SPECIAL JOINT MEETING
DUBLIN VILLAGE COUNCIL AND PLANNNING AND ZONING COMMISSION
May 28, 1985
7:30 P.M.
The special joint meeting of the Dublin Village Council and the Planning
and Zoning Commission was called to order by Mayor James E. Lewis at
7:30 P.M. on Tuesday, May 28, 1985.
Mrs. Headlee led the Pledge of Allegiance.
Members of Council present were: Mr. Amorose, Mrs. Headlee, Mayor Lewis,
and Ms. Maurer. Mr. Close, Mr. Sutphen, and Mr. Thornton were absent.
Members of the Planning and Zoning Commission present were: Mr. Berlin,
Mr. Callahan, Mr. Jezerinac, Mr. Macklin, Mr. Miller and Mr. Reiner.
Mr. Smith, Law Director, and Mr. Banchefsky, Assistant Law Director were
present as were Mr. Sheldon, Village Manager, and Mr. Bowman, Village
Planner.
Mayor Lewis announced that the meeting was being held at the request of th
members of the Planning and Zoning Commission.
Mr. Bowman reported on a number of projects currently underway, planning-
wise.
1. To be designed this year, the tying in of the Shawan Falls inter-
section with Corbin's Mill and signalization of same either this
year or next.
2. Working with Vorelco trying to extend Shawan Falls, hopefully getting
some of the traffic onto the Frantz Road/Post Road intersection.
3. Examining a cut through from Monterey Drive to Corbin's Mill Drive,
to be designed this year.
4. Scioto Bridge project is scheduled to be bid on November 7, 1985.
5. Mr. Sheldon is working with the Mid-Ohio Regional Planning Commission
and the Ohio Department of Transportation to try and prioritize the
S.R. 161 improvement (going to four lanes).
6. The Administration has requested and received a proposal to look at
the traffic movement within the northwest quadrant; specifically
with regard to the expected traffic volumes within the quadrant; to
first identify future capital improvements and right-of-way needs
on existing street systems and secondly to develop a method of
extending Coffman Road and Avery Road or Muirfield Drive (south of
Post) between U.S. 33 and Post Road. Also to specifically look at
developing a means of interrupting the limited access right-of-way
on U.S. 33.
7. There is a public meeting scheduled on the West Branch Sewer for
June 6, 1985 at 8:00 P.M. in the Council Chambers. The latest word
is that Dublin should be prepared to tie in in 1988. Dublin's share

Mr. Bowman also said that given the number and complexities of land use
issues faced by Council and the Commission over the last two years there
appears to be a feeling (particularly among Commission members) that
critical land use decisions are being looked at on a case by case basis
rather than within an overall policy planning framework. The feeling
is that Dublin is now in a position to be able to manage growth or is
Dublin being managed by growth.
Following is a summarv of remarks and concerns expressed by individual
members of the Commission - all agreeing with the need for direction
and guidelines from Village Staff and Council.
Mr. Macklin
1. When examing applications on a case by case basis and approving same,
questions regarding traffic situations, availability of water, etc.
arise.
2. What is the capital improvement situation?
3. Tuller Road. At present it is not wide enough for two cars in the
winter, let alone the potential commercial traffic. Perhaps
developers should be required to finance portions of it so that it
does not become a burden to the entire Village of Dublin.
Mr. Reiner
1. Looking for direction on how to approach the problems. Some
communities require developers to pay a large percentage of the
"problems they are bringing in with their development".
2. Proposed 160 acre office park (McKitrick property). How are 5000
cars, twice per day, going to get out to S.R. 161/Frantz Road?
Who will be paying for all of this?
3. The applicant of the proposed office park made a verbal commitment.
but no fixed commitment to the community to help defray some of the
expenses.
Mr. Berlin
1. A major concern in trying to approve or disapprove reauests. Ne~d
Village Councilor some other authority to establish guidelines.
It does not seem fair to the developer to use conditions for him/her
to get approval (such as widening a road, a bridge). The Code
needs to be changed to "make it work right".
Mr. Jezerinac
1. Are the developers leading the Commission with regard to Planning or
is the Commission leading the developers?
2. The large increase in traffic along S.R. 161 and U.S. 33 from Avery
Road to Sawmill Road - same with Frantz Road. Recommend that no
development be allowed north of the bridge (the bridge over Post Road)
until "some of this is straightened out".
3. Also recommend that S.R. 161 between Sawmill Road and U.S. 33 be

