Hartmann, Assistant Law Director Re: Ordinance 74-22 – Agreement with the Ohio Power Company and Dublin City Schools and Acquisition of an Easement from the Dublin City Schools for the Franklin Street Extension Project (21-012-CIP) Summary The Franklin Street Extension Project (Project) will construct an extension of Franklin Street from West Bridge Street north to North Street and reconstruct Franklin Street from West Bridge Street south to Sells Alley as shown on the attached exhibit. The Project will construct the roadway, install permeable paver parking bays, brick paver sidewalks, street trees, street lighting, and burial of the overhead utility lines from Sells Alley to North Street. The intersection of West Bridge Street and Franklin Street will be signalized and include pedestrian crossings. Finally, the temporary pedestrian crossing of Bridge Street at Darby Street will be removed. Presently, this Project is planned to start construction in early 2023 and is anticipated to be complete in the fall of 2023. Acquisition This ordinance allows the City Manager to enter into a utility easement and construction agreement (Agreement) with Dublin City Schools (DCS) and the Ohio Power Company (AEP) that provides the following: 1. The City of Dublin (City) will receive a required utility easement on DCS property for City use. The cost of this easement is $1.00. 2. The City is authorized to assign the same easement rights to AEP for routing of the existing primary overhead electric lines and placing them underground. 3. AEP will vacate their existing overhead easement on DCS property with 24 months of the Agreement execution. It is necessary for the City to obtain the utility easement from DCS for the location of a cabinet for the traffic signal, which will be located at the intersection of West Bridge Street and Franklin Street. Further, AEP must obtain an easement in the same location to bury the existing overhead power lines. Rather than requiring AEP to obtain an overlapping easement, this ordinance allows AEP the necessary rights in the easement the City is obtaining from DCS to bury the overhead power lines. Per the Agreement, the overhead power lines must be buried within 24 months, at which time AEP will vacate their existing overhead easement on DCS property. The City will bear the cost of burying the overhead power lines, which will be established via a separate agreement which will come before Council for consideration at a future Council meeting. Additionally, one (1) acquisition from a City parcel is also required (Ordinance 69-22, which will be considered on second reading at the December 5, 2022 Council meeting). The property acquisitions for the three (3) remaining privately owned parcels are ongoing and are expected to be finalized within the next four (4) months. All remaining private landowners have signed right-of-entry agreements allowing the City to access and make changes to the areas impacted by the Project. This agreement has been executed by AEP and approved by DCS. Recommendation Staff recommends adoption of Ordinance 74-22 at the second reading/public hearing on January 9, 2023, as this ordinance authorizes the City Manager to execute all necessary documents to formally accept the necessary property interests described above.
