Mr. Amorose moved, seconded by Mrs. Maurer, to approve the minutes of the
October 19th meeting. Vote on the motion waS unanimous for approval.
Mrs. Headlee moved, seconded by Mrs. Maurer, to approve the bill listing.
Mr. Chambers questioned the bill for electrical inspections, stating that
he understood these inspections were noW performed "in house". Mr.
Sheldon replied that they are done by contractural personnel. Mr. Amorose
questioned the bill for tires for a police cruiser. Mr. Sheldon agreed
that there seemed to be some confusion on the bill listing, but requested
Council approval while he looked into the matter. Vote on the motion to
approve the bill listing was unanimous.
The Clerk read two (2) letters from the Dublin School Administration
thanking Council and staff for their assistance in approving the vacation
of High School Road.
Ordinance No. 38-83
Said ordinance to rezone a B.397 acre tract of land along the east side of
S.R. 745 and immediately north of B4 N. High Street from R-2 to CB was read
for the third time. Mr. Halley, the applicant, requested that Council
table the ordinance until the next regular meeting because he has only
recently learned that the interior roadway of his proposed development for
this tract will have to be elevated, and thus there are some previously
unforeseen costs that will need to be studied. Mr. Chambers moved,
seconded by Mrs. Maurer, to table this ordinance until the next meeting.
Vote on the motion was unanimous for approval.
Ordinance No. 44-83
Said ordinance to delete the Standard Construction Drawings from the
Codified Ordinances was read for the third time. Vote on the ordinance
was unanimous for approval.
Resolution No. 15-83
Said resolution to delete Appendices A through U from Chapter 1115 of the
Codified Ordinances was read for the second time.
Resolution No. 16-83
Said resolution to repeal' Section 1103.03 of the Codified Ordinances was
read for the second time.
Ordinance 48-83
Said ordinance amending Ordinance 52-B1 (Compensation Plan) waS read for
the second time.
Ordinance 49-83
Said ordinance to adopt the procedure authorized under O.R.C. 3929.B6 to
enable the Municipality to receive insurance proceeds as security for the
repair or removal of fire damaged structures was introduced bY Mrs.
Headlee and read for the first time. Mr. Smith explained the purpose of
this legislation and answered several questions posed by Council members
and members of the audience. Mrs. Headlee moved, seconded by Mrs.
Maurer, to dispense with three-time reading rule and pass the ordinance
as an emergency. Vote on the motion and the ordinance was unanimouS for
approval.

Resolution No. 17-83
Said resolution congratulating the 1983 Dublin High School Boys Golf Team
for winning the championships of the C8L, Double ~ Central District, and
Double A State waS introduced by Mrs. Headlee and read for the first time.
Mr. Chambers moved, seconded by Mr. Thornton, to dispense with the three-
time reading rule and pass the resolution as an emergency. vote on the
motion and the resolution was unanimous.
Resolution No. 50-B3
Said ordinance enacting amendments to the 1983 Annual Appropriations
(Ordinance 68-82) was introduced by Mr. Thornton and read for the first
tim~Mrs. Maurer moved, seconded by Mr. Amorose, to dispense with
the three-time reading rule and pasS the ordinance as an emergency. Vote
on the motion and the ordinance waS unanimous for approval.
Ordinance No. 51-83
Said ordinance to accept the lowest/best bid for two (2) new police
cruisers waS introduced by Mrs. Headlee and read for the first time.
Low bidder was 80b McDorman Chevrolet at $18,236.74 for two (2) 1984 Chevy
Impalas. Mr. Chambers moved, seconded by Mr. Thornton, to dispense with
the three-time reading rule and pass the ordinance as an emergency. Vote
on the motion and the ordinance was unanimous for approval.
Ordinance No. 52-83
Said ordinance to accept the lowest/best bid for a neW truck for the
Maintenance Department was introduced by Mr. Sutphen and read for the
first time. Low bidder waS Bob McDorman Chevrolet at $10,110.45. Mr.
Amorose moved, seconded by Mr. Sutphen, to dispense with the three-time
reading rule and pass the ordinance as an emergency. Vote on the motion
and the ordinance was unanimous for approval.
Proposed Force Main - Riverside Drive
Mayor Lewis requested Mr. Sheldon to introduce this subject. Mr. Sheldon
explained that over one (1) year ago the City of ColumbUS, because of
sewage problems at their Zoo facility, had proposed running a sewer line
across the bridge at O'Shaughnessy Dam and connecting same into our gravity
fiow sewer system which terminates at our pump station on South High street.
The sewage i" then pumped under the river into ColumbuS's trunk line on
the east side. Mr. Sheidon had informed Columbus that prior to bringing
that proposal to Village council, he would insist that ColumbuS would
have to agree to pay: 1) the costs of increasing the pump sizes, and
2) pumping costs associated with the increased sewage flow into our pump
station. Columbus has noW proposed an B" force main down S.R. 257 within
State R.D.W. and to be tied into our present trunk line which terminates
at 1-270 and Riverside Drive. ColumbuS has submitted these plans to
Dubiin. Mr. Smith referred to our 1971 Sewer Agreement with the City of
ColumbUS which states that within 30 days of submission of final plans
for a connection of ColumbuS sewer lines to Dublin sewer lines, Dublin
must either approve, or disapprove with reasons. There are other
provisions in the agreement in need of clarification, e.g. it must be a
connection of a sewer designed to serve a locale within the Dublin system
area, i.e. tributary design area. The Zoo may be outside of said area.
At the executive session earlier in the evening, Council directed Smith
to meet with the Columbus City Attorney and report to Mr. Sheldon by the
end of the week.
Mr. Chambers then spoke and objected to the proposed location of the
force main. He queried as to why residents who do not presently have
sewer service would be bypassed. Or why not build the line down Sawmill
Road? He suggested that the residents along Riverside Drive might be
surveyed as to their desire for sanitary sewer service, and if they are
in favor then Columbus could apply the cost of the force main toward a

