Hammersmith, PE, Director of Engineering/City Engineer Re: Resolution 55-22 - Authorizing the City Manager to Cooperate and Enter into an Agreement with The Ohio Department of Transportation for the Resurfacing of SR- 745 From Emerald Parkway North to Shawnee Hills (ODOT PID Number 111618) Background The Ohio Department of Transportation (ODOT) is planning improvements to the SR-745 (Dublin Road) corridor from just north of the Emerald Parkway intersection in Dublin to the southern corporation limits of the Village of Shawnee Hills, totaling 3.11 miles. The work includes pavement milling, resurfacing, curb ramp repairs, and pavement markings. The City has coordinated with ODOT for this work to be completed next Spring 2023 prior to the 2023 Memorial Tournament (May 29 – June 4, 2023). A map of the project limits within Dublin is included below. This project is part of ODOT's Urban Paving Program, whereby ODOT funds a flat cost per lane mile of the construction costs associated with the pavement surface treatment and the local municipality contributes the remainder of the construction costs of the pavement surface treatment within its corporation limits. The local municipality is also required to contribute 100 percent of the cost of non-surface related items such as curbs, curb ramps, gutters, and partial and full-depth pavement repairs. Based on ODOT's preliminary cost estimates, the construction cost for the overall project from Dublin to Shawnee Hills is estimated to be $877,000. Dublin's contribution is currently estimated to be $377,000. This is a preliminary estimate that will be refined as the construction plans are prepared and finalized. Additionally, in order to advance this project, which ODOT had originally scheduled for State Fiscal year 2025, Dublin has agreed to provide the detailed design and construction inspection services for this project. Based on ODOT's current bid schedule, Dublin's contribution will be due in December 2022. ODOT plans to bid this project in March 2023, with construction beginning in late April or early May 2023, with completion prior to the 2023 Memorial Tournament. Although ODOT plans to have construction completed prior to the 2023 Memorial Tournament, City Staff will work closely with ODOT to ensure construction is not in progress during the tournament. In the event construction is unable to be completed prior to the Tournament due to unforeseen circumstances, construction will begin following the conclusion of the Tournament. All work will be performed while maintaining traffic where possible with efforts to minimize interruptions to motorists, provide access for emergency vehicles, and consistently provide a safe work area for motorists and workers. Recommendation Staff coordinated with ODOT to advance this project from State Fiscal Year 2025 to the Spring of 2023 to improve the conditions of SR-745 and to resurface over the temporary asphalt patches placed as part of the Deer Run Force Main and Lift Station Project to provide a safe and smooth roadway for the travelling public. After your preparation and approval of the legislation document, please forward it to the Council for their necessary action. Vandia*, File* PRELIMINARY PARTICIPATORY LEGISLATION RC 5521.01 Ordinance/Resolution# PID No.111618 County/Route/Section FRA/DEL-745-0.69/0.00 The following is enacted by the City of Dublin of Franklin (An Ordinance/a Resolution) (Local Public Agency) County, Ohio, hereinafter referred to as the Local Public Agency (LPA). SECTION I - Project Description WHEREAS, the STATE has identified the need for the described project: Resurfacing of SR745 through the City of Dublin in Franklin and Delaware counties. NOW, THEREFORE, be it ordained by the bythe City of Dublin of Franklin County, Ohio. (LPA) SECTION II - Consent Statement Being in the public interest, the LPA gives consent to the Director of Transportation to complete the above described project. SECTION III - Cooperation Statement The LPA shall cooperate with the Director of Transportation in the above described project as follows: The LPA agrees to provide the detailed design services for the subject project. The LPA further agrees to pay One Hundred Percent (100%) of the cost of those features requested by the LPA which are determined by the State and Federal Highway Administration to be unnecessary for the Project. The LPA further agrees to provide construction inspection personnel for the Project, up to a maximum of one person. The LPA further agrees to pay One Hundred Percent (100%) of the cost of the Project more than $500,000. The LPA further agrees that change orders and extra work contracts required to fulfill the construction contracts shall be processed as needed. The State shall not approve a change order or extra work contract until it first gives notice, in writing, to the LPA. The LPA shall contribute its share of the cost of these items in accordance with other sections herein. The LPA further agrees to pay One Hundred Percent (100%) of the cost to install and/or repair curb ramps at all necessary intersections to ensure compliance with the Americans with Disabilities Act. SECTION IV - Maintenance Upon completion of the described Project, and unless otherwise agreed, the LPA shall: (1) provide adequate maintenance for the described Project in accordance with all applicable state and federal law, including, but not limited to, 23 USC 116; (2) provide ample financial provisions, as necessary, for the maintenance of the described Project; (3) maintain the right-of-way, keeping it free of obstructions; and (4) hold said right-of-way inviolate for public highway purposes. SECTION V - Authority to Sign The of said City of Dublin is hereby empowered on (Contractual Agent) (LPA) behalf of the City of Dublin to enter into contracts with ODOT pre-qualified consultants (LPA) for the preliminary engineering phase of the Project and to enter into contracts with the Director of Transportation necessary to complete the above described project. Upon the request of ODOT, the is also empowered to assign all rights, (Contractual Agent) title, and interests of the City of Dublin to ODOT arising from any agreement with its (LPA) consultant in order to allow ODOT to direct additional or corrective work, recover damages due to errors or omissions, and to exercise all other contractual rights and remedies afforded by law or equity. The LPA agrees that if Federal Funds are used to pay the cost of any consultant contract, the LPA shall comply with 23 CFR 172 in the selection of its consultant and the administration of the consultant contract. Further the LPA agrees to incorporate ODOT's "Specifications for Consulting Services" as a contract document in all of its consultant contracts. The LPA agrees to require, as a scope of services clause, that all plans prepared by the consultant must conform to ODOT's current design standards and that the consultant shall be responsible for ongoing consultant involvement during the construction phase of the Project. The LPA agrees to include a completion schedule acceptable to ODOT and to assist ODOT in rating the consultant's performance through ODOT's Consultant Evaluation System.
