Mayor Lewis called the meeting of the Dublin Village Council to order at
7:30 P.M. on December 19, 1983. Council members present were: Mr. Amorose,
Mr. Chambers, Mrs. Headlee, Mr. Lewis, Ms. Maurer, Mr. Sutphen, and
Mr. Thornton. Mr. Sheldon, Village Manager, and Mr. Smith, Law Director,
Were also present. Village Staff members in attendance were: Mr. Strutner,
Mr. Bowman, Mr. Warner, and Ms. Prushing.

Mr. Amorose made a motion to accept the minutes of the December 5th
meeting; motion seconded by Mr. Sutphen. The motion to approve the
minutes passed unanimously.
Mrs. Headlee moved to accept the Bill Listing; seconded by Mr. Amorose;
the motion passed unanimously.
At the request of Mayor Lewis the Clerk read a section of the Manager's
Report dealing with bill SB 250. Effective January 1, 1984, all
operators and owners of motor vehicles driven on the roads and highways
of Ohio will be required to have proof of financial responsibility. The
Law Director and Police Department will be working together to educate
the public regarding the provisions of the bilL
Public Hearing and Second Reading - Ordinance No. 46-83 - Proposed re-
Zoning of a 50+ acre tract located between Avery Road and Wilcox Road,
South of Shier-Rings Road. To be rezoned from R, Rural to: RI, Restricted
Industrial.

Mr. Jim Steller, an attorney from Westerville for the Avery Land Company,
(owner of the tract) spoke for the change in zoning. Mr. Steller mentioned
that the request for rezoning is no longer Light Industrial. At the
Planning and Zoning Commission meeting it was modified to Restricted
Industrial. The tract to the north (approximately 22 acres) is zoned
Restricted Industrial. Both tracts were recently annexed to the Village
of Dublin.

Mr. Chambers requested information regarding the differences between
Light Industrial and Restricted Industrial from the Village Staff. Mr.
Sheldon and Mr. Bowman replied that Restricted Industrial encompasses
less objectionable manufacturing type uses. All uses must be contained
within a closed structure. The Planning and Zoning Commission has been
hesitant to recommend Limited Industrial uses.

Several property owners spoke in opposition. Mr. Wayne Rickert and Mr.
Paul Turpin spoke in opposition of the rezoning request, speaking for
the nearly 200 people who live in the area. They said they would prefer
it remain agricultural for the following reasons:
1) Traffic already is heavy on the perimeter roads and they are not
wide enough to be safe at the posted speed limits
2) Land along Shier-Rings and S.R. 33 is better suited and has a
better location for industrial development
3) There is almost 200,000 square feet of vacant industrial space at
the east end of Shier-Rings Road adjacent to 1-270 which has been
vacant for a long time. Perhaps more competitive space would only
be created.
However, Mr. Rickert and Mr. Turpin felt that they could not stop the
zoning change so they asked that the Council consider the following
recommendations of the property owners:
1) An in-depth civil engineering review be conducted, and the review
be made available for public review and comment at least 60 days
prior to any final zoning hearing.

2) If the civil engineering review is favorable, request only
Restricted Industrial zoning be permitted. Also requested that
the category labeled "Laboratories" and "Other" industry be denied.
3) Drainage is very poor, especially the Dan-Sherri subdivision. High
water table, culvert crossing Avery Road, clay content of soil,
etc. need to be considered.
4) Traffic is also a concern. Perhaps? traffic signal at Avery Road
and Shier-Rings Road and/or at Wilcox Road and Shier-Rings Road
would be in order. Also recommended a reduction in the speed limit
to 35 mph. Also, can the roads handle the additional traffic loads?
5) Recommend set-backs on Avery Road and Wilcox Road be 175'.
6) Landscape perimeters of buildings.
7) Landscaped natural appearing sight barriers on Avery Road and Wilcox
Road frontage be constructed.
8) Code requiring open service areas to be screened by walls or fences
6' to 8' high wi th an opaqueness of 75~~ be enforced.
9) Enforce signage code and grant no variances.
10) All site lighting of a type using a parabolic lens directing all
light on to the ground, and all bulbs to be High Pressure Sodium
vapor type.
11) All driveways and parking lots be blacktopped.
12) Concern regarding adequacy of well water, water purity, and effects
of waste dumpage. Asked that the City and/or Developer bear the
cost of any water, sewer, and sewage treatment facilities required.
13) Requested the Zoning Department of the Village of Dublin aid them
in ridding the area of some of the "corporate eyesores".
Mr. Rickert and Mr. Turpin indicated that they would be willing to meet
with the City of Dublin officials, Developers, and/or Buyers for further
discussion of concerns.
Mr. Kermit Grener, Mr. Willard Nicol, Mr. Alvin A. Rings, and Mr. Alvin W.
Rings, representing St. Johns Lutheran Church also spoke to the issue.
Their concern was the cemetery (a historical landmark) located on the
northwest corner of the church property.
1) Traffic flow on Avery Road. Will the road be widened in the future,
thus affecting the cemetery grounds?
2) Regarding the area behind the cemetery - perhaps a landscaped
buffer zone would be in order.
Mr. Grener agreed to confer with the Church Council of St. Johns to see if
they might be willing to share in the cost of a buffer zone behind the
cemetery.

