A RESOLUTION WAIVING COMPETITIVE BIDDING
REQUIREMENTS, PURSUANT TO SECTION 8.04
(`CONTRACTING PROCEDURES'), PARAGRAPH (C)
("WAIVER OF COMPETITIVE BIDDING") TO EXTEND
THE CONTRACT FOR THE PURCHASE OF ROCK SALT
WHEREAS, Section 8.04(c) of the Revised Dublin Charter authorizes Council, by a
vote of no less than five (5) members, to waive competitive bidding requirements if
Council determines that it is in the best interest of the City to do so; and
WHEREAS, in 2006, based on competitive bidding, the City awarded the rock salt
contract to Cargill Deicing Technology (Cargill);and
WHEREAS, the contract awarded to Cargill did not include an extension; and
WHEREAS, Cargill has proposed an extension of the 2006 contract at the 2006 bid
price; and
WHEREAS, the City has determined the 2006 rate is competitive, based on other bids
received by other public entities in 2007.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dublin, State of
Ohio, ~ of the elected members concurring that:
Section 1. Extension of the current contract with Cargill for the purchase of rock salt
at the 2006 bid price of $49.39 per delivered piled ton is hereby authorized.
Section 2. Competitive bidding requirements in Section 8.04, paragraph C of the
City of Dublin Codified Ordinances. are hereby waived for the purchase of rock salt.
Section 3. This Resolution shall take effect upon passage in accordance with
Section 4.04(a) of the Revised Charter.

Memo
Attached for your consideration is Resolution 64-07, waiving competitive bidding for purchase
of rock salt for the 2007-2008 season and authorizing a contract with the current vendor. This
commodity was competitively bid in 2006, with the bid awarded to Cargill Deicing Technology,
the lowest bidder. Although this bid did not include a provision for extension, Cargill has agreed
to extend last year's contract to the City at the same price of $49.39 per ton, delivered and piled.
Based on an estimated quantity to be purchased of 8,000 tons, the cost of this contract extension
will total $395,120.

Staff recommends passage of Resolution 64-07, waiving competitive bidding for the purchase of
rock salt and authorizing the City Manager to enter into a contract with Cargill Deicing
Technology, the current vendor for this commodity, at the price of $49.39 ton for piled delivery.
