The January 5, 1981, regular meeting of Council was called to order at 7:45 P.t .
by Mayor Headlee after the adjournment of an Executive Session which began at
6:30 P.M. Those present were: Chambers, Geese, Headlee, Lewis, Mand, Maurer,
and Shawano Also present were Mr. Smith, Law Director, and Mr. Wolfe, Village
Engineer. I
Minutes of the December 15, 1980 regular meeting of Council were amended by
Mr. Shawan and Mr. Chambers. Mr. Mand moved, seconded by Mr. Chambers, to
approve the minutes as amended and vote on the motion was unanimously approved
Mr. Mand then moved, seconded by Mr. Shawan, to approve the minutes of the
December 29, 1980 special meeting and the vote on the motion was for unanimous
approval. Mr. Shawan moved, seconded by Mr. Mand, to approve the bills
(attached) and all present voted in favor of the motion.
A letter from Janet Isenhart, President, Dublin Abbey Players, was read to
Council thanking them and the Village for their support and permission to use
the Council Chambers for rehearsals and the production of "I Never Sang for
my Father."
Mayor Headlee referred to a memo from Mr. Sheldon concerning the continuation
of the employment of the Smith and Gunner Law Firm as the Village Law Director
Mr. Mand moved, seconded by Mr. Shawn, to approve retaining said firm as the
Law Director and all present voted for the motion.
Ordinance No. 82-80
This Ordinance concerning the 1981 Appropriations was read for the third time.
Mr. Mand moved, seconded by Mr. Chambers, to approve the Ordinance and vote
on the motion was unanimously approved.
Ordinance No. 85-80
Said Ordinance appointing members to the various Boards and Commissions was
read for the second time. As the result of an Executive Session, members weret
appointed to all Boards and Commissions except the Planning & Zoning Commissio
and the Personnel Review Board. These members will be appointed at Council's
January 19, 1981 meeting. Mr. Mand moved, seconded by Mr. Geese, to dispense
with the three-time reading rule and to pass as an emergency. Vote on the
motion and the Ordinance was for unanimous approval.
Ordinance No. 01-81
This Ordinance to renew the note on Phase II sewers was introduced by Mr.
Shawan and read for the first time. Mr. Mand moved, seconded by Mr. Lewis,
to dispense with the three-time reading rule and to pass as an emergency.
Vote on the motion and Ordinance was unanimous for approval.
Ordinance No. 02-81
This Ordinance to amend the Traffic Code - Chapter 303 was introduced by
Mr. Mand and read for the first time. Mr. Geese made a motion, seconded by
Mayor Headlee, to dispense with the three-time reading rule and to pass as
an emergency. The motion failed with the vote as follows: 3 Yeas - Geese,
Headlee, Lewis; 4 Nays - Mand, Maurer, Shawan, Chambers. Second reading
will be on January 19, 1981.

Ordinance No. 03-81
Said Ordinance appointing members to the C.I.C. was introduced by Mr. Lewis
and read for the first time. Mr. Lewis then moved, seconded by Mr. Shawan
to table the Ordinance until such time as members have been appointed.
The vote on the motion was unanimously approved. Present members of the
C.I.C., Mr. Lewis, Mr. Chambers, Mr. Shawan, and Mayor Headlee, will continue
to serve until new members are appointed.
Ordinance No. 04-81
Said Ordinance entering into an Engineering Service Agreement, was introduced
by Mr. Mand and read for the first time. Mr. Mand moved, seconded by Mr.
Shawan, to dispense with the three-time reading rule. The vote on the motion
and Ordinance was unanimous for approval.
Resolution No.~ 01-81
This Resolution declaring the intent to appropriate property for a sidewalk
was introduced by Mrs. Maurer and read for the first time. Mr. J. G. Manns,
property owner, appeared before Council to voice his concerns about the pro-
posed sidewalk. Mr. Smith suggested he, Mr. Sheldon, and Mr. Manns, set a
meeting date for the purpose of discussing this matter in more detail.
Council members will be advised of this meeting date so they may attend if
they wish.
Other Items
Request for exemption from Stormwater Retention - Section I of Brandon Village
was duscussed. Mr. Wolfe had requested Hockaden and Associates, Inc., pre-
pare an analysis modifying the Village drainage regulations. Mr. Sheldon
suggested Council review this analysis and prepare to discuss this in more
detail at the January 19, 1981 meeting of Council.
Ms. Kay Murphy appeared before Council requesting permission to set up a tem-
porary sales trailer at the Newtowne Homes site for a period of six months.
Mr. Shawan moved, seconded by Mr. Geese, to approve this request for a period
of six month~ ending June 30. Vote on the motion was for unanimous approval.
Mr. Sheldon requested Council's approval to retain Richard Termeer as a con-
sultant to assist Nan Trissel, the new Finance Director. His services will
be on a part-time basis at $5.00 per hour. Mrs. Maurer moved, seconded by
Mr. Chambers, to approve the request and Council voted unanimously for
approval.
Mr. Sheldon then requested Council's approval to purchase an additional tornadJ
siren. Washington Township will be purchasing one and with two additional
sirens, approximately located at Rings and Avery Roads and Brand Road and
Muirfield Drive, more of the Village residents will be able to hear the warn-
ing. Mr. Geese moved, seconded by Mayor Headlee, to approve the request and
all those present voted in favor of the motion.
Council Roundtable
Mr. Mand - responded to Mr. Sheldon's request for Council's oplnlon concerning
the purchase of land north of Avery Park. He thought it would be a worthwhile
purchase.

He referred to the updated information of the proposed aquatic center and
would like to see an updated cost analysis of the outdoor pool.
Mr. Lewis - referred to the land north of Avery Park and would like recommen-
dations from the Parks and Recreation Committee as to what plans they would
have for additional land at this site and how much land they would need to
implement the planned useage.
Mr. Geese - questioned the status of the "Tot-Lot" planned for the Waterford
Village Development. He was told this was eliminated and additional landscap-
ping was added in its place (see Minutes of October 6, 1980).
He then suggested all members of Boards and Commissions should be invited to
attend the joint meeting of Planning and Zoning and Council, January 12, 1981.
Mr. Chambers - would like Mr. Sheldon's recommendations as to what he feels
the Village should do concerning the purchase of the land at Avery Park. He
questions whether we want to purchase this land in preference to land along
the Scioto River which the Parks and Recreation Committee has been consider-
ing or other possible Capital Improvements, and thinks Council should be
given options.
Mr. Shawan - questioned the status of Sister's Restaurant Site Plan. Mr.
Smith informed him Council has 30 days from January 2, 1981 to approve or
disapprove P & Z's recommendation. If Council fails to act within 30 days,
P & Z's recommendation will become final. Mr. Shawan requested this issue
be placed on the January 19th Agenda and Mr. Smith said he would notify
Mr. Ruma of this date.
Mrs. Maurer - suggested the Clerk of Council write a letter to those persons
on the Boards and Commissions whose terms have expired, thanking them for
their service. (Thank you letters were sent January 7, 1981 to said persons.)
Mrs. Maurer expressed her concerns with the current Sister's Restaurant situa-
tion and asked for recommendations for ways to avoid similar situations in
the future. Mr. Smith suggested he and the P & Z members receive packets at
an earlier date to give them more time to study applications for various re-
quests. Mr. Sheldon assured him this could be done and in the future, packets
will be sent out 8-10 days before the P & Z meeting.
Mayor Headlee adjourned the meeting at 9:12 P.M.