At the request of Mayor Lewis, Mrs. Headlee reviewed the recommendations
of the Planning and Zoning Commission regarding the Ordinance:
1) Zoning to be changed from Light Industrial to Restricted Industrial.
2) Establish a 175' setback from the centerline of Avery Road, and a
100' setback line the centerline of Wilcox Road. No buildings or
structures or improvements would be allowed within the building
line.
3) Dedication of addi tional Avery Road right-of-way of 26'.
4) Treat all surrounding Township property as residential.
5) Strictly enforce the landscape code.
Mr. Rickert mentioned that they are recommending 175' setbacks for both
Avery Road and Wilcox Road. They have also asked for an access through
Shamrock Park off of Shier-Rings Road. He also felt that the Village has
not been helpful in strict enforcement of the Planning and Zoning codes.

Ordinance No. 45-83 - New Dwelling Code
Mayor Lewis mentioned the amendment written by the Village Engineer
regarding Wood Shakes that is to be incorporated in the Ordinance. The
amendment reads as follows: "R810.4 - Below Windows - No windows from
occupied spaces shall have non-rated wood shingles or hand-split shakes
below their openings. Hand-split shakes used in these areas are to be
treated, fire retardant shakes, or shingles." Mr. Sutphen made a motion
to incorporate the amendment into the Ordinance. He also recommended that
a requirement regarding square footage be included; i.e., the number of
square feet per unit required for the application of treated shingles or
wood shakes. Mrs. Headlee seconded the motion. The vote to amend the
Ordinance was unanimous. The vote on the Ordinance was unanimous.
Ordinance No. 53-83 - Annual Appropriations for 1984
The vote to approve the Ordinance was unanimous.
Ordinance No. 55-83 - Repeal 1978 Imposed Load Limit on Glick Road
Mrs. Headlee suggested that the load limit be kept down to 20 tons. Mr.
Warner will prepare an amendment to that effect before the third reading
of the Ordinance.

Ordinance No. 56-83 - An Ordinance to accept the Lowest/Best Bid for Law
Enforcement Officers Professional Liability Insurance
The Ordinance was introduced by Mr. Amorose. Mr. Strutner, in a memo,
recommended the acceptance of the bid from Anson Smith and Company for
$2,924.00/year for three years. Mrs. Headlee moved to wave the three
time reading and declare an emergency. The motion was seconded by Mr.
Chambers. The motion to declare an emergency passed by a vote of 7-0.
The vote was also unanimous for passage of the Ordinance.

Ordinance No. 57-83 - Amend 1983 Annual Appropriations
Ihe Ordinance was introduced by Mrs. Headlee. Mr. Thornton moved that
the Ordinance be treated as an emergency, seconded by Mr. Sutphen. The
motion declaring an emergency passed by a vote of 7-0. The vote on
passage of the Ordinance was unanimous.

Ordinance No. 58-83 - $1,000,000 Village of Dublin Ohio Industrial Develop-
ment First Mortgage Revenue Bonds (Russel G. Means
and Thomas C. Jack, Borrowers) (Employee Benefit
Management Corp. Project)
Mayor Lewis made the introduction. The proposal was considered on
December 15, 1983 by the Dublin Area Community Improvement Corporation,
at which time it was discussed in some detail, and the CIC made a
recommendation for approval to Council. In order to do so it will have
to be treated as an emergency. Ms. Insley, representing the prospective
borrowers, spoke regarding the need to move more rapidly than usual _
the pending legislation in Congress. Mr. Smith, Law Director, commented
that upon consultation a "clean" opinion was given, and he could see no
legal problem with the request. Mrs. Headlee moved to treat the
passage of the Ordinance as an emergency. The motion was seconded by
Mr. Chambers. The vote on the emergency measure was unanimous. The vote
on the Ordinance passed 7-0.
Ordinance No. 59-83 - Amend Fire Code
introduced by Mr. Sutphen. Mayor Lewis suggested that consideration be
given to the idea that the Fire Department notify those businesses
affected by this change.

