Form No. 1097 ~ ---~ Held March 4, 19.85 19 Mayor James E. Lewis called the regularly scheduled meeting of the Dublin Village Council to order at 7:30 P.M. on Monday, March 4, 1985. Mr. Thornton led the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mr. Close, Mrs. Headlee, Mayor Lewis, Ms. Maurer, Mr. Sutphen and Mr. Thornton. Mr. Sheldon, Village Manager, and Mr. Smith, Law Director were also present as were Mr. Bowman, Mr. Carr, Ms. Prushing, and Mr. Warner of the Village Staff. Mr. Thornton moved to approve the minutes of the February 18, 1985 Council meeting with an addition to the record regarding Ordinance No. 07-85 (Rezoning of 11.45 Acres at Sawmill and Martin Roads). He requested that the following be added: "For the remaining approximately two acres of residentially zoned PUD ground within the Village of Dublin (further described as the 175 foot east-west strip immediately south of the required 125 foot buffer yard), the applicant agrees that no residential buildings be constructed within said area and that construction in such areas shall be limited to parking, landscaping, amenity features and facilities that may be constructed by a future developer (such as park facilities, tennis courts and other ancillary recreational facilities, and additional yard space)." Mr. Amorose seconded the motion. The vote was unanimous in favor of approving the minutes of the February 18, 1985 meeting of Council with the above addition. Mrs. Headlee had a question regarding the payment of $1,054.00 to the Dublin schools for the use of facilities in the four elementary schools for dance classes (jazzercise, exerjazz, and aerobics). She said that it was her understanding that there was an agreement with the schools for a tradeoff in the use of facilities such as parks and school rooms. Ms. Prushing said that it was her understanding that because the classes are held after regular school hours custodial services must be paid for. The class sessions are for a four month period. Mrs. Headlee moved to pay the bills, and it was agreed to get additional information regarding procedures and facilities for dance classes and/or the use of school facilities. Mr. Amorose seconded the motion. The vote was 7-0 in favor of paying the bills. Ordinance No. 64-84 Rezoning of a .685 Acre Tract on the West Side of Liggett Road. Second Reading. Public Hearing. The request was for a change of zoning from R (Rural District) to RI (Restricted Industrial District). Mr. John Delibera of 2399 Brandon Road in Columbus registered as a proponent of the project. Mrs. Sophie Liggett of Liggett Road expressed concern noting that she was interested in finding out specifically, where the building was to be located because she did not want her vision "barred". Mr. Delibera told Council that the request was approved by the Planning and Zoning Commission at their February 5, 1985 meeting. He also said that Mr. Phil Patterson was interested in the property for the purpose of constructing a warehouse/storage type building for his commercial pool business. Since Mr. Patterson had hoped to be in the building by June of 1985, Mr. Delibera said that he was not sure whether or not Mr. Patterson was still interested in the property. Mayor Lewis explained to Mrs. Liggett that the plan submitted to the Plan- ning and Zoning Commission which described a particular building is no longer a valid proposal since the building planned is perhaps no longer planned. The intention of the owner was still to apply for the rezoning whether or not the potential first developer was still interested. Mr. Delibera said that the "deal may still go through". Mr. Smith, responding to a question from Mrs. Headlee, said that whatever building was constructed on the site, said building would still have to comply with the building code with regard to setbakcs, elevations, etc. RECORD OF PROCEEDINGS Minutes of Dublin Village Council Meeting ~~J:s Meeting National Graphics Corp., Cols., O. Form No. 1097 ~ r- Held March 4, .1985 19 Page Two Resolution No. 04-85 - Express the Intent to Have Dublin Declared a City. Third Reading. Mayor Lewis mentioned the memorandum submitted by Mr. Sheldon to members of Council and the Law Director; a memorandum summarizing prior communica- tions as well as adding some additional comments. Mayor Lewis also reminded members of Council that at the last meeting of Council he had suggested that if members of Council had any additional questions regardin the matter, that those question should be submitted, in writing, to the Law Director. Mr. Smith, the Law Director, heard from no one. Mayor Lewis suggested that there could be a misunderstanding with regard to what responsibilities accrue to Dublin as a city versus those that are remaining options once Dublin becomes a city should Dublin decide to become a township. Becoming a city would give Dublin some options in considering becoming a township. It does not mean that once Dublin would become a city that the city would necessarily form their own town- ship. Therefore, some of the comments regarding the fire department are not necessarily pertinent with city status, but would become important with consideration of forming Dublin's own township. Keeping in mind his premise, what's good, what's bad for Dublin, Mr. Thornton, following the last meeting, said that he had investigated three areas of concern: 1. With regard to the question of state highways, he said that one can assume that there is an unknown cost factor for maintenance of said highways. 