Form No. 1097 ~ Held Ma y 7, 1984 19 '--' The scheduled meeting of the Dublin Village Council was called to order by the Vice-Mayor, Mr. Close, at 7:30 P.M. on Monday, May 7, 1984. Councilmembers present were: Mr. Amorose, Mr. Close, Mrs. Headlee, Ms. Maurer, Mr. Sutphen, and Mr. Thornton. Mayor Lewis was absent. Law Director Mr. Smith, and Village Manager Mr. Sheldon, were also present as were Village Staff members Mr. Bowman and Mr. Warner. r- Mr. Amorose made a motion to approve the minutes of the April 16th meeting. The motion was seconded by Mrs. Headlee and passed with a unanimous vote of the members present. , ........... Mrs. Headlee moved to pay the bills with the following amendment: "to withhold payment to R.P.M. Maintenance (the cleaning company) until the Municipal Building is cleaned properly". Ms. Maurer felt that it would be more appropriate for the Village Manager to super- vise the operation and give the company an opportunity to improve their services rather than withhold monies they have presumably earned. Ms. Maurer felt that withholding monies might be an unfair labor practice. Responding to a question, Mr. Sheldon said that the situation has been a problem at times, but that he felt Mrs. Headlee's motion gave him "sufficient leverage" to work with R.P.M. to improve the situation. Mr. Sheldon also noted that this particular problem arises with many businesses in Dublin and that the Village Municipal Building does not present a unique situation. The vote on the amendment was as follows: Mr. Thornton, yes; Mr. Sutphen, yes; Ms. Maurer, no; Mrs. Headlee, yes; Mr. Close, yes; Mr. Amorose, yes. The vote on the motion to pay the bills was 6-0. r Tabled Ordinance No. 12-84. Appointing Deputy Clerks of Mayor's Court. Mr. Close recommended continued tabling of the Ordinance until the May 22nd Council Meeting. Tabled Ordinance No. 13-84. To Permit and Control Satellite Dish Antennas. Mr. Close, after consulting with Mr. Bowman, said that additional time would be required to obtain the necessary information regarding wind-load factors, etc. The Ordinance remained tabled. Ordinance No. 08-84. Rezoning 4.347 Acres at the Rear of Frank's Nursery. Third Reading. It was noted that because of the Conditions of Approval of the Planning and Zoning Commission, the zoning for this parcel would be 10 units per acre. The Record of Action of the Planning and Zoning Commission, including the Conditions for Approval of 10 units per acre is noted in "Exhibit C". The Exhibit is a permanent part of the Ordinance. The vote was 6-0 for approval. \. Ordinance No. 15-84. Rezoning of 5.81 Acres on the South Side of S.R. #161 at David Road. Third Reading. Mr. Bowman mentioned Ordinance No. 18-84 which would be introduced later in the meeting. The Ordinance (No. 18-84) is for a parcel adjacent to the property cited in Ordinance No. 15-84. Both are rezoning applications by the same applicant, same firm. The requests are for SO (Suburban Office). The SO designation will become important when coming up for Corridor District Review (the entire 9 acres). Mr. Bowman indicated that the Corridor District recommends the Suburban Office Zone, but when the two parcels are considered together it will have important affects as far as where the roadways go and the beginnings of a service road on these parcels. i"'-" t \ RECORD OF PROCEEDINGS 361 ~ Minutes of Meetillg ~ National Graphics Corp., Cols., O. Mr. Bainbridge noted that he felt that the zoning change to office buildings is in the best interest of the neighborhood. The vote was 6-0 for approval. Resolution No. 09-84. Coalition Regarding Zimmer Nuclear Plant. Second Reading. There was no discussion. The Third Reading and further discussion will be held on May 22, 1984. Resolution No. 10-84. Declaring a Specific Property a Nuisance. First Reading. Emergency. The Resolution was introduced by Mrs. Headlee. Mrs. Headlee moved to do away with the three time reading rule and treat as an emergency. Mr. Thornton seconded the motion. In response to a question by Ms. Maurer with regard to possible legal problems (notification), Mr. Smith said that the Resolution had been advertised as part of the meeting agenda. The vote on the resolution was 6-0 for passage. ........ ( \...... Ordinance No. 18-84. Rezone 3.84 Acres on the South Side of S.R. #161 200 Feet East of David Road. First Reading. The Ordinance was introduced by Mrs. Headlee. Mr. Sutphen moved to refer the Ordinance to the Planning and Zoning Commission. Ms. Maurer seconded the motion. The vote was 6-0 to send the Ordinance to the Planning and Zoning Commission. '-" Discussion of Special Census Costs, etc. Mr. Sheldon reported that a letter had been received from the Bureau of Census indicating that the estimated cost of a special census would be $8,795 (to Dublin). The Village would be required to advertise in the paper for qualified applicants and from perhaps 30 or 35 applicants, 11 or 12 would be selected. An office quarters equipped with telephone(s), office furniture, adding machine(s), typewriter(s) would also have to be provided by the Contractor (the Village of Dublin). Responding to a question from