Form No. 1097 ~ II eld January 7, 1985 19 Mayor James E. Lewis called the regularly scheduled meeting of the Dublin Village Council to order at 7:30 P.M. on Monday, January 7, 1985. Mr. Thornton led those present in the Pledge of Allegiance. Members of Council present were: Mr. Amorose, Mr. Close, Mayor Lewis, Ms. Maurer, Mr. Sutphen, and Mr. Thornton. Mrs. Headlee was absent. Mr. Smith, Law Director, and Mr. Sheldon, Village Manager, were also present as were Village Staff personnel: Mr. Warner, Mr. Bowman, and Ms. Prushing. Mr. Amorose moved to approve the minutes of the December 17, 1984 meeting. Mr. Thornton seconded the motion. The vote was 6-0 in favor. Mr. Amorose moved to approve the bill listing. Mr. Sutphen seconded the motion. The vote was unanimous in favor. Mr. Thornton made a motion to approve the minutes of the Special Meeting of Council which was held on December 28, 1984 at 8:30 A.M. Mr. Amorose seconded the motion. The vote was as follows: Mr. Amorose, yes; Mr. Close, yes; Mayor Lewis, yes; Ms. Maurer, yes; Mr. Sutphen, abstain; Mr. Thornton, yes. There were no objections to a request by the Upper Arlington Rotary Club for a one day liquor permit for a function to be held at 6565 Frantz Road on Saturday, February 16, 1985 from 7:30 P.M. to 12:00 P.M. Ordinance No. 32-84 - Amended Preliminary Plan - Earlington Village. Third Reading. The vote of those present was unanimous for approval. Ordinance No. 33-84 - Amended Preliminary Plan - Brandon Village. Reading. The vote was 6-0 (unanimous) for approval. . I Th1rd Ordinance No. 61-84 - Approve Inclusion of Ordinances in Codified Ordinances. Third Reading. The vote was unanimous of those present for approval. Ordinance No. 01-85 - Appoint Members to Various Boards and Commissions. First Reading. Mr. Amorose introduced the Ordinance. Council agreed to treat this as a first reading and recommended that action be taken at the January 21, 1985 meeting. Mayor Lewis noted that the Charter states that the present members of the various Boards, Commissions, and Committees are to serve until reappointed or replaced. Ordinance No. 02-85 - Proposed Rezoning of Approximately 10 Acres on Tuller Road. First Reading. Mr. Close introduced the Ordinance. Mr. Amorose moved to submit the Ordinance to the Planning and Zoning Commission for consideration. The vote was 6-0 in favor of the motion. Appointment of the Law Director. Mr. Close moved to accept the recommendation of the Village Manager and reappoint Mr. Stephen Smith as Law Director until December 31, 1985. Mr. Amorose seconded the motion. Form No. 1097 ~ I II eld January u7, 1985 19 Page Two Council Selection of Planning and Zoning Representative from Council to the Planning and Zoning Commission. It was agreed to defer selecting a representative until the January 21, 1985 Council meeting. Request from the Parks and Recreation Committee for Phones for Avery and Scioto Parks. Mayor Lewis mentioned the memoranda from Mr. Sheldon and Mrs. Saylor, Chairman of the Parks and Recreation Committee, regarding the request. The question was raised regarding the extent of liability for the Village for vandalism if the phones were installed. Mrs. Saylor said that she felt that the public health and safety factor outweighed the liability as a result of vandalism. Mayor Lewis asked that members of Council present their questions to Mr. Sheldon, who will research the issue further and report back to Council at the next meeting. Accepting Sewer Easements for Tuller Road. Mr. Close moved to accept two easements - one from Tuller Road Investment and one from Mr. McKitrick. Ms. Maurer seconded the motion. The vote was 6-0 in favor. Council Roundtable Discussion 1. Mr. Amorose Mr. Amorose gave a slide presentation depicting violations of Dublin ordinances with regard to home businesses, signs, litter, land- scaping, etc. He noted the absence of enforcement of existing ordinances. Mr. Amorose also made the following comments: that the Village Manager meet with the Village Planner and the Village Engineer and, if it is deemed necessary, as it appears to be, hire whatever staff the Villager Manager finds he needs to enforce all existing ordinances. This may require reassigning the responsibilitie of code enforcement from the Engineering Department to the Planning Department. This makes sense because the Planner works closely with the Planning and Zoning Commission and the Board of Zoning Appeals. The educational background of a planner, in many cases, deals with the function and use of space as well as aesthetics. Mr. Amorose moved to direct the Village Manager to meet with the Village Planner and Engineer and compile a report to be presented at the January 14, 1985 Executive Session of Council regarding code and ordinance enforcement. Mr. Thornton seconded the motion. The vote was unanimous in favor. 2. Ms. Maurer Ms. Maurer asked that the newspaper, perhaps with a letter from the Village Manager, inform the residents of Dublin that it is illegal to discharge firearms within the Village of Dublin.