2. Regarding the school system, Mr. Thornton said that he had spoken with several persons regarding the benefit to the schools. A report received from the school superintendent indicated that an annual cost of $86,000.00 goes to the county - another person said the cost was $25,000.00. He noted that the above figures were cost figures, not a savings. Mr. Thornton also mentioned the fact that approximately one half of those persons in the Dublin School District do not reside within the corporate limits of Dublin. 3. A duplicate police situation in the Perry Township part of Dublin. Mr. Thornton said that he felt that the potential savings in this area was a great "unknown". What will happen when Dublin tries to phase out a police department? Or will Dublin have two police departments? Mayor Lewis said that the question of the Perry Township Police Department does not come under resolution until Dublin considers becoming a township, and than at that time the question of duplicate police coverage will have to be resolved. Mayor Lewis also told Mr. Thornton that there would be a cost to Dublin with regard to state and federal roads and highways. He also said, however, that the only cost with regard to the police department would be the further growth of Dublin and the requirement for additional personnel and equipment which would happen whether Dublin would become a city or not. Mayor Lewis said that he felt it was to the advantage of Dublin to move in the direction of becoming a city. Mr. Close said that he disagreed with Mr. Thornton's position in that if Dublin is ever going to be in a position to save the residents on the east side of the river the 12 mill additional police levy, Dublin has to become a city to take the step. Mr. Close also said that he felt this should be a "package deal"; that it would ultimately be in the best interest of Dublin to form its own township. I. Form No. 1097 ~ ~ Held March 4, 1985 19 Page Three Mr. Close also offered some clarification regarding a comment he had made at the last meeting regarding fire insurance in north Muirfield. He said that it is his present belief that all of Muirfield presently is classed 5 or 6, and that the rate for classes 1 through 6 is the same. He also said that he was still not completely sure with regard to the accuracy of this information. Mayor Lewis said that with regard to the insurance rates the issue is very complicated. The last report that he received from the fire department (received from the State Fire Marshall) indicated that the portion of Muirfield that is in Franklin County is a class 5 and the porti n of Muirfield in Delaware County is either a 7 or a 9. He said, though, that he has not actually seen the comparable ratings for Delaware County. Ms. Maurer said that after reviewing all information she felt that as a representative of the taxpayers, that becoming a city would be a "losing deal". The vote was as follows: Mr. Close, yes; Mr. Amorose, yes; Ms. Maurer,no; Mr. Thornton, no; Mrs. Headlee, no; Mr. Sutphen, no; Mr. Lewis, yes. Resolution No. 05-85 - The Intent to Redivision the Four (4) Wards. Third Reading. Mayor Lewis made the following comments: 1. Regarding the Charter - The voters voted on the Charter as written, not on the intent of those persons writing the Charter. 2. The intent to redistrict to equalize the ward populations cannot be called gerrymandering (in his opinion). 3. Throughout the legislative history of this country the redistricting in congressional races and state races in those cities that have wards, the general intent, as interpreted by the courts of this land are that there be the one vote concept that is equal to voter distribution among the wards. With the growth of Dublin that has occurred since the establishment of the wards, Dublin has wards that contain populations in excess of 2 to 1. Mayor Lewis also said that he felt that it was only fair to the people and voters of the community to re-establish the wards. Mrs. Headlee commented that she felt that with all the new development, in four years the wards will probably have a more even distribution of population. She said that she felt that each voter, at the present time, is represented and that redistricting at the present time is not indicated. Mr. Close said that he was not opposed to redistricting every four years and indicated that he was in favor of the redivisioning of the wards at the present time. Mayor Lewis commented that the figures he had used were registered voters and that there is no question that certain wards have 1~ to 2 times the number of voters of other wards and that those figures are disproportionat which is not the intent of the Charter nor the Constitution of the United States. Regardless of the time period, Mayor Lewis said that he was in favor of equal representation and the river does not create two communities; everyone is in Dublin. The vote on the Resolution was as follows: Ms. Maurer, no; Mr. Close, yes; Mr. Amorose, no; Mrs. Headlee, no; Mr. Sutphen, no; Mr. Thornton, no; Mr. Lewis, yes. Resolution No. 07-85 - Approve and Accept Easements - Tuller Road Sanitary Sewer. First Reading. Emergency. Mrs. Headlee introduced the Ordinance and moved to do away with the three time reading rule and treat as an emergency. Mr. Close seconded the I' motion. The vote was 7-0 in favor of doing away with the three time ill reading rule and treating as an emergency. The vote on the Resolution was II 7-0 in favor. Form No. 1097 ~ Held March 4 ,1985 19 1 r Page Four Mayor Lewis announced that there would be a special meeting of Council on March 11, 1985 at 7:30 P.M. to consider Capital Improvements. Request from Dublin Women's Club Regarding Fifth Annual Arts Festival. The Festival will be held on Sunday, September 8, 1985 and the request was to close South High Street from Bridge Street to Waterford