Mr. Close, Mr. Sheldon noted that when a Village becomes a City, the City is responsible for maintaing the state routes; specifically S.R. #745, S.R. #257, and parts of S.R. #33 and #161. As a City, Dublin would get reimbursed to a degree; the costs recovered would be approximately the cost of snow removal. Ms. Maurer mentioned the cost of widening S.R. #161 between Bridge Street and the area where it becomes four lanes - what would be the cost to Dublin (the costs now being carried by the State). Mr. Sheldon said that the assistance would be less if Dublin were a City. Mr. Sheldon also said that in his opinion the cost assistance would be greater if Dublin remained a Village - a Village would probably be assisted with perhaps 75 to 80% of the cost whereas if Dublin were a City it would be a 50/50 split. Mr. Thornton mentioned the Dublin Bridge. Mr. Sheldon said that City versus Village status would probably have little effect on that situation. The project is scheduled to go out for bids in February, 1985. What is best for Dublin should be the determining factor. The heavy costs incurred should be considered. Mr. Close requested that more specific information regarding costs involved be made available to Councilmembers before a commitment is made to doing the special census. Mrs. Saylor, Chairman of the Parks and Recreation Committee, mentioned the report received by Councilmembers regarding the responsibilities of the Parks and Recreation Committee and the job description for the Director of Parks and Recreation. Mrs. Saylor, in response to a question, noted that the educational requirements for the Director of Parks and Recreation was an optimum situation which allowed for flexibility. Mr. Smith noted that because of the Dublin Village Charter's provisions a Resolution would be in order for the May 22nd meeting. Council Roundtable Discussion 1. Mr. Thornton A. Mr. Thornton mentioned the poor condition of the road in front of the Village Square Shopping Center (Sister's Chicken and Biscuits area). Mr. Warner said that the roadway is the responsibility of the State but that he and his staff are studying and determining what to do about the drainage situation which is Dublin's responsibility. r '- 2. Mrs. Headlee A. Mrs. Headlee recommended that the newspapers remind residents that vacant lots as well as yards have to be rid of weeds, etc. B. Mrs. Headlee also recommended that the chairs used by Councilmembers in the Council Chambers be repaired. 3. Mr. Sutphen A. Mr. Sutphen mentioned the excessive amount of mud on the road in front of the Donegal Cliffs subdivision. B. He also mentioned the obstructed view when looking south on Frantz Road leaving the Huntington National Bank due to the trees on the site triangle. Mr. Warner said that a letter was mailed to the bank on April 27th requesting the relocation of those trees. .-- 4. Ms. Maurer \..' A. Ms. Maurer reported that the second meeting of the Estates, Gifts, and Benefits Commission had been held. Lee Beall is a new member, and the Commission is searching for three more members. At the meeting the Commission decided to work on a proposal for Council to create a gift handbook for Dublin. Ms. Maurer made available to members for perusal a handbook prepared by Lake Forest, Illinois. The Commission will be working with staff members, as well as the Dublin Historical Society, in the preparation of the handbook. Mr. Amorose noted that the Maintenance Department is to be commended for the striping of the Frantz Road/161 inter- section. He also mentioned that he appreciated the work and effort being done by the Parks and Recreation Department personnel on the parks, noting a great improvement. B. It was recommended, as a result of Mr. Amorose's observation, that a "summary report" be included with Ordinances and Resolutions which come up for a Third Reading. ~ 6. Mr. Close A. Mr. Close noted that Mayor's Court will be held in the High School Gymnasium on May 8, 1984. The Council Chambers will be being used as a voting place for the Primary Election. B. Monday, May 28th, will be the Village's official observance of Memorial Day. r- Mrs. Headlee recommended that more Village residents display the flag, especially on Memorial Day, Fourth of July, etc. She also commented favorably on the flag in front of Elby's Restaurant. '-- A Dublin resident mentioned a large number of dogs running loose - can anything be done about the situation? It was noted that the Village does not have the staff or facility for "holding" same prior to referral to the Franklin County Animal Control facility. Mr. Close mentioned that due to a resignation there is a vacancy on the Board of Zoning Appeals. A notice will be placed in the newspapers for applicants, and those who indicated an interest in serving on the Board in December will be called to see if they are still interested. There will be an Executive Session of the Council on Tuesday, May 22, 1984 at 7:00 P.M. Responding to an inquiry of a resident regarding the force main sewer situation, Mr. Sheldon mentioned the conflict and continuing discussions between the City of Columbus and Delaware County officials regarding same.
