Fonn No. 1097 "~ Held December 20, 1982 19 The regular meeting of Council was called to order by Mayor Lewis at 7:30 P.M. with the following members present: Amorose, Chambers, D'Alonzo, Headlee, Lewis, Maurer, Thornton. Also present were Mr. Sheldon, Village Manager, and Mr. Smith, Law Director. Mr. Amorose amended the minutes of the December 6th meeting by changing the datJ for a committee report and discussion on Ordinance No. 02B-82 from December 20tr to January 3rd. Mrs. Headlee moved, seconded by Mr. Thornton, to approve the minutes as amended. Vote on the motion was unanimous for approval. Mr. Amo- rose moved, seconded by Mr. Chambers, to approve the bill listing for December 20th. Vote on the motion was unanimous for approval. Ordinance No. 65-82 JI Said ordinance dealing with the keeping of dangerous animals was read for the third time. Mr. D'Alonzo moved, seconded by Mr. Amorose, to delete reference to the piranha since they are sold by pet stores in the area and since they could not survive in a fresh water environment. Mr. Amorose added to the motio to Use the word "venomous" reptiles instead of "poisonous." Vote on the motion to amend the ordinance and passage of the ordinance was unanimous for approval. Ordinance No. 67-82 Said ordinance, to accept a petition of 2.996 acres on Dublin Road to the Village, was read for the second time. Ordinance No. 68-82 Said ordinance proposing the Annual Appropriations for Fiscal 1983 was read for the second time. Ordinance No. 69-82 Said ordinance to prohibit obscene conduct or distribution of obscene material in the Village was read for the second time. Ordinance No. 70-82 Said ordinance to amend the 1982 Appropriations was introduced by Mr. Chambers J and read for the first time. Mr. Chambers moved, seconded by Mrs. Headlee, to dispense wi th the three-time reading rule and pass the ordinance by an emergenc ,. Vote on the motion and the ordinance was unanimous for approval. Announcements The Clerk read a portion of a letter from Mr. Parkinson, Department of Public I Services, in which he reported an increase in the water, sewer, and drainage rates which will be effective January 1, 1983. A letter from Jacob Shawan was also read which gave the results of the Dublin Fund dinner dance. A total of $9,399 was received after all bills were paid and this amount will be matched by the Columbus Foundation. Mayor Lewis com- mended those persons on the Dublin Fund committee for their contribution to the Village. Mrs. Headlee also expressed appreciation for Mr. Shawan's service to the community through the Dublin Fund. Mayor Lewis referred to the ordinance which established the Fund committee and said he would like to request that Mr. Shawan be appointed to serve another year on said committee. There was a discussion as to whether it was Council's responsibility to make this appointment. Mr. Chambers moved, seconded by Mr. D'Alonzo, to appoint Mr. Shawan to the Dublin Fund for another year if it was legally acceptable for Council to do so. Form No. 1097 ~_~" Held December 20, 1982 19 Page Two Committee Report Re: Middle School BUilding/Muni Building expansion Mr. D'Alonzo said the committee has looked at the cost effectiveness, the accesJ, and convenience of the Village using the old section of the Middle School as J office space for various departments of the Village. He said he would like to see a list of the Village's requirements over the next 3-5 years in order to consider that along with a concept plan of the building. Mr. Sheldon said it i possible an .archi tect' s concept plan would cost approximately $400-$500 or more., Council did not object to this estimated expense. I Discussion of Columbia Gas rates - Law Director Mr. Smith asked for a recommendation from Council as to whether they would like I the Consumer's Counsel to represent Dublin in the Columbia Gas Rate increase which has been filed with PUCO. Mayor Lewis explained that he and Mr. Thornton will be meeting with Columbia Gas and suggested a decision be made after that meeting whether or not to ask for the Consumer Counsel's assistance. Report of Committee on Billingsley Ditch Study Mr. Amorose said the committee met on December 9th with Mr. Eifert, Columbus Engineering Consultants, Ltd. He reported recommendations made by the committee and Mayor Lewis asked that he provide a copy to each Councilmember for their consideration. After a discussion, Mr. Chambers moved, seconded by Mr. Amorose, that the Law Director be asked to look at the Committee's comments on the study and the study itself, secure such second opinions and make a recommendation to Council by the first meeting in January. Fire Hydrant Maintenance - Washinqton Township Fire Board In reference to his memorandum on a new contract for fire hydrant maintenance with Washington Township, Mr. Sheldon explained the new contract would require the