The February 2, 1981 regular meeting of Council was called to order by Mayor
Headlee at 7:30 P.M. Those present were: Chambers, Headlee, Lewis, Mand,
Maurer, Shawan. Mr. Geese arrived at 7: 50.;1?~}1. Also present were Mr. Smith,
Law Director, and Charles Wolfe, Village Engineer.
Mr. Mand made a motion, seconded by Mr. Shawan, to approve the minutes of the
January 19, 1981 meeting. All those present voted in favor of the motion.
Mr. Chambers then moved, seconded by Mr. Lewis, to approve the listing of
bills (attached) for February 2, 1981. All those present voted in favor of
the motion.
A letter from Chi Weber was read to Council informing them of his change of
residence outside the Village corporate limits and subsequently his resignation
as a member of the Personnel Review Board.
Ordinance No. 68-80
This Ordinance, approving, adopting, and enacting the Codified Ordinances, was
removed from the table with a motion by Mr. Mand and a second by Mr. Shawano
Vote on the motion was for unanimous approval. Mr. Shawan then moved, seconded
by Mr. Mand, to approve the Ordinance and vote on the motion was for unanimous
approval.
Ordinance No. 77-80 (7:40-8:10)
Said Ordinance dealing with the proposal to rezone 17.3 acres in Delaware
County, east of S.R. 745, was read for the third time. Mr. Ray Johnson and
Mr. Gerry Bird, the developers, were present and made available to Council-
members revised plans of the rezoning and a brief summary of various submittals
and items of record (summary attached). Mr. Grinch, a resident of said area
and representing Robert P. Grinch, was also present and submitted a collection
of items for Council's review (attachedd.
Mrs. Maurer questioned the developers as to whether they would provide green
space or pay park fees. Mr. Bird said they would pay a park fee. Mrs. Maurer
expressed concern about the use of our present Subdivision Regulations regard-
ing Park Fees which would govern a development that is classified as PUD. She
pointed out that the pending Ordinance No. 08-81 would cover a park fee in a
PUD development. Mr. Smith said the developers would comply with the present
Subdivision Regulations since Ordinance No. 08-81 has not been approved.
Mr. Mand stated he has been against the rezoning from the beginning because the
RI zoning is more appropriate for the area between 745 and east of the river.
The rezoning is not advantageous at this time since the community is develop-
ing at an appropriate and reasonable rate relative to traffic, schools, and
other public service interests. The neighbors and contiguous land owners
opposed the rezoning and the only persons benefitting are the developers. Also
this land will not all be developed by the applicants but by other developers
as well.
Mayor Headlee requested a vote on the approval of said Ordinance and the vote
was as follows: 3 Yeas - Lewis, Shawan, Chambers; 3 Nays - Headlee, Mand,
Maurer. Mr. Geese arrived at this time and after expressing his concerns about
the water and sewer services to the site and the lack of a committment from the
developers for these services, he voted against approval of the Ordinance. The
final vote was 3 Yeas and 4 Nays.
There was confusion at this ti~ to whether the Ordinance was defeated be-
cause of different interpretations of Section 4.11B of the Village Charter.
Mr. Chambers made a motion, seconded by Mr. Shawan, to table the Ordinance un-
til Mr. Smith checked the interpretation of the Charter and that the vote not

be recorded until the next meeting of Council. The motion was defeated with
the vote as follows: 2 Yeas - Chambers, Shawan; 5 Nays - Headlee, Lewis, Mand,
Maurer, Geese. Mr. Smith will inform Council at their next meeting of the
correct interpretation of the Charter and whether or not a majority vote or
a 2/3 vote is needed to disapprove the Ordinance.
Resolution No. 03-81
This Resolution dealing with a committment regarding drug and alcohol abuse
was introduced by Mr. Shawan and read for the first time. After Mr. Shawan
and Mrs. Maurer amended the Resolution, Mr. Shawan moved, seconded by Mr. GeesE,
to dispense with the three-time reading rule and to pass as an emergency.