Mr. Mi ller
1. The term capital improvements seems to be a "catch phrase".
2. Somme immediate concerns -
a. To alleviate the water pressure problem - a water tower is
needed.
b. Status of Tuller Road.
c. Status of Muirfield Boulevard extension.
3. McKitrick property situation. Checking on communities from
Washington, D.C. to San Franciso and determining that communities
more often than not are having these projects paid for. Who
negotiates? Council? Planning and Zoning?
Mr. Callahan
1. The Commission has not been able to "arm twist"!"negotiate" road
improvements or such dollars out of developers to any great extent
at all. Most communities that do have a history of sharing those
costs with the developers have the legal structure to do so.
Planning and Zoning does not have the legal power to do that.
2. Muirfield Boulevard to tie into the Avery Road extension needs to
be done. Perhaps the Village should explore and really convince
the State highway people that Dublin needs another interchange
between Avery Road and 1-270 and to tie Coffman Road into that
interchange.
3. The Planning and Zoning Commission does not have the legal authority
to deny any application for rezoning on the basis of inability to
provide capital development to serve them. That authority, with
limits, should be established.
4. The water pressure fluctuates greatly. The testing has not been
done at "peak" hours. A number of years ago there was discussion
of the development of new sections in Muirfield. At the time
Muirfield agreed to build or share in the cost of an elevated water
storage tank when it was needed in the northwest area.
5. The Commission seems to be in a quandry regarding some of the major
developments as to what is the Commission's responsibility regarding
the approval or disapproval and the consequent affect on the
ability of the community to deliver services.
Mr. Reiner commented that the Commission, in a very subjective way, has
been trying to "balance the budget" - commercial and residential.
Mayor Lewis said that he felt that there is definitely a lack of awareness
of a number of the things that are going on. He said that he did not
think it is anyone's fault but a lack of attention being directed in the
right spots.

1. Sawmill Road. The Village has been in negotiation for over six

Discussions have been held in an attempt to line up a five lane
intersection with that intersection going directly across Sawmill
to the east. On the Columbus side that intersection is to lead
into a loop road that will go around east and then south across S.R.
161, continue south, and come back in to the west and join Sawmill
Road south of the Sawmill Road/S.R. 161 intersection. The Village
does not know, however, when it will be built.
The reason that the intersection is important is because Dublin has
a plan to tie in that five lane intersection with Sawmill Road
into Tuller Road. Dublin had a commitment a year ago by the develop-
er of a proposed shopping center in the land to the south of Tuller
Road and to the west of the Len Immke dealerships to build that
complete exchange and to relieve the current sharp turn of Tuller
Road into Sawmill Road. The developers had financing problems and
the property has been sold. A meeting was held a week ago with the
new owner of the property (Continental Development) and he has been
more than cooperative in building the realigning of Tuller Road and
the intersection going into Sawmill Road. There have been some
delays but the project is underway.

2. Tuller Road. The improvement on Tuller Road is then planned to
coincide with the realignment of Tuller Road on the east end where
it intersects with Sawmill Road. At that time the Village will do
their improvements to Tuller Road. It is a commitment but what is
not known are the dates. After having listened to the new owner
and having worked out a solution on the Abbott and Kuenning propertie
for the right-of-way for the intersection, the intersection should
be completed by the end of 1986. At that time Dublin will make
additional improvements to Tuller Road. As it stands now, the
Abbott property situation "will not cost the Village a penny". The
road improvements will be similar to Frantz Road in the ability to ~
handle weight and a fair amount of traffic.
As any property on the south side of Tuller Road the Commission shoul
be aware of any additional rights-of-way needed for road improvement
or sewerlines or waterlines.