Lastly, he felt that if Columbus waS under an E.P.~. mandate to sewer the
Zoo, perhapS we could assist Columbus in gaining an extension of time
and the entire matter could be approached anew. Mayor Lewis responded
that Columbus does not own R.O.W. on Sawmill Road north of 1-270. We
have had discussions over the past 3 years with Columbus regarding the
sewer problem at the Zoo. ~t the October 17th meeting the Mayor reported
on a recent meeting with the Greater Columbus Oevelopment Council concerning
the west branch sewer. We have not yet had an opportunity to resolve
whether we can join with ColumbuS and approach E.P.~. to garner federal
funding to combine with Columbus and Dublin funds to construct a gravity
flow sewer to serve the entire northeast Quadrant. lhis is a difficult
engineering problem as well. Lastly, Columbus has always recognized that
this force main would be only a temporary solution until either a fully
developed east branch or west branch sewer is completed.
Mr. Chambers stated that he felt the Council should go on record as
directing no one from the Village ~dministration sign the plan, and
also take the time necessary to work out a solution.
Several residents from Riverside Drive commented on the proposed sewer.
Discussion continued with Mr. Lewis, Mrs. Maurer, Mr. lhornton, Mr.
~morose, and Mr. Sheldon all contributing. Mr. Chambers then moved,
seconded by Mr. lhornton, to instruct the LaW Director to file a
disapproval of these plans with the City of ColumbUS, and to request a
timetable to work under in order to present alternatives and investigate
the same. It is expected that the Village Manager and Mayor will lend
the weight of their offices to the LaW Director's efforts. Vote on the
motion. was unanimous for approval.

Proposed Landscaping at the Water Tower
Mr. ~morose and Mrs. Headlee felt that more specific landscape plans were
necessary for this site. lhere was also concern that the Village comply
with the Landscape Ordinance. Mr. ~morose moved, seconded by Mrs.
Headlee, to direct the Village Manager to contract with a landscape
architect to produce a formal landscape plan for the site. lhe cost for
the service is not to exceed $200.00. Vote on the motion waS unanimous
for approval.
Mayor Lewis referred to a memo from the Village Manager regarding the
Final ~udit Report on E.P.~. phase II Sewer Costs. Council concurred with
the Village Manager's request to re-imburse the U.S.E.P.~. in the amount
of $30,169.00 for overstated payments previously made to the Village under
the grant.
Mayor Lewis announced that Mrs. Headlee and he would act as a committee to
screen applications for the Clerk of Council. Mr. Sheldon and Mr. Strutner
will assist in this review.

1) Request that the published agenda for the next Council meeting
include discussion of the Capital Improvement Program so that any
public input can be obtained.
2) Is there any way to avoid future E.P.~. findings like the one
earlier?
Mr. Sheldon responded that the amount of any overpayment is not
finalized until the final audit is completed, and that is usually
several years after the project has been completed.