Vote on the motion and the Resolution was unanimous for approval.
Resolution No. 04-81
Said Resolution estimating aggregate maximum amount of public funds to be
awarded as active and inactive deposits was introduced by Mr. Mand and read
for the first time. Mrs. Maurer moved, seconded by Mr. Mand, to dispense with
the three-time reading rule and to pass as an emergency. Vote on the motion
and Ordinance were unanimous for approval.
Ordinance No. ffi8-81
Said Ordinance dealing with amending the Zoning Code relating to signage and
setting a public hearing was introduced by Mrs. Maurer and read for the first
time. Mr. Mand moved, seconded by Mrs. Maurer, to set March 2, 1981 as the
public hearing date for this Ordinance. Vote on the motion was unanimous.
Resolution No. 05-81
This Resolution amending Resolution No. 43-79 concerning the Estates and Bene-
fits Commission was introduced by Mr. Mand and read for the first time.
Mr. Shawan requested Mr. Smith to find out whether or not a person contributing
money to the Village would receive a tax deduction.
Ordinance No. 11-81
This Ordinance dealing with appointments to the Personnel Review Board and the
Forestry Commission was introduced by Mayor Headlee and read for the first
time. Mayor Headlee said an Executive Session will be held before the February
16, 1981 meeting of Council to consider applicants for these positions. The
Executive Session will be at 7 P.M.
Council Roundtable Discussion
Mayor Headlee reported to Council the plans for a "bang up" March 17th St.
Patrick's Day program in Dublin. The celebration will begin at 7:30 A.M. and
Mayor Headlee advised everyone to wear green because citations will be issued
to those not wearing the color green. A parade is planned to begin at 10:30 A.M.
at the Village Square Shopping Center and will end at the Dublin Plaza Shopping
Center. The Women's Club at the Dublin Community Church will have their
annual St. Patrick's Day luncheon, Chamber of Commerce will serve green beer
from 3:00 P.M. - 5:00 P.M., and Mayor Headlee will be serving green punch and
shamrock cookies at the Village Municipal building. Joe Wolfe of Realtors Asso~
ciatlon is this year's chairman for the St. Patrick's Day celebration.
Mr. Mand brought to the attention of Council a request for Phase II of Donegal
Cliffs to tap into the Summitview water line which will be discussed at the
P & Z meeting February 3, 1981. He said an agreement for tapping into this
water line was for Phase I only and would appreciate comments from Council-
members concerning this matter. Mr. Chambers said he did not think they should
discuss this issue without the presence of Dan Smith, the applicant. Mr. Smith
Law Director, said he had prepared a memo for the P & Z members regarding this
matter and it would be discussed in more detail at their meeting tomorrow night.

Mr. Lewis suggested that the Estates, Gifts and Benefits Commission should re-
view the possible donation of a park site by Sherex. Said site is at the inter
section of Frantz and Rings Roads.
Mr. Geese expressed concern that the Columbus and Southern Ohio Electric Com- I
pany has not installed mercury lights at the corner of Glick Road and Muirfield
Drive. Mr. Howard Adams of Muirfield, Ltd., advised him this was being done
at this time.
Mr. Shawan thanked Mr. Sheldon for having the signs installed on Bright Road to
prohibit truck traffic.
Mrs. Maurer thanked Mr. Sheldon for providing an updated list of tabled ordin-
ances over the past five (5) years.
In reference to the January 14, 1981 minutes of the Parks and Recreation Commit
tee, Mrs. Maurer said she would like Council to be advised of the WoalpettCon-
suIting firm's recommendations to Parks and Recreation concerning the Scioto
Park project. Mr. Sheldon said this could be arranged and would request the
Parks and Recreation Committee and a representative from the WOd~Defr firm appear
before Council for this purpose. Mrs. Maurer said she would also like Council
to be informed of the solar type heating being considered for the proposed
pool facilities.
Mayor Headlee adjourned the meeting at 9:00 P.M.
