'" 11 cld March 16, 1981 19 The regular meeting Those present were: Mrs. Maurer arrived Director, were also of Council Chambers, late. Mr. present. was called to order by Mayor Headlee at 7:30 P.M. Headlee, Lewis, Mand, Shawano Mr. Geese and Wolfe, Village Engineer, and Mr. Smith, Law Mr. Mand moved, seconded by Mr. Lewis, to approve the minutes of the March 2, 1981 meeting. All those present voted in favor of the motion. Mr. Chambers moved, seconded by Mr. Mand, to approve the bill listing for March 16, 1981 (attached). All those present voted in favor of the motion. The Cierk read correspondence to Council from the Ohio Department of Liquor Con- trol requesting approval or disapproval for issuance of a D-3 permit to the United Realty Enterprises, Inc. Mr. Lewis moved, seconded by Mr. Shawan, to object to this application and request a hearing. Vote on the motion was as follows: 6 Yeas - Chambers, Headlee, Lewis, Mand, Maurer, and Shawan; 1 Absten- tion - Geese. Resolution No. 13-81 Said resolution recognizing the Dublin High School Girl's Gymnastic Team was in- troduced by Mr. Lewis and was read to the team. The Coach, Connie Montgomery, and the team members, Erin Brunner, Cindy McGee, Jerrie Dowler, and Anne Riley, were introduced by Mr. Donald Riley. Mayor Headlee commended them for their performance and for placing second in the Ohio State Gymnast competition held March 6 and 7, 1981. Ordinance No. 10-81 (7:45-8:25) Said Ordinance amending the Zoning Code, Ordinance 21-70, Section 541, relating to signage, was read for the third time. Mr. Mand moved seconded by Mr. Geese, to amend the following sections as recommended by the Planning and Zoning Com- mission. Section 541.02 - (add) This definition shall include back lighted plastic panels or strip lighting affixed to any wall or roof where any such panels or lighting serves to identify a business and attract attention rather than to illuminate space for human activity. Vote on the motion was for unanimous approval. Section 54l.043-C - "Monochromatic in color, not including black and white" to be changed to the original wording,"No signs shall be more than three (3) colors." Vote on approval of this amendment was as follows: 6 Yeas - Geese, Headlee, ewis, Mand, Maurer, Shawan; 1 Nay - Chambers. Section 541.06 - Substitute the words "not permitted" for the word "NONE. " Vote on this amendment was unanimous for approval. Mr. Lewis moved, seconded by Mr. Shawan, to table said ordinance until it could be rewritten to incorporate all amendments before voting on the final approval. The motion failed with the vote as follows: 3 Yeas - Lewis, Shawan, Chambers; 4 Nays - Geese, Headlee, Mand, Maurer. Mr. Chambers moved, seconded by Mr. Shawan, to exclude the section on color (54l.043-C). The motion failed with the vote as follows: 3 Nays - Lewis, Shawan, Chambers; 4 Nays - Geese, Headlee, Mand, Maurer. Mrs. Maurer moved, seconded by Mr. Mand, to modify Section 541.03-7 to read "seven (7) square feet" instead of "six (6) square feet." The motion passed with a unanimous vote for approval. Held March 16, 1981 19 Page Two Mr. Lewis moved, seconded by Mr. Shawan, to incorporate Mr. Smith's and Mr. Gun- ner's recommendations of March 5, 1981, concerning Section 541.084-1 on non- conformance. In their memo they stated it was their opinion you cannot discon- tinue a sign solely because of a change of ownership in the property. The mo- tion was unanimously approved. Mrs. Maurer moved, seconded by Mr. Mand, to amend the following section: Section 541.03-7 - (add) "Such signs shall be placed on the property referred to and shall not. . . . The motion was unanimously approved. A vote was taken on passage of said Ordinance and it was approved as amended with the vote as follows: 4 Yeas - Geese, Headlee, Mand, Maurer; 3 Nays _ LeWis, Shawan, Chambers. Mr. Mand asked Mr. Smith to rewrite Section 541.084 dealing with non-conforming signs to replace that section which was amended. Ordinance No. 12-81 Said ordinance to authorize the purchasing of land for Municipal purposes was read for the third time. Mr. Chambers moved, seconded by Mr. Shawan, to table aid ordinance. Geese and read for the first time. esolution No. 11-81 aid resolution, authorizing the Village Manager to conduct a census to deter- ine wards in the Village, was introduced by Mr. Lewis and read for the first ime. Mr. Lewis moved, seconded by Mr. Mand, to dispense with the three-time eading rule and pass as an emergency. Approval of the motion and the resolu- ion was unanimous. Resolution No. 12-81 Said resolution, clarifying the effects of Ordinance No. 08-81 on Ordinance No. 80-79 concerning open space/park fees, was introduced by Mr. Mand and read for the first time. Resolution No. 14-81 A motion