The June 1, 1981 regular meeting of Council was called to order by Mayor Headle
at 7:30 P.M. Those members present were: Chambers, Geese, Headlee, Lewis, Mand
Maurer, Shawano Also present were Mr. Sheldon, Village Manager, Mr. Smith, Law
Director, and Mr. Wolfe, Village Engineer.
Mr. Geese amended the minutes of the May 18, 1981 Council meeting. Mr. Shawan
moved, seconded by Mr. Lewis, to approve the minutes as amended and vote on the
motion was unanimous for approval. Mr. Shawan moved, seconded by Mrs. Maurer,
to approve the bill listing for June 1, 1981 (attached) and vote on the motion
was unanimous for approval.
The Clerk read a letter to Council from Mr. Ben Hale, Attorney for the Village
Square Shopping Center and Sisters Restaurant, stating that he will appeal _
to the Board of Zoning Appeal the denial of the Sisters Restaurant COD applica-
tion by the Planning and Zoning Commission and Council.
Warner-QUBE Update
Mr. Small, representing Warner-QUBE, was present to report the status of cable
television installation in the Village. He said the reason service is not yet
available is because most of the area has underground utilities and State law
requires permission for the use of easements from each property owner. He
said once they receive this permission, service should be available in some
areas within 60 days of that date. The area north of 161 to the river is now
wired and cable service will be available by July. Since Muirfield's utility
lines are entirely underground, they will not receive service until sometime in
1982.

Resolution No. 16-81
Said resolution, dealing with a payback agreement for sewer overslzlng with
Indian Run Meadow development, was removed from the table with a motion by Mr.
Mand, and seconded by Mr. Shawano Vote on the motion was unanimous to remove
said resolution from the table.
Mr. Ison, Attorney for the developers of Indian Run Meadow, reviewed past dis-
cussions of the proposed agreement (see May 18, 1981 minutes) and stated his
client has no plans for developing said area if this agreement is not approved
by the Village.
Mr. Geese presented a copy of the document agreed to by the original property
owner in 1978. Mr. Smith said he would like time to review this material be-
fore commenting.
Mr. Ison said he has looked at all the exhibits of the rezoning ordinance and
considering all of these things together, in 1978 there was an understanding
between the property owner and Village of Dublin that established three (3)
basic principals.

1. The developer would be required to extend a sewer line to
Avery Road.
2. No general tax revenues would be required.
3. The developer alone could not extend the sewer line without
the participation of other property owners.
He said the proposed agreement says the developer is willing to build a 21-inch
sewer line from its present terminus across Indian Run Meadows property to
Avery Road if Dublin will pay the difference in cost of a 10 and 15 inch line
and the 21 inch line.

After further discussion, Mr. Shawan moved, seconded by Mr. Geese, to table
the resolution until the June 15, 1981 meeting. Mr. Lewis added to the motion
a condition asking the developer to consider returning June 15 with a proposal I
based on the cost of their bearing the expense of an 18-inch line and present-
ing to Council the added cost of expanding the line to 21-inches. Vote on the
motion was unanimous to table said resolution with the conditions stated.
Mr. Mand said he would like Mr. Wol fe, along with Mr.. Sheldon, to examine
the Villages ordinances concerning sewerline installations and clarify where a
sewerline should extend when crossing properties.
Ordinance No. 78-80 (8:25 - 9:05)
Said ordinance dealing with the proposed rezoning of 147 acres south of Rings
Road remained tabled until the June 15, 1981 meeting of Council. Mr. Mand
made a motion to remove the ordinance from the table but the motion died for
lack of a second.
Mr. Lewis said he had some questions he would like answered before considering
this ordinance. In reference to the need for a pump station, he said he would
like to know what the maximum flow rate is of the trunk sewer servicing the
community versus already existing approved developments versus existing committ
ments for expansion of the sewer. He questioned whether the Tennis property
south of Rings Road (Columbus) planned to use the same trunk.

Mr. Lewis was concerned that plans were being made for the sewer with the anti-
cipation of the expansion of the west bank sewer. In talking with Mr. Parkin-
son, Public Service Division, Columbus, that expansion has been delayed indef-
initely. He added the only sewer in Franklin County Metropolitan area that is
approved is one that is required by EPA and will be subsidized by Federal match
ing funds and there are no matching funds available for additional sewer instal
lations. Mr. Lewis felt for these reasons the Village cannot depend on a west
bank sewer in any predictable length of time.
After further discussion, Mr. Harrison Smith said he will prepare material with
in the next two weeks to try to answer the questions of Mr. Lewis. Mayor Head-
lee asked Mr. Smith to have this material by June 11, 1981 so Council will
have time to review it. She also requested that the Council and the Adminis-
trative staff research and report at the June 15, 1981 meeting.
Preliminary Report of Capital Improvement Proqram
Mr. Chambers reported the Committee (Mr. Mand, Mrs. Maurer, Mr. Chambers, with
Mrs. Trissell, Finance Director in attendance) decided it was necessary to go
to the voters for a 1/2% increase in the Income Tax and tell them what the in-
crease would be used for. They also felt it was necessary to issue bonds to
carry out those projects that were suggested by members of Council. He explain
ed the procedure that will be followed in getting this issue on the November 4,
1981 ballot.

