AUTHORIZING THE SUBMISSION OF A PETITION FOR THE REGULAR
ANNEXATION OF 79 ACRES, MORE OR LESS, OF PROPERTY FROM
DARBY TOWNSHIP, MADISON COUNTY TO THE CITY OF
DUBLIN, OHIO
WHEREAS, the City of Dublin desires to annex from Darby Township 79 acres, more or
less, of property located south of Plain City-Dublin Road, west of Houchard Road, and
segmented by the New York Central Lines Railroad that is owned in fee simple by the
City of Dublin as legally described in the attached Exhibit A and depicted in the annexation
plat attached hereto as Exhibit B; and
WHEREAS, pursuant to Ohio Revised Code Section 709.02, the City of Dublin, as the
majority of the owners of real estate contiguous to land already within the City of Dublin,
may petition the Board of County Commissioners of Madison County, State of Ohio, for
a regular annexation; and
WHEREAS, upon receipt of an annexation petition from the City of Dublin for the
annexation of the property, the Board of County Commissioners of Madison County, State
of Ohio, shall schedule a hearing for the annexation petition.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin, Delaware,
Franklin, and Union Counties, State of Ohio, _-S__ of the elected members concurring,
that:
Section 1. The City of Dublin hereby authorizes a petition for annexation of 79 acres,
more or less, of property located south of Plain City-Dublin Road, west of Houchard Road,
and segmented by the New York Central Lines Railroad that is owned in fee simple by
the City of Dublin as legally described in the attached Exhibit A and depicted in the
annexation plat attached hereto as Exhibit B.
Section 2. The City Law Director is hereby appointed the Agent of the Petitioner and
the Law Director and City Clerk are hereby authorized to file a regular annexation petition
for this property with the Board of County Commissioners of Madison County, State of
Ohio, to submit all required paperwork and evidence, and to appear before the
Commission on behalf of the City of Dublin for all necessary hearings.
Section 3. This Ordinance shall take effect and be in force from and after the earliest
date allowed by law.

Madison County to the City of Dublin
Background
The City of Dublin recently acquired approximately 243 acres of land in the West Innovation District
which can be leveraged for a number of strategic opportunities related to economic development,
transportation enhancements, and recreational expansions. This land is split between Franklin and
Madison Counties and currently falls outside the corporate boundaries of the City of Dublin.
The City intends to pursue the annexation of the land in Franklin County and Madison County under
two separate annexation proceedings and processes. This memorandum addresses the Madison
County annexation which will be handled as a regular annexation.
Regular Annexation Process
Ohio R.C. Section 709.02 governs the regular annexation process. It requires at least 51% of the
owners of real estate within the proposed area to be annexed to sign and file the petition. The City
of Dublin is the sole landowner for this 79-acre parcel and is thus able to file the petition.
The regular annexation process is not as perfunctory as the municipal property annexation process
and requires a hearing before the Madison County Board of County Commissioners. At that hearing,
the City and Darby Township will be represented and present evidence in favor of the annexation.
The County Commissioners are required to review objective, statutory criteria in their decision of
whether or not to grant the annexation.
The City Law Director recommends this regular annexation process for Madison County land rather
than the municipal annexation process because of the City’s longstanding policy and desire to
conform boundaries and place all land within the City of Dublin also within Washington Township.
By following the general annexation process, the City preserves the right to conform the City’s
boundaries with those of Washington Township. Under the municipal annexation process, the land
annexed remains within the township it sits—here, Darby Township.

Staff recommends approval of Ordinance 39-24 at the October 21, 2024 City Council Meeting.