Drive from 7:00 A.M. to 7:00 P.M. Mrs. Headlee moved to approve the request of the Dublin Women's Club with the stipulation that the Fire Chief be consulted regarding the accessi- bility and availability of emergency equipment, and that Lt. Geis be consulted with regard to the number of special duty police officers require The vote was 7-0 in favor. Presentation of Goals and Objectives of the Parks and Recreation Committee for 1985 by Mrs. Beth Brooks, Chairman of the Parks and Recreation Committe . Park Land Mrs. Brooks mentioned the goal of planning for the first step being an evaluation of existing as regards maintenance. With regard to donated park land the be definition, a major concern being lands be available. Mrs. Brooks mentioned the Donegal Cliffs area where dumping has been taking place. She mentioned that a letter has been sent to Mr. Steve Smith requesting information regarding receipt of deeds on the lands, what control does Dublin have before the lands are deeded to Dublin, and the legal right to cross land to have access to the park lands. An analysis will be done regarding the projected use for the park lands - active or passive. The goal would be to have one major acquisition project each year as regards park land - a project which would not require an expenditure by the Village, citing specifically Indian Run Gorge which would require working together with the schools, Village Staff, and Council to determine types of maintenance and controls (police protection, e. g. ) . Recreation. 1. The number one goal is the Avery Road Park expansion. 2. Bike trails need to be defined, specifically the design, construction and placement of same within the Village, working together with the Planning and Zoning Commission. Community Center 1. The feeling is that the Parks and Recreation Department/Committee should conduct the survey of the needs assessment in the community as regards a proposed community center. Responding to a question from Mayor Lewis, Mrs. Brooks said that the Committee would be prepared to make recommendations and establish priorities to be presented at the Capital Improvements Meeting on March 11, 1985. 1. park land in 1985; park lands, especially 2. question to be considered will when (in which year) will the 3. 4. 5. Ms. Maurer said that she felt that the needs assessment regarding a possible community center should be made a responsibility of the Parks and Recreation Committee and Director of the Parks and Recreation Department. Mrs. Headlee said that she wanted to see the plans for solving the drainage problems at Avery Road Park before the project comes to Council. Mrs. Brooks said that the Director of Parks and Recreation would be before Council in April to present the proposed Avery Road Park expansion project. A letter from Mr. David Wolfe of the Dublin area Community Improvement Corporation and a recommendation from Mayor Lewis at a meeting with the Dublin area Chamber of Commerce for committee assistance to the municipality and Council. A letter from the Franklin County District Board the activities and services they provided to the in 1984. A letter from the Franklin County Board of Mental Retardation and Development Disabilities regarding their report to the community which will be held on Wednesday, March 27, 1985 at 8:30 A.M. Mayor Lewis, who will be unable to attend, invited any Council member who was interested to attend. 2. of Health outlining Village of Dublin 3. Council Roundtable Discussion 1. Mr. Thornton Mr. Thornton again mentioned the need for public restroom facilities in the Olde Dublin shopping district. 2. Mrs. Headlee Mrs. Headlee brought to the attention of those present an advertise- ment which appeared in a local newspaper advertising jazzercise, exerjazz, and aerobics classes being held in the local schools. She noted that no mention was made of an affiliation with the Parks and Recreation Department. Mr. Carr said that the groups give the Parks and Recreation Department a percentage of their gross income and then the Department, from that amount, pays for the rental of the school classrooms. He also said that the issue is being studied carefully as regards the future of these particular programs. 3. Mr. Sutphen Mr. Sutphen mentioned a survey he had done regarding the Old Cemetery on Kinross. The people in the area want the cemetery area to remain as it is at present. Mayor Lewis announced that the proposed plan regarding the area will be presented at the next meeting of Council. Ms. Maurer suggested that the plan be published in the newspaper so that residents can be informed. 4. Mr. Amorose Mr. Amorose commented regarding the letter from Mr. Dave Wolfe. He suggested doing nothing until the next CIC meeting with regard to committee assignments. Mr. Amorose invited all to participate in the St. Patrick's Day Festivities. Members of Council agreed to participate in the parade. S. Ms. Maurer Ms. Maurer mentioned the correspondence from the River Forest Civic Association regarding the Dunne property proposed rezoning (to be rezoned from R-1 to R-2). 6. Mr. Close Mr. Close mentioned the damage done to the soccer fields at Avery Road Park due to persons riding horses in the area. Mr. Close commented that Resolution No. 04-85 regarding declaring Dublin a city is a "dead issue". March 4, 1985 19 Page Six Mr. Close asked how sewer charges are determined in areas of Dublin that have no water. Mr. Sheldon said that those charges are determined by an average rate that is paid by the users of Columbus for those that do not have a water meter. Mr. Close mentioned the possibility of naming Mr. A. C. Strip as chairman of the subcommittee dealing with the community center.
