The regular meeting of Council was called to order by Mayor Headlee at 7:30 P.M.
Those present were: Chambers, Geese (arrived 7:40), Headlee, Mand, Maurer,
Shawano Mr. Lewis was absent from the meeting. Also present were Mr. Smith,
Law Director, Mr. Sheldon, Village Manager, and Mr. Wolfe, Village Engineer.
This being a Public Hearing for Ordinance No. 44-81 dealing with the proposed
rezoning of a 1.699 acre tract on the southwest corner of Pinney and Frantz
Roads, members of the Planning and Zoning Commission present were Mr. Amorose
and Mr. Jezerinac.
Mr. Shawan moved, seconded by Mr. Chambers, to approve the minutes of the
August 17, 1981 meeting. Vote on the motion was as follows: 3 Yeas - Chambers
Headlee, Shawan; 2 Abstentions - Mand, Maurer. Mr. Chambers moved, seconded
by Mr. Shawan, to approve the bill listing (attached) for September 14, 1981.
All those present voted in favor of the motion.
The Clerk read correspondence from the Ohio Department of Liquor Control noti-
fying Council that the Wine and Cheese Emporium, Ltd., Co., 305 W. Bridge St.,
is requesting a CI and C2 permit. Mr. Shawan moved, seconded by Mr. Mand, to
not object to this request. All those present voted in favor of the motion.
A letter from Phil Hill, Chairman, Parks and Recreation Committee (attached)
was then read to Council. In response to said letter, Mr. Mand made a motion
to ask the Village Manager and Assistant Village Manager to review procedures
relative to transmitting material that is pertinent to the Parks and Recreation
Committee before decisions are made by Councilor any other body of the Village.
Mr. Chambers seconded the motion and added that the Parks and Recreation Com-
mittee should in turn respond promptly to Council. He said discussion of the
riverbank land and land across the river was presented to the Committee by him
approximately a year ago and he has asked about it several times since then
with no satisfactory response. Vote on the motion was unanimous for approval.
Mr. Smith commented on the status of the Income Tax issue and whether or not it
would be permitted to appear on the November ballot since there was no record
of it being filed with the Franklin County Board of Elections. He said the
Board of Elections voted 2-2 to permit placing the issue on the ballot so the
Secretary of State is required to cast a deciding vote. Mr. Smith expected to
receive a decision no later than Thursday, September 17, 1981. Mr. Chambers
moved, seconded by Mr. Mand, to tentatively schedule a Special meeting for
Monday, September 21, 1981 at 5:00 P.M. should the Secretary of State's deci-
sion require Council to prepare for a Special Election for December 8, 1981.
At this time Council will decide whether or not to leave the Bond issues on the
November ballot. Vote on the motion was unanimous for approval.
Ordinance No. 44-81
Said ordinance, dealing with the proposed change of rezoning of a 1.699 acre
tract on the southwest corner of Pinney and Frantz Roads, was read for the
second time. This being a public hearing on said ordinance, there was no one
present to oppose the rezoning.
Mr. Richard A. Lavinsky, Attorney for the owners of said property, was present
to speak for the rezoning. He said his client is requesting the rezoning for
the purpose of establishing office space for the firm of Enlow, Holdrieth and
Company, CPA's. Mr. Jezerinac asked what the plans were for the corner lot and
Mr. Lavinsky said there were none at this time.
The application was then referred to the Planning and Zoning Commission for
their consideration at the October 6, 1981 meeting.
Resolution No. 28-81 (as amended)
Said resolution dealing with adopting Council Rules of Order was read for the
second time. Mr. Chambers submitted a list of amendments for Council members ,
consideration before the third reading at the September 28th meeting. Mr. Mand

