NECESSARY CONVEYANCE DOCUMENTS AND CONTRACTS TO

RIGHT-OF-WAY, WITHOUT LIMITATION TO EXISTING ACCESS
RIGHTS, AND A 0.066 ACRE TEMPORARY CONSTRUCTION AND
GRADING EASEMENT, FROM GFS MERGER III, LLC, FROM THE
PROPERTY LOCATED AT 3907 WEST DUBLIN GRANVILLE
ROAD, FOR THE PUBLIC PURPOSE OF CONSTRUCTING
ROADWAY IMPROVEMENTS, AND A SHARED USE PATH, WHICH
WILL BE OPEN TO THE PUBLIC WITHOUT CHARGE
WHEREAS, the City of Dublin (“City”) is preparing to construct the Dublin Center Drive
Shared Use Path Project, 22-023-CIP (“Project”); and
WHEREAS, the Project requires that the City obtain the following property rights from
the parcel identified as Franklin County Parcel Number 273-009145-00, owned by GFS
Merger III, LLC (“Property Owner”), as described in the attached Exhibits A and
depicted in the attached Exhibits B:
e 2-WD: a 0.077-acre fee simple right-of-way, without limitation to existing
access rights.
e 2-T: a 0.066-acre temporary construction and grading easement.
WHEREAS, the City and Property Owner participated in good faith discussions and
have come to mutually agreeable terms for the acquisition of the necessary property
rights for the sum of $56,006.00; and
WHEREAS, the City desires to execute and accept necessary conveyance documents
and contracts to complete the transaction between the City and Property Owner.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Dublin,
Delaware, Franklin, and Union Counties, State of Ohio, (, _ of the elected members
concurring that:
Section 1. The City Manager is hereby authorized to execute and accept all
necessary conveyance documents and contracts to acquire the above referenced
property rights from the property located at 3907 W. Dublin Granville Road, identified
as Franklin County Parcel Number 273-009145-00, from Ohio State University
Physicians, Inc., for the sum of $56,006.00.
Section 2. Council further hereby authorizes and directs the City Manager, the
Director of Law, the Director of Finance, the Clerk of Council, or other appropriate
officers of the City to take any other actions as may be appropriate to implement this
Ordinance without further legislation being required.
Section 3. This Ordinance shall take effect upon passage in accordance with
4.04(b) of the Dublin Revised Charter.

Re: Ordinances 27-24 and 28-24 – Acquisition of Right-of-Way and Temporary
Easements for the Dublin Center Drive Shared Use Path Project (22-023-CIP)
Background
The Dublin Center Drive Shared Use Path Project (Project) constructs 618 feet of shared use path
from the northwest corner of Stoneridge Lane north to the existing path on Dublin Granville Road.
The Project will provide a valuable connection between existing shared use paths and greatly
improve the shared use path network connectivity in the area. The Project will also construct
Americans with Disabilities Act (ADA) compliant curb ramps at Dublin Center Drive and Stoneridge
Lane. Please see the attached Project Location Map and Acquisition Exhibits A and B for reference.
Summary
The final alignment for the Dublin Center Drive Shared Use Path requires the acquisition of right-
of-way and a temporary easement from each of two commercial properties along Dublin Center
Drive. The properties are identified as Parcel 1 (3900 Stoneridge Lane) and Parcel 2 (3907 West
Dublin Granville Road) on the Project Location Map. Parcel 1 is owned by Ohio State University
Physicians, Inc. and Parcel 2 is owned by GFS Merger III, LLC (also known as Gordon Food
Services).
The City utilized ms consultants, Inc. as the primary point of contact with the Property Owners of
Parcel 1 and Parcel 2 throughout the negotiation and acquisition process. The acquisition from
Parcel 1 provides 0.049 acres of new fee simple right-of-way and the acquisition from Parcel 2
provides 0.077 acres of new fee simple right-of-way. The temporary easements on each parcel are
necessary to construct the Project (grading, site restoration, etc.), but do not contain permanent
improvements to be maintained by the City. The City has participated in good faith discussions
with both Property Owners and has arrived at mutually agreeable terms for these acquisitions.
To construct the Project, two signs along the west side of Dublin Center Drive in line with the
proposed shared use path will need to be relocated. One sign is owned by Ohio State University
Physicians, Inc., and the other is owned by GFS Merger III, LLC. The signs’ existing locations were
approved by the City in 2009. The proposed locations for these signs were negotiated with each
Property Owner to remain a safe distance from the shared use path, while remaining visible for the
businesses. The proposed relocations were approved by the Planning and Zoning Commission on
May 2, 2024 as part of a Master Sign Plan (Case 24-058MSP). The case was approved by the
Planning and Zoning Commission with no conditions.

Acquisitions
A Good Faith Offer Letter, the appraisal report, and associated information were provided to the
Property Owner of Parcel 1 on January 3, 2024, and provided to the Property Owner of Parcel 2 on
January 29, 2024. The property acquisition consists of the following property rights from the

Ohio State University Physicians, Inc.: The good faith discussions with the Property Owner
have resulted in mutually agreeable terms for the acquisition of property interests and incidentals
of $36,550.08. The Property Owner agreed to the appraised value of the property interest of
$20,188.00, plus the cost to relocate the existing sign located in the Project’s shared use path
alignment of $16,362.08. The sign was not included in the appraised value as it currently exists
fully within right-of-way, as was approved by the City in 2009, and not within the acquired
property.
Gordon Food Services: The good faith discussions with the Property Owner have resulted in
mutually agreeable terms for the acquisition of the property interest of $56,006.00, which is an
increase of $1,719.00 above the appraised value of $54,287.00. This includes the cost to relocate
the existing sign located on the acquired property.
These Ordinances authorize the City Manager to execute and accept on behalf of the City all
necessary conveyance documents to formally acquire the necessary property interests from the
Property Owners.
Recommendation
Staff recommends adoption of Ordinances 27-24 and 28-24 at the second reading/public hearing
on July 1, 2024, as these ordinances authorize the City Manager to execute all necessary
conveyance and contract documents to formally accept the necessary property rights described
above.
