Form No. 1097 c,:~ 1I eld February 21, 1983 19 Mayor Lewis began the meeting by swearing in newly appointed Councilman Dan Sutphen at 7:30 P.M. Those members present were: Amorose, Chambers, Headlee, Lewis, Maurer, Thornton. Also present were Mr. Sheldon, Village Manager, Mr. Gunner, Assistant Law Director, Mr. Bowman, Planner, Mr. Strutner, Assistant Manager, and Mrs. Trissel, Finance Director. Mr. Amorose moved, seconded by Mrs. Headlee, to approve the minutes of the February 7th meeting. All those present voted in favor of the motion except Mr. Sutphen who abstained. Mr. Amorose moved, seconded by Mrs. Maurer, to approve the minutes of the February 14th meeting. All voted in favor of the motion except Mr. Sutphen who abstained. Mr. Amorose moved, seconded by Mrs. Headle~ to approve the bill listing of February 21st. Vote on the motion was unanimous for approval. Mayor Lewis introduced Emmett Karrer who, on behalf of the Dublin Historical Society, presented the Village with an aerial picture of Dublin taken in 1947. Mayor Lewis expressed his appreciation on behalf of Council and the Village. Ordinance No. 04-83 - Public Hearinq Said ordinance, to amend the Planning and Zoning Code to establish a permit section, was read for the second time. This being a public hearing on the ordinance, there was no one present to oppose the amendment. Mr. Bowman ex- plained the exact nature of the permit section and answered questions of Councilmembers. He further explained the section was for the purpose of regu- lating land uses in the Village such as heliports. Tabled Ordinance No. 69-82 Said ordinance, to prohibit obscene conduct and obscene materials, remained tabl ed. Resolution No. 03-83 Said resolution, to certify, endorse, and support a litter control program, was read for the second time. Mr. Chambers moved, seconded by Mr. Amorose, to amend the resolution as follows per Mr. Strutner~ recommendation: (Second to last paragraph) HEREBY authorizes the Village Manager to apply for a Litter Control Single Project Grant; and, if award- ed, to enter into the necessary agreement and administer the grant to implement said program for Dublin; and, Vote on the motion was unanimous for approval. Mr. Chambers then moved, sec- onded by Mrs. Headlee, to dispense with the three-time reading rule and pass the resolution by an emergency. Mr. Chambers explained that the grant would amount to $25,000 toward the purchase of a street cleaner which would cost approximately $67,000. After further discussion, Mr. Chambers withdrew his motion to pass as an emergency. Ordinance No. 08-83 Said ordinance to regulate alarm systems in the Village, was introduced by Mr. Thornton and read for the first time. Mr. Strutner answered questions pertain- ing to the need for the ordinance. Ordinance No. 09-83 Said ordinance, to amend the 1983 Appropriations, was introduced by Mr. Amorose and read for the first time. Mr. Amorose moved, seconded by Mr. Chambers, to dispense with the three-time reading rule and to pass the ordinance as an emer- gency. Vote on the motion and ordinance was unanimous for approval. Form No. 1097 "'~~ Held February 21, 1983 19 Page Two Ordinance No. 10-83 Said ordinance to issue vendor's licenses to permit businesses and organization3 to sell wares and food during the St. Patrick's Day celebration was introduced by Mrs. Headlee and read for the first time. Mr. Sheldon recommended a fee of $5.00 for the permit and Mrs. Headlee said the number of permits should not exceed thirty (30). Council agreed with these figures. Mr. Amorose moved, seconded by Mrs. Headlee, to amend Section 2-B to read "maximum" instead of minimum and to correct a typographical error in Section 1, and to dispense with the three-time reading rule and pass the ordinance as an emergency. Vote on the motion and the ordinance was unanimous for approval. Appointments of Council P&Z Representative and C.I.C. Mr. Chambers moved, seconded by Mr. Amorose, to nominate and appoint Mrs. Headlee to serve as Council representative to the Planning and Zoning Commis- sion for the year 1983. The motion passed with the vote as follows: 6 Yeas _ Amorose, Chambers, Sutphen, Lewis, Maurer, Thornton; 1 abstention _ Headlee. Mr. Amorose moved, seconded by