Form No. 1097 .",~ II dd September 7, 1982 19 The regular meeting of Council was called to order by Mayor Lewis at 7:30 P.M. with the following members present: Amorose, Chambers, D'Alonzo, Headlee, Lewis, Maurer, Thornton. Also present were Mr. Strutner, Acting Village Manager, Mr. Wolfe, Village Engineer, and Mr. Smith, Village Law Director. Mr. Amorose moved, seconded by Mr. Chambers, to approve the minutes of the August 16th meeting. Vote on the motion was as follows: 5 Yeas - Amorose, Chambers, D'Alonzo, Lewis, Thornton; 2 Abstentions - Headlee, Maurer. Mr. Thornton questioned the bill listing of Vance's Shooters Supplies and Mr. Strut- ner explained that the bill was for ammunition used for the Police Departments semi-annual fire arms qualifications test. Mr. Thornton also questioned the bill of C. E. Williams for $5,118.43 for modi fications to Frantz Road Intersec- i tion and bridge intersection analysis. Mrs. Trissel, Finance Director, was not present at the time to clarify the bill. Mr. Chambers then moved, seconded by Mr. Thornton, to approve the bill listing excluding the C. E. Williams bill. Vote on the motion was unanimous for approval. Later in the meeting, Mrs. Trissel explained the bill of C. E. Williams was a combination of the two sep- arate items. Mr. Thornton then moved, seconded by Mrs. Maurer, to pay said bill. Vote on the motion was unanimous for approval. Mayor Lewis briefly reported on the Annual Mayor and Municipal Officials outing held at the Rickenbacher Air Force Base the end of August. He also announced the awards presented to those who participated in the golf tournament. The Clerk read a letter received from the Franklin County Board of Elections notifying Council that the question of whether or not to permit the Sunday sale of liquor in Precincts Band C, Ward 4, would be on said precinct's ballot ,November 2. The applicant is Rivera Country Club. Appeal of Electronic Game Ordinance - P.J. Abbott Mr. Abbott was present to request a variance of Ordinance No. 26-82 pertaining to the licensing of electronic game machines. Mr. Smith said in reviewing the ordinance (page 8, paragraph 10, item 2 in particular) ". . . the appellant process for an applicant whose license is denied or whose license is suspended or revoked would come before this body . . . and ask for a hearing of the entire committee of Council. He said since Mr. Abbott is requesting permission to have three (3) additional games installed at the Dari Twist, the appeal process does not apply. He suggested an amendment to the ordinance should be consid- ered in which six (6) games would be permitted. Mr. Abbott read a letter from Mr. Sheldon in which he was advised to appear before Council to request a variance. Mr. Chambers said it was his understand- ing that this was the procedure to follow. After further discussion, Mayor Lewis asked for a recommendation from Council as to whether they felt there is a provision in the ordinance to grant a variance or whether the variance should be introduced as an amendment. Mr. Thornton suggested that those persons in thE audience to speak for the amendment/revocation of the ordinance be permitted to speak before any decision was made. Those persons present were: Marsha Scherer, William Large, Marty Cummins, Frank E. Myers, Steven Shorts, Nancy Monaghan, Carol Irion, Chris Bivertein, and Jim Abbott. Generally, they felt the ordin- ance was unconstitutional, imposing legislators' opinions on other people, an infringement on the business enterprise system, forcing Dublin youth from the area, and discouraging businesses that provide entertainment for the children from coming to Dublin. Mayor Lewis appointed Mrs. Maurer, Mr. Thornton, and Mr. Smith to meet with Mr. Sheldon to review the comments received regarding the game ordinance. He said he would like said committee to devise questions/procedures as to what action should be considered either in the form of an amendment, removal, or no action at all. Mayor Lewis asked that the committee report back to Council at the September 20th or October 4th meeting. He encouraged other Councilmembers to attend the committee meeting if they so desired. Form No. 1097 "cL~ Held September 7, 1982 19 Page Two Mr. Chambers moved, seconded by Mr. Thornton, that the variance be granted at this time with the understanding that if,:,tbe appointed corbrbitteelcomes up wi th ~ different solution, the applicants will abide by the decision of Council re- garding that solution. After further discussion, Mr. Chambers withdrew his motion. Mr. Chambers then moved, seconded by Mr. Thornton, that the request of the Abbott's be tabled for further consideration at the next meeting of Council. Vote on the motion was unanimous for approval. Ordinance No. 46-82 Said ordinance to amend Section 2.04 (2) of the Village Income Tax reyulations was read for the third