Force Main Sewer
Mayor Lewis requested a report from Mr. Thornton, in the absence of Mr.
Wolfrom, from the Committee on the Force Main Sewer. At the last meeting
of the Committee, with all members present, the following proposal was
passed by a vote of 4 yes, 2 no:
"I propose that this Committee, having listened to and weighed much
discussion on the subject of the proposed 8" Force Main Sewer, evaluated
the several options and considered the long term effects of these options,
do hereby recommend to the Council of Dublin that the Village accept the
engineering plans of the Ci ty of Columbus, as amended and approved by our
Engineering Department. This recommendation is made with the understand-
ing that: the plans as amended will:
1) Permit no blasting; 2) Lay entirely within the existing State of Ohio
Right-of-W~y; 3) All contractors shall be adequately bonded to lnsure
restoration of damage done to any property."
That was the recommendation from the Committee to the Council.
Mr. Sutphen moved to accept the proposal of the Committee. Mrs. Headlee
seconded the motion.
Mr. Finkes presented a petition from 7 property owners of approximately
400 acres in the Northeast Quadrant urging Council to cooperate with the
City of Columbus in the building of the oversized force main sewer system.
The signers also agreed to commit their proportionate share of the cost
of the system. Mr. Hale, speaking for Mr. McKitrick, indicated that they
would be interested as did Mr. Dan O'Brien of Summer and Company, and
Mr. John Yeager. Mr. Finkes reiterated - why not let the people tap in who
are willing to pay for it.
Mr. Parkhill, a committee member, and a resident owner, reiterated the
engineering difficulties involved with pump stations, wells, etc. He
spoke urging the passage of the motion.
Mr. Hitchins spoke against the oversizing as being the worst alternative;
engineering difficulties, wells, project developing too quickly. He
recommended pursuing the injunction and felt that gravity lines along the
River would be the best alternative for the future. He later mentioned
that he was familiar with pump stations and they didn't work years ago
and they don't work now.
Mr. Stoycheff agreed with Mr. Hitchins and again indicated that most
residents don't want development and the sewer. They want "nothing" done;
and he opposed passage of the motion.

Mr. Chambers, who was not a member of the committee but who attended all
meetings but one, made the following points:
1) The original proposal from Columbus was a surprise as was, historically,
the Dublin Road relocation and the separation of the Joint Fire Board.
2) The proposal offered no benefit to Dublin.
3) The formation of the Committee was proposed by Mr. Chambers. It was
to get a real feel for what the citizens really wanted, and he
felt that the Committee still does not know how the citizens really
feel about the Force Main Sewer.

The survey of the citizens in the affected area never came to fruition.
The attitude of Columbus is that they are going to do what they want
to do.
He gave some historical information regarding Federal grants;
Columbus also never finished the west bank sewerA
Many options are still available to Dublin.
Dublin maintains the State of Ohio Right-of-Way; not the State.
Regarding lift stations - build a "good" one, not a "dumb" one.
Ms. Maurer gave her impressions of the Committee's work. There were
pragmatic considerations, legal considerations, engineering considerations,
and financial considerations in the Committee's final decision. There
was difficulty in deciding what to include in the survey to truly reflect
and respond to all of the citizens questions and concerns. Ultimately, a
gravi ty sewer system will be best for the citizens of Dublin.

Several residents, who had not been contacted, mentioned they were against
the force main sewer. They also questioned why the special meeting which
had been suggested to discuss the force main sewer was not held. Mr.
Amorose mentioned that he did make an effort to contact those people
affected, and did succeed in contacting about one-third of them. His
telephone survey results indicated that everyone would rather have
nothing, and were opposed to oversizing, and the pump station..

The motion was read again and the vote by Council was as follows:
Amorose, Yes; Chambers, No; Headlee, Yes; Maurer, Yes; Sutphen, Yes;
Thornton, Yes; Lewis, Yes. 6 Yes; 1 N04
Mayor Lewis expressed appreciation to all who participated in discussions
and mentioned that the option of the gravity system is still available.
Council Roundtable Discussion
Mrs. Headlee reported on a meeting with Mr. Sandusky (and his replacement)
from the Franklin County Board of Health. Mr. Strutner and Ms. Prushing
of the Village Staff also attended the meeting. Mrs. Headlee mentioned
that she had spoken with surrounding area churches who were not aware of
the services provided by the Mobile Health Clinic (monthly visits). Under
consideration is the possibility of offering the service here at the
Dublin Municipal Building beginning in Mayor June, with a drive aimed
at greater community awareness of the services available.
Ms. Maurer spoke in appreciation of Mr. Chambers' service on the Dublin
Village Council.
The meeting was adjourned at 9:51 P.M.
