"... Mr. Thornton led all present in the Pledge of Allegiance. \- Members of Council present were: Mr. Amorose, Mrs. Headlee, Mayor Lewis, Ms. Maurer, Mr. Sutphen, and Mr. Thornton. Mr. Close arrived at 7:34 P.M. Mr. Smith, Law Director, was also present as was Ms. Prushing, Acting Village Manager. Village Staff members also present were Mr. Bowman and Mr. Warner. Mr. Amorose moved to approve the minutes of the August 20, 1984 Council Meeting. Mr. Thornton seconded the motion. The vote was as follows: Mr. Sutphen, abstain; Mr. Thornton, yes; Ms. Maurer, yes; Mr. Lewis, yes; Mrs. Headlee, yes; Mr. Amorose, yes. Mr. Thornton moved to pay the bills. Mr. Amorose seconded the motion. Mayor Lewis pointed out to Councilmembers an error in the Bill Listing. The $2,420.00 charge to provide water taps for Avery Park and Dr. Walker by Eger's Trenching was a quotation and not a bill. This item is to be struck from the bills to be paid. The vote was: Mr. Amorose, yes; Mrs. Headlee, yes; Mr. Lewis, yes; Ms. Maurer, yes; Mr. Sutphen, abstain; Mr. Thornton, yes. II'""""" Correspondence A request, through the Ohio Department of Liquor Control, from Mr. Peter J. Albanese, DBA Pete's Pizza, for a C1 liquor permit (beer only in original sealed containers for carryout only). The address indicated on the application was 6500 Riverside Drive, Suite B. Because of in- sufficient information Mr. Smith, the Law Director, recommended that the Village request a hearing on the advisability of issuing the permit. Mrs. Headlee moved to file an objection. Mr. Sutphen seconded the motion. The vote was 6-0 in favor of filing an objection. '-- Ordinance No. 30-84 - Re: Street Cleaning, Mud on Streets, etc. Tabled. Mr. Thornton moved to remove the Ordinance off of the table. Mrs. Headlee seconded the motion. The vote was 7-0 in favor. Mr. Thornton moved to accept the amendments of Ordinance No. 30-84. Mr. Close seconded the motion. The vote was 7-0 in favor. The vote on the Ordinance was unanimous (7-0). Ordinance No. 31-84 - Rezoning of 10.537 Acres on Tuller Road. Third Reading. The vote was 7-0 in favor of the rezoning. Ordinance No. 39-84 - Rezoning of 9.2 Acres West of Sherex on Rings Road. Third Reading. The vote was unanimous (7-0) in favor of the rezoning. Ordinance No. 40-84 - Proposed Agreement with Disaster Services Agency. Third Reading. The vote was unanimous for approval (7-0). ..... Ordinance No. 44-84 - Ordinance to Renew Glick Road Improvement Note ($240,000.00). First Reading. Emergency. Mrs. Headlee introduced the Ordinance. Mayor Lewis commented that the recommendation of the Finance Director was the bid submitted by Prescott, Ball, & Turben with an interest rate of 7.43%. Mrs. Headlee moved to do away with the Council Rule of Order because the Ordinance had not been advertised. Mr. Close seconded the motion. The vote was unanimous. Mrs. Headlee made a motion to enter the name of Prescott, Ball & Turben and do away with the three time reading rule and treat as an emergency. Mr. Amorose seconded the motion. The vote was 7-0 in favor. The vote on the Ordinance was 7-0 in favor. Form No. 1097 ~ Held Septe_mber_4, 1984 19 ".., Page Two ..... Request to Advertise for Waterline Bids for 932 Feet on Rings Road. Responding to questions Mr. Warner made the following comments: 1. This waterline will be made available to everyone on Rings Road. 2. It is a short loop from Frantz Road to the end of Llewellyn Farms. The developers of Llewellyn Farms brought the 12" line up from Dublin Road to their easterly property line and this will complete a southerly loop into Columbus's system for the downtown Old Dublin area in case anything happens to the 24" line across the river. 