Re: Resolution 03-23 – Authorizing the City Manager to Enter into a Letter of
Agreement with Ohio Bell Telephone Company d/b/a AT&T for the South
High Street Utility Burial – Phase 1 Project (19-030-CIP)
Background
As part of the Downtown Historic District beautification efforts, the City will be relocating the existing
overhead utility lines along South High Street through the South High Street Utility Burial - Phase 1
Project (Project) by installing underground electric (AEP) and telecommunication utilities (Spectrum,
AT&T, Breezeline, and Dublink) to service the affected parcels. The Project consists of two phases as
requested by AEP. The Phase 1 Project area includes Franklin Street south of West Bridge Street and
the west side of South High Street between West Bridge Street and Short Street. The Phase 2 area
includes the east side of South High Street and Blacksmith Lane between West Bridge Street and
Short Street. A location map is provided at the end of this memo. At the completion of the Project, all
overhead utility lines and poles along South High Street will be removed between West Bridge Street
and Short Street.
Presently, this Project is anticipated to be complete by the summer of 2023. The Phase 1
underground improvements are scheduled to be performed in advance of the Franklin Street
Improvements Project, which includes road reconstruction, sidewalks, curb ramps, and street trees on
Franklin Street between Sells Alley and Waterford Drive.
Summary
Beginning in 2019, and after the initial coordination with American Electric Power (AEP), City Staff has
been coordinating extensively with Ohio Bell Telephone Company (AT&T) to determine the scope of
work and develop the construction drawings necessary to bury their existing overhead
telecommunication facilities for the Project. As a part of this Project, through this Letter of
Agreement, AT&T will remove all existing overhead telecommunication facilities and install new
underground telecommunication facilities (wires, cables, and connections) in the Phase 1 Project
area. AT&T will receive reimbursement from the City for the cost of removing the existing overhead
facilities and installing the underground telecommunication facilities. The City’s underground
telecommunication conduit contractor is responsible for installing the telecommunications conduit
including all above ground items for the telecommunication utilities.
The City is responsible for the difference in the total construction costs less AT&T’s enhancement
costs. In this case, the enhancements include AT&T fiber buildout where it does not currently exist,
which includes portions of Franklin Street and portions of Sells Alley between Franklin Street and Mills

Lane. Therefore, the City is responsible for a cost of $113,056.89. The Project is funded in the 2022-
2026 Capital Improvements Program (CIP) from the South High Street Utility Burial, Phase 1 (ET203)
in the amount of $1.825 million and funded further through Ordinance 19-22 with an additional $2.32
million.
In order to complete the burial of the utilities as part of the Project, including the telecommunication
work, the following agreement will be brought forward for Council consideration at a future City
Council meeting:
• Funding agreement with Charter/Spectrum for the burial and installation of their
infrastructure. The costs associated with that agreement is separate from the costs
associated with this agreement. The cost and contractual language associated with that
agreement is currently being finalized.
Recommendation
Staff recommends approval of Resolution 03-23, authorizing the City Manager to enter into a Letter of
Agreement with Ohio Bell Telephone Company d/b/a AT&T for the South High Street Utility Burial –
Phase 1 Project.