1) Appreciates the start by the staff on Council's list of "blights
and blemishes".

2) What about the sewer grates on S.R. 257 that are causing problems
at the entrance there to Village Square? Mr. Warner stated that
since these grates are in the paved portion of the road, it had
been believed that the State waS responsible. However, it has
noW been learned that the State has abandoned maintenance of
these structures, thus the Village will have to effect the
required repairs.
Mayor Lewis adjourned the meeting at 8:50 P.M.

PROPOSED FORCE MAIN SEWER - RIVERSIDE DRIVE
Mayor Lewis requested Mr. Sheldon to introduce this subject and give the
background.
MR. SHELDON _ "The City of Columbus has for some time had problems with their
sewage at the zoo, and about a year ago they began to talk about a sewer
running across the bridge in some manner and getting into our sewer system
which would pump down to our pump station on this side, or west side, of
the river. As most of you know, and for those of you who don't know, all
of the sewage on the west side of the river goes to a common pump station on
South High Street and is pumped across the river to the east side. That
pump station, designed for certain criteria, will serve a maximum population
of certain figures and my reaction to that request was that if they want
to do that, then before I take it to Council, they would have to be agreeable
to expand the pump station and be willing to pay part of the power cost of
that pumping station. And they, after study, on that for about a month and a
half and decided that was too expensive to do... They kept talking about it
for another 8 or 9 months and within the last 10 or 12 days the R.D. Zande
Company brought in what I believe is a preliminary force main plan which
would start at the zoo, come all the way down 257 at ! 270 and Riverside Drive
on the west side with an 8" force main, ~' deep. This is for approximately
three miles, 2.3 miles of which is in the Village. It would come into the
sewer which now terminates just south of the I 270 overpass on Riverside
Drive. Columbus has the right, according to our contract, to enter into
our sewer at any point to make connections or extensions. They must submit
prior plans and specifications to the Village of Dublin. The Village of
Dublin must have good engineering reasons for turning them down or can ask
for an appeal. If we don't respond to the plans in a 30 day period, they
may proceed to build the sewer line. At this point in time, they plan to
proceed wi th design and anticipate taking bids about mid-December."

MR. SMITH _ "Yes. The agreement that we have with the City of Columbus,
signed in 1971, does say that within 30 days submission of final plans
to us _ well, as I told Council in executive session this evening, I
believe that means any plans. When they're talking about going out for
bids, I kind of think they are viewing them as final plans. We then have
30 days to either approve or disapprove those plans. If we disapprove them
and attach, either from our engineer or a consulting engineer reasons for
that, then it appears to me from the contract that it goes on hold and goes
into some type of discussion process with the City of Columbus. In addition,
this contract is 7 pages long and has some other provisions in it that need
some clarification or discussion, and our office has been offering to do
that with Mr. Lashutka's office at City because there is some language in
the contract that refers to the fact that it must be a Dublin sewer system area tha
is being served. Of course the zoo is above Dublin and at some point in time
that mayor may not take it out of what is called the 'tributary design area'.
So, we are in the process of taking a look at that contract. They say it's
been in effect since '71 and we will be back to Sherm prior to the end of the
week with what we feel that contract says with regard to those things so that
we can then make any other plans which Council wishes to make. It is my
opinion, though, that even though the plans are labeled preliminary
plans, that Council should treat them as final plans because when you
start talking about going for bids you are talking about a final decision,
and I don't think we want to play semantics. If we have some legitimate

the Council will bear with me if 1 exceed my 5 minutes limit. First, and
don't let me sound like a lawyer. I'm not, but as I read this, we may
object on the grounds either of engineering or location. That word is used
specifically, and I most certainly object to the location. When this matter
was first brought forward about a year or so ago,the suggestion was that
Columbus come across the river to the general Muirfield area, and at that
point go into our sewer system which then would, true we would have to pump
it up, but we have been trying with Columbus for some years to get them to
complete the west bank of the sewer up into the general Old Dublin area, and
I suggested at that time that we use the zoo's requirement as a lever to
get some more attention from Columbus on that point. I presume that that was
done, but at any rate, I have not had a report since that it was done, and
1 would like to. If it has not been done, then certainly we should go back

