Fonn No, 1097 ",'t~ 1I eld January 3, 1983 ID The regular meeting of Council was called to order by Mayor Lewis at 7:30 P.M. with the following members present: Amorose, Chambers, Headlee, Lewis, Maurer, Thornton. Mr. D'Alonzo was absent. Also present were Mr. Sheldon, Village Manager, Mr. Wolfe, Engineer, and Mr. Smith, Law Director. Mayor Lewis made a minor change in the minutes of the December 20th meeting. Mr. Thornton then moved, seconded by Mr. Amorose, to approve the minutes, as corrected. Vote on the motion was unanimous for approval. Mrs. Headlee moved, seconded by Mr. Chambers, to approve the bill listing for January 3rd. Vote on the motion was unanimous for approval. Ordinance No. 02B-82 Said ordinance regulating the use of geothermal wells was a tabled item. Mrs. Maurer requested it remain tabled until the January 17th meeting. Ordinance No. 67-82 Said ordinance to accept an annexation petition for 2.996 acres across from Grandview Drive on Dublin Road was read for the third time. Vote on passage of the ordinance was unanimous for approval. Ordinance No. 68-82 Said ordinance proposing the Annual Appropriations for Fiscal 1983 was read for the third time. Mrs. Maurer moved, seconded by Mr. Amorose, to amend the Appropriations for Transfers within the General Fund by $5,000.00 to go to the Building/Engineering Fund increasing the Appropriation for Transfers from $962,000.00 to $967,000.00. Vote on the passage of the motion and ordinance was unanimous for approval. Ordinance No. 69-82 Said ordinance to prohibit obscene conduct or obscene materials in the Village was read for the third time. Mr. Smith said he had additional material avail- able for Councilmember's consideration and therefore recommended the ordinance be tabled until a later date. Mrs. Maurer moved, seconded by Mr. Amorose, to table the ordinance. Vote on the motion was unanimous for approval. Ordinance No. 01-83 I Said ordinance to appoint members to the boards and commissions was introduced \ by Mrs. Headlee and read for the first time. Mrs. Headlee moved, seconded by \ Mr. Chambers, to reappoint Gerald Macklin to serve on the Planning and Zoning Commission for a term of four (4) years and to table appointments to the boards! and commissions in Sections 2-7 until after the Executive Session meeting scheduled for January lOth. Vote on the motion was unanimous for approval. I Mrs. Headlee then moved, seconded by Mrs. Maurer, to reappoint Mr. D'Alonzo as Council Representative to the Planning and Zoning Commission. Vote on the mo- tion was unanimous for approval. Resolution No. 01-83 Said resolution, to approve the vacation of 2' of easement on Lot 19 of Phase V of Waterford Village for a sanitary sewer, was introduced by Mrs. Maurer and read for the first time. Mrs. Headlee commented that in the future, more attention should be given to developers building on easements. Mr. Chambers suggested the surveyor of a development be held responsible for boundary lines rather than Council. Ordinance No. 02-83 Said ordinance, to amend the Fire Prevention Code by designating the Chief of the Washington Township Fire Department as the Fire Inspector for the Village, was introduced by Mr. Chambers and read for the first time. 153 RECORD OF PROCEEDINGS ).J imdes of VILLAGE OF DUBLIN ~b ).Jeetillg National Graphics Corp., Cols., O. Form No, 1097 '"~ ,-- II ehl January 3, 1983 19 Paqe Two Mr. Chambers commented on the fact that the Fire Inspector would be paid by another jurisdiction and approximately 50% of the area to be covered is outside of that jurisdiction. He questioned whether it will be satisfactory to the residents of the township to pay for this service to the Village. Mayor Lewis suggested Mr. Sheldon and Mr. Smith review this proposed amendment further from a legal standpoint and comment at the next regular meeting of Council. Appointment of Law Director Mrs. Headlee moved, seconded by Mr. Chambers, to reappoint Mr. Stephen Smith as Law Director as recommended by the Village Manager for a one year term to expire December 31, 1983. Vote on the motion was unanimous for approval. Discussion on Concept Plan for Old Section of the Middle School Mr. Chambers said since the committee has received only a part of the informa- tion needed, he would like to table the matter until the next regular Council meeting. All Councilmembers were in agreement. Other Mayor Lewis reported that the Washington Township Trustees have stated they are considering changing their meeting dates to the second and fourth Mondays of each month. This would permit the trustees and Councilmembers to attend each others meetings if so desired. Also, the Trustess recognize the possibility of the Village purchasing the ex- isting Fire Station building and surrounding property and agree to have a joint meeting with Council to discuss this prior to going to bid. Suggested dates were January 24th or 31st. A tentative date was set for January 31st. Mayor Lewis then suggested a special meeting early in February for the purpose of discussing the Capital Improvement Program. The date of February 14th was tentati vely set. Since February 21st is a holiday and the date for a Council meeting, Mayor Lewis asked Council if they would like to change the date. It was the general concensus of Council to meet on the regularly scheduled date, February 21st. Council Roundtable Discussion Mr. Chambers requested that the Village Manager arrange to have the building open one-half hour before special/regular meetings are scheduled. Other Councilmembers agreed this would be helpful. Regarding Mr. Sheldon's meeting with Harmon Merwin of M.O.R.P.C., Mr. Chambers asked that the subject of formation of a Township also be discussed. Mr. Smith thanked Council for another year of service. He spoke of the Billing~ sley Dltch problem and said he checked with the firm of John Gotherman, Cleve- land, who are experts in Municipal Law. Mr. Gotherman quoted a fee of $4,000- 7,000 to review his file on Billingsley Ditch. Mr. Smith then contacted the offices of Smith and Hale, as well as Bob Holland's office, Columbus, and while they would not be willing to enter into any litigation, they would write an opinion letter after reviewing any materials. Mr. Smith recommended reviewing the memorandum from Smith and Hale with the further option of looking further for another firm to review the case.
