Form N". 1097 ',;{0i'b> Held November 3, 1980 ml The November 3, 1980 regular meeting of Council was called to order by Mayor Headlee with the following members present: Chambers, Geese, Headlee, Mand, Maurer, and Shawano Mr. Lewis was absent from the meeting. The minutes of the regular meeting held October 20, 1980 were read. Mr. Mand made a motion, seconded by Mr. Shawan, to approve the minutes and they were unanimously approved by all members present. The listing of bills (attached) were moved for approval by Mr. Mand, seconded by Mr. Geese, and were unani- mously approved for payment. Ordinance 61-80 A motion was made by Mr. Mand, seconded by Mayor Headlee to remove this Ordin- ance, dealing with accepting a petition for annexation of 53.4 acres, from the table. Vote on the motion was unanimously approved. After a lengthy discussion, Mr. Mand moved, seconded by Mr. Geese, to again table the Ordinance in order to give the Law Director sufficient time to pre- pare an Ordinance which would impose a capacity charge for persons who have sewage available but were not assessed for same. The motion failed with a tie vote as follows: 3 Yeas - Geese, Mand, and Maurer; 3 Nays - Headlee, Shawan, and Chambers. After further discussion, Mr. Geese made a motion, seconded by Mrs. Maurer, to make a provision that Mr. Jeffrey Forster, a new resident in said area, con- tact Mr. Robert Parkinson, Columbus Service Director, for permission to tap the sewer pursuant to being annexed to the Village of Dublin. The vote on the motion was as follows: 5 Yeas - Geese, Headlee, Mand, Maurer, and Shavmn; 1 Nay - Chambers. Mr. Geese then made a motion, seconded by Mrs. Maurer, to retable the Ordinance and the vote was as follows: 4 Yeas - Geese, Headlee, Mand, Maurer; 2 Nays - Shawan and Chambers. It was suggested that Mr. Sheldon Village Manager, assist Mr. Forster in his efforts to contact and negotiate with Mr. Parkinson. Ordinance 68-80 This Ordinance to approve and enact the Codified Ordinances was read for the third time. Mrs. Maurer made a motion, seconded by Mr. Geese, to table said Ordinance until such time each Councilmember has had time to read the Codi- fied Ordinances. The vote on the motion was unanimous. Mayor Headlee re- quested Council to make notes of any findings and give them to John Strutner, Assistant Village Manager. Mr. Chambers further suggested that a Walter Drane Company representative be invited to the next Council meeting to dis- cuss the Codified Ordinances. Ordinance 73-80 This Ordinance granting exemption from the mandatory sewer hook-up was read for the second time. Mr. Geese made a motion, seconded by Mrs. Maurer, to pass the Ordinance as an emergency measure. The vote on the motion and the Ordinance was unanimous approval. Resolution 32-80 Said Resolution pledging support to resolve the drug problem in Dublin was read for the second time. Mrs. Maurer made a motion, seconded by Mr. Geese, to amend the Resolution by removing the word "apparent" throughout the Reso- lution. The vote was unanimously approved on the amendment. Mr. Shawan then motioned, seconded by Mr. Geese, to dispense with the three-time read- ing rule and pass as an emergency. The vote for the motion and Resolution was unanimous approval. Form No. 1097 e,:;;~ II eld November 3, 1980 19 Page Two Ordinance 75-80 The Ordinance dealing with the Industrial Revenue Bonds (C.I.C) Inverness Investment Agreement was introduced by Mr. Shawano It was read for the first time. Mrs. Maurer made a motion, seconded by Mr. Chambers, to dispense with the three-time reading rule and pass as an emergency. The vote on the motion and the Ordinance was unanimous approval. Ordinance 76-80 The Ordinance establishing fees for building permits, etc., was introduced by Mrs. Maurer. After a lengthy discussion and, after it was explained that certification of the Dublin Building Department had been approved effective November 1, 1980 requiring a fee structure in order to issue permits, Mr. Geese made a motion, seconded by Mrs. Maurer, to dispense with the three-time read- ing rule and pass as an emergency. The motion and Ordinance were approved with the vote as follows: 5 Yeas - Shawan, Maurer, Mand, Headlee, and Geese; 1 Nay - Chambers. Ordinance No. 77-80 Said Ordinance, providing for a change of zoning of 17.3 acres in Delaware County on the east side of S.R. 745, was introduced by Mrs. Maurer and read for the first time. All members of Council agreed the public hearing should be held at the December 1, 1980 regular meeting of Council. Ordinance 78-80 This Ordinance dealing with the change of zoning south of Rings Road and west of Dublin Road, was introduced by Mr. Shawan and read for the first time. A public hearing was scheduled to be held at Council's regular meeting December 15, 1980. Resolution 33-80 Said Resolution, concerning lot splits in the Shannon Park area was introduced by Mr. Mand and read for the first time. Mr. William Newman, Attorney for the development, was present. Mr. Mand made a motion, seconded by Mt. Geese, to dispense with the three time reading rule and to pass as an emergency. The Resolution, and motion, being unanimously approved was then referred to the P&Z Commission for concurrence at their November 4, 1980 meeting. Roundtable Discussion Mr. Mand - referred to a letter from the River Forest Civic Association, Inc., (copy attached) and requested Mr. Sheldon look into the traffic patterns of S.R. 745 in an effort to find solutions to the problems concerning the residents of River Forest. Mr. Sheldon will meet with Mr. Mack, Director of Division Six - O.D.O.T. regarding same. Mr. Chambers - requested all meetings of Council be recorded. This procedure will be done beginning with the November 17, 1980 regular meeting of Council and the recorder was used for the November 4, 1980 meeting of the P&Z Commissior . Mr. Chambers also inquired as to installation of Street Lights in River Forest and Mr. Strutner gave a report concerning same. Mr. Chambers expressed his concern of recent Ordinances involving the Building Department that do not pro- vide for an appeal process in most cases. Mr. Shawan - Reported the Dublin Fund of Columbus Foundation had a "kick off" event at the Ohio National Bank with a good turnout and hoped that everybody would make themselves familiar with said Fund. Residents of River Forest Subdivision are particularly alarmed about traffic on this rou"te because it provides the only access to our homes and because so~e of our families have been per- sonally involved in ....' ., A ... "nese lnCJ..uen vS. As a member of council we appeal to you to act immediately to reduce the hazardous con- d~tions on 745 before another fatality occurs. We acknowledge the difficulty at this time of obtaining state money to alter the roadbed but in the interim we demand that Council act on alternate, though admittedly less ideal solutions. We urge the followin~ actionsl 1. Reduce the speed limit from 45 mph to 35 mph be- tween Glick Road and :ndian Run Drive. 2. Direct our police ~fficers to patrol 745 ag~ress- ively so that the new speed limit is enforced. (Our residents a~ree that ~ravel trucks are fla- grant in their disregard even of current speed limits) . 3.: Install a flashin'?; warning light at the intersection of Brand Road and 745 where the majority of these . accidents have occureo, (~he comoination of dense foliage and a hill dramatically obstructs vision at this point so that motorists are not alert to oncoming vehicles) 4. Because the shoulder .of this road is so narrow, bicyclists are in real peril and also present an additional hazard to motorists. We ask that this matter be placed on the agenda for the next council meeting and we stand ready to provide testimony if it is needed. Thank you for your. consideration.
