AN ORDINANCE REPEALING ORDINANCE 92-02
REGARDING AN OHIO PUBLIC EMPLOYEES
RETIREMENT SYSTEM (OPERS) PENSION "PICKUP"
PLAN FOR THE POSITION OF CITY MANAGER.

WHEREAS, Council has determined that Ordinance No. 92-02 establishing a
pension "pick up" plan for the position of City Manager, under Section 42 U.S.C.A.
subsection 414(h)(2) should be repealed.
NOW, THERE, BE IT ORDAINED by the Council of the City of Dublin,
State of Ohio, of the members concurring:
Section 1. That Ordinance No. 92-02 establishing a pension "pick up" plan for the
position of City Manager, under Section 42 U.S.C.A. subsection 414 (h)(2), is
hereby repealed.
Section 2. That this Ordinance shall take effect and be in force from and after the
earliest period permitted by law.

Memo
Staff has been advised in writing by the Ohio Public Employees Retirement System (OPERS)
that, given the City's desire to no longer provide a pension "pick up"plan for the position of City
Manager, Ordinance No. 92-02 establishing such a plan should be repealed legislatively.
Therefore, staff has prepared the attached legislation repealing Ordinance No. 92-02 for Council
consideration at this time.
The need to formally repeal Ordinance No. 92-02 came to staff's attention following a verbal
inquiry made by staff to OPERS in the process of preparing the employment agreement for the
appointment of Mr. Terry Foegler as the City's new City Manager. Initially, staff was verbally
advised by OPERS that repeal of Ordinance No. 92-02 would not be necessary; however, upon
closer examination, officials at OPERS sent written notice advising staff that formal repeal of
Ordinance No. 92-02 was the proper course of action.
Recommendation
Staff recommends adoption of Ordinance 06-09 at its second reading/public hearing at the March
2, 2009 Council meeting.
