Form No. 1097 ",2"" Held August 16, 1982 19 The regular meeting of Council was called to order by Mayor Lewis at 7:30 P.M. with the following members present: Amorose, Chambers, D'Alonzo, Lewis, Thorn ton. Mrs. Headlee and Mrs. Maurer were absent from the meeting. Also present were Mr. Sheldon, Village Manager, Mr. Wolfe, Village Engineer, and Mr. Smith, Village Law Director. Mr. Amorose corrected the last sentence of the paragraph heating units to read ". . . he has encountered with his Mr. Thornton moved, seconded by Mr. Chambers, to approve ed. Vote on Mayor Lewis thanked Mr. Chambers for serving as Acting Mayor from August 13th to the morning of August 16th. The Clerk read a letter from Mr. Reidel, Superintendent of Dublin Local School~, thanking Council for the construction of the barrier on 161 across from the Middle School. A letter from Mr. Fleming, Vice Presdient of Operations, Adria Laboratories, was also read thanking the Village for the waiver of $19,000.00 toward utility tap fees. Ordinance No. 36-82 Said ordinance proposing read for the third time. the ordinance. to rezone 20 acres in Muirfield from Rl to P.U.D. was All those present voted in favor of the passage of I Ordinance No. 44-82 ~ Said ordinance, to appoint a member to the Parks and Recreation Commission to fill the unexpired term of Mel Shaver, was read for the second time. Mr. Cham bers moved, seconded by Mr. Thornton, to nominate Julie Wall and to dispense with the three-time reading rule and pass the ordinance as an emergency. Vote on the motion and the ordinance was unanimous for approval. faJ I I Mr. Curtin provided Council with an itemization of what would be accomplished I by passage of the ordinance. They were: Ordinance No. 46-82 Said ordinance to amend Section 2.04 (2) of the Village Income Tax was read the second time. Mr. Robert Curtin and Mr. Tom Nolan, Columbus Income Tax administrators, were present to comment on the ordinance. 1. More compatibility with approximately 70% of other municipal income tax ordinances in the state of Ohio. 2. The essential change from the existing income tax ordinance is that net losses from unincorporated business activities will no longer be allowed as an offset against a taxpayers' W-2 income. 3. There will be no impact resulting from this change during 1982. It will, however, result in reducing the amount of refunds made in 1983, thereby providing greater net tax dollars for the city. Mayor Lewis, Mr. Chambers, and Mr. Thornton each expressed the fact that it appeared the amendment would not benefit the taxpayer but rather the tax col- lector and the auditors. Form No. 1097 .,.~ Held August 16, 1982 19 Page Two Mr. D'Alonzo asked whether there has been a number of problems with residents of Dublin and net losses from unincorporated business activities. Mr. Curtin said the initial reason for the legislation is that Dublin tax laws would be uniform with that of Columbus' tax laws. Mr. Curtin said if Dublin does not approve the ordinance, Columbus will be required to notify practictioners of the variance in Dublin's tax laws and it would require additional work for tax authorities. Mayor Lewis said the amendment appears to be for the convenience of the tax collector and counselor, however, the Council will give additional thought to the ordinance. He thanked Mr. Curtin for appearing to answer questions and to further clarify the intent of the legislation. Ordinance No. 47-82 Said ordinance, to amend Ordinance No. 81-80 which established sewer and water benefit surcharge capacity fees, was introduced by Mr. Chambers and read for the first time. I Ordinance No. 48-82 I Said ordinance requiring consideration of the C. E. Williams Traffic Study for I zoning changes, variances and conditional uses, was introduced by Mr. D'Alonzo and read for the first time. Mr. Smith provided copies of an amended ordin- ance for Councilmembers. Mr. Chambers stated he preferred legislation which would set more specific guidlines for the developers. Discussion of Bird and Bull Memo Mr. Richard Bull was present to speak for the Dublin Building Systems, Inc. He said the company is considering development of an industrial park on a 22.390 acre tract at the southwest corner of Shier-Rings Road and Wilcox Road which is adjacent to the corporation limits of Dublin (Shamrock Park). I I Mr. Bull said Mr. Vic Irelan, owner of said property, would like to install an I 18" sanitary sewer system, li ft station, and force main and pump into an ex- J isting manhole on the 8" Shier-Rings Interceptor sewer located at the northeas~ corner of Shier-Rings Road and Wilcox Road. He said this sewerline increases in size to 15" and eventually ties into the 21" Cosgray Ditch Interceptor Sewer which terminates just west of Interstate 270. Mr. Bull asked Council to consider joining with the developer and participating in the cost between the presently required 8" sewer and the 18" line that would be required in the future. He estimated the cost of the difference in size would be $10.00 to $15.00 per lineal foot or approximately $18,000.00 total. Mayor Lewis asked Mr. Bull to discuss this with the Planner and Engineer and the Planning and Zoning Commission. He said Council would then consider that body's recommendation. Other Mayor Lewis announced the Ohio Edison Company is planning to make application with P.U.C.O. to increase their rates. He said a public hearing will be held on or about November 9th and for those serviced by Ohio Edison and who are concerned with the increase to make a note of that approximate date. Council Roundtable Discussion Mr. Thornton commented that since the Hayden Run Bridge is presently closed, he notices the increase in traffic through Dublin. He said it further proves the need for something to be done with the 161 bridge as soon as possible. Form No. 1097 .,~ Held August 16, 1982 19 Page Three Mr. D'Alonzo mentioned the recent decision of the Ohio Department of Health disapproving construction of the CHAMA hospital in Dublin. He said he thought the entire matter had been handled in an unsatisfactory manner by disregarding I preferences of the residents of Dublin. He hoped the recent decision would not affect the consideration of Riverside Hospital. He commented on the Planning and Zoning Commission's recommendation that the electronic games ordinance remain unchanged at this time. He said he felt there were two items that should be clarified or deleted and he would suggest these amendments sometime in the near future. He expressed a desire to be~in work on a Master Plan which can be used by all recommending Boards and Commissions of the Village. Mr. Chambers reported he would have a motion ready at the next Council meeting I which will direct the Village Manager to enter into negotiations to either take over the communication facilities of the combined Police Departments or to es- tablish new facilities for the Village. Mr. Hawks, resident of Thornhill Lane, was present to ask if anything further had been done to proceed with deadending Thornhill Lane. Mr. Sheldon said Mr. Vlahos had fifteen (15) days from the date of the delivery of the resolu- tion to respond which would be August 20th. He said if no response is received from Mr. Vlahos, additional steps will be taken to proceed with the plan. ; Mayor Lewis adjourned the meeting at 8:40 P.M. /J ~ 711 tkJ?W7?"
