Mayor James E. Lewis called to order the regularly scheduled meeting of the Dublin Village Council at 7:30 P.M. on Monday, May 6, 1985 Mr. Thornton led those present in the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mayor Lewis, Ms. Maurer, Mr. Sutphen, and Mr. Thornton. Mrs. Headlee and Mr. Close were absent. Mr. Smith, Law Director, and Mr. Sheldon, Village Manager, were also present as were Mr. Warner, Mr. Bowman, and Ms. Prushing of the Village Staff . Mr. Amorose moved to approve the minutes of the April 15, 1985 meeting. Mr. Thornton seconded the motion. The vote was unanimous (5-0) in favor of approval of the minutes. Mr. Sutphen made a motion to pay the bills. Mr. Amorose seconded the motion. The vote was 5-0 in favor. It was noted that the body armor for the police officers has arrived, been issued, and is being used by police officers. Correspondence There was no objection to a request for a one day liquor permit for a function to be held on May 18, 1985 at Stouffer's Dublin Hotel from the Columbus Speech and Hearing Center and the Stouffer Hotel Company. Ordinance No. 14-85 - Rezone 1.95 Acres South Side of Dublin-Granville Road and David Roads. Second Reading. Public Hearing. Mr. Ralph Smithers, the applicant, registered as a proponent. There were no registered opponents. Mr. Smithers presented the following points of information: 1. The site of approximately 2 acres is located on the south side of S.R. 161. Suburban Office zoning is being requested. The site has SO zoning immediately to the east. There are approxi- mately four or five properties to the west that are not zoned SO; beyond that point the zoning is SO. The proposal has been reviewed with Mr. Bowman. The land use concept prepared by the Village suggests office land uses an appropriate development. The proposed thoroughfare plan has alos The lots in the area have 100' frontage 850' . There will be a need, some time in the future, for an east/west street so that the property could be adequately served from a traffic standpoint. There would be willing to reserve the land necessary for the future road improvement. Ms. Maurer recalled that upon researching a deed in the area she came across a covenant in the deed to build only residential, which requires permission from everyone in the original plat (Sharp). Mr. Smithers said that his attorneys would research the issue and ensure that the deed restrictions would be such that they could develop. Mr. Thornton noted that the easement for the proposed road would take out about six parking spaces from the project. Mr. Smithers said that even without the six parking spaces they would meet the code requirement for the square footage of office space shown. least allowing the land to be dedicated for the purpose. Mr. Hausfeld made a correction to the Planning and Zoning Commission minutes of April 2, 1985 on page nine, #10. Corrected it should read - "The closest one of their structures would come to a River Forest structure would be 125' and the maximum 315'." 5. Regarding vehicular circulation Mr. Hausfeld noted that their road would be stubbed at the Brandon P.ll.D. property line. The road would also have a stop sign and then flow to the right to get to the rear of the subdivision. 6. The depression areas are the retention basins for the site. 7. The engineers will analyze the retention basins and will be able to determine their capacities at the present time. 8. The site will be self-contained as far as drainage - they will not increase the runoff onto the adjacent properties. 9. The engineering drawings will be examined by the staff of the Village of Dublin. It was noted that the stub of the road will be matched up by Brandon when they begin that P.ll.D. Mr. Amorose asked regarding the 9.79 acres of dedicated open space. Mr. Bowman said that the area staff is most interested in would be the three acres that would be matched up with the Brandon park land area. The other areas (sinkholes) would be private reserve areas - as well as the entrance area. The responsibility for those areas would lie with the civic association. Mr. Thornton expressed his concerns regarding the fact that the developer will be changing the rate at which water will be going down hill. He said that he wanted that concern studied by the engineer. Mayor Lewis said that it was his understanding that a detailed drainage examination will be done as a part of the final plat as a condition of the rezoning. Mr. Hausfeld said that had been agreed to. Mr. Solack, a resident on Dublin Road, said that the sinkhole has been expanding in the last five years. He also addressed Council regarding his concerns of the increased flow rate into the sinkhole which could result in flooding on his property. He said that the permeable surface area would be decreased to impermeable surface area, increasing the runoff area. Mayor Lewis said that those details would be examined in the drainage study. Mr. Thornton referred to the concern expressed by residents regarding the water supply in the area, referring to an inadequate water supply last summer in the River Forest Subdivision. Mr. Warner said that the City of Columbus has assured him that they have corrected all the problems at the booster station, which caused the problems. He also mentioned that since last summer the loop up Avery Road has been completed, thus taking most of muirfield off that line. The City of Columbus will also be constructing, in 1986, an elevated storage tank on Summitview which should help the situation. Mr. Warner said that water to the subdivision would come from the line supplying Donegal Cliffs. Mayor Lewis asked if the Village was still under the restriction imposed by the City of Columbus on the number of taps on the line. Mr. Warner said that he would study and address the issue and report back to Council. It was noted that Brandon would loop into the line on Dublin Road and tie into the loop on Coffman Road or Brand Road (whichever is available). Mr. Warner will investigate the matter further. Mayor Lewis noted that in the developer's statement before the Planning and Zoning Commission, it was stated that the price of the homes in the sub- division would be $175,000.00 and up. Mr. Rakestraw said that "they would be in that range". Mr. Reibold said that typically the sale of the package, including house and lot, is approximately five times the lot price. That varies, however, with price ranges. Mayor Lewis asked if Mr. REibold would consider putting a minimum square footage in the deed restrictions. Mr. REibold said that he felt it was a little early to be doing that. He