Form No. 1097 ""iL:JJ;;o Held June 21, 1982 19 The regular meeting of Council was called to order by Mayor Lewis at 7:30 P.M. with the following members present: Amorose, Chambers, Headlee, Lewis, Maurer Thornton. Also present were Mr. Sheldon, Village Manager, Mr. Wolfe, Village Engineer, Mrs. Trissel, Finance Director, and Mr. Smith, Law Director. Mr. D'Alonzo was absent from the meeting. Mrs. Maurer amended the minutes of the June 7th meeting. She said those persons resent to oppose the electronic games ordinance asked that said ordinance be rescinded and not "that the committee be reactivated to discuss possible amend- ents to the ordinance." Mrs. Maurer then moved, seconded by Mr. Thornton, to pprove the minutes as amended. Vote on the motion was unanimous for approval. rs. Headlee moved, seconded by Mr. Chambers, to approve the bill listing for une 21st (attached). All those present voted in favor of the motion. rdinance No. 33-82 aid ordinance dealing with the proposed Tax Budget for the Fiscal 1983 and the roposed use of Federal Revenue Sharing Funds, was read for the second time. his being a public hearing on the ordinance, Mrs. Trissel explained the pur- ose and clarified the format of the budget to the public. rdinance No. 27-82 Said ordinance proposing an agreement with the Dublin Historical Society to leas the Coffman property was a tabled item. Mrs. Headlee moved, seconded by Mr. Chambers, to remove the ordinance from the table. Vote on the motion was unani- mous for approval. Mr. Chambers made a motion, seconded by Mr. Thornton, to amend Section 6, Re- pairs, Maintenance, and Renovations, of the Agreement to add a paragraph as follows: To delineate the fact that in the event that a disagreement arises as to the direction of the Village Manager to commence with repairs/main- tenance to the facility, that such disagreement shall be decided by a majority vote of Dublin Village Council. r. Smith asked Mr. Robert Reese, President of the Society, if he would agree to his amendment. Mr. Reese agreed to the addition of the paragraph. Vote on the otion and ordinance was unanimous for approval. rdinance No. 84-80 aid ordinance to ban the sale of drug paraphenalia was a tabled item. After di - ussing the recent ruling by the Supreme Court and the changes made in the ori- inal ordinance, Council concurred to reintroduce the ordinance at the July 7th eeting and treat it as new legislation instead of removing the present ordinanc rom the table. esolution No. 15-82 aid resolution to confirm the adoption of f Agreement was read for the third time. as unanimous for approval. an amendment to M.O.R.P.C.'s Articles Vote on the passage of the resolution rdinance No. 32-82 aid ordinance to accept an annexation of a 1.973 acre tract in the "Dublin Es- ates" to the Village of Dublin was read for the second time. rdinance No. 35-82 aid ordinance to appoint a person to fill the unexpired term of William Easter- ay on the Parks and Recreation Committee was read for the second time. Mr. hambers moved, seconded by Mr. Thornton to nominate Michael Cleveland to serve n the committee. Mr. Chambers then moved, seconded by Mr. Amorose, to dispense ith the three-time reading rule and pass as an emergency. Form No. 1097 ,'W.", II del June 21, 1982 19 Page Two Resolution No. 18-82 Said resolution authorizing the City of Columbus to place a fifty-four (54") inch culvert under Sawmill Road was read for the second time. Ordinance No. 36-82 Said ordinance dealing with the rezoning of 20 acres in Muirfield to P.U.D. was introduced by Mrs. Headlee and read for the first time. Mrs. Headlee moved, seconded by Mr. Amorose, to forward the ordinance to the Planning and Zoning Commission for their consideration and recommendation. Vote on the motion was unanimous for approval. Ordinance No. 37-82 Said ordinance to amend Ordinance No. 52-81, the Compensation Plan for Employeec of the Village, was introduced by Mrs. Headlee and read for the first time. Mr Sheldon explained that this amendment was for the purpose of adding a classifi-1 cation/salary for the newly hired Village Planner. Mr. Thornton moved, seconde by Mr. Amorose, to dispense with the three-time reading rule and pass as an emergency. Vote on the motion and ordinance was unanimous for approval. I Ordinance No. 38-82 Said ordinance proposing an amendment to the Landscape Ordinance pertaining to landscaping of sites altered or expanded [Section 1183.07 (c) (2)] was intro- duced by Mr. Amorose and read for the first time. I 1 Meeting dates for July and September \ Because the first Council meetings of the months of July and September fall on I National Holidays (July 5th and September 6th) Council concurred that the meet-I ing dates should be changed to Tuesdays, July 6th and September 7th. The I second meeting of the month would then be held July 19th and September 20th. I Consequently, the Planning and Zoning meetings will be held July 7th and Septemi ber 8th. I I i I I Adria Request for Waiver of Tap Fees Mayor Lewis referred to a memo regarding said request. Mr. Sheldon explained the reasons involved and Council concurred to discuss it further at the July 7th meeting. Mayor Lewis suggested considering items three (3) and (4) of the request, excluding item six (6). Discussion of Rt. 33-161 and Expansion of the Bridge Mayor Lewis mentioned a meeting that was held June 21st with representatives of O.D.O.T., M.O.R.P.C., Franklin County and representatives of the Village to further consider the recommendation of the expansion of said roads and bridge. Mr. Emmett Karrer was present to comment on the recommendations. He thought it would be most advantageous to reconstruct the present bridge to four lanes rather than build a new bridge. He preferred two four (4) foot sidewalks rather than one (1) eight (8) foot sidewalk. Mayor Lewis summarized past discussions and said consideration is now being given to dividing the projects into phases. He said Phase I would be four-lan- ing the bridge with some modifications for the intersections, Phase II, the expansion of 161 from Frantz Road to the Bridge, and Phase III would be the expansion of 161 from Riverside Drive to Sawmill. Mayor Lewis said if Council would agree at this time to proceed with four-laning the Bridge, there is a 1 possibility it could be scheduled as early as 1984. 