requested that any other changes be made available to Council members before
the September 28th meeting.
Ordinance No. 41-81
Said ordinance dealing with accepting a bid for trash collections was read for
the second time. The bid of Waste Management of Ohio - Columbus (aka Adco) was
the chosen bidder at $8,475.00 per existing 1665 homes within corporate limits
plus $5.09 per month per resident in excess of the current 1665 homes. Service
will begin October I, 1981 and terminate September 30, 1983. Mr. Shawan moved,
seconded by Mrs. Maurer, to dispense with the three-time reading rule and pass
as an emergency. Vote on the motion and ordinance was unanimous for approval.
Ordinance No. 42-81
Said ordinance dealing with a proposed change of zoning to LI (Limited Indus-
trial) of a 104 acre tract west of Avery Road and south of Post Road was intro-
duced by Mr. Shawan and read for the first time. A Public Hearing was estab-
lished for October 5, 1981 at 7:30 P.M. to discuss the rezoning.
Ordinance No. 43-81
Said ordinance dealing with accepting a bid for Trails End Drive waterline was
introduced by Mr. Geese and read for the first time. 4D Haulage and Excavating
was the chosen bidder at $17,300.96. Mr. Mand moved, seconded by Mr. Geese,
to dispense with the three-time reading rule and pass as an emergency. Vote
on the motion and ordinance was unanimous for approval.
Ordinance No. 45-81
Said ordinance contracting to employ a Village Planner was introduced by Mr.
Geese and read for the first time.
During discussion, Mr. mand suggested a thorough examination be made of the
services of our Planner and that consideration be given to other planning ser-
vices. He felt Council needed to discuss the role and function of a Planner
before voting on the ordinance. Mrs. Maurer suggested hiring someone that
would work solely for Dublin. Mr. Chambers said he would like a recommendation
from the Planning and Zoning Commission and Mr. Mand said he would present this
issue at the Commission's September 15, 1981 meeting.
Ordinance No. 46-81
Said ordinance dealing with accepting a bid for fencing along the Cemetery was
introduced by Mrs. Maurer and read for the first time.
Madge Shriver, of the Cemetery Commission, said they recommended a chain link
fence because it is less expensive and the area to be fenced would not be in
public view. Mr. Chambers said he preferred an iron fence because it would
last longer.
After further discussion, it was the general concensus to accept the bid of
Abe Ziadek for chain link at $7,625.00. Mr. Mand moved, seconded by Mr. Geese,
to dispense with the three-time reading rule and pass as an emergency. The
motion failed with the vote as follows: 4 yeas - Geese, Headlee, Mand, Chambers
2 hays - Maurer and Shawano
Resolution No. 42-81
Said resolution dealing with an agreement for housing prisoners ln Union County
was introduced by Mr. Shawan and read for the first time. Mr. Mand moved,
seconded by Mr. Geese, to dispense with the three-time reading rule and pass
as an emergency. Vote on the motion and the resolution was unanimous for
approval.

Ordinance No. 47-81
Said ordinance dealing with a police mutual aid agreement with Union County
was introduced by Mr. Shawan and read for the first time. Mr. Mand moved, I
seconded by Mr. Geese, to dispense with the three-time reading rule and pass as
an emergency. Vote on the motion and the ordinance was unanimous for approval.
Acceptance of Plat for Royal Lytham Ct. - Muirfield
Mr. Howard Adams was present to request approval of said plat. Mr. Geese moved
seconded by Mr. Mand, to approve the request. Vote on the motion was unanimous
for approval.
Council Roundtable Discussion
Mr. Mand referred to the BZA minutes of August 29, 1981 and objected to BZA's
procedure in handling the Conditional Use application of Dr. Porter's Car Wash.
He said P & Z disapproved the application and BZA has requested the applicant
revise his plans. According to our ordinances, BZA has no authority to take
this type of action. Mr. Mand asked Mr. Smith to clarify the function of BZA
and Mr. Smith said he would have a legal opinion prepared by the September 28,
1981 meeting.
Mr. Shawan suggested Council should request that BZA should not take action on
this application until after Mr. Smith's opinion is reviewed at the September
28th meeting.
Mr. Geese commented on the duplicate tax levy that affects Dublin residents in
Perry Township. He referred to Mr. Smith's memo stating Perry Township's
"legal advisor told them the police and road levies cannot be removed or im-
posed upon only a part of the taxing district." Mr. Geese said there are other
alternatives available. Mr. Smith said he is preparing litigation concerning
this issue and will keep Council informed.
Mr. Chambers said he feels the majority of Dublin/Perry Township residents do
not know they are being taxed twice. He said there is a Perry Township tax
increase on the November ballot and asked the assistance of the press to inform
these residents of the increase and that they are paying duplicate taxes.
Mr. Chambers questioned whether we have adequate equipment to fight fires that
could occur in anyone of the large buildings newly constructed in Dublin. He
made a motion, seconded by Mr. Shawan, that a committee of Council pursue this
matter to see in what way it can be of help in this matter. Vote on the motion
was unanimous for approval.
Mayor Headlee said she and Mr. Sheldon have discussed this problem over the past
five or six months and more information should be available within the next
three weeks. She said she would appoint a committee, if necessary, at the
September 28, 1981 meeting.
Mr. Shawan expressed concern about further development on the east side of
Sawmill Road (Columbus) and the increased water run-off this would cause for
Dublin residents to the west. After further discussion, Mr. Smith said he
would talk with Mr. Wolfe and consider the possibility of filing a temporary
injunction against this development. Mr. Shawan then moved, seconded by Mrs.
Maurer, to authorize the Law Director to follow up on this problem to the full-
est extent possible. Vote on the motion was unanimous for approval.

Mayor Headlee announced "Beggars Night" would be Thursday, October 29, this
year.
She expressed disappointment in the turnout for the "Concert in the Park" with
Jeff Reed. She said it was enjoyed by those who did attend. She then thanked
those who were responsible for the art show in Dublin held September 13, 19BI
and hoped it would be planned again for next year.
Also, she said Bob Karrer has requested Council meet with the Historical
Society for the purpose of showing final plans of the area around the Spring
house. Their meeting is tentatively planned for October 27, 1981.
Mayor Headlee adjourned the meeting at 9:05 P.M.