to add said resolution, approving and accepting a sanitary sewer ease- ment, to the agenda was made by Mr. Chambers and seconded by Mr. Geese. The motion was unanimously approved and was read for the first time. Mr. Chambers moved, seconded by Mr. Geese, to dispense with the three-time reading rule and approval of the motion and the resolution was unanimous. General Discussion with the Trustees of the C.I.C. Mr. Lewis referred to suggestions made to Council in December 1980 regarding the general operating procedures of the community and dealing specifically with the organization of the various boards and committees and the way major projects might be handled. At that time he made suggestions in regard to reorganizing some aspects of the Dublin C.I.C. January 9, 1981 a meeting of the C.I.C. was held and several items were brought to his attention: The C.I.C. is an independent corporation provided by Ohio Law that serves under contract to Dublin. It is not created by the commun- ity or by the Council. It is an area improvement corporation and has the right and privi- ledge to consider projects that are not necessarily in the muni- cipal boundaries of Dublin. Membership is made up of members who are not necessarily residents of the community. He said for these reasons he would like to change his original proposal and would like to have comments from the members and Executive Committee of the C.I.C. before this is done. He suggested that Mayor Headlee appoint a committee to work on a more definitive recommendation and asked this be placed on the April 6, 1981 Agenda. Re uest from Mr. Solack to tem oraril into the sewer line. Mr. Geese moved, seconded by Mr. Mand, to accept the request to delay tapping into the sewer line for eighteen (18) months. Approval of the motion was un- animous. Fire Lane in Dublin Plaza Sho in Center Cleaners, appeared before Council to appeal the request of Fire Chief Daines, to remove the sign in front of Swan Cleaners allowing five (5) minute parking for their customers. This area is marked as a Fire Lane. Council confirmed that Swan Cleaners must comply with Chapter 353, Section 353.02 (b) and (c) and 353.07 of the Codified Ordinance and remove the "5 Minute Parking" sign. Mr. Shawan requested Mr. Smith check on the variances in effect in Upper Arling- ton, Columbus, Westerville, Whitehall, Bexley, and Grove City regarding this request. Dublin Abbe PIa ers Jackie Rerms, representing Dublin Abbey Players, was present to request permis- sion to use the Chambers for their next production "Bad Seed." This would be held in May. Mr. Geese moved, seconded by Mr. Chambers, to approve the request and approval of the motion was unanimous. II eld March 16, 1981 r H) Pa e Four Council Roundtable Discussion Mr. Lewis referred to 2.6 acres of land that Western Electric and Sherex Chemi- cal Co., Inc. may donate to the Village. He introduced Mr. Robert Fulton of Sherex who explained they have offered to purchase one (1) acre of the plot of land at the corner of Old and New Rings Road and Frantz Road and donate this to the Village. He was hopeful Western Electric will then donate the remaining 1.6 acres to the Village. He said Sherex would maintain the landscaping at their expense. Mr. Lewis moved, seconded by Mr. Geese, to give Sherex and West- ern Electric the assurance, upon completion of proper title and transfer, that we would be happy to receive this parcel of land as a gift to the Village. The motion was unanimously approved. Mr. Lewis asked if there was a possible conflict of interest concerning Mr. Reiner's and Mr. Amorose's contribution to the compilation of the Landscape Ordinance. Mr. Smith said he would prepare a legal opinion on this subject. Mr. Geese said, in reference to a memorandum to Councilmembers from Mr. Strutner, he agreed that the Maintenance Department should have uniforms. Mr. Chambers expressed concern that there is not full and free discussion of items brought before Council. He said all elected members of Council have an equal right to speak at any reasonable length and encouraged members to think in these terms. Mr. Shawan requested that ordinances and resolutions being considered at Council meetings include names of sponsors. He asked if the plague for John Moffit was on order and was told it was. Mrs. Maurer, in reference to the discussion of the Fire Lanes in Dublin Plaza, asked Mr. Smith if the Village has any authority to request that something be done to improve visibility in the parking area. She said it is difficult to enter the main thoroughfare. Mr. Smith said he would check into this matter. ~a or Headlee reminded Council of the change in format of the Mayor's Monthly Report which was prepared by her, the State Auditor, and Clerk of Courts. r.