The Bond Counselor i' preparing two documents, one dealing with transportation
requirements and one dealing with Parks and Recreation projects such as the
swimming pool, community center, and Avery Park addition. Three issues will be
on the ballot, the increase of 1/2% on the Income Tax and two issues asking for
authorization for the issuance of bonds in order to carry out the projects.
Resolution No. 27-81
Said resolution dealing with clarification of Income Tax/Bond Issues was intro-
duced by Mr. Chambers and read for the first time. Mr. Chambers then made a
motion, seconded by Mr. Mand, to table the following ordinances:

Vote on the motion to table these ordinances and resolution was unanimous for
approval.
Ordinance No. 30-81
Said ordinance designating Wards for the Village of Dublin was read for the
second time. Mayor Headlee asked the newspapers to publish a request asking
the residents of the area to state their opinions of the Ward divisions to the
Councilmember in their Ward.
Resolution No. 22-81
Said resolution dealing with a petition to dead end Thornhill Lane was read for
the second time.
Resolution No. 23-81
Said resolution dealing with establishing a Village nursery was read for the
second time. Mr. Mand moved, seconded by Mr. Geese, to dispense with the
three-time reading rule. The motion failed with the vote as follows: 2 Yeas _
Geese, Mand; 5 Nays - Headlee, Lewis, Maurer, Shawan, Chambers.
Discussion on Parks and Recreation Recommendation Re: Consulting Firm Agree-
ment
Mr. Hill, Chairman of the Parks and Recreation Department was present and in-
troduced Mr. Horn of Brandstetter/Carroll and Associates. After some dis-
cussion, Mr. Mand moved, seconded by Mr. Geese, to approve the plans of Brubake /
Brandt, Inc., and Brandstetter/Carroll and Associates for the swimming pool and
community center project. Mr. Chambers amended the motion to approve Phase I,
planning and programming, of the plans. Vote on the motion was unanimous for
approval.
Ordinance No. 32-81
Said ordinance dealing with issuance of Bonds, Phase II Sewers, for assess-
ments was introduced by Mr. Geese and read for the first time. Mr. Geese moved
seconded by Mr. Lewis, to dispense with the three-time reading rule and pass as
an emergency. Vote on the motion and the ordinance was unanimous for approval.
Ordinance No. 33-81
Said ordinance dealing with accepting a bid on the 1981 Street Improvements was
introduced by Mr. Shawan and read for the first time. The bid of Northwood
Stone and Asphalt, $195,434.50, was selected and Mr. Shawan moved, seconded by
Mr. Geese, to dispense with the three-time reading rule and to pass as an
emergency. Vote on the motion and the ordinance was unanimous for approval.
Proposed 1982 Budget
Said budget was prepared by the Finance Director and presented to Council for
their consideration and first reading.
Resolution No. 26-81
Said resolution dealing with setting a Public Hearing date of June 15, 1981 on
the 1982 Budget was introduced by Mr. Shawan and read for the first time. Mr.
Shawan moved, seconded by Mr. Mand, to dispense with the three-time reading
rule and to pass as an emergency. Vote on the motion and the resolution was
unanimous for approval.
Ordinance No. 34-81
Said ordinance dealing with a proposed Charter change was introduced by Mr.
Geese and read for the first time.

Ordinance No. 30-81 ~
Said ordinance proposing an amendment to original Ordinance No. 30-81 designat-
ing Wards was introduced by Mr. Geese. It was decided the amendment should be
Ordinance No. 30B-81 and considered read for the second time since it is a part
of Ordinance No. 30-81.
Informal Discussion on Proposed Aqreement with Adria
Mr. D'Alonzo, Adria Laboratories, Inc., was present to discuss water and sewer
services to an approximate 100 acre site on Rts. 161-33 and provided Council
with tentative costs and agreement for this project. After some discussion,
Council decided a format should be prepared by Adria and presented to Council.
Petition to build sewerlines by assessment - Brandon and Earlington
This discussion was tabled until the June 15, 1981 meeting of Council.
Sisters Chicken Discussion
Mr. Smith requested this discussion be tabled until June 15, 1981 meeting of
Council.

Vacation of an Easement - Craig Lindberg - Water ford . n
Mr. Geese moved, seconded by Mr. Mand, to dlspense with the Council Rule of
Order and allow Mr. Lindberg to submit a request for vacating an easement.
Vote on the motion was unanimous for approval.
In regards to the request, Mr. Smith requested Mr. Lindberg sign an Indemnifi-
cation Agreement. Mr. Geese then moved, seconded by Mr. Chambers, to approve
the request and have Mr. Lindberg arrange to meet with Mr. Smith to sign said
agreement.
Council Roundtable Discussion
Mayor Headlee referred to the discussion concerning the stone fences in Dublin
(May 18, 1981 meeting of Council) and said there is a section in the Codified
Ordinance pertaining to this issue (Section 541).
Mr. Mand asked to schedule an Executive Session before the June 15, 1981 meet-
ing and Mayor Headlee requested Council meet at 6:30 P.M. before the regular
meeting to discuss sewerline requests.
Mr. Chambers thanked the press for the coverage of the Memorial Day activities.
Mr. Geese mentioned the fact that four (4) of the six (6) new signs recently
placed throughout Dublin by the Jaycees have been stolen. He asked the news-
paper to inform the public that no charges would be filed if those persons who
took the signs would return them. Mayor Headlee added there would be no ques-
tions asked if the signs were returned to her house or the Police Department
in the middle of the night.
Mr. Shawan asked if anyone sees some person removing stones from the stone fenCES
throughout Dublin to please report it to the Police Department.
He also mentioned the Scioto Park is being well used, however, there is a great
deal of trespassing on private property. He requested the "No Trespassing"
signs be replaced on the north and south side of the Park.
