HomeMy WebLinkAboutResolution 41-24RECORD OF RESOLUTIONS BARRETT BROTHERS - DAYTON, OHIO Form 6301 Resolution No._41-24 Passed , AUTHORIZING THE CITY MANAGER TO APPLY FOR AND EXECUTE A GRANT AGREEMENT TO ACCEPT GRANT FUNDING FROM THE CLEAN OHIO CONSERVATION PROGRAM ADMINISTERED THROUGH THE OHIO PUBLIC WORKS COMMISSION FOR THE WATERWAYS MAINTENANCE PROGRAM, YEAR 2 (2025) PROJECT (24-016-CIP) WHEREAS, the State of Ohio, through the Ohio Public Works Commission, has made grant funding available through the Clean Ohio Conservation Program for the Waterways Maintenance Program, Year 2 (2025) Project (24- 016-CIP); and WHEREAS, the intention of this grant is consistent with the purpose of the Waterways Maintenance Program, Year 2 (2025) Project, which provides for the maintenance of waterways located in City-owned areas or areas where the City has maintenance responsibility through an established easement; and WHEREAS, it is in the best interest of the City of Dublin to take advantage of the opportunities provided by the Clean Ohio Conservation Program by applying for grant funding; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, Delaware, Franklin and Union Counties, State of Ohio, __ "7 of the elected members concurring, that: Section 1. The City Manager is hereby authorized to apply to the Ohio Public Works Commission for Clean Ohio Conservation Program grant funding for the Waterways Maintenance Program, Year 2 (2025) Project (24-016-CIP). Section 2. The City Manager is hereby authorized to execute a grant agreement with the Ohio Public Works Commission and accept grant funding through the Clean Ohio Conservation Program for the Waterways Maintenance Program, Year 2 (2025) Project (24-026-CIP) should funding be awarded. Section 3. This Council further hereby authorizes and directs the City Manager, the Director of Law, the Director of Finance, the Clerk of Council, or other appropriate officers of the City to prepare and sign all other agreements and instruments and to take any other actions as may be necessary to implement this Resolution. Hendershot, P.E., Director of Utilities and Stormwater Management Re: Resolution 41-24 – Authorizing the City Manager to Apply for and Execute a Grant Agreement to Accept Grant Funding from the Clean Ohio Conservation Program Administered through the Ohio Public Works Commission for the Waterways Maintenance Program, Year 2 (2025) Project (24-016-CIP) Background The City of Dublin proactively monitors various sources to identify potential funding opportunities that match well with our identified current or future initiatives. Staff identified the Clean Ohio Conservation Program (Program), administered through the Ohio Public Works Commission, as a potential funding source for the City’s Waterways Maintenance Program within the Capital Improvements Program (CIP). The Program provides grant funding for up to 75-percent of the estimated costs for projects that acquire green space for environmental conservation or protect and enhance riparian corridors, streams, rivers, lakes and other bodies of water. Summary The Waterways Maintenance Program Year 2 (2025) Project (Project) includes the bank stabilization of nine sites along various waterways in the City of Dublin. The Project consists of clearing and grading activities, stream bank reshaping and stabilization, riprap and erosion protection matting installation, installation of temporary sediment controls, permanent stabilization of disturbed areas and riparian buffer zone plantings to enhance channel stability. The Project was identified as part of the Waterways Maintenance Program, which has been established to preserve and improve the stability and flood carrying capacity of the waterways and to protect riparian corridors and infrastructure. The nine sites included in the Project were prioritized based on the severity of erosion and other relevant factors. City Council approved the Waterways Maintenance Program as part of the 2024-2028 CIP. The Program requires a deed restriction be recorded for project areas occurring on City-owned property and a conservation easement be recorded for project areas occurring on private property wherever Program funding and local match funding are utilized. Based on this requirement, and in review of the nine sites along various waterways within the Project compared to the initiatives of the Program, Staff has identified Site 28 within the Project as a viable candidate for consideration to receive grant funding through the Program. Site 28 is located along Tonti Creek, which is within the City-owned Reserve C of the Wyandotte Woods subdivision, south of Wyandotte Woods Boulevard, west of Boylston Court. Staff does not have concerns with placing a deed restriction on Reserve C of the Wyandotte Woods subdivision for the purposes of environmental conservation, as this area is a passive open space that is heavily wooded. The Ohio Public Works Commission requires City Council to pass a resolution that authorizes the City Manager to apply for grant funding through the Program. Staff is currently reviewing the 90% construction drawings for the Project. The 90% engineer’s opinion of probable construction cost for the Project is $1,600,000, which includes $185,000 for Site 28. The total cost of Site 28, including design and construction administration, is $268,000, which is the basis for the grant application request of $200,000. The budgeted funds for the Project in the adopted 2024-2028 CIP is $800,000 in 2024 and $200,000 per year in 2025-2029. Staff will seek additional funding appropriations during the 2025-2029 CIP adoption process. Construction activities for the Project are expected to commence in summer 2025 and be completed in spring 2026. Recommendation Staff recommends Council approval of Resolution 41-24 authorizing the City Manager to apply for and execute a grant agreement to accept grant funding from the Clean Ohio Conservation Program administered through the Ohio Public Works Commission for the Waterways Maintenance Program, Year 2 (2025) Project (24-016-CIP).