time. The ordinance was unanimously disapproved. Ordinance No. 47-82 Said ordinance to amend Ordinance No. 81-80 regarding sewer and water benefit surcharge capacity fees was read for the second time. Ordinance No. 48-82 Said ordinance requiring application of the C. E. Williams Traffic Study as a guideline was read for the second time. Mr. Chambers moved, seconded by Mr. D'Alonzo, to table the ordinance until a committee is appointed and has had an opportunity to review the C. E. Williams recommendations and the comments from the Planner and P&Z Commission to formulate a final recommendation to Council. Mr. D'Alonzo)and Mr. Chambers were appointed to serve on the committee.' Vote on the motion was unanimous for approval. Ordinance No. 49-82 Said ordinance, authorizing the issuance of notes in the amount of $320,000 for the purpose of improving Glick Road, was introduced by Mrs. Headlee and read for the first time. Mrs. Maurer moved, seconded by Mrs. Headlee, to dispense with the three-time reading rule and pass the ordinance as an emergency and to accept the bid of Huntington National Bank at 7.95 per cent interest rate. Vote on the motion and the ordinance was unanimous for approval. Ordinance No. 50-82 Said ordinance, to accept the lowest/best bid for Glick Road improvements, was introduced by Mr. Chambers and read for the first time. Mr. Chambers moved, seconded by Mr. D'Alonzo, to dispense with the three-time reading rule and pass as an emergency. Mr. Chambers then moved, seconded by Mrs. Maurer to accept the bid of Northwood Paving Company at $330,525.40 which included the Base Bid and Alternate "A". Vote on the motions and ordinance was unanimous for approval. Ordinance No. 51-82 Said ordinance, amending the Building Code pertaining to the issuance of the Building Permit, was introduced by Mr. Thornton and read for the first time. I Ordinance No. 52-82 Said ordinance, to accept the lowest/best bid for the Scioto Park improvements, was introduced by Mr. Chambers and read for the first time. Mrs. Headlee moved seconded by Mr. Amorose, to dispense with the three-time reading rule and pass the ordinance as an emergency and accept the bid of Dryden, Inc., at $123,195.01. The motion passed with the vote as follows: 5 Yeas - Amorose, Chambers, HeadleE, Lewis, Maurer; 2 Nays - D'Alonzo, Thornton. Mr. Phil Hill was present to comment on the projects that were chosen to be com pleted this year. Mr. Amorose asked about the possibility of installing a fence along the north and south sides of the park to eliminate trepassing onto private property. Mayor Lewis suggested acquiring recommendations as to what the most effective type of fencing would be for this purpose before approving I this project. Form No. 1097 ""S"" Held September 7, 1982 19 Page Three Ordinance No. 53-82 Said ordinance to amend the Traffic Code, Section 373.02 (e) pertaining to bicycles, mopeds, or motorcycles was introduced by Mrs. Maurer and read for the[ 'first time. Mr. Amorose questioned why only the motorcycle was cited in refer- ence to the height of handle bars. Mr. Smith said he would check on that sec- tion. Resolution No. 21-82 Said resolution to accept easement for sanitary sewer construction was intro- duced by Mr. Thornton and read for the first time. Mr. Chambers moved, second- ~d Mr. Thornton, to dispense with the three-time reading rule and pass the resolution as an emergency. The motion and resolution was passed with the vote as follows: 6 Yeas - Amorose, Chambers, Headlee, Lewis, Maurer, Thornton; I Abstention - D'Alonzo. Ordinance No. 54-82 Said ordinance to fix rates charged by Columbia Gas of Ohio was introduced by Mayor Lewis and read for the first time. This is the Village's ordinance in response to Columbia Gas's Ordinance No. 21-82. (See paragraph under Other.) Other Mayor Lewis referred to a request from Coalition for Cost Effective Health Ser- vices asking the Village to contribute $147.00 toward their budget. In their letter of August 26th, they said the purpose of the Service was to promote the highest quality health care at the most reasonable cost to the citizens of I Franklin. Mayor Lewis asked Council members whether or not they would like to take action on this request. Mrs. Headlee said she would like more information [ such as how the Mayor's Council feels about this Service. Mayor Lewis asked Mrs. Headlee to research and report her findings to Council at the September 20lh meeting. I Ordinance No. 02-82 I Mrs. Maurer referred to said ordinance dealing with geothermal wells and per- ' mits for drilling wells for that purpose. Presently the ordinance is tabled I and she requested that it be removed from the table at the September 20th meet-I ing and be treated as a first-time reading. I Swimming Pool Project I In regard to a memorandum from the Parks and Recreation Committee on a proposed I outdoor