The regular meeting of Council was called to order by Mayor Lewis at 7:30 P.M.
with the following members present: Amorose, Chambers, D'Alonzo, Headlee,
Lewis, Maurer, Thornton. Also present were Mr. Sheldon, Village Manager, Mr.
Wolfe, Village Engineer, and Mr. Smith, Law Director.
Mr. Thornton, Mr. Chambers, and Mr. D'Alonzo amended the minutes of the Febru-
ary 1st meeting. Mrs. Maurer then moved, seconded by Mr. Thornton, to approve
the minutes as amended. Vote on the motion was unanimous for approval. Mrs.
Headlee then moved, seconded by Mr. Chambers, to approve the bill listing for
February 15th. Vote on the motion was unanimous for approval.
Ordinance No. 58-81 - Public Hearing
Ordinance No. 58-81, proposing to rezone 39+acres in Muirfield to P.U.D., was
read for the second time. This being a public hearing, those persons for and
against the rezoning were asked to sign their names in order to speak during
the discussion.
Mr. Howard Adams was present, representing Muirfield and to speak for the ordin
ance. He said the Muirfield Golf Club owns 60 acres under an option and the
reason they are asking for the rezoning on the 39+ acres only is because the
current owner, Mr. Tibbals, was willing to give Muirfield the option subject
to zoning for parking/housing. He said this area will be used for parking
approximately one week out of the year for the Memorial Tournament and would
remain open space the balance of the year.
Dr. Mand, resident of River Forest, commented on the rezoning. He reminded
those present that this is a preliminary plan being discussed and the final
plans must agree with this preliminary plat. He noted there is only one road
for access to the remaining 20 acres and if this plan is approved, there can
be no changes for additional roads later on without applying to the Planning
and Zoning Commission. Further, he said he was concerned that in the future a
higher density of homes could be built on the remaining 20 acres because of the
39+ acres being zoned open space. Mr. Adams assured Dr. Mand these 60 acres
were not split and Muirfield will not build more than the 38 lots on the 20
acres. Dr. Mand said he was only concerned because of the possibilities of a
change in ownership and because it is unusual to request a rezoning of a por-
tion of a tract of land and hold the remaining land until a later date.

There were some questions from residents of Dublin in the audience regarding
buffering between contiguous property and drainage.
Ordinance No. 02-82
Said ordinance regarding installation of Geothermal Wells was a tabled item.
~.1rs. Maurer referred to the memo (attached) from her and Mr. Amorose which
recommended the kind of proposAd legislation the Village should consider re-
garding installation of geothermal heating/cooling systems. She said a joint
committee of the Ohio Department of Natural Resources (ODNR) ,Ohio Environmen-
tal Protection Agency (OEPA), and the Ohio Department of Health (ODH) are work-
inq on procedures for conductinq a pump test for supply wells to show whether
or not there would be adequate water for the system as well as for domestic use

