Ashrawi, Attorney At Law Re: Ordinance 71-21 – Acquisition of Easement and Property for the Deer Run Force Main and Lift Station Project (19-025-CIP) SUMMARY The Deer Run Force Main and Lift Station Project (the “Project”), which includes installing approximately 12,750 linear feet of 16-inch force main (sanitary sewer) and a wet-weather sanitary pump station (lift station), was recommended in the Deer Run Sewer Modeling Report (2012). As a result, the Project is programmed in the 2021-2025 Capital Improvements Program (CIP) as the Deer Run Sanitary Sewer Improvements, Group #1. The lift station will be located on the existing sanitary sewer alignment near Deer Run and west of the Dublin Road right-of-way on property owned by the Muirfield Village Golf Club (MVGC). The force main will be located along Dublin Road between Deer Run and Emerald Parkway. The Project requires the acquisition of property interest from the MVGC. After engaging in amicable and supportive discussions, MVGC has agreed to dedicate, as a donation to the City, the property interests necessary to construct and maintain the proposed lift station and force main as detailed in the construction plans (see attached location exhibit). The construction of the Project is expected to commence in early 2022. ACQUISITION The City is acquiring from MVGC only the property interest necessary for purposes of the Project. As depicted in the legal descriptions and exhibits attached to this memorandum, the City is acquiring 0.181 acres of land (1-WB) and 0.076 acres of temporary construction and grading easement (1-T) from MVGC. As MVGC has agreed to donate these to the City, there will be no cost to the City in acquiring the property interests. This ordinance authorizes the City Manager to execute all necessary conveyance documentation and contracts to formally acquire the aforementioned property interests as a donation and in the form of a fee simple warranty deed and temporary construction and grading easement.
