The regularly scheduled meeting of the Dublin Village Council was called
to order by Vice-Mayor, Michael Close, at 7:30 P.M. on Monday, December
3, 1984.

Mr. Thornton led those present in the Pledge of Allegiance.
Members of Council present were: Mr. Amorose, Mr. Close, Mrs. Headlee,
Ms. Maurer, Mr. Sutphen, and Mr. Thornton. Mayor Lewis was absent.
Mr. Smith, Law Director, and Mr. Sheldon, Village Manager, were also
in attendance as were Mr. Warner, Village Engineer, and Ms. Prushing,
Finance Director.
Mr. Amorose made a motion to approve the minutes of the November 19, 1984
Council Meeting, with the following correction on page 5, under Council
Roundtable Discussion (Mrs. Headlee). The words "Jaycees" should be
inserted in place of "Dublin Area Chamber of Commerce". Mrs. Headlee
seconded the motion. The vote was 6-0 (unanimous) for approval of the
minutes.
Mr. Amorose moved to approve payment of the bills. Mr. Sutphen seconded
the motion. The vote was unanimous of those present to pay the bills.

Resolution No. 19-84 - Inducement for Industrial Revenue Bonds - Manage-
ment Horizons. Second Reading.
Mr. Jack Levey, bond counsel from the law firm of Schwartz, Shapiro, Kelm
and Warren was present at the meeting. Mr. Close said that because the
dollar amount for the bonds had been increased from $2,500,000.00 to
$2,700,000.00, another notice of public hearing has been published, as
well as the third reading for the Resolution, to be heard at the Council
Meeting of December 17, 1984.

Ordinance No. 60-84 - Proposed 1985 Appropriations. Second Reading.
Mr. Thornton moved to approve passage of the Ordinance as an emergency
measure. Mr. Sutphen seconded the motion.
Mr. Close, responding to a question from Ms. Maurer, said that the only
items included in the appropriations ordinance are the regular salary
increases for staff that have been recommended by the Village Manager,
and approved. Mr. Close also explained that the appropriations ordinance
before Council contains nothing in the way of additional new expenditures,
with the exception of the increases in salary to existing employees. He
said that it is anticipated that at an executive session of Council in
January discussion will be held regarding the requests for additional
employees by department heads.
The vote was unanimous of those present for treating Ordinance No. 60-84
as an emergency. The vote on the Ordinance was 6-0 (unanimous).

Ordinance No. 61-84 - Approve Inclusion of Ordinances in the Codified
Ordinances. First Reading.
The Ordinance was introduced by Ms. Maurer. There was no further action.

Other
Action on Report of Assessment Equalization Board - Shier-Rings Waterline.
Mr. Amorose moved to approve and accept the report of the Assessment
Equalization Board. Mr. Thornton seconded the motion.
Mr. Warner answered Mr. Thornton's question regarding the missing 300 feet
of waterline by saying that by "word of mouth" he learned that the Village

staff made the decision that that section did not have to be built
because the developer brought the waterline underneath the bypass.
That 300' (feet) of waterline was deleted because of the cost to the
developer of bringing the line underneath the bypass. Mr. Warner said
that the decision was made during the construction of the waterline
before the present agreement he found on the books was entered into. It
was part of the approved plans for the waterline construction that the
line be brought under the overpass and extended an additional 300 feet.
Mr. Warner also said that there was additional expense in getting the
line under the freeway because of the casing, and boring operation. He
also said that the water payback agreement is with Mr. Irelan.
It was noted that Equity Planning Corporation would be asssessed $9,595.00
for the waterline.
Responding to a question from Mr. Close, Mr. Warner said that to the best
of his knowledge there is not an agreement between Mr. Irelan and the
present landowners.
Ms. Maurer noted that the developer had indicated that he felt that he had
paid for his share of the line in the purchase price of the property.
Mr. Sheldon said that the cost to extend the line under 1-270 and across
was $142,350.00. Mr. Warner said that the cost of construction of the
300 feet would be approximately $10,000.00.
Mr. Smith said, by rejecting the report of the Assessment Equalization
Board, the Village will not be able to divide the cost among the other
property owners. If a newly appointed Assessment Equalization Board
would also reject the report of the first Board, the Village would have
to pay the cost of the line.
The Village payback payments to Shamrock II were and are for what was
actually constructed.
Mr. Thornton said that he felt that the question was whether or not this
particular property owner is being assessed twice for a waterline -
whether he paid that assessment to the people he bought the property
from and then is being asked to pay for it again. Is that not a matter
of written record?
Mr. Close said that the person who is negotiating to buy the property
is in a better position to protect himself from having to pay twice than
anyone else.
Mr. Smith said that the Village has no way of knowing what went on in the
negotiations when the property was purchased.
All property owners are being assessed the same unit cost.

The vote was 6-0 to approve the report of the Assessment Equalization
Board.

Proposed Construction of Sewerline on Tuller Road.
Mr. Amorose moved to approve the proposed Tuller Road sewerline agreement
which Mr. Sheldon had issued in a memorandum dated November 27, 1984.
mr. Sutphen seconded the motion.
Mr. Sheldon explained that what the motion is is an oral commission by
Council, duly recorded, to commit to the project up to $120,000.00
which will be followed by a payback agreement which Mr. Sheldon will have
written and prepared in which case they, Taggart, Marryott, Reardon
would be repaid at 30% of all Dublin sewer tap fees paid on said sewer-
line from Riverside Drive to their easterly property line for a period
not to exceed 15 years.

No notes or bonds will need to be issued. The money will come from the
sewer fund.
The vote on the motion was 6-0 (unanimous).

Council Roundtable Discussion

Thornton
Mr. Thornton mentioned the completion of Frantz Road (the
Columbus section having been finished). He noted two items
regarding same - the alignment of the road has been changed;
the Columbus section has no curbs and some of the sod has al-
ready been damaged.
Mr. Thornton noted that there is to be an article in Business
First on downtown Dublin, and also that camera crews from PM
Magazine have been in downtown Dublin filming. He suggested
that, with the increased exposure and interest in the Old Dublin
area, the Administration move ahead with a program to provide
facilities (rest rooms) for those visiting the Old Dublin
downtown area.

Mrs. Headlee
Mrs. Headlee agreed with Mr. Thornton regarding the downtown area
of Dublin. She also mentioned the limited parking available,
suggesting encouragement of usage of the two public parking lots,
noting that local employees should use the back lots of their
businesses for parking.
3. Mr. Sutphen
Avery Road Waterline Area - the paths into the fields are extremely
narrow. Mr. Warner said that those "pull off" areas are for access
to the hydrants. A couple of those areas will be extended in the
spring. "The lanes for access to the farmers are a foot back in
and are maintained right now."

Mr. Sutphen also commented about the mud around construction areas.
Mr. Warner told Mr. Sutphen that information regarding the Village's
policy on mud is included when building permits are issued.
4. Ms. Maurer
Ms. Maurer had a request to Mr. Sheldon regarding maintenance of the
Old Muirfield Cemetery. Mr. Sheldon said that employees of the
Village are mowing the Cemetery; a chain and two posts have been
installed at the access point; nothing has been done regarding the
fallen and/or broken tombstones. Representatives of the Dublin
Historical Society have recommended leaving the area "as is" (with
the option of a fence).

Mr. Sheldon said that the Village would follow up with the City of
Columbus regarding Frantz Road and curbing. He did indicate that the
area from Tuttle Road to Hayden Run Road will be the center two lanes of
the future road and curbs will be put in when the additional two lanes
are completed.
