, as well as a bikepath easement of 0.210 acres, more or less, and temporary construction easements of 0.027 acres, 0.089 acres, and 0.025 acres, more or less, located in the City of Dublin, County of Franklin, State of Ohio. ACTION TAKEN IN THIS CASE: The Law Department engaged TranSystems (Mr. Ty Brown) to negotiate the acquisition with Mr. Klein. Mr. Klein has indicated that he is willing to negotiate with the City and is presently obtaining an appraisal of the property interests that the City is acquiring. Negotiations with Mr. Klein will continue to take place after passage of this resolution. This resolution indicates the City's intent to appropriate the above land and is precautionary in the event that the City is unable to come to an agreement with Mr. Klein within the timeframe required for construction of the inters ection improvement. If an agreement is reached, then the Law Department will prepare an ordinance authorizing the City Manager to enter into a real estate purchase contract and associated conveyance documents with the landowner. If an agreement cannot be reached, the Law Department will prepare an ordinance to appropriate the property interests via an eminent domain proceeding.
