The regular meeting of Council was called to order by Mayor Headlee at 7:30 P.M.
with the following members present: Chambers, Geese, Headlee, Lewis, Maurer,
Shawano Mr. Mand was absent from the meeting. Also present were Mr. Sheldon,
Village Manager, Mr. Wolfe, Village Engineer, Mr. Smith, Law Director, and
Mr. Gunner, Assistant Law Director.
Mr. Shawan moved, seconded by Mr. Geese, to amend the paragraphs referring to
the discussion of a possible violation of the election laws by Councilmembers.
Vote on the motion was as follows: 5 Yeas - Geese, Headlee, Lewis, Maurer,
Shawan; 1 Nay - Mr. Chambers. Mrs. Maurer then clarified the last paragraph
of that discussion and it was decided to include that clarification in the
amendment. Mr. Geese moved, seconded by Mr. Lewis, to approve the minutes as
amended. Vote on the motion was as follows: 5 Yeas - Geese, Headlee, Lewis,
Maurer, Shawan; 1 Nay - Chambers. Mr. Shawan moved, seconded by Mr. Geese,
to approve the bill listing of December 7, 1981. Vote on the motion was unani-
mous for approval.

Ordinance No. 51-81
Said ordinance dealing with amending the Zoning Code concernlng procedures for
determining uses was read for the second time. This being a Public Hearing,
proponents/opponents of the amendment were asked to register. Mr. Gunner then
explained the purpose of this proposed amendment. Mr. Smith suggested that
perhaps this determination should not be made by the P & Z Commission, but
that it should be an administrative function and be determined by Mr. Sheldon.

Mr. Sheldon said since this is the second reading and should Mr. Smith's sug-
gestion be accepted, he would like to have time to consider any changes
Council members might want to make.
Mayor Headlee then introduced Bob Stippel who introduced members of his Weblo
Den. The boys were working on their Citizenship Award and thought observation
of a Council meeting would be an appropriate experience.
Ordinance No. 42-81
Said ordinance dealing with the proposed

Ordinance No. 52-81
Said ordinance dealing with the proposed Compensation Plan for Village Employee
was read for the third time.
Mr. Lewis moved, seconded by Mr. Shawan, to amend Section 8., paragraph E, to
include a provision that calls for any increase during the period of automatic
increases, as stipulated in paragraphs Band C incorporating a merit increase
in addition to the automatic increase which exceeds 14% in anyone year, be
subject to the further approval of Council. Vote on the motion was unanimous
for approval.
Ordinance No. 54-81
Said ordinance,dealing with accepting a petition for annexation to Dublin of
1.644 acres (portion of Dublin Road - roadway only) south of Tuttle Road and
north of Thornhill Lane, was read for the second time.
Ordinance No. 55-81
Said ordinance dealing with accepting a Quit Claim Deed for open space of
1.1272 acre tract of land approximately at the intersection of Frantz and Rings
Road was read for the second time.