Mrs. Maurer then suggested the ordinance remain tabled until the joint committee,
mentioned above, provides Council with materials on testing supply wells. In
the meantime, she and Mr. Amorose thought it would be appropriate to hold a
public hearing so that members of the community might hear from those who have
the geothermal system and about any problems they may have encountered with
the system. Mrs. Maurer asked Mr. Smith to check and see if OEPA well con-
struction standards can be required and inspected by local authorities.
Mayor Lewis said the ordinance would remain tabled until material is received
from the joint committee.
Ordinance No. 07-82
Said ordinance dealing with the proposed adoption of the B.O.C.A. Fire Code
was read for the third time.
During a discussion, Mr. Chambers questioned the procedures for appointing mem-
bers of the Board of Appeals. He said he would like it noted that the chief
appointing authority is Council and would like to amend the ordinance to allow
at least one-third (1/3) of the membership to be citizen members not necessar-
ily possessing the qualifications listed in the B.O.C.A. Code.
Mr. Chambers then moved, seconded by Mrs. Headlee, to approve the ordinance
but delete Section F-I04.1 dealing with the Constitution of the Appeals Board.
Mr. Smith said an amendment to said section would be prepared for the next
regular Council meeting March 1st. Vote on the motion and the ordinance was
unanimous for approval.
Resolution No. 03-82
Said resolution dealing with establishing a term of Council representative to
P&Z was read for the third time. Vote on the resolution was as follows: 4 Yeas _
Amorose, D'Alonzo, Lewis, Maurer; 3 Nays - Thornton, Chambers, Headlee.
Mrs. Headlee submitted a letter to Mayor Lewis to be read into the minutes
stating she resigned as Council representative to the P&Z Commission because
of the imposed one-year term. Mayor Lewis accepted her resignation with re-
gret. He said the resolution was discussed prior to any appointment and was
resolved before any appointment and was sorry Mrs. Headlee felt the action
taken was specifically in reference to her appointment. Mayor Lewis then asked
Council to consider the vacancy and said a new appointment would be made at
the March 1st meeting. (Mrs. Headlee's letter of resignation is recorded on the
back of page two.)
Ordinance No. 10-82
Said ordinance to amend Sections 181.14 and 181.16 of the Codified Ordinances
pertaining to penalty and interest sections of the Income Tax Ordinance was
introduced by Mrs. Headlee and read for the first time. So that said ordin-
ance would become effective by April 1st, as requested by the Tax Division of
the City of Columbus, Mr. Chambers moved, seconded by Mrs. Maurer, to dispense
with the three-time reading rule. Vote on the motion and the ordinance was
unanimous for approval.
Ordinance No. 11-82
Said ordinance dealing with appointing a member to the Forestry Commission was
not placed on the agenda for publication. Mr. D'Alonzo, therefore, moved,
seconded by Mr. Amorose, to waive the Council Rule of Order and consider this
appointment at this time. Vote on the motion was unanimous for approval. Mrs.
Maurer then moved, seconded by Mr. Thornton, to dispense with the three-time
reading rule and pass as an emergency and to appoint Mr. Richard Vance to the
Forestry Commission for the remainder of a 3-year term expiring December 31,
1984. Vote on the motion and the ordinance was unanimous for approval.

Acceptance of Final Plat for Muirfield Phase 20
Mr. Howard Adams was present to request approval of said plat. Mr. D'Alonzo
moved, seconded by Mr. Amorose, to approve the final plat and vote on the motio
was unanimous for approval.
Mayor Lewis announced the Board of Zoning Appeals would hold a meeting Thursday
at 7:30 P.M. in the Municipal Building to discuss a variance request by Elmer
Reinhard on Summitview Road and Roush Hardware in Dublin Plaza.
Council Roundtable Discussion
Mr. Thornton said he was concerned about the tax increase imposed on those
residents on High Street in Old Dublin. He said he knows of Mr. Chambers'
efforts in working on a proposal to present to the State legislature and won-
ders if there isn't something Council could do to prohibit collection of these
taxes before this legislation is considered.
Mr. Smith said the Auditors office has arranged for these property owners to
file an application to go before the Board of Review. Mr. Smith said his offic
has requested these people receive a 5% rebate on their July taxes (2~% per
half). He said an appeal on behalf of these property owners or Dublin cannot
be filed until January 1983. He said nothing more can be done at this time,
however, if the property owners have filed their applications for relief, his
office will represent them on behalf of the Village.
Mr. D'Alonzo said he would like the new Council representative to P&Z and the
entire Commission to check into the necessity for legislation for installation
of dish antennae in Dublin.
Mr. Chambers said he will prepare a resolution regarding the property tax for
residents on High Street in Old Dublin and will have it ready for Council to
consider at the March 1st meeting.
Mr. Amorose said he has noticed a number of illegal signs in Dublin, i.e.,
Sunoco on Sawmill has an illegal bench sign, the Copy Center, and Citgo at 161
and Sawmill. He also questioned the school bus stop shelter at David Road and
161 and said it was more a billboard than functional shelter for school
children. He asked other councilmembers to report any other signs that do not
meet the Sign Code requirements.
Also, he said the sidewalk on Dale Drive is recelvlng mud and rock from the
8 foot imbankment on the west side of the Honda Building. He asked Mr. Wolfe
to look into this.
Mrs. Maurer said she would like Councilmembers to comment on the report she and
Mr. Amorose prepared on the geothermal wells. Mayor Lewis suggested, upon re-
ceipt of the responses, Mrs. Maurer and Mr. Amorose review and incorporate the
changes then make a recommendation to remove the ordinance from the table for
discussion.
Mayor Lewis adjourned the meeting at 8:55 P.M.