3. S.R. 161/Sawmill Road Intersection. Dublin applied for the four
laning of that road ten to fifteen years ago. It was re-emphasized
when Dublin got the change in priority on the bridge two or three
years ago. The problem when dealing with the state and federal
highway is that the Village is not just dealing with state and
federal agencies but also dealing with about four ~ayers of bureau-
cracy under each one of them. Then the Village is also dealing with
M.O.R.P.C., the county, etc. To get the project to move forward
depends primarily on federal funds. The first step, generally, in

The Village cannot do S.R. 161/U.S. 33 short of offering to pay
for it entirely on its own, which the Village cannot afford to do,
and even then Dublin would have to go through all of their red tape
in order to get permission to do it. The Village is continuing to
press for S.R. 161 from Corbin's Mill to Sawmill Road.
The development, particularly on the east side of the bridge, is a
major problem. On the south side of S.R. 161 there are approxi-
mately 35 50' lots that are 300' deep. Ideally to get something
doe with that land would be to get those property owners together to
agree on something. Such a meeting has been suggested several times
but so far Dublin has not been successful in accomplishing it.
Wendy's, with their expansion, is putting in some right hand turn
lanes and a traffic signal at their expense (which should help).

4. Bridge Schedule. It is to go out for bid in November. One reason
for the November bid is to give the contractor ample time during
the winter months to do a great deal of the construction. A lot
of it will be pre-fabricated. The bridge deck will be pre-stressed
concrete beams. Those beams will be built during the winter months
at the contractor's location. When the weather breaks the deck
work will be begun; perhaps resulting in a reduction of the
construction time from five months to four months. With the bridge,
the Village is committed to expand Bridge Street to the intersection
at High Street. That expansion will not be the final solution.

5. Intersection at Corbin's Mill/Shawan Falls Drive. The project is
moving along approximately on schedule. Shawan Falls Drive will
move all the way around to a northerly connector with Frantz Road.
There will be a cut through from Monterey Drive to Corbin's Mill
Drive (Reserve A) allowing some persons to enter the shopping
center without having to use S.R. 161. As soon as the intersection
is there and signaled, then the left hand turn lanes on Frantz Road
(into the shopping center) will be substantially changed. Major
improvements need to be made. With the traffic light at S.R. 161
and Corbin's Mill, traffic will be encouraged to use Corbin's Mill
Drive.

6. Coming north on Frantz Road going into Post Road. The Williams
Company has done a preliminary plan of expanding Post Road west at
least to the Coffman Road intersection. The state and federal high-
ways have been informed that the Village wants approval of a project
to put in a second bridge crossing 1-270. If approval is received
(Dublin cannot do it along) the Federal Government will pay 75%,
the state 10% or 15% fand Dublin will pay 10%. So that Post Road

7. Muirfield Drive Extension. The property that was previously not
for sale is now for sale. The property that was uncertain is now for
sale. An informal commitment has been received that the extension
of Muirfield Drive (at least two lanes running from the existing
terminus of Muirfield Drive southbound to the Avery Road/Post Road
intersection) will be built by the end of 1986 at no cost to the
Village of Dublin.

8. Avery Road/U.S. 33. This project is on the agenda with M.O.R.P.C.

9. Traffic Study. A request is in to the C.E. Williams Company. The
proposal was received by Mr. Sheldon on this date - that being for
a traffic study of the northwest quadrant of Dublin which includes th
Post Road Bridge, widening Coffman Road, the extension of Coffman
Road. The cost of the study is expected to be $20,000.00 and should
take approximately four months to complete.

