The regular meeting of Council was called to order by Mayor Lewis at 7:30 P.M.
with the following members present: Amorose, Maurer, Chambers, Lewis, Sutphen,
Headlee, and Thornton. Also present were Mr. Sheldon, Village Manager, and
Mr. Smith, Law Director. Mr. Amorose moved, seconded by Mrs. Headlee, to
approve the minutes of the August 1st meeting. Vote on the motion was unanimous
for approval. Mrs. Maurer moved, seconded by Mr. Sutphen to approve the bill
listing for Aug. 15th. Vote on the motion was unanimous for approval.
Ordinance No. 39-83
Said ordinance dealing with vacating Old High School Road was read for the
second time. There was nobody present from the School Board to explain why
they want the road vacated by the Village. Mr. Sheldon said he will ask the
Assistant School Superintendent, Mr. Wall, to attend the next meeting to
explain the reasons for the request.
Ordinance No. 40-83
Said ordinance dealing with accepting a petition for annexation of territory
to the Village of Dublin, a 75.13 acre tract south of Shier-Rings Road and
east of Avery Road was introduced by Mr. Chambers and read for the first time.
Mr. Amorose requested a map of the area and Mr. Sheldon said he will prepare
one.

Ordinance No. 41-83
Said ordinance dealing with accepting the lowest/best bid for garbage collect-
ing for the Village was introduced by Mrs. Headlee and read for the first time.
Mr. Smith told Council he received a letter from Waste Management Company, the
present collector for the Village. They feel the bidding was done improperly.
Mr. Smith said he will prepare a memo on the subject for next meeting.

Final Plat approval "The Fairways at Muirfield"
Mrs. Headlee, Council's representative on Planning and Zoning Commission,
(P & Z), told Council this Plat has been approved with certain conditions and
there seems to be some misunderstanding among the P & Z members about whether
the conditions have been met. She wishes to refer it back to P & Z for re-
approval. She explained to Council, that at the Planning and Zoning
Commission's meeting in July Mr. Adams agreed to change the entrance from
Dunnsinane to Carnoustie Drive inresponse to the residents' request. The plan
had to be redrawn, so P & Z approved the amended plans on the condition that
final engineering will have to be approved and the residents will have a
chance to look at the plans before it comes to Council, but apparently they
did not. Mr. Miller, who was also present from P & Z, confirmed that according
to the agreement, the plan was to be redrawn with the Planner and Engineer's
approval and then presented to the residents of Birnam Wood. Mrs. Maurer
also received a phone call from Mr. Jones, the resident most opposed to the
plan, because when he purchased his property he was assured of a greenbelt
between his property and any future development. The resident from 8715
Dannison explained that due to the proposed sewer line and right-of-way they
will loose some of the trees. They are asking for the properties in question
to be moved back to a reasonable distance, in order to preserve some of the
"greenbelt"~ Hr. Howard Adams told Council that he objects to the delay
because they have done everything they were asked to do. Moving the road
entailed a considerable expense, including donating an acre of land. He him-
self sold the land for the Birnam Wood development and nothing was ever said
about a greenbelt. He is sorry about any misrepresentation. Everything is
done within the law, in fact on a final plat approval for single family
development it is not required to show the location of the houses, they have
only done it as a courtesy to P & Z, therefore it should not even be an issue.

Mr. Adams said he personally measured the distance between the two properties
in question and it is 27', so they are not in violation of anything, he does
not understand, why Council would send him back to P & Z. Mr. Adams asked Mr.
Bowman to comment on what was said and agreed upon at the last P & Z meeting.
Mr. Bowman said that in his opinion Mr. Adams fullfilled the requirements
placed on him by the Commission, including presenting the amended drawings
to the residents. Mr. Adams made the point at the meeting that he would
merely give a copy to the residents to show what happened, not to comment on.
Due to the road change some lot lines have changed, but the basic plans have
not. The Planner and Engineer have approved the change and final engineering.
Mrs. Maurer belives that Muirfield Ltd. should take pride in trying to keep
everybody happy and conform to the spirit of what Muirfield represents. Mr.
Smith suggested that if everybody is agreeable, P & Z should hold a special
meeting on the 22nd of August to reapprove the plan, immediately followed by
a special Council meeting to give final approval. This way only one week
will be lost and all the discomfort can be resolved. Mr. Adams agreed to
wait till next week, but told Council there will be no changes made, as the
required changes have already been taken care of. Mr. Lewis said Council
needs to be assured that the contingencies have been met and P & Z is satis-
fied with the amended plan.

Municipal BuildinR
Mr. Lewis told Council that Mr. Bowman, the Planner, has drawn up a map of the
Municipal property and has sketched in layovers the various options that have
been proposed for additional facilities for the Village staff. With Council's
permission he would like to submit this to P & Z for recommendations and then
bring it back to Council for further discussions. Mr. Emmett Karrer from the
Historical Society was present to express his thoughts in regard to the
Coffman property and expansion of the Municipal Building. He said the Society
is concerned about the aesthetic value of the appearance of Coffman property,
which they regard as the Museum of Dublin; and money has already been spent
in that regard. Development could diminish the historical value of the
property. Mr. Lewis said that since all the possible options encroach on the
Coffman property any decision that is made will have to be made with the
agreement of the Historical Society.
Landfill
Mr. Smith reported that Mr. Sheldon served notices to people who have been
doing landfill, and they agreed to meet with him and the Engineer trying to
solve the problem. Mr. Dave Thomas, who has control of land on which dumping
is taking place, was present. He told Council that this area, which was a
quarry previously, is not noticeable from the road. Mr. Amorose said his main
concern is the possibility of a delta of debris forming on the flood plain
along the river. Mr. Smith said there is an ordinance to prevent dumping.
He suggested to arrange a meeting with Mr. Duffy, attorney representing Mr.
Thomas, and the Enginee~ and work out this problem.

Roundtable
Mr. Thornton suggested that before we decide to vacate Old High School Road, we
should obtain an easement for excess to the historical cemetery on that road.
Mr. Lewis wants the School Board to give us some reasons to vacate.
Mrs. Headlee opposes vacating the road, because the sewer in that area and
the bridge across the ravine were built with taxpayers money, so everybody
should have access to it.
Mr. Lewis said it has always been his concern that when Council gets a re-
commendation from Planning and Zoning Commission with a contingency for some
other further approval or review, it comes to Council without any evidence

that the contingency has been met, except the assurance of the developer, or
whoever is representing the case. This puts an undue burden on the individual
members of Council. He wishes to ask P & Z to review their submissions for
final approval of Council "so that by the time they do come to Council, the
minutes or other comments reflect complete compliance". Then Council would
not have to take last minute responsibility for assuring that those contingen-
cies have been met.
Mr. Chambers suggested that Council should listen to the tape from the P & Z
meeting at which The Fairways of Muirfield plans were approved to avoid
controversy. Mr. Chambers also believes that before we send plans for
additional office space for the Village to P & Z recommendation, we should
exhaust investigation of how the Middle School Building could be used. He is
not going to vote on any new building, until he is satisfied that the existing
structure cannot be used at a reasonable cost.
Mayor Lewis adjourned the meeting at 9:15 P.M.