51 RECORD OF PROCEEDINGS M irlldes of VILLAGE OF DUBLIN national graoo!CS Meeting National Graphics Corp., Cols., O. Form No. 1097 ,,;~ 11 eld June 21, 1982 19 Mrs. Maurer moved, seconded by Mr. Chambers, to proceed with the necessary to have Phase I placed on the "fast track" schedule. \ st~t \ Paqe Three Enqineering Proposals for Frantz Road Referring to proposals for engineering work for the design of Frantz Road. Mayor Lewis requested that Council approval be given to the low bidder for said project. Mr. Thornton moved, seconded by Mrs. Maurer, to accept the low bid of Burgess and Niple at $38,500. Vote on the motion was unanimous for approval. Mr. Chambers added that while he is not against this improvement, he feels that Council is again acting on a single action instead of a whole Capital Improve- ment Program. Request from Dublin Abbey Players Council received a letter from Sherri Erickson, President of Dublin Abbey Players, requesting permission to use the Council Chambers for a play scheduled the last two weeks in January. Council concurred to approve the request. Billinqsley Ditch Study Mayor Lewis referred to Mr. Sheldon's memorandum regarding Billingsley Ditch and the fact that M.O.R.P.C. 's Policy Committee disapproved of their staff con- ducting this study. Mr. Sheldon then obtained quotations from other engineer- ing firms. Mr. Chambers moved, seconded by Mr. Amorose, to authorize the Mana- ger to enter into a contract with the low bidder, Columbus Engineering Consul- I tants, at $4,600. Vote on the motion was unanimous for approval. I Other I In reference to Ordinance No. 21-82 which proposes to fix and regulate gas 1 rates in Dublin, and which is presently tabled, Mayor Lewis said he had receive a revised ordinance and it will be submitted to Council for consideration at the July 7th meeting. Mayor Lewis said the revision to said ordinance resultedi from a number of regional meetings held by the Consumer's Counsel. I I Mrs. Headlee questioned whether the Glick Road repair would be completed by thel time school starts in the fall. Mr. Wolfe explained that the plans are not com+ pleted but should be by July. Since bids would need to be taken after the Plan1 are approved, he said he did not expect the project to be completed by the time school starts but should possibly be completed before the winter months. I Mr. Chambers said he thought consideration should now be given to more office space in the Municipal building. He asked that an analysis be made as to what can be done to provide more space in the building for the future. I Mrs. Maurer referred to the request of the Law Director at the June 7th meeting to register objections to the renewal of any liquor licenses by August 31st. She asked whether the Police Department might have comments concerning this matter. Council Roundtable Discussion In reference to the proposed Geothermal Well Ordinance No. 02-82 (tabled Janu- ary 18, 1982), Mrs. Maurer said she had learned a report that was to be made by various Ohio agencies (see February 15th minutes) on testing supply wells would not be available for some time because of budget cutbacks. She, therefore, suggested Mr. Smith look at the report prepared by her and Mr. Amorose, meet with them, and possibly update the proposed ordinance with these recommendation~. She said she would like the ordinance removed from the table within the next couple of meetings of Council. Form No. 1097 .,;~ II eld June 21, 1982 19 Paqe Four Mayor Lewis suggested that Mrs. Maurer and Mr. Amorose prepare a statement as to the object/purpose of this legislation. Mayor Lewis said he agreed with Mr. Chambers' comments pertaining to space in the Municipal building. He said he would like to see a three to five year study done by an architectural firm who would advise Council as to what could be done to provide more space. He asked Mr. Sheldon to take the necessary steps to accomplish this project. Mayor Lewis mentioned the design review legislation that the Architectural Re- veiw Board has prepared and submitted to Councilmembers. He suggested no ac- tion be taken at this time and especially until the new Planner, Patrik Bowman, has had an opportunity to review this legislation. Mr. Sheldon expressed his appreciation to Emmitt Karrer for assistance In dis- cussing the proposed traffic plans for the Village. Mr. Reese, President of the Dublin Historical Society, thanked Council for approval of the lease of the Coffman property to be used by the Society. He said now that the Society has a home, he feels there will be many more histori- cal gifts donated to the Society. Mr. Shawan, from the audience, expressed concern that the Dublin C.I.C. had not I met for several months. Mr. Carstens said the main purpose of the organization was to approve Industrial Revenue Bonds. Since there have not been any bond lssue requests, there has not been a need for the organization to meet. Mayor Lewis adjourned the meeting at 9:20 P.M.