further stated that he felt the prices they were asking for the lots would dictate a minimum square footage that would be acceptable. The price range would be compatible with recent development in Dublin. Mr. Smith noted that in reviewing the minutes of the Planning and Zoning Commission meeting, and in discussions with perons, he was left with the distinct impression that the developer was saying that this was the quality of the home that was going to be built ($175,000.00). He also said that he wanted the developer to be perfectly aware before the vote that one of the considerations expressed by Planning and Zoning and one of the concerns expressed by the developer in response - that they were left with the opinion that there would either be a deed restriction as re- gards square footage or be some way to make sure that there would not be "a different kind of development being built there". Mr. Smith and Mr. Rakestraw will discuss the issue, and Mr. Rakestraw said that they will respond to Council's concerns before the vote at the May 13th meeting. Ordinance No. 20-85 - Outlining the Duties of the Architectural Review Board. Second Reading. Public Hearing. Mr. Tom Grace, Chairman of the Old Dublin Committee, registered as a proponent of the ordinance. There were no registered opponents. Mr. Grace pointed out a typographical error in Ordinance No. 20-85. In Section 1191.02, subsection B. the following should be deleted - "Except for initial appointments, and the member of Council appointment". Mr. Grace also noted that the Old Dublin Committee urges the adoption of the ordinance. Mayor Lewis announced that the next meeting of Council will be on May 13, 1985 rather than May 20, 1985. It was decided to move the discussion of the request of the Dublin Counsel- ing Center to "Other Business". .... Ordinance No. 13-85 - Amend Chapter 1305.05, Codified Ordinances Re: Occupancy Permits. Tabled Ordinance. Mr. Smith mentioned the memorandum from Mr. Warner suggested that the ordinance be dropped. Mr. Thornton moved to remove the ordinance from the table. Ms. Maurer seconded the motion. The vote was 5-0 in favor. Mr. Thornton said that he felt that Council should adhere to the engineer's suggestion and vote the ordinance down. The vote on the third reading of the ordinance was as follows: Mr. Amorose, no; Mayor Lewis, no; Mr. Sutphen, no; Ms. Maurer, no; Mr. Thornton, no. Form No. 1097 ~ Held May 6, 1985 19 Page Six Ordinance No. 23-85 - Accept Bid on Telephone System for Municipal Building Expansion. First Reading. Emergency. Ms. Maurer introduced the Ordinance. Ms. Maurer moved to waive the three time reading rule and treat as an emergency. Mr. Sutphen seconded the motion. It was determined that approximately six other installations of this system are in the Village of Dublin, and that the system is expandable. All departments will be served except the Police Department which will use the current system. The vote on doing away with the three time reading rule and treating as an emergency was 5-0. The vote to accept the recommendation of the Village Manager to accept the bid of Teletronics Inc. in the amount of $9,250.00 was accepted unanimously. Other Final Plat Approval - The Moors in Muirfield. Mr. Sutphen moved to accept the final plat. Mr. Thornton seconded the motion. The vote was unanimous in favor. Request from Dublin Counseling Center. Responding to questions raised by members of Council at the last meeting, Mr. Ramon Priestino presented the following information. 1. The staff of the Counseling Center are on salary. They receive no fees themselves directly. The Center serves all ages adolescents. The problems affect the entire family. 43% of the clients receive some form of financial assistance. Of that 43%, 50% have a substantial amount of their fee reduced or subsidized. 57% of the clients pay a full fee. Mr. Priestino made available to members a handout - including a list of staff members, the board of directors, and a five year budget projection. Mr. Smith said that it was his considered opinion, from considerable case law history in the State of Ohio, that a municipality does not have the right to give away public property. He also noted that there are exceptions, quoting, "that when there is a direct benefit to a municipality (Village of Dublin) in absence of monetary consideration, if an obligation is assumed, that was the Village's or City's obligation that would constitute adequate consideration". He also said that he felt that the Dublin Counseling Center does provide a valuable service to the community at large as well as surrounding communities. He said that he felt the question becomes - is there a direct benefit flowing to the Village. He also said that he felt that the service performed by the Center is not an obligation to the community, and therefore the deed should not be given to the Center. Ms. Maurer said that she was dissatisfied with the opinion and felt that other alternatives should be explored before making a decision. She noted specifically the services provided by the Center to the Dublin Police Department. Mr. Smith indicated that he was unaware the Police Department and that he would the issue further. Mr. Bowman introduced and presented a series of planning maps that have been prepared - a land use map, sewer map, water map, and a transportation map (eventually becoming a major street improvement map). The fifth map will be a Parks and Recreation open space map. He indicated that he intended to have the maps reduced and presented to members of Council, Planning and Zoning Commission members, and members of the Board of Zoning Appeals. Mr. Bowman also briefly discussed his Preamble Plan which would be used as a basis, eventually leading to a Capital Improvement Plan. Mayor Lewis suggested that members of Council take time to study the maps. Council Roundtable Discussion Mr. Thornton 1. Mentioned the positive aspects of the report submitted by the Code Compliance Officer. Mr. Sutphen 1. Mr. Sutphen asked what programs or plans were being envision at the intersection of Frantz Road and S.R. 161; specifically stripes on the left hand turn lane. Mr. Sheldon said that certain concepts were being examined and will be presented to Council at a later date. Ms. Maurer 1. Ms. Maurer mentioned a concern of Mr. Bill Miller of the Planning and Zoning Commission regarding potential traffic problems on Coffman Road. Mayor Lewis said that a traffic study is underway. Mr. Amorose 1. Mr. Amorose reminded all those present to vote in the May 7, 1985 election. The meeting was adjourned at 9:25 P.M. ca~~n~ ~ I- II