10. Mayor Lewis mentioned the letter received from the Dublin Chamber of
Commerce asking the Village to widen Frantz Road to Tuttle Road so
that it would help relieve the traffic on the bridge. He noted that
even if Dublin were to go ahead with the other two lanes they could
not be completed before construction on the bridge would begin. When
the road was extended from Rings Road to Tuttle Road it was the
intent that as the population in that section and the Columbus sector
builds then the other two lanes would be added, probably around 1990
or some time thereafter. When the agreement was first reached with
Columbus they agreed to match the boulevard all the way to Hayden
Run. After the change of administration in Columbus, the commitment
to boulevard was withdrawn and the road was built so that what is
there now are the two center lanes and Columbus will add one lane
on each side.

11. Mayor Lewis noted that conversations have been held with both County
Commissioners and the City of Columbus on improving Glick Road
across the dam.

12. Meetings have been held with County Commissioners regarding four
laning Sawmill Road north of 1-270 to the Delaware County Line.
They plan to go ahead with that in late 1986 or 1987. There is a

13. Mayor Lewis said that Mr. Warner has been asked to prepare a list
and, to the extent that he can, give an estimated cost broken into
two parts - the design engineering and the ultimate construction cost
A distinction will also be made between those in which county, state,
or federal assistance can be expected. The remaining amount will be
reduced to a budget and then will work that into the Village's
forecasted income and expense over the next five years so that the
Village can tie in what has to be done in the way of road improve-
ments along with the connection to the West Branch Sewer. The
estimate in 1980 was that the cost would be approximately 1~ million
dollars. The estimate two weeks ago said that it would be closer to
4.2 million dollars. That along with the additional water projects
are being worked into a pro forma balance statement over the next
five years. This should be ready for consideration by Council before
the deadline in August for getting on the ballot. It will command
then a request to increase the income tax by ~%. Mayor Lewis said
that he felt that if the Village "takes that route" that it make
the commitment that the tax increase will be committed entirely for
capital improvements.

14. Waterlines. The Village should be negotiating within the next ten
days to contract to bring the sewer from the vicinity of OCLC up
to the intersection of Coffman and Brand Road. That will be
extended to the north and to the west and will be done on a contract
similar to the ones with Muirfield and Jack Kessler's property where
they will pay for the improvement and recapture some of their money
in a limited time period through tap fees on their property (Earling-
ton and Brandon).
Further conversations have been held with the developers of the
property in bringing the waterline from Coffman over to the S.R. 745
waterline which may traverse Brandon and the developers of Earlington
are bringing the waterline across to join with the waterline at
Muirfield. It would then be the intent of the Village to probably
cut the Coffman Road line at about the vicinity of the high school
and tie it into the west side of the booster pump currently going to
the storage tank in Union County so that the water that would be
required by the additions to the high school and the buildings on
the McKitrick property would come from the input side of the
booster pump; the additional connector that would go up to S.R. 745
and Muirfield Drive across the Brand Road intersection would be on
that booster pump.
Mrs. Headlee asked if that would mean that Muirfield would "get out 0
building their water tower?"
Mayor Lewis said it would not. He said that the commitment is an
existing legal commitment that Muirfield does have to build a water

on the east side of the river and Donegal Cliffs. The booster pump
on Summitview (across 745) has been turned off. That line was
built by Muirfield to supply Muirfield and subsequently extended
down to River Forest and then further down to Donegal Cliffs. The
agreement at the time with the City of Columbus was that Dublin
would be permitted to have only a certain number of taps on that
line and that eventually Dublin would be cut off from that line.
Dublin has been considering that circumstance.
If the Village gets the waterline off of Coffman Road so that it loop
the Donegal Cliffs' line that will probably result in additional
water supply and pressure needed at least up to the Summitview line
connector. If the Village is able to bring in the Earlington line
so that it ties into the Muirfield line, that should also increase
the supply and pressure. Since both of those are currently both
moving forward but the Village does not know precisely what the
timing is, the Village still has the option of asking Muirfield to
build a water tower. With the intention of looping the waterlines it
was the opinion of the Village Engineer that the Village could more
than adequately handle the water pressure up into Glick Road through
the loopings until Columbus cuts the Summitview line - then
Muirfield would build the tower to offset the extra connector. Mr.
Warner, last week, said that he was not sure that the Village had the
connector up Avery Road, that they weren't going to cut that line.
The topic needs to be investigated further for verification. The
commitment does exist in a duly passed ordinance, by Muirfield, to
build a 500,000 gallon tank in the vicinity of the Glick/Avery Road
intersection. An acre of land has been committed for the location
of the tank.
Mrs. Headlee said that it was her understanding that Indian Run
Meradows was supposed to draw a lot of their water off of the Post
Road line. However, since the Avery Road waterline was put in they
are tapping off of that.
Mayor Lewis noted that the Post Road and Avery Road are on the
same line.
With regard to the water pressure situation Mr. Callahan suggested
renting recording pressure guages which will record the fluctuations
in pressure.

15. Regarding roads, Planning and Zoning, and authority. Generally,
when a developer comes into Dublin the developer builds all the
roads, puts in the utilities, etc. on the property he is developing.
It is the policy when that occurs then the run through on the sewer
and water should be of sufficient volume and size to continue beyond
the periphery of his property. In addressing any new development
that commitment should be gotten. That the roads be of sufficient
with with curbs and gutters to be up to the standards of the
community. When the Village gets developments such as Tuller Road

the standpoint of how much you can ask one developer versus 5,000
homes or 10 developers. It is not an easy matter to resolve.
It was noted that the McKitrick development will not be built for three
years.
Mr. Smith noted that in the contract with Mr. McKitrick's lawyer, a
clause was added that the approval of the rezoning in no way commits
the Village to allow them to proceed with any development if the Village
is not ready to deliver the services to the project.
Mayor Lewis said that Ms. Prushing, Finance Director, has been asked to
develop a computer program that will give a calculation on financial and
other impact aspects of future developments. Additional factual informa-
tion is needed before decisions can be made. That information should be
available in 30-60 days.
Ms. Maurer expressed concern regarding the number of accesses onto S.R.
161, suggesting perhaps planning of an access/service road on those
lots on S.R. 161. It was also noted that each of those properties al-
ready have curb cuts.
Mr. Callahan noted that when those properties were subdivided it was
determined that they each have access to the highway.
Mr. Smith said that the Commission does have the authority to negotiate
(with prudence) with developers; e.g., indicating to them of they want
to build their project Dublin needs "so and so". He also suggested that
those "negotiations" be handled before the meetings, suggesting perhaps
a sub-committee of the Planning and Zoning Commission meet with the
Law Director's staff, the Planner, and Engineer prior to the meeting "to
tell us what you want". The Law Director's office will assist in
establishing guidelines under which the Commission can operate. It
would be better to negotiate prior to the evening of the meeting when
members of the Commission are expected to vote.
Mayor Lewis said that at a recent staff meeting the possibility of
developing a checklist was discussed - for example, comments on sewers,
traffic, rights-of-way, curb cuts, landscaping, etc. requesting that
the Planning Department comment on each item on the checklist for each
development prior to Commission members receiving their packets.
Ms. Maurer suggested that perhaps some members of Council could be
involved with the Planning and Zoning Commission in devising such a
checklist.
Mr. Reiner suggested that perhaps expansion of the Planning Department
Staff would be of help. Mayor Lewis said that additions to the Planning
Department have been approved.
Mr. Jezerinac suggested that when doing the proposed economic studies
that consideration of not only what capital improvements should be done
but consideration also give to other projects - policement, firemen,
community centers, parks, recreation, etc.

Mr. Smith, responding to a question from Mr. Macklin, said that there is
northing wrong with telling a developer "up front" that the necessary
services may not be available when he is ready to begin construction -
just don't change the gam plan at the last moment.
Written minutes of the Staff meetings will be made available to members of
Council. The next meeting of Staff will probably be held the week of
June 17th, but no later than the week of June 24th.
Mr. Macklin suggested that Mrs. Headlee attend Village Staff Meetings,
representing the Planning and Zoning Commission.
It was suggested that similar joint meetings be held, perhaps every three
or four months.
The meeting was adjounred by the Mayor at 9:47 P.M.