Mr. Lewis said since the deed was prepared by Sherex and it is only by infer-
ence that Western Electric land is included in the deed he moved to table said
ordinance until a comparable Quit Claim Deed is received from Western Electric.
Mrs. Maurer seconded the motion and vote on the motion was as follows: 5 Yeas-
Headlee, Lewis, Maurer, Shawan, Chambers; 1 Nay - Geese.
Resolution No. 50-81
'Said resolution, dealing with declaring an intent to appropriate property to
create a turn-around and dead-end on Thornhill Lane, was read for the second
time. It was pointed out at this time that two signatures are needed from
residents in order to acquire easements to complete this turn-around.
Resolution No. 51-81
Said resolution,dealing with accepting amounts and rates determined by the
Budget Commission, was introduced by Mr. Shawan and read for the first time.
Mr. Lewis moved, seconded by Mr. Shawan, to dispense with the three-time read-
ing rule and to pass as an emergency. Vote on the motion and the resolution
was unanimous for approval.
Ordinance No. 57-81
Said ordinance, dealing with approval of the inclusion of updates in the
Codified Ordinances for 1981, was introduced by Mr. Lewis and read for the
first time. Mrs. Maurer moved, seconded by Mr. Geese, to dispense with the
three-time reading rule and pass as an emergency. Vote on the motion and
ordinance was unanimous for approval.
Ordinance No. 58-81
Said ordinance, dealing with a proposed rezoning of 39 acres to PUD on the
southeast edge of Muirfield, was introduced by Mr. Shawan and read for the
first time. The ordinance will next appear before the P & Z Commission at
the January meeting.
Ordinance No. 59-81
Said ordinanc~dealing with amending Ordinance No. 46-81 and accepting an alter
nate fence bid, was introduced by Mr. Geese and read for the first time. The
next low bidder was Byers Fence Company at $8,208.00. Mr. Geese moved, second-
ed by Mr. Lewis, to dispense with the three-time reading rule and pass as an
emergency and to accept the Byers Fence Company's bid. Vote on the motion and
ordinance was unanimous for approval.
Ordinance No. 60-81
Said ordinance, dealing with the proposed appropriations for the fiscal year
1982, was introduced by Mr. Lewis and read for the first time. Mr. Sheldon
said he or Nan Trissel, Finance Director, will be available to answer any
questions Council members may have regarding this ordinance.
Acceptance of Final Plat - Muirfield Phase 18, Section 1
Mr. Howard Adams was present to request acceptance of said plat. Mr. Smith
said Council could accept the plat subject to approval of the bond requirements
Mr. Chambers moved, seconded by Mr. Lewis, to accept the plat with said condi-
tion and vote on the motion was unanimous for approval.
Applicants Request to Install a Tele-communication Dish Antenna
Mr. Smith informed Council that there has been a request for installation of
said antenna on residential property zoned RI next to the freeway on the west
side of 257, north of the outerbelt. He said the present Zoning Code has no

classification for the disc, however, under Section 163.25 it allows Council to
permit a use in a district in unusual situations. He said before Council took
any action, he wanted to put it on the agenda for a formal discussion and
notify any contiguous property owners of the proposed installation.
Mr. Sheldon added this falls under the "Exceptional Use District" in the Zoning
Code.
Council Roundtable Discussion
Mr. Lewis referred to the joint meeting of Council and the Dublin Historical
Society and a letter of October 27th from Mr. Reese, President of that Society.
He wondered if any direct action had been taken in working out an agreement
for the use of the Coffman property by the Historical Society and it not,
encourage initiation of such action.
Mr. Sheldon said he had talked to Mr. Reese and a date will be scheduled for
a meeting with Mr. Loveland, their legal advisor, to discuss the agreement as
soon as possible.
Mr. Lewis asked Mr. Smith if the B.O.R. grant can be applicable to a life
estate. Mr. Smith said he would check into it.
Mr. Geese moved, second by Mr. Lewis, to offer to pay half the cost of repair-
ing the storm drainage with Dale Properties in front of the Honda building on
S.R. 161. At Mr. Sheldon's suggestion, Mr. Geese added the motion include
appropriations for the proper amount of funds to do so. Vote on the motion
was unanimous for approval.
Mr. Geese referred to a memo from Charles Wolfe of October 3rd regarding the
Billingsley Ditch problem and asked if there is anything new to report. (See
October 9th minutes.) Mr. Wolfe said there is not much he can do until the
residents decide on an attorney and in what direction they are going to go.
He said he would be willing to meet with each individual resident to discuss
their particular problem.
After further discussion and comments from residents in that area, Mr. Chambers
said he would like to see a report from Mr. Wolfe suggesting other possibilitie~
to correct the problem besides a legal injunction.
Mr. Lewis then suggested that it might be advantageous for Mr. Wolfe, Mr. Smith,
and the residents to have a meeting to discuss a plan of action so that every-
one can agree to questions that need to be answered.
Mr. Chambers referred to a letter from Mr. Parkinson regarding Martin Road and
the lack of a through street to/from Riverside Green area. He said he would
like Mr. Sheldon, with the concurrence of the entire Council, to advise Mr.
Parkinson that our citizens have discussed this matter repeatedly and do not

Mrs. Maurer reminded Councilmembers and Mr. Chambers that, according to Section
505 of the Charter, Councilmembers should advise the Manager what they would
like to have done and in turn the Manager would inform the proper administra-
tive staff member. She said this was in reference to Mr. Chambers asking
Mr. Wolfe to prepare a particular report on the Billingsley Ditch problem.

Mayor Headlee reminded everyone to vote tomorrow.
Ron Jezerinac asked Council to give some thought as to whether they would like I
to have a representative from MORPC present at the Council meetings.
Mayor Headlee adjourned the meeting at 9:00 P.M.
