Form No. 1097 <i~ II dd August 17, 1981 19 The regular meeting of Council was called to order by Mayor Headlee at 7:30 P.M with the following members present: Chambers, Geese, Headlee, Lewis, Shawano Mr. Mand and Mrs. Maurer were absent from the meeting. Also present were Mr. Sheldon, Village Manager, and Mr. Smith, Law Director. Mr. Shawan moved, seconded by Mr. Chambers, to approve the minutes of the August 3, 1981 meeting. All those present voted in favor of the motion. Mr. Chambers moved, seconded by Mr. Shawan,to approve the bill listing of August 17 1981 (attached). All those present voted in favor of the motion. The Clerk read a notice from the Ohio Department of Liquor Control in Muirfield Country Club was requesting a D4 liquor permit. Mr. Shawan seconded by Mr. Lewis, not to object to the issuance of said permit. the motion was unanimous for approval. which the moved, Vote on Resolution No. 39-81 Said resolution dealing with specific standards and procedures for the Board of Zoning Appeals was read for the second time. Mr. Lewis moved, seconded by t1r. Shawan, to table said resolution until January 1982. He said this would be the beginning of the new term for said Board and felt it would be more appropriate to consider these regulations at that time. During a discussion, Mr. Geese said he felt noti fication of BZA meetings was not sufficient to reach the general population and thought something should be done now such as requiring the meeting dates to be published in all three papers in Dublin. Mr. Chambers then requested the Village Manager to inform the Chairmen of all Boards, Commissions, and Committees that they should notify all newpapers in Dublin of impending meeting dates along with an agenda. Vote on the motion to table said resolution until January 1982 was approved with the vote as follows: 4 Yeas - Shawan, Chambers, Headlee, Lewis; 1 Nay _ Geese. Resolution No. 28-81 (Amended) Said resolution dealing with the adoption of Council Rules of Order was intro- duced by Mr. Chambers and read for the first time. Mayor Headlee requested any chanbes or corrections should be made by the September 14, 1981 meeting. Mr. Shawan suggested the Rules of Order allowed the Mayor too much control over discussions. He said he was not making inference to the present Mayor but he felt there was often not enough discussion on important issues. Mr. Chambers commended the committee for an excellent first writing of the Rules of Order and said he will have a few amendments and omissions prepared by the next meet- ing. Ordinance No. 41-81 Said ordinance dealing with accepting a bid for trash collection services was introduced by Mr. Geese and read for the first time. Mr. Josselyn, hauling contractor, Mr. Swenson, Flower Garbage, and a representa tive from Adco Disposal Systems, were present to answer any questions. Ordinance No. 42-81 Said ordinance dealing with the proposed change of zoning of the Adria tract of land was introduced by Mr. Shawano Mr. Shawan then questioned whether this ordinance should be considered because it would not be officially annexed to the Village until August 19. Mr. Smith said it should not be discussed until the 30 days are up and recommended waiting until the September 14 meeting or scheduling a special meeting. Form No. 1097 <~ II dd August 17, 1981 19 Page Two Mr. D'Alongzo, Adria Laboratories, was present and Mr. Chambers suggested to him that if he found reason to expedite this matter within the next few days he thought Council would be willing to hold a special meeting. Mayor Headlee told Mr. D'Alonzo to call Mr. Smith if a special meeting would be necessary I and allow time for notification of a public hearing to be sent to contiguous property owners and the newspapers. Ordinance No. 44-81 Said ordinance dealing with the change in zoning or Pinney and Frantz Roads was introduced by Mr. Shawan and read for the first time. Mr. Lewis corrected the location state in the title from "northeast" to "southwest" corner. A public hearing on this proposal is scheduled for September 14, 1981 at 7:30 P.M Resolution No. 41-81 Said resolution dealing with an agreement with the Franklin County Commissi()ner~ regarding the H.C.D. Funds was introduced by Mayor Headlee and read for the first time. Mr. Lewis moved, seconded by Mr. Shawan, to dispense with the I three-time reading rule and pass as an emergency. Vote on the motion and resoli ution was unanimous for approval. Discussion on a proposed annexation of a section of Dublin Road Mr. Sheldon said this is 1.664 