and try to get the process started. If we end up having to pay to pump
that sewage for a year or two, it will be absolute minimal compared to the
cost involved in some other plans that have been suggested - such as the
one presently being discussed. 1 find it - I will make a couple of other
suggestions of points for negotiation that I think that at this point I'd
rather think in terms of negotiating with Columbus a system which would
actually be preferred by them as well as us, rather than depend entirely
on the legalities of the situation, and I believe that there are
opportunities to do that. The thought of building three miles of force main
sewer through soli d rock and pass doz ens 0 f ci ti z ens who themsel v e s do no t
have sewers is simply repugnant to me on every count, and we need a better
system than they have suggested. A couple of other suggestions - this is
a force main sewer, they don't have to be concerned about elevations,
particularly. They own Sawmill Road, the whole length of it, and both sides
of it, and they own the right-of-way on both sides of Sawmill Road. On our
side of Sawmill Road there is very little in the way of houses, and so I would
suggest that a second alternative we might discuSS with them is to bring
their force main sewer down Sawmill Road to tie in at whatever point suits
them. And thirdly, a suggestion that we be given time to make a survey of the
citizens along Riverside Drive to see what the desire of the citizens is
with respect to a proper gravity flow sewer down Riverside Drive, and
whatever portion of cost would be attributed to the force main sewer Columbus
would apply to the cost of the gravity sewer with Dublin and its citizens
possibly paying the rest. But that would depend on a survey of those
citizens before we do that. Until very recently, the citizens had no
particular desire to have sewers. There is some indication that that
point of view is changing, and I would like to know more about it. Now
certainly, if it is the case, as I have been told, that Columbus is being
having their feet held to the fire by the EPA, who has told them they must
put in something at the zoo before next summer, I think we would owe it to
Columbus to go to bat in their behalf to get that rule extended. If it is
an EPA rule, then it is a bureaucratic rule. It isn't law. It's a bureau-
cratic decision and such decisions are always subject to change, either by
logic or by political punch. And we can apply either logic or political punch
to this question and get that extended by the EPA in their behalf. Thank you Sil

I believe the right-of-way on Sawmill Road belonging to Columbus only extends
as far north as 270. I s that right Mr. Sheldon?"

time, Franklin County wants to place Sawmill from 270 north to the Delaware
County line on a five year MORPC tip plan. So I think that 1S correct."
MAYOR LEWIS. "I though I recall that when ColumbUS announced their intentions
to boulevard that or else expand or otherwise upgrade it, and they were only
going as far as 270 because that was as far as thei r right-of-way went."

MAYOR LEWIS. "Yes in just a minute, Mr. Chambers. In so far as our
maintaining communications with Columbus, we have had meetings going back
three years ago discussing various alternatives to this sewer problem at
the zoo and as a matter of fact I reported at the October 17th meeting of
Council the most recent meeting we had had with the Development Committee
of greater Columbus, and their efforts going back even into the 1950s in
regard to the west bank sewer, and the fact that we were a little
disappointed in having reached an agreement with Columbus nearly a year ago
to proceed with the west bank sewer. But because of the financial problems
that rose in Columbus during 1983 in regards to the trash burning power
plan, wage and salary considerations among the various services of the
City of Columbus, that they deferred any further conversations on the
west bank sewer during this year. The other item that we have not had an
opportunity to resolve since these plans were just developed to our engineer
within the last few days, is whether the possibility exists from a
financial point of view and perhaps our joining with Columbus in its appli-
cation with the EPA of combining the funds that they intend to expend for
this 8" sewer with a contribution from Dublin, and if at all possible, from
the Federal Government in building a sewer of adequate size to serve the
northeast quadrant of Dublin. But of course that becomes a particularly
difficult engineering problem and would take some time, but it is at least
under consideration and, in fact, I think Mr. Sheldon made an effort to speak
further on this subject with Mr. Parkinson today. Is that correct Sherm?"

MAYOR LEWIS. "And then finally it is my understanding when Columbus made this
proposal to proceed with an 8" line at 4~' that they recognized this would
just be a temporary solution until we can ultimately have either a fully
developed east bank and/or west bank sewer that would be a more permanent

of our citizens. It is Three or four years ago I went through that
ordeal of having a sewer that we wanted put in front of our house. There
is going to be blasting in the immediate vicinity of those houses.
I lost one well out of that process. My neighbor lost their well out of

that I am concerned about is what action we should take immediately versUS
the unknown time schedule for doing the engineering, and the determination of the

going that way. The question is under investigation by the City Engineer
and the City Manager and, as Mr. Smith indicated, then we will probably file
this cause for delay as called for in the contract until we can at least
get some preliminary information that then we could take to you as residents
with a little bit more specific information. I think that if we did that
you would want to know what the apparent cost is going to be and how it is
going to affect you as property owners because I'm sure it is going to be a
very expensive project, however we proceed. If we do proceed in cooperation

upon what the cost is we're willing to pay our fair share to bring that
sewer up there but obviously it can't be a carte blanche because I don't
know how much it's going to cost. Is there anything that the property owners

extension from that point north is gravity as long as you're on the east side
of 257 but it cunnot be gravity to any connections on the west side of 257.
And that creates a part of this dilemma. I mean it is a complication. It's
an engineering complication it's a cost complication.

because the zoo is on the west side, although this water park is going to be..."

to connect the gravity sewer when and if it is ever constructed with the line

MR. SHELDON. "I f we build a gravity sewer on the east side of the road. If
we built it for the Village of Dublin residents it would terminate at the
Delaware County line-that is as far as we would go. By them putting theirs
on the west side, if we ever do that, and it is still a temporary situation
at that time, it does not interfere with their force main.

If they want to give us $500 a frontage foot, I might think very favorable on
it, but if they are just going to come in and rip everything up whey it seems
like it would be a pretty terrible thing just to get rid of waste from the zoo~

be no remuneration because they're working in the state right-of-way. There
would be no compensation at least to my knowledge or in my opinion."

smaller zoo sewer with one that would accommodate the residents along
Riverside Drive, it seems to me we would be charged something for that. Am

the other end of that solid rock. What is going to happen?"

if the damage has already been done. I think some engineerS or somebody

They say they do restore the property but they really don't. What we're
talking about is it possible for us to do anything to forestall the zoo
sewer problem and get it incorporated with a permanent fixture which would
do everybody, mostly people, a lot of good. I have a lot of sy""athy for
Jack Hanna and the apes and everybody else, but I think the citizens come
before that. I would suggest that we on Council do whatever is in our power
to get the City of Columbus and our people together and come up with
a permanent, more workable, less damaging solution for sewage. "
MRS. MAURER. "Could I ask a question about the basis of the requirement
to the zoo is that their treatment plant isn't working. Now my question
is _ what possible damage is occurring to us? I knoW that when our pu""
doesn't work south of Dublin, and when the electricity goes out, our
sewage goes into the river. If the zoo's seWage is going in the river
it's damaging us. I think we ought to take into consideration that there
may be some basis to the EPA requirement that they get some other kind of
treatment. We may be having our water polluted and the waterways that we use
in the summertime for swimming and boating and so on may have residue from
large animals in it and that is something we have to keep in mind. There is
another side to this. The EPA is there for a reason - it is to protect

human beings from pollution and from the consequences of inadequate
treatment. I feel that we have a schizophrenic split here. On the
one hand we have people who are saying, as Mr. Hitchins is saying,
I don't want any sewer, anytime, of any kind in fron of my house or
within reach of it or going past on either side of the road. On the
other hand we have people like Mr. Yeager, Mrs. Painter and other people who
have property to be developed are saying - If you're going to have a sewer
come down here I want one large enough to serve my property. You can't
all agree with Mr. Chambers. We may ask for a delay but I think what we
need to have clarification of is some idea of what the needs are. I agree
with that. We need to know what the needs are of our citizens, but
we're going to have an inevitable conflict of values here and the delay
will not clear that up. I would like to agree with asking for an
objection to be raised within the 30 days, but we need to have a clarification
of what the people along the river want. To that end I think the people
who are in support of each of these sides need to get out and find out
who are their supporters and on which side of the issue."

is right on Riverside Drive, but I do have a very good concern for Dublin
and I have called everyone that I know of that is in the phone book, that
has a listed number, and asked them whether they are very much concerned
about this line, if they are opposed to it, or if they are not opposed to
it. This has nothing to do with the gravity sewer which, by the way, I
think the original plans were to be put along the river and not even
close to Riverside Drive. I wanted to put first thing first and to
express the people who couldn't come tonight because they had other
commitments. Every last person that I talked to on the phone said that
they did not want to have a forced line on Riverside Drive. Every last one.
That has nothing to do with the gravity system and I'm sure that is a split
like Mrs. Maurer said. However, by the comments of most people like Mr.
Keller most of them, I think, feel that they don't want the gravity system
ei ther. "

in general in my phone conversations I just wanted to make it clear that
everyone was opposed to the gravity system, Qn Riverside Drive and every-