Mrs. Headlee, to nominate and appoint Mr. Thornton to serve on the Dublin C.I.C. The motion passed with the vote as follows: 6 Yeas - Chambers, Sutphen, Headlee, Lewis, Maurer, Amorose; 1 ab- stention - Thornton. Mr. Ruma - NO LEFT TURN - Village Square Shopping Center Mr. Charles Ruma was present to ask that the NO LEFT TURN sign be removed from the drive exiting along S.R. 257. He said the situation has created a hazard in the shopping center because cars have to cross parking lanes to get to Dale Drive so they may turn left. He said he did not believe there should be a left-hand turn permitted for traf~c going under the bridge and that he woul~ be glad to assist in whatever way to alleviate that situation. Mr. Thornton presented a survey taken on Friday, February 18th from 11:50 A.M. to 1:00 P.M. and from 5:10 P.M. to 6:00 P.M. and on Saturday from 11:45 to 12:45. The survey indicated a majority of the cars ignored the NO LEFT TURN signs. He said he did not see any danger to those persons turning left. Mr. Amorose moved, seconded by Mrs. Headlee, to direct the Village Manager to contact the Ohio Department of Transportation for their recommendation as to how to make the intersection safer. Vote on the motion was unanimous for approval. Mr. Amorose then moved, seconded by Mr. Thornton, to remove the NO LEFT TURN signs immediately and wait for a report from Mr. Sheldon as to the results of the ODOT recommendation. The motion passed with the vote as follows: 5 Yeas - Thornton, Amorose, Sutphen, Headlee, Lewis; 2 Nays - Chambers, Maurer. Proposal - Municipal Transition Study Mr. Sheldon reported on the proposed transition from Village to City status. He said the cost of MORPC to provide staff services would be approximately $6,000 and possibly more if additional staff services were needed. Council directed Mr. Sheldon to investigate other sources to obtain the information re- qui red. Municipal Sovereign Immunity Mrs. Maurer referred to a memorandum from Mr. Strutner and Mr. Gunner regarding Municipal Sovereign Immunity and the Haverlack v. Portage Homes, Inc. The Ohio Municipal League is asking cities and villages for financial assistance to con- tinue work on this issue. Dublin's contribution would be $50. Mrs. Maurer moved, seconded by Mr. Amorose, to authorize the Village Manager to contribute $50 for this cause. Vote on the motion was unanimous for approval. Form No. 1097 ,,,,(~," II elc/ February 21, 1983 19 Page Three Capital Improvements Mayor Lewis said Mr. Sheldon had written a letter to the County Commissioners in January asking that if Dublin proceeds with Frantz Road improvements, would I they be willing to participate. Mr. Sheldon received a response stating they would be willing to contribute $200,000 toward the cost of the project with th provision that when completed, Dublin annexes that portion of Frantz Road stil in the County. He said he would like to suggest again that bids be solicited for the Frantz to Rings Road improvement. During a discussion, it was decided more discussion is needed. Mayor Lewis said Mr. Sheldon suggested Mr. Bowman, Planner, be consulted along with Mrs. Trissel, on the projects that have been discussed in past Capital Improvement meetings. Mayor Lewis said he suggests a meeting be held April 11th to dis- cuss a new Capital Improvement Program with Mrs. Trissel, Mr. Bowman, and Mr. Sheldon contributing to the discussion and compiling pertinent information. Other Mayor Lewis thanked the committee appointed to look into the possible use of the old middle school building for preparing a report for Council. Also, he announced the promotion of the Dublin Technology Center which will be I located at the intersection of Post and Avery Road. Council Roundtable Discussion Mrs. Headlee thanked Mr. Thornton for his survey on the traffic exiting the Village Square shopping center. Mr. Sheldon asked Council if there was any objection to the Festival of Arts closing a portion of High Street in Dublin for their annual show. did not object. Mr,. Amorose welcomed Dan Sutphen to Council. He referred to the proposed Village nursery and a memo from the Forestry Commission. Mr. Sheldon suggeste1 he talk to Mr. Kris Miller, Vice Chairman of the Forestry Commission.