acres which is a section of Dublin Road bounded on the north by Tuttle Road and 1180 feet south and approximately 100 feet north of Thornhill Lane. He said Franklin County has petitioned that this area be annexed to Dublin and asked if Council had any objections. After some dis- cussion, Mr. Shawan moved, seconded by Mr. Chambers, not to object to the annexation. Vote on the motion was unanimous for approval. Discussion on use of Municipal Buildinq as a Voting Place Mr. Sheldon said the Franklin County Board of Elections has requested that the Municipal Building be used as a voting place. He said two (2) precincts of Ward number 4 would use this area and asked Council for their consideration. Mr. Chambers questioned whether this was legally possible since persons running for office would be working in the building on election day. Mr. Smith said that law refers to campaigning within so many feet of the polls and within so many hours during the time the polls are open. He said other suburban cities use their Municipal building and he did not see any problem with it. Mr. Chambers then moved, seconded by Mr. Shawan, to welcome the Board of Elec- tions to use the Municipal building and, more specifically, the Council Chambers for a voting place. Vote on the motion was unanimous for approval. It was mentioned at this time that the Planning and Zoning Commission would need to reschedule their meeting place on election night to a room upstairs in the Municipal building. Discussion on fencing of Cemetery Herb Jones, Chairman of the Cemetery Commission was present for this discussion. He said the Commission would like permission to bid for purchase and installa- tion of a chain link fence across the southern and eastern portion of the cemetery. He added the sillnewall would be continued along the west side on Monterey Drive and the north side to the Church at some future date. Mr. Geese moved that the Village Manager advertise for bids as submitted. Mr. Lewis seconded the motion and further moved to include the recommendation of the Cemetery Commission to ask the Maintenance Department to do the preliminary work required for any grading, survey lines, etc. Vote on the motion was unani- mous for approval. Form :No. 1097 .,'t~ Held August 17, 1981 19 Page Three Mr. Chambers then moved, seconded by Mr. Shawan, that bids be taken at the same time for an iron post type fence so a comparison in price can be made. Vote on the motion was unanimous for approval. Council Roundtable Discussion Mr. Geese requested Mr. Smith to contact the Franklin County Commissioners and request they check with the Perry Township Trustees concerning the millage charged to Dublin residents. Mr. Geese said he would like to know why Dublin residents are paying this millage while Perry Township residents in Columbus and Worthington are not. Mr. Chambers said he is in the process of briefing organizations, individuals, and candidates for Council, on the tax increase bond issue. He said he had hoped to have a slide presentation prepared to simplify the issues involved but found it to be expensive. He said he now plans to ask the Village staff to assist in preparing drawings to transfer to slides which will cut down on the cost of this project. Also, he commented on the drawing depicting changes in the traffic on the bridgE which he presented at the August 3, 1981 meeting. He said he has received many favorable comments and none unfavorable. Mr. Shawan suggested that prohibiting the left turn going north on Riverside Drive be enforced during the evening rush hour only and Mr. Chambers agreed. Mr. Shawan said he is concerned with the Dublin Cli ffs development which was recently approved by Planning and Zoning. He said there has been considerable flooding in this area and would like the Village to make sure any additional water run-off caused by developing can be eliminated. He said he would like this checked into before the Dublin Cliffs development get underway. Mr. Smith referred to the Charter amendment which will appear on the November ballot and informed Council the Board of Elections has authority to modify the language so the subject will fit on the ballot. Also, he said he has contacted Union County of the Adria land being annexed to the Village and said future police and fire protection for this area are being discussed. Mayor Headlee reminded Councilmembers of the Ohio Municipal Officials outing at Rickenbacker Air Force Base August 27, 1981. She said reservations are needed should any members desire to attend.