Village to pay $30,rather than $20,per hydrant. Mr. D'Alonzo moved, seconded by Mrs. Headlee to permit the Village Manager to enter into a contract with the Washington Township Fire Board to pay $30 per hydrant. The motion passed with the vote as follows: 5 Yeas _ iD'Alonzo, Headle3, Lewis, Thornton, Amorose; 2 Nays - Chambers, Maurer. Discussion of Meeting with Fire Board and Recommendations Mr. Chambers summarized the results of attending the Fire Board Meeting of December 13th. He said at this time he feels there is no possibility of reach- ~ng any sort of accomodation with the Fire Board or of getting answers to questions that were asked concerning the splitting of the Fire Departments. Mr. Chambers then moved, seconded by Mr. Thornton, that the Dublin Council de- clare its intention to petition with the Franklin County Commissioners to form the township of Dublin within Franklin County under the provisions of Section B03.07 of the Ohio Revised Code. The Village Manager is requested to obtain special legal counsel to work with Village Council and the administration in achieving that purpose in a rapid and orderly manner. The motion failed with the vote as follows: 2 Yeas - Chambers, Thornton; 5 Nays _ Headlee, Lewis, Maurer, Amorose, D'Alonzo. Form No. 1097 ",8" 1I eld December 20, 1982 19 Page Three After further discussion, Mr. D'Alonzo moved, seconded by Mr. Chambers, that the Mayor appoint a committee to commence negotiations with Washington Township I for the provision of fire and emergency services following the transition from Village to city and township status. The motion failed with the vote as follows: 3 Yeas - Amorose, Chambers, D'Alonzo; 4 Nays - Lewis, Maurer, Thorntor, Headl ee. Mayor Lewis then requested that Mr. Sheldon invite Mr. Herman Merwin, MORPC, to converse with the Planner, Law Director, and Mr. Sheldon, and discuss a transi- tion from Village to city and township status for the purpose of possibly mak- ing a more formal report to Council. Other I I I Council Roundtable Discussion , Mr. Thornton expressed concern of the sale of the present Fire Station building and suggested the Village make a bid on that site. Mayor Lewis said the presen post office will also be for sale in the near future and consideration should be given to that site as well. Mayor Lewis announced that trustees of the Dublin Fund have requested consider- ation be given to forming an arts counsel in Dublin. In the meantime, he said an additional request has been made to arrange for the Columbus Symphony Orchestra to perform in a park in Dublin next spring. He asked Council if there was any objection to Dublin paying $2,500 with the provision that the Dublin Fund would pay $5,000 to cover the total cost of $7,500 for this per- formance. There was no objection and Mr. Sheldon will make application to the Dublin Fund for this performance. Mrs. Headlee wished everyone a Merry Christmas and a Happy New Year. Mr. D'Alonzo reported on the P&Z meeting of December 7th. He reflected on the past year as a new Councilmember and expressed gratitude for those Dublin resi- dents who give their time serving on the various boards and commissions. Mrs. Maurer also expressed interest in bidding for the Fire State site. She I also thanked those persons who have served on the boards and commissions for their time. Mr. Amorose asked Mr. Sheldon to contact the representative of Dale Properties in regard to erosion, etc. along Dale Drive. Mr. Chambers said now that Dale Drive is completed he would like to move that a left hand turn onto Riverside Drive from the shopping center be prohibited and instead direct the traffic to Dale Drive where a left hand turn onto said drive would be permitted. Mr. Amorose seconded the motion. The vote was unani- mous for approval. He also commented on the fee charged for an overtime parking citation and sug- gested a reduction in cost be considered. Form No. 1097 "~ Hchl December 20, 1982 19 Page Four Mayor Lewis reported that the policy for expired licence stickers has been changed so that a person who has been ticketed may continue to drive until he purchases a valid sticker. If this is done with 24 hours of issuance of the citation and the expired sticker does not exceed ten days, the fine is dis- missed. He commented on the parking fines and said he would like to propose a 90-day trial period in which a fee of $5.00 would be charged for overtime parking, suspending court costs, and permitting the violator to mail the fine to the I Police Department. There were no objections from Council. Mayor Lewis said he would request this procedure begin immediately. Mayor Lewis thanked those persons in the audience who regularly attend Council meetings. He thanked Council for their cooperation and wished everyone a Merry Christmas and Prosperous New Year. Mayor Lewis adjourned the meeting at 9:45 P.M. ~ . ii );I.