3. This line does not go west of Frantz Road. Responding to a question from Mayor Lewis regarding the financial impact of the estimated cost of the waterline of $30,400.00, Ms. Prushing said that the water fund has in excess of approximately $200,000.00 in it. Mr. Amorose moved to authorize the Village Manager to solicit bids for the completion of the Rings Road Waterline Loop. Mr. Thornton seconded the motion. The vote was unanimous in favor. ".. , i -- Discussion on Land Surrounding the Old Cemetery in Muirfield. There were no representatives present from the Memorial Tournament to speak to Council regarding the request. The request was that the Memorial Tourna- ment would have permission to use the approximately 1~ acres surrounding the cemetery during the Tournament for mobile offices and/or tents. In return for the use of the land, the Memorial Tournament would make improvements on the land and would maintain the land and the cemetery throughout the year. As a result of concerns expressed by Councilmembers regarding the actual size of the cemetery, disposition of the trees, etc. Council asked that Mr. Thomas Cerra of the Memorial Tournament be present at the September 17, 1984 meeting of Council to present additional information and answer questions of Councilmembers. Old Dublin Historic District - Committee Appointments. As a result of the motion of the Architectural Review Board to create a committee for the purpose of planning the future development of Old Dublin and retaining the historical character, Mayor Lewis appointed the following persons to serve on said committee - Appointee Mr. Tom Grace Mr. George Thomas Representing Architectural Review Board Property owners of the Old Dublin Historic District Residents of the Old Dublin Historic District Old Dublin Merchant's Association Dublin Historical Society Dublin Village Council Member-at-Large Member-at-Large Mr. Thomas Kellett Ms. Nancy Kieffer Mrs. Robert Karrer Mr. L. E. Thornton Mr. George Eger Craig L. Wright, D.D.S. ".. Council Roundtable Discussion ... 1. Mrs. Headlee Mrs. Headlee asked that reports be made available to Councilmembers regarding the Manager's staff meetings which Council, at their January meeting, suggested be implemented. Mrs. Headlee mentioned the report submitted by Mr. Warner on the South and North Fork of Indian Run Stream. She indicated that she is researching the same project and will report to Council, showing how the stream is drying up. ~f\>'_ ll..~~'~';<,".,. Mr. Joe Fetro, President of the Shannon Park Civic Association, addressed the Village Council regarding deed restrictions for Shannon Park II. Mr. Fetro posed a question - who makes sure what is passed by the Planning and Zoning Commission and Council is actually enforced? What happens when those enforcements do not occur? Mr. Fetro mentioned two letters he had written regarding the fact that copies of the deed restrictions for Shannon Park II had not been received for review by the Shannon Park Civic Association. The development commenced without deed restrictions being filed. It was mentioned that deed restrictions are usually filed when the first building is sold. Mr. Bowman said that deed restrictions address the issues of general upkeep of the resident units, how the common property will be maintained, and that the deed restrictions for Shannon Park II will be similar to those for Killarney Court. Several additional comments were made by Councilmembers, Mayor Lewis, Village Staff, and Mr. Fetro. 1. Mayor Lewis had a question regarding the legal responsibility of the Village with regard to a warranty deed that may be substantially in excess of zoning compliance. He suggested that the Law Director examine the question, as well as the concerns of the Shannon Park Civic Association, so as to determine the responsibility of Council in such a situation. 2. Mr. Fetro said it was not the deed restrictions in themselves that was of concern, but after a plan is passed by the Planning and Zoning Commission, who then enforces the requirements. Who is responsible for enforcement if there is not compliance? 3. Mayor Lewis indicated that there was a question in his mind, when talking about deed restrictions, as to who should have the ultimate responsibility and/or authority. 4. Mr. Close said that he felt that it would take only "a brief period of time" to produce a set of deed restrictions and said that he could not understand why it would take a month or more to get a set of deed restrictions filed. Mr. Close suggested that the developer supply a set a deed restrictions "with the rest of his package during the final hearing before the Planning and Zoning Commission or go home". 5. Mrs. Headlee said that as a stipulation of approval by the Planning and Zoning Commission the developer was told that the deed restric- tions were to be filed. The same plan was approved by Council as well. 6. Mr. Smith will investigate the issue further and give Council an opinion. ".... ....