swimming pool,as well as a memorandum from the Dublin School Board and I the Village Council Liaison Committee regarding the same issu~ Mayor Lewis sug- I gested the Parks and Recreation Committee/a representative meet with the Liaisori Committee and establish some guidelines for proceeding in regard to the two recommendations. Council concurred with this suggestion. Columbia Gas Fixed Rates Increase Mayor Lewis explained what effect the Columbia Gas Company's proposed Ordinance No. 21-82 would have on the Village's gas rates. He said the Village received a notice from Columbia Gas that since Ordinance No. 21-82 had not been acted on they were in the process of filing with PUCO to have them set the rates for Dublin. Mayor Lewis said he then met with Mr. Sheldon and Mr. Smith and it was decided to offer Ordinance No. 54-82 to Columbia Gas. They rejected said ordin ance but said they would draw up a new proposed ordinance based on the formula of Ordinance No. 54-82. Mayor Lewis said he has not received the new proposal as yet but if it is not acceptable, he suggests allowing Columbia Gas to proceec with filing their case with PUCO. Form No. 1097 c,:(~ II elel September 7, 1982 lD Page Four Helicoptor Crash in Muirfield Mr. D'Alonzo referred to the helicopter crash that occurred Friday, 5eptemb@f3 d in Muirfield. He said this incident prompted him to ask and seek answers to I the following questions: I. Are there any regulations that govern the height of aircraft moving over residential neighborhoods? 2. Are there any regulations that govern where helicopters can land in Muirfield. If so, how can these regulations be reviewed? 3. Who should residents voice their concerns to? Are there any other organizations investigating such incidents besides FAA? 4. Is it possible for Council to receive a report on what happened and why? 5. What authority does Council have, possibly through P&Z, to govern this type of activity in a residential area? 6. What provisions were made in the final plans that were filed by Muirfield concerning landing sites for helicopters. Was it or was it not authorized? He said he would like these questions answered by the next Council meeting. Mrl Strutner said he would follow up on this request. Mr. Chamber's suggested the Village Manager provide an ordinance which would I designate approval of helicopter landing sites in advance of their use. Deadending of Thornhill Lane Mayor Lewis informed Mr. Hawk. , resident of Thornhill Lane, that Mr. Sheldon I expects to receive an appraisal of another resident's property (Mr. Vlhaos) by September 15th. He said further action would then be taken at the Council meeting of September 20th. Council Roundtable Discussion Mr. Thornton referred to the COTA bus now available to Dublin area residents. He said he rode the bus to downtown Columbus and returned in a short period of time.and urged others to make use of the service. Mrs. Headlee commented on the Frantz/161/33 intersection presently under con- struction. She said someone is moving the barricades in that area which could cause a serious accident. She said some thought needs to be given as to who is liable should an accident occur. She also mentioned traffic in excess of the speed limit along Avery Road, Brand Road, and Muirfield Drive and asked that this be looked into. Mr. D'Alonzo reported, as Council representative to the School Board, that said Board plans to conduct a demographic study for the school district to analyze population trends. He said the members of the School Board indicated they were anxious to discuss the design and purpose of the study with appropriate Village officials to insure maximum "utility," from both points of view, from the study He said the School Board also requested the Village Council support the upcom- ing school levy by way of a resolution. Mr. Chambers made a motion that the Village Manager is requested to immediately enter into such negotiations as he may think proper looking toward an early date at which the Dublin Police Department will assume control of its own commur- ication facilities. The motion failed with the vote as follows: 2 Yeas - Chambers, Thornton; 5 Nays - D'Alonzo, Headlee, Lewis, Maurer, Amorose. Mr. Smith commented on the Columbia Gas Company ordinance. He suggested that the Village Council join the Consumer Counsel to fight the rate increase. Also, referring to the Electronic Games Ordinance, he said he believed if the ordinance was tested in a court of law it would be found constitutional. For the record, he stated his office does not make recommendations to Council to vote for or against an ordinance. Mr. Strutner announced that Friday Dublin will employ its first woman Police Officer. Mr. Wolfe reported on the Glick Road Improvement plans. Mr. D'Alonzo suggested he notify the residents of the proposed work to be done on Glick